उत्तर प्रदेश साधारण खण्ड अधिनियम, 1904 (उत्तर प्रदेश अधिनियम संख्या 1/सन्‌ 1904) की धारा 21 के साथ पठित संयुक्त प्रान्त आबकारी अधिनियम, 1910 (यू0पी0 अधिनियम संख्या 4 सन्‌ 1910) की धारा 41 के अधीन प्रदत्त शक्तियों का प्रयोग करके, आबकारी आयुक्त, उत्तर प्रदेश, राज्य सरकार के पूर्व अनुमोदन से इस निमित्त प्रकाशित समस्त पूर्व नियमों, जहां तक वे नियमावली से असंगत हों, का अधिक्रमण करकेे देशी मदिरा को बोतलों में भरने (बाटलिंग) के लिये लाइसेंसों से सम्बन्धित निम्नलिखित नियमावली बनाते हैं :

उत्तर प्रदेश देशी मदिरा को बोतलों में भरने की नियमावली, 2020

1-संक्षिप्त नाम और प्रारम्भ-(1) यह नियमावली उत्तर प्रदेश देशी मदिरा को बोतलों में भरने की नियमावली, 2020 कही जायेगी।

(2) यह गजट में प्रकाशित किये जाने के दिनांक से प्रवृृत्त होगी।

2-परिभाषाएं-(1) जब तक विषय या संदर्भ में कोई बात प्रतिकूल न हो इस नियमावली में-

(क) ''अधिनियम'' का तात्पर्य समय-समय पर यथा संशोधित संयुक्त प्रान्त आबकारी अधिनियम, 1910 से है ;

(ख) ''समिश्रण'' का तात्पर्य दो या दो से अधिक स्प्रिट अथवा भिन्न-भिन्न मधसारिक सान्द्रता अथवा भिन्न- भिन्न गुणवत्ता अथवा श्रेणी की शराब को एक साथ मिश्रित करने से है ;

(ग) ''बन्ध पत्र'' का तात्पर्य तत्समय प्रवृत्त किसी विधि या विनियम द्वारा या तद्‌धीन प्राधिकृत या अपेक्षित बाध्यता से है;

(घ) ''बंधित भण्डागार'' का तात्पर्य ऐसे अनुमोदित भण्डागार से है, जिसका प्रयोग, ऐसे गोदाम से निकासी के समय प्रतिफल शुल्क के भुगतान के लिये बंध पत्र के अधीन वहाँ पर लाये गये उत्पाद शुल्क योग्य पदार्थों के भण्डारण के लिये किया जाता है;

(ड.) ''रंजन एवं परिष्करण'' का तात्पर्य स्प्रिट या अवनतिकृत स्प्रिट में रंजक तथा वासक द्रव्य मिलाने से है;

(च) ''देशी शराब'' का तात्पर्य तनु या तीव्र मद्यसार युक्त सादी या मसोलदार स्प्रिट से है जो एक्सट्रा न्यूट्रल अल्कोहल (ई.एन.ए.) से विनिर्मित की गयी है;

(छः) ''आबकारी वर्ष'' का तात्पर्य दिनांक 01 अप्रैल से प्रारम्भ होने वाले और अगले कैलेण्डर वर्ष के 31 मार्च तक समाप्त होने वाले वित्तीय वर्ष से है;

(ज) ''प्रपत्र'' का तात्पर्य इस नियमावली से संलग्न प्रपत्र से है; (झ) ''लाइसेंस'' का तात्पर्य इस नियमावली के अधीन प्रदान किये गये लाइसेंस से है; () ''लाइसेंस प्राधिकारी'' का तात्पर्य आबकारी आयुक्त, उत्तर प्रदेश से है; (ट) ''लाइसेंस फीस'' का तात्पर्य देशी मदिरा की बोतल भराई के अनन्य विशेषाधिकार के लिये लाइसेंस प्रदान किये जाने के निमित्त प्रतिफल से है, जो लाइसेंसधारी द्वारा, उसको लाइसेंस प्रदान किये जाने के पूर्व, ऐसी दरों पर, जैसा कि समय-समय पर आबकारी आयुक्त द्वारा राज्य सरकार की पूर्व स्वीकृति से निर्धारित किया जाय, राजकीय कोषागार में ई-पेमेन्ट के माध्यम से संदत्त की जायेगी;

(ठ) ''प्रभारी अधिकारी'' का तात्पर्य आबकारी विभाग के ऐसे अधिकारी से है, जो सहायक आबकारी आयुक्त की श्रेणी से नीचे का न हो, जो आबकारी आयुक्त द्वारा निर्देशाधीन लाइसेंस कार्य संचालन हेतु नियुक्त किया गया हो;

(ड) ''सादी स्प्रिट'' का तात्पर्य ऐसी स्प्रिट से है जिसमें कोई सुवासक न मिलाया गया हो और जिसमें कोई रंजक अथवा सुवासक द्रव्य अथवा अन्य पदार्थ या अवयव न मिलाया गया हो;

(ढ़) ''पोर्टल'' का तात्पर्य विशेष रूप से निर्मित इलेक्ट्रानिक प्लेटफार्म पर मदिरा निर्माण की प्रक्रिया से लेकर इसके वितरण के अन्तिम अवस्था तक की सूचनाओं को विहित प्रारूप में अपलोड करने के प्रयोजन से है;

(ण) ''प्रापक'' का तात्पर्य ऐसे पात्र से है, जिसमें भभका (स्टिल) की वर्तुलाकार नली गिरती है; (त) ''स्प्रिट का तनुकरण'' का तात्पर्य उच्च तीव्रता की ई.एन.ए. में पानी मिलाकर तनु करने से है; (थ) ''सुरक्षा कूट'''का तात्पर्य आबकारी विभाग द्वारा यथा अनुमोदित सुरक्षा कोड से है, जो प्रत्येक कार्टन (केस) तथा बोतल अथवा किसी अन्य आधान पर प्रतिफल शुल्क के भुगतान के प्रमाणस्वरूप चस्पा किया जायेगा;

(द) ''मसालेदार स्प्रिट''का तात्पर्य सादी स्प्रिट में सुवासकों एवं मसालों को मिलाने के पश्चात्‌ प्राप्त स्प्रिट से है;

(ध) ''राज्य'' का तात्पर्य उत्तर प्रदेश राज्य से है; (न) ''तीव्रता''का तात्पर्य देशी शराब की ऐसी तीव्रता से है, जैसा कि समय-समय पर राज्य सरकार के पूर्व अनुमोदन से आबकारी आयुक्त द्वारा नियत की जाय और जो एल्कोहलोमीटर से उपदर्शित होती हो;

(प) ''बोतल में बन्द करना'' का तात्पर्य बिक्रय के प्रयोजनार्थ शराब को किसी कुण्ड अथवा टैंक से बोतल या समान पात्र में अन्तरित करने से है। बोतल में बन्द करने के अन्तर्गत बोतल में फिर से भी बन्द करना सम्मिलित है;

(फ) ''माप'' का तात्पर्य किसी पात्र, आधान, कुण्ड अथवा टैंक में रखी गयी या उनमें से ली गयी स्प्रिट की मात्रा अवधारित करना अथवा किसी कुण्ड या अन्य पात्र की क्षमता अवधारित करना है;

(ब) ''कुण्ड'' का तात्पर्य ऐसे स्थिर पात्र से है, जो शराब के भण्डारण के लिये प्रयुक्त होता है; (भ) ''गोदाम (भण्डागार)'' का तात्पर्य देशी शराब की बोतल भराई के लिये लाइसेंस प्राप्त परिसर के ऐसे भाग से है, जिसमें आबकारी नियंत्रण में निकासी एवं उपभोग योग्य स्थिति में स्प्रिट को भण्डारित किया जाता है।उत्तर प्रदेश असाधारण गजट, 20 अक्टूबर, 2020 ई0 3 (2) इस नियमावली में अपरिभाषित किन्तु अधिनियम में परिभाषित शब्दों और पदों के वहीं अर्थ होंगे, जो अधिनियम में क्रमशः उनके लिये समनुदेशित हाें। 3-लाइसेंस की स्वीकृति-(1) बोतलों में भरने का लाइसेंस, प्रपत्र सी0एल0बी0-1 में आबकारी आयुक्त द्वारा निम्न को स्वीकृत किया जा सकता है-

(क) आसवक (डिस्टिलर) को देशी मदिरा की बोतल भराई के लिए ; (ख) पी0डी0-33 लाइसेंस धारण करने वाली ऐसी कम्पनी या इकाई, जिसका न्यूनतम 50 करोड़ रूपये का विनिधान तथा न्यूनतम 40 के0एल0 प्रतिदिन की क्षमता हो, को पच्चीस लाख रूपये की बैंक प्रत्याभूति सहित शपथ पत्र द्वारा यह आश्वासन प्रतिबद्धता प्रदान करने पर कि उसे देशी मदिरा की बोतल भराई हेतु सी0एल0बी0-1 लाइसेंस स्वीकृत किये जाने के दिनांक से दो वर्षों के भीतर स्वीकृत क्षमता का 25 रूपया प्रति कि0ली0 जमा कर पेय आसवनी अधिष्ठापित करना होगा। यदि उक्त इकाई विनिर्दिष्ट अवधि के भीतर पेय आसवनी स्थापित करने में विफल रहती है तो पूर्वोक्त बैंक प्रत्याभूति, आबकारी आयुक्त द्वारा राज्य सरकार के पक्ष में समपहृत कर ली जायेगी और बोतल भराई लाइसेंस, आसवनी प्रवर्तित किये जाने तक निलम्बित अवस्था में रहेगा;

(2) प्रपत्र सी0एल0बी0-1 में लाइसेंसधारक, बोतल में भरने के अपने विशेषाधिकार को पूर्णतः या उसके आंशिक भाग को निम्नलिखित को समनुदेेशित कर सकता हैः- (क) उत्तर प्रदेश राज्य के अन्य आसवक; (ख) भारत में अन्य राज्य या संघ राज्य क्षेत्र के किसी आसवक; परन्तु यह कि ऐसा कोई समनुदेशिती इस रूप में किसी अधिकार का तब तक प्रयोग नहीं करेगा जब तक कि सी0एल0बी0-1 लाइसेंस धारक द्वारा दिए गए आवेदन पत्र पर आबकारी आयुक्त द्वारा उसे प्रपत्र सी0एल0बी0-2 में लाइसेंस स्वीकृत न कर दिया गया हो; (3) किसी आसवक को बोतल में भरने हेतु सी0एल0बी0-2 में लाइसेंस, आबकारी आयुक्त द्वारा निम्नलिखित शर्तों के अध्यधीन प्रदान किया जा सकता हैः- (क) कोई आसवक,बोतल में भरी गई स्प्रिट के लेबलों पर आबकारी आयुक्त का अनुमोदन प्राप्त करने के पश्चात्‌ अपना ब्राण्ड नाम लिखने का हकदार होगा; (ख) आबकारी आयुक्त की विशेष अनुज्ञा के अधीन के सिवाय और उसके अनुसार रंगना, समिश्रण करण (ब्लेडिंग), सुवासित करना या तीव्रतावरोह करना निषिद्ध होगा। 4-लाइसेंस फीस-दो लाख रूपये की लाइसेंस फीस का संदाय किए जाने पर वर्ष या उसके आंशिक भाग के लिए प्रपत्र सी0एल0बी0-1 में लाइसेंस प्रदान किया जा सकता है। पाँच लाख रूपये की लाइसेंस फीस का संदाय किए जाने पर वर्ष या उसके आंशिक भाग के लिए प्रपत्र सी0एल0बी0-2 में लाइसेंस प्रदान किया जा सकता है। परन्तु यह कि प्रपत्र सी0एल0बी0-2 में नये लाइसेंस की स्वीकृति हेतु फ्रेंचाइजी फीस रूपया 5,00,000.00 (पॉंच लाख) वर्ष या वर्ष के आंशिक भाग के लिए सदेय होगी। 5-आवेदन किए जाने की प्रक्रिया-(1) नियम-3के अधीन बोतल भराई लाइसेंस के लिए आवेदन करने वाला कोई व्यक्ति आवेदन पत्र को अभिहित पोर्टल पर अपलोड करेगा और वह आवेदन पत्र के साथ निम्नलिखित विवरण आबकारी आयुक्त, उत्तर प्रदेश को प्रस्तुत करेगा, अर्थात्‌- (क) सी0एल0बी0-1 लाइसेंस के मामले में राज्य में वैध आसवनी लाइसेंस, अथवा (ख) वैध पी0डी0-33 लाइसेंस तथा नियम-3(क)(दो) में निर्धारित मानदण्डों को पूर्ण करने के प्रमाण में अभिलेखीय साक्ष्य ; (ग) सी0एल0बी0-2 लाइसेंस के मामले में,राज्य अथवा अन्य राज्य अथवा संघ राज्य क्षेत्र में वैध आसवनी लाइसेंस; (घ) अक्षांश एवं देशान्तर दर्शाते हुए जियो टैगिंग सहित स्थान और भू-गृहादि, जिसमें बोतल की भराई की जायेगी; (ड.) अभिलेख की प्रति जिसमें प्रस्तावित स्थल अथवा क्षेत्र पर आवेदक का अधिकार, हक एवं हित प्रदर्शित हो; (च) सप्ताह या माह के अधिकतम संख्या दिवस, जिसके दौरान बोतल भराई की जायेगी ; (छ) तीन प्रतियोंमें भू-गृहादि का एक विस्तृत नक्शा जिसमें विभिन्न कक्ष या उपकक्ष तथा उसमें सभी स्थायी फिक्सचर्स दिखाये गये हों; (ज) इस आशय का शपथ पत्र कि उस पर कोई लोक या राजकीय देयता का बकाया नहीं है। (2) यदि जाँच के पश्चात्‌ आबकारी आयुक्त का यह समाधान हो जाय कि आवेदक अपेक्षित लाइसेंस धारण करने योग्य है तथा जिस भू-गृहादि में वह बोतलों में भराई कार्य करना चाहता है वह उपयुक्त है तो वह ऐसे व्यक्ति4 उत्तर प्रदेश असाधारण गजट, 20 अक्टूबर, 2020 ई0 को लाइसेंस प्रदान कर सकता है। ऐसा प्रत्येक लाइसेंसधारी 1,00,000/-(एक लाख ) रूपये की सावधि जमा रसीद जो आबकारी आयुक्त के पद नाम से गिरवीकृत हो, प्रतिभूति के रूप में लाइसेंस जारी करने के पूर्व जमा करेगा। लाइसेंसधारी को उन पर उपगत होने वाला व्याज, जब वह देय हो जाय, आहरित करने की अनुज्ञा दी जायेगी। 6-लाइसेंस संचालित करने के लिए बंधपत्र एवं प्रतिभूति-लाइसेंसधारी प्रपत्र सी0एल0बी0 में एक बन्ध पत्र आबकारी आयुक्त द्वारा नियत की गयी प्रतिभूति के साथ निष्पादित करेगा। प्रतिभूति या तो नकदी में या ब्याज वाहक प्रतिभूति, सरकारी वचन पत्र, राष्ट्रीय बचत प्रमाण पत्र, डाक घर बचत बैंक पास बुक या डाकघर नकद प्रमाण पत्र में या भारतीय स्टेट बैंक या राज्य सरकार द्वारा सम्यक रूप से अनुमोदित किसी अन्य बैंक की सावधि जमा की रसीदों के रूप में दी जायेगी। यदि किसी समय आबकारी आयुक्त किसी कारण से यह समझता हो कि इस प्रकार नियत की गयी धनराशि अपर्याप्त या अत्यधिक है, तो वह उसे बढ़ा या घटा सकता है। 7-बोतल भराई लाइसेंस का नवीनीकरण-(1) बोतल भरने केे लाइसेंस का नवीकरण करने के लिए आवेदन आबकारी आयुक्त, उत्तर प्रदेश को प्रत्येक वर्ष 28 फरवरी को या उसके पूर्व प्रपत्र सी0एल0बी0-3 में दिया जायेगा। जब तक शुल्क या उसकाकोई आंशिक भाग बकाया न हो, या कोई अन्य पर्याप्त कारण न हो, आबकारी आयुक्त द्वारा प्रपत्र सी0एल0बी0-1 एवंसी0एल0बी0-2में बोतल भरने के लाइसेंस को दो वर्षों के लिए नवीकृत किया जा सकता है।किन्तु उक्त लाइसेंस नवीकरण सम्बन्धित पी0डी0-2/पी0डी0-33 लाइसेंस की वैधता की अवधि तक वैध रहेगा। (2) सी0एल0बी0-1 व सी0एल0बी0-2 लाइसेंसों के लिए नवीकरण फीस निम्नानुसार संदेय होगी-

परन्तु यह कि सी0एल0बी0-2 लाइसेंस के नवीकरण के लिए आधी नवीकरण फीस के समतुल्य फ्रेंचाइजी फीस भी संदेय होगी। अनुमानित वार्षिक बोतलों में भरी मदिरा की मात्रा की गणना माह जनवरी के अन्त से पूर्ववर्ती दस माह में बोतलों में भरी गयी कुल मदिरा की मात्रा के आधार पर की जायेगी।

8-लाइसेंस की निबन्धन एवं शर्तें-प्रपत्र सी0एल0बी0-1 तथा सी0एल0बी-2 में प्रदान किया गया प्रत्येक लाइसेंस, निम्नलिखित निबंधन एवं शर्तांे के अध्यधीन होगा- (1) लाइसेंसधारी बोतल में भराई कार्य उसी भू-गृहादि में करेगा जो आबकारी आयुक्त अथवा उसके द्वारा प्राधिकृत अधिकारी द्वारा पूर्वानुमोदित हो और लाइसेंस पर सम्यक्‌ रूप से पृष्ठांकित हो। उक्त भू-गृहादि का प्रयोग देशी मदिरा को बोतल में भरने एवं उसे भण्डारित करने के सिवाय किसी अन्य प्रयोजन के लिये नहीं किया जायेगा; (2) लाइसेंसधारी उक्त भू-गृहादि में आबकारी आयुक्त के पूर्व अनुमोदन के बिना कोई परिवर्धन या परिवर्तन नहीं करेगा। इस प्रकार के सभी परिवर्धन एवं परिवर्तन लाइसेंसधारी द्वारा प्रस्तुत नक्शे एवं नीलेमुद्रण पर दर्शाये जायेंगे; (3) बोतल में भराई कार्य इस प्रयोजनार्थ अलग किये गये, पृथक कक्ष (कक्षों) में किया जायेगा। लाइसेेंसधारी मदिरा के भण्डारण के लिये भराई कक्ष (कक्षों) में बोतल भराई के कुण्ड स्थापित करेगा। वह भराई कक्ष (कक्षों) में छानने, भरार्ई करने या इससे सम्बन्धित प्रक्रिया के लिए आवश्यक उपकरण स्थापित करेगा; (4) बोतलों में भरी गयी मदिरा, पृथक कक्ष (कक्षों) में रखी जायेगी; (5) प्रत्येक कक्ष के बाहर एक तख्ती लगायी जायेगी जिस पर स्पष्ट रुप से लिखा जायेगा कि कक्ष का प्र्रयोग किस प्रयोजन के लिए किया जा रहा है; (6) सिवाय आबकारी आयुक्त के विशेष अनुज्ञा के और उसके अनुसार सम्मिश्रण या तीव्रतावरोह निषिद्ध है; (7) सिवाय आबकारी आयुक्त की विशेष अनुज्ञा के और उसके अनुसार देशी मदिरा में कोई सुवास पैदा करने वाला या रंजन करने वाला पदार्थ अथवा कोई अन्य पदार्थ मिलाना निषिद्ध है; (8) विशेष परिस्थितियों में भारत निर्मित विदेशी मदिरा को बोतल में भरने के लिए आबकारी आयुक्त द्वारा अनुमोदित बोतल भराई कक्ष को, आबकारी आयुक्त की पूर्वस्वीकृति से देशी मदिरा की बोतल भराई के लिए प्रयोग किया जा सकेगा, परन्तु यह कि किसी भी दशा में देशी मदिरा की बोतल भराई के समय भारत निर्मित विदेशी मदिरा की बोतल भराई नही की जायेगी;

(9) लाइसेंसधारी देशी मदिरा को ऐसी क्षमता एवं तीव्रता की बोतलों या अन्य संधानों में भराई करेगा जैसा कि आबकारी आयुक्त द्वारा राज्य सरकार के पूर्वानुमोदन से निर्धारित किया जाये; (10) लाइसेंसधारी आबकारी आयुक्त द्वारा देशी शराब की बोतल भराई के लिए प्रयुक्त बोतलों या अन्य संधानों के संबंध में जारी निर्देशों का अनुपालन करेगा;

(11) कांच/पेट बोतल के चेस्ट पर वर्ष के अंतिम दो अंकों सहित शब्द ''यू0पी0ई'' समुद्‌भृत किया जाएगा; (12) बोतलों को भरने के तुरंत बाद, बोतलबंद शराब के भण्डारण कक्ष में निकालने से पूर्व उनमें सुरक्षा कोड चस्पा करने के साथ कार्क, कैप्सूल तथा लेबल लगा दिया जाएगा। बोतलों मेें भराई की प्रत्येक प्रक्रिया की एक विशिष्ट क्रम संख्या दी जायेगी, जिसे बैच नंबर के रूप में जाना जाता है, और यह बैच नम्बर लेबल पर लिख दिया जायेगा। आबकारी विभाग के अभिहित पोर्टल पर प्रतिदिन एक डिजिटल रिकॉर्ड भी ऑनलाइन अनुरक्षित किया जायेगा और प्रस्तुत किया जाएगा; (13) बोतलों पर लेबल इस प्रकार चिपकाये जायेंगे जिससे कि वे सरलता से पहचाने जा सके। बोतलों पर उभारे गये या बालुकाक्षेपित शब्दों, अक्षरों तथा अंको पर लेबल नही चिपकाया जाएगा ; (14) लाइसेंसधारी उत्तर प्रदेश में विक्रय की जाने वाली देशी मदिरा के लेबुलों पर अधिकतम फुटकर मूल्य इस प्रकार मुद्रित करेगा जो सरलता से दृश्य हो; (15) बॉटलिंग इकाई ठोस कचरे के पुनर्चक्रण और प्रबंधन के लिए ऐसी समस्त व्यवस्थाएं करेगा जैसा कि ठोस अपशिष्ट प्रबंधन नियम 2016 में विहित किया गया है;

9-सुरक्षा कोड का अनुप्रयोग-लाइसेंसधारी प्रत्येक कार्टन (केस) तथा बोतल अथवा किसी अन्य पात्र पर प्रतिफल शुल्क के भुगतान के प्रमाण स्वरुप आबकारी विभाग द्वारा अनुमोदित सुरक्षा कोड बोतल भराई के तुरन्त बाद देशी शराब की निकासी के पूर्व लगायेगा। ये समस्त अभिलेख डिजिटल रुप में भी अनुरक्षित किये जायेंगे और आबकारी विभाग के अभिहित पोर्टल पर प्रतिदिन आनलाइन अपलोड किये जायेंगे। लाइसेंसधारी आबकारी आयुक्त द्वारा इस निमित्त जारी किए गए निदेश के अनुपालन के लिए समस्त आवश्यक व्यवस्था करेगा। 10-बोतल भराई संक्रिया- बोतल भराई संक्र्रिया निम्नलिखित शर्तों के अघ्यधीन होगी- (1) बोतलों में मदिरा की भराई सिवाय आबकारी निरीक्षक तथा लाइसेंसधारी के किसी प्रतिनिधि की संयुक्त उपस्थिति के आई0पी0 पते के साथ सी0सी0टी0वी0 कैमरे की निगरानी में नही की जायेगी। बोतल में भराई कार्य आवश्यकताओं के अनुसार लगातार किया जा सकता है; (2) आबकारी आयुक्त बोतल भराई से सम्बन्धित संक्रियाओं के समुचित पर्यवेक्षण के लिए आवश्यक आबकारी कर्मियों की संख्या विनिश्चित करेगा और उसका विनिश्चय लाइसेंसधारी के लिये बाध्यकारी होगा; (3) लाइसेंसधारी आबकारी आयुक्त के समाधान पर्यन्त आबकारी कर्मचारीवर्ग के लिए देशी मदिरा को बोतलों में भरने के लिए बंधित भण्डागार के निकट कर्मचारीवर्ग के प्रत्येक सदस्य के प्रतिमाह वेतन के अनधिक दस प्रतिशत किराये पर क्वार्टरों की व्यवस्था करेगा; लाइसेंसधारी क्वार्टरों तथा उनके लगे स्थानों को समुचित रूप से मरम्मत करके रखने के लिए बाध्य होगा तथा उसमें निवास करने वाले किसी अधिकारी को उसके प्रयोग या उसके उपभोग में न तो बाधा पहुॅचायेगा न परेशान करेगा। यदि लाइसेंसधारी के पास आवासीय सुविधा उपलब्ध नहीं है तो वह आस-पास के मुहल्ले या कस्बे में आवास की व्यवस्था पद के अनुसार करेगा और उसके किराए का भुगतान करेगा। आवास या किराए के स्थान की पर्याप्तता के विवाद के मामले में उक्त मामला आबकारी आयुक्त को निर्दिष्ट किया जाएगा और उसका विनिश्चय समस्त संबंधितों के लिए बाध्यकारी होगा; (4) देशी शराब को बोतल में भरने के लिए बंधित भाण्डागार का प्रभारी आबकारी निरीक्षक, जब तक कि अन्यथा निर्देश न दिया जाये, तब तक आसवनी के सहायक आबकारी आयुक्त के पर्यवेक्षण में कार्य करेगा और उसके साथ पत्र व्यवहार करेगा । बोतल भराई संक्रिया से सम्बन्धित समस्त सामान्य मामलों में लाइसेंसधारी को चाहिए कि वह प्रथमतः प्रभारी आबकारी निरीक्षक को आवेदन करे जो, यदि आवश्यक हो, उच्च आदेश प्राप्त करेगा; (5) देशी शराब को बोतल में भरने के लिए बंधित भाण्डागार में नियुक्त निरीक्षकों की पारी (शिफ्‌ट) और उपस्थिति के घंटे सहायक आबकारी आयुक्त द्वारा नियत किए जाएंगे; (6) बोतल में भराई से सम्बन्धित संक्रिया पृथक-पृथक कक्षों में संचालित की जायेगी जो भराई कक्ष कहे जायेंगे जो इस प्रयोजन के लिए भू-गृहादि के भीतर देशी मदिरा भण्डार के निकट होगा। इन कक्षों में लाइसेंसधारी6 उत्तर प्रदेश असाधारण गजट, 20 अक्टूबर, 2020 ई0 छानने, भराई करने या इससे सम्बन्धित किसी भी प्रक्रिया के लिए आवश्यक उपकरण स्थापित कर सकता है। बोतल भराई करने के कक्षों में देशी मदिरा का भण्डारण करने के लिए बोतल भराई कुण्ड परिनिर्मित किये जायेंगे। बोतल में भरी मदिरा पृथक-पृथक कक्षों में भण्डारित की जायेगी; समस्त कक्ष भली भॉति हवादार होंगे। खिडकियॉ और रोशनदानों में मजबूत लोहे के छड़ लगाये जायेंगे, जो सीमेन्ट से जड़े होंगे और उनमें तार की जाली लगायी जायेगी, जाली के छिद्र 25 मि0मि0 से अधिक बडे नहीं होंगे। प्रत्येक कक्ष के बाहर एक पट्‌ट लगाया जायेगा जिस पर स्पष्ट रुप से जिस उद्‌देश्य के लिए कक्ष का प्रयोग किया जा रहा है, अंकित किया जायेगा। सभी कमरे लाइसेंसधारी और आबकारी निरीक्षक के पृथक-पृथक ताले और चाबी के अधीन रहेंगे; (7) किसी आसवनी में बोतल भराई के लिए अपेक्षित मदिरा मापी जायेगी तथा मदिरा कक्षों में स्थाई रुप से लगाये गये पाइप द्वारा जिसमें काक को तथा जिसपर आबकारी का ताला या डिजिटल लॉक लगा हो या आबकारी आयुक्त द्वारा अनुमोदित किसी अन्य इलेक्ट्रॉनिक उपकरणों/साधनों से बन्द हो बोतल भराई कक्ष में लायी जायेगी; (8) देशी मदिरा की बोतल भराई के लिए बंधितभाण्डागार पर तैनात आबकारी कर्मचारीवर्ग हेतु अनुज्ञात अवकाश दिवस निम्नलिखित हैः- रविवार, गणतंत्र दिवस (26 जनवरी), गुड फ्राइडे, महात्मा गांधी का जन्मदिन (2 अक्टूबर), स्वतंत्रता दिवस (15 अगस्त), क्रिसमस दिवस (25दिसंबर), होली (होली जलाने के बाद का दिन), जन्माष्टमी, दशहरा (प्रमुख दिन) दिवाली (प्रमुख दिन), इदुल फितर (प्रमुख दिन) इदुल-जुहा, मोहर्रम (10 वां दिन) और शबे-ए-बारात अन्य राजपत्रित अवकाश की अनुज्ञा तभी दी जायेगी, यदि लाइसेंसधारी विशेष आधारों पर आबकारी आयुक्त की स्वीकृति से स्वंय बंद करता है। 11-देशी स्प्रिट का रासायनिक विश्लेषण-(1) आबकारी आयुक्त द्वारा प्राधिकृत रासायनिक परीक्षक अथवा सहायक रासायनिक परीक्षक द्वारा सही तीव्रता का विश्लेषण और घोषणा के लिए लाइसेंसधारी बंधित भण्डागार के प्रभारी अधिकारी को प्रत्येक बैच से विभिन्न क्षमता की बोतलों में भराई के पश्चात्‌ देशी स्प्रिट की दो बोतलेंं निःशुल्क प्रदान करेगा; (2) यदि आपूर्ति की गई विशेष बैच की देशी स्प्रिट की तीव्रता में कोई भिन्नता पाई जाती है, तो लाइसेंसधारी उस बैच में विनिर्मित मात्रा पर उदग्रहणीय प्रतिफल शुल्क के अंतर कीधनराशि के साथ-साथ ऐसे प्रतिफल शुल्क की धनराशि के दो गुणा तक की शास्ति का भुगतान करने के लिए उत्तरदायी होगा। 12-कुण्डों एवं रिसीवर की शर्ते-संयंत्र में टंकी और रिसीवर को ऐसे स्थापित किया जायेगा कि उनकी अन्र्तवस्तु का प्रमापन तथा मापन सही तरीके से किया जा सके। 13-कक्षों एवं पात्रों का चिन्हांकन एवं क्रमांकन -(1) लाइसेंसधारी अपने संयत्र के सभी कक्षाें की बाहरी दीवारों अथवा स्थान को रंग से रंगेगा;

(2) लाइसेंसधारी बाटलिंग संयत्र के पात्रों को ऐसी रीति से पेंट एवं अंकन भी करेगा जैसा कि आबकारी आयुक्त द्वारा विनिर्दिष्ट किया जाये। 14-भंडारण के लिए पात्र-गोल पात्रों के सिवाय किसी बाटलिंग प्लाट में कोई स्प्रिट भण्डारित नही की जायेगी। स्प्रिट वाले प्रत्येक पात्र में एक सीरियल नंबर चित्रित या उत्कीर्ण होगा, और इस तरह के प्रत्येक पात्र का बाहरी हिस्सा स्पष्ट रूप से दिखाई देगा। 15-देशी मदिरा बोतल भराई संयत्र में दोनों आयतन एवं तीव्रता द्वारा स्प्रिट की बोतल भराई तथा मापन हेतु इलेक्ट्रानिक उपकरणों की प्रतिष्ठापना, उपयोग एवं अनुरक्षण-

(1) बाटलर आबकारी आयुक्त के समाधान के अनुसार बाटलिंग कक्ष में स्वचालित/अर्द्ध स्वचालित बाटलिंग लाइनें स्थापित करेगा;

(2) लाइसेंसधारी स्प्रिट से भरे हुए किसी पात्र के अवगाह स्थान अथवा स्तर को न तो परिवर्तित करेगा एवं न ही किसी पात्र में स्प्रिट की प्रमाप लेने के लिए प्रभारी अधिकारी को धोखा देने अथवा गुमराह करने के लिए किसी अन्य साधन का प्रयोग करेगा;

(3)(क) देशी मदिरा बोतल भराई संयत्र में कम से कम दो मास फ्लोमीटर होंगे, जिनमें से एक समिश्रित देशी मदिरा की प्राप्ति के लिए तथा दूसरा वांछित तीव्रता और माप में पेय देशी स्प्रिट की बोतल भराई सुनिश्चित करने के लिए होगा। ;

(ख) समस्त भण्डारण कुण्डों तथा बोतल भराई कुण्डों पर रडार आधारित लेबिल ट्रांसमीटर इन टैंकों में भण्डारित स्प्रिट के स्तर को रिकार्ड करने के लिए लगाये जायेंगे;

(ग) देशी मदिरा बोतल भराई संयत्र में दो इलेक्ट्रानिक बाटल काउन्टर्स होंगे। पहला स्वाचालित भरने वाली इकाई के ठीक बाद बाटलिंग लाइन पर स्थापित किया जायेगा और दूसरा भी सुरक्षा कोड चिपकाने के ठीक बाद उसी लाइन पर होगा। सम्बन्धित डिस्टलर/बाटलर इन बाटल काउन्टर्स को अपनी लागत पर देशी स्प्रिट बाटलिंग संयत्र में प्रतिष्ठापित और रख-रखाव करेंगे;

(घ) मास फ्लोमीटर, रडार आधारित लेबिल ट्रांसमीटर, सेंसर आधारित इलेक्ट्रानिक बाटल काउन्टर्स और अन्य उपकरणों/सहायक उपस्करों की प्रतिष्ठापना और उपयोग से सम्बन्धित तकनीकी विशिष्टताओं और मार्गदर्शी सिद्धान्तों का विवरण और इन उपकरणों के माध्यम से माप, रिकार्ड और संग्रहीत किये जाने के लिए अपेक्षित विनिर्दिष्ट मानकों को आबकारी आयुक्त द्वारा समय समय पर जारी किये गये मानक संचालन प्रक्रिया (एस0ओ0पी) में विहित किये जायेंगे;

(ड़) देशी स्प्रिट बोतल भराई संयत्र का लाइसेंसधारी इन इलेक्ट्रानिक उपकरणों और अन्य सहायक उपस्करों के नियमित अनुरक्षण के लिए उत्तरदायी होगा। देशी स्पिट बोतल भराई संयत्र के लेखा में प्रदर्शित संयत्र में प्राप्त, संयत्र से निर्गत एंव संयत्र में अवशेष स्प्रिट की मात्रा एवं तीव्रता, इन उपकरणों से प्रभारी अधिकारी एवं आबकारी विभाग के अधिकारियों को नियमित आधार पर उपलब्ध होगी। बोतल भराई संयत्र के प्रभारी अधिकारी/अथवा किसी निरीक्षणकर्ता अधिकारी द्वारा इन उपकरणोें की खराबी का पता लगने पर तत्काल ठीक कर लिया जायेगा तथा उप आबकारी आयुक्त को इसके विषय में सूचित कर दिया जायेगा। इन उपकरणों के इसके अभिहित मानक के अनुरुपमरम्मत होने तक संयंत्र का संचालन निलंबित रहेगा;

(च) देशी स्प्रिट बोतल भराई संयत्र का प्रभारी अधिकारी देशी शराब के बोतल भराई संयत्र में प्रयुक्त समस्त मास फ्लोमीटर का कैलीब्रेशन, वित्तीय वर्ष में एक बार आबकारी आयुक्त द्वारा प्राधिकृत किसी निर्दिष्ट संस्था से सुनिश्चित करायेगा और ऐसे कैलीब्रेशन का प्रमाण-पत्र कम से कम तीन वर्षों तक परिरक्षित किया जायेगा;

(छ) बोतल भराई संयत्र पर परेषण के पहुंचने पर तुरन्त प्रभारी अधिकारी उक्त देशी मदिरा को मास फ्लोमीटर के माध्यम से प्राप्त करने हेतु आवश्यक प्रबन्ध करेगा। प्रभारी अधिकारी मास फ्लोमीटर द्वारा प्रदर्शित आंकड़ो के आधार पर आयातित अथवा परिवहन की गयी देशी मदिरा की मात्रा और तीव्रता को अभिलिखित करेगा। मास फ्लो मीटर से आंकड़ा प्राप्त करने की प्रक्रिया यथा विहित एस0ओ0पी0 द्वारा निर्देशित होगी।वह परेषण के अवरण पास पर मात्रा एवं तीव्रता को पृष्ठांकित भी करेगा। आबकारी सत्यापन प्रमाण पत्र (ई0वी0सी0) के प्रपत्र में प्राप्त प्राविष्टियों के साथ पास की एक प्रति, तुरन्त अधिकारी को वापस कर दी जायेगी, जिसने पारेषण निर्गत किया था तथा दूसरी प्रति, प्रविष्टियों सहित संयत्र में रखी जायेगी;

(ज) किसी बोतल भराई संयत्र में एक्सट्रा न्यूट्रल अल्कोहल या रिड्‌यूस्ड अल्कोहल को आबकारी आयुक्त द्वारा अनुमोदित कुण्डों या किन्ही अन्य पात्रों में भण्डारित किया जायेगा। टंकियों में स्प्रिट के स्तर को अभिलिखित करने के लिए समस्त भण्डारण कुण्ड और रिडक्शन कुण्ड पर राडार आधारित लेबिल ट्रांसमीटर भी लगेंगे और स्प्रिट की मात्रा बल्क लीटर में प्रदर्शित करने के लिए इस सम्बन्ध में प्राधिकृत प्राधिकारी द्वारा प्रमाणित अद्यतन ''लेवल वाल्यूम'' तालिका के अनुसार पी0एल0सी0 (प्रोग्रामेबल लॉजिक कंट्रोलर) लेबिल ट्रान्समीटर से जुड़ेेगा;

(4) लाइसेंसधारी राज्य सरकार की पूर्व स्वी—ति से आबकारी आयुक्त द्वारा निर्धारित समय सीमा के भीतर इन उपकरणों को प्रतिष्ठापित करेगा।

16-अन्य आसवनियों से स्प्रिट लाये जाने के लिए अनुज्ञा- (1) आबकारी आयुक्त, उत्तर प्रदेश से लिखित अनुज्ञा और वैध परमिट या पास के आवरण के सिवाय किसी लाइसेंसधारी को बोतल भराई संयत्र में स्प्रिट लाये जाने की अनुमति नहीं होगी। राज्य के बाहर की आसवनियों से निर्गत स्प्रिट का परेषण, सम्बंधित राज्य के सुसंगत पासेस से आच्छादित होगा, जबकि राज्य के भीतर स्थित आसवनियों से निर्गत स्प्रिट का परेषण, पी0डी0-25/पी0डी0-26 पासेज से आच्छादित होगा;

(2) लाइसेंसधारी बोतल भराई संयत्र मेें अन्य आसवनियों से स्प्रिट/ईएनए की आपूर्ति हेतु अनुज्ञा प्रदान करने के लिए आबकारी आयुक्त को आवेदन करेगा। आवेदन प्रभारी अधिकारी की सम्यक्‌ संस्तुति के साथ प्रपत्र सी0एल0बी-20 में किया जायेगा।

17-रजिस्टर और विवरण-बोतल भराई संयत्र का प्रभारी अधिकारी निम्नलिखित रजिस्टरों का अनुरक्षण करना सुनिश्चित करेगा-

(1)(क) प्रपत्र सी0एल0बी0-4 रजिस्टर, जिसमें लाइसेंसधारी बोतल में भरने के लिए प्राप्त तथा निर्गत की गयी मदिरा की मात्रा,उसका विवरण तथा उसकी तीव्रता प्रविष्ट करेगा;

(ख) प्रपत्रसी0एल0बी0-5 रजिस्टर, जिसमें लाइसेंसधारी स्वयं द्वारा कृत बोतल भराई संक्रिया को प्रविष्ट करेगा;

(ग) प्रपत्र सी0एल0बी0-6 रजिस्टर, जिसमें लाइसेंसधारी लाइसेंस प्राप्त भू-गृहादि में बोतल भराई और भण्डारित की गयी देशी मदिरा का दैनिक लेखा प्रविष्ट करेगा;

(घ) प्रपत्र सी0एल0बी0-7 खाता बही, जिसमें लाइसेंसधारी लाइसेंस प्राप्त भू-गृहादि में समस्त संव्यवहार का सारांश प्रविष्ट करेगा;

(ड.) प्रपत्रसी0एल0बी0-8 रजिस्टर, जिसमें लाइसेंसधारी किसी माह की समाप्ति पर मदिरा की बल्क(जो बोतल में न भरी गई हो) तथा बोतल में भरी गई मदिरा के स्टाक की प्रविष्ट करेगा;

(च) प्रपत्र सी0एल0बी0-9 विवरण जिसमें भण्डारण और बोतल भराई/छीजन दर्शाया जायेगा; (छ) प्रपत्र सी0एल0बी0-10 आवेदन, जो अग्रिम जमा के सापेक्ष देशी शराब निर्गत किये जाने के लिये होगा;

(ज) प्रपत्र सी0एल0बी0-11 पास बोतल भराई बंधित भाण्डागार से थोक लाइसेंस (सी.एल.-2) को देशी मदिरा की निकासी किये जाने से आच्छादित होगा;

(झ) प्रपत्र सी0एल0बी0-12 में कुण्ड प्रमाप रजिस्टर; () प्रपत्र सी0एल0बी0-13 में कुण्डवार डिप बुक; (ट) प्रपत्र सी0एल0बी0-14 में मांगपत्र रजिस्टर; (ठ) प्रपत्र सी0एल0बी0-15 में प्रभारी अधिकारी की दैनिक डायरी; (ड) प्रपत्र सी0एल0बी0-16 में निरीक्षण पुस्तिका; (ढ़) प्रपत्र सी0एल0बी0-17 में त्रुटि रजिस्टर; (ण) प्रपत्र सी0एल0बी0-18 में प्रतिफल फीस के अग्रिम भुगतान का रजिस्टर; (त) प्रपत्र सी0एल0बी0-19 में दैनिक निकासी रजिस्टर; (थ) लाइसेंस प्राप्त बॉटलिंग भू-गृहादि में अन्य आसवनियों से स्प्रिट/ईएनए की आपूर्ति हेतु अनुज्ञा प्रदान करने के लिये प्रपत्र सी0एल0बी0-20 में आवेदन;

(2) लाइसेंसधारी प्रपत्र सी0एल0बी0-15 में प्रभारी अधिकारी की दैनिक डायरी के सिवाय पूर्वोक्त रजिस्टरों में लेखा भी अनुरक्षित रखेगा;

(3) ये प्रपत्र डिजिटल रूप में भी अनुरक्षित किये जायेंगे तथा आबकारी विभाग के अभिहित पोर्टल पर प्रतिदिन आनलाईन प्रस्तुत किये जायेंगे।

18-अन्य निर्बन्धन-सी0एल0बी0-1 अथवा सी0एल0बी0-2 लाइसेंस के अधीन देशी मदिरा को बोतल में भरने के लिए निम्नलिखित अतिरिक्त विशेष शर्तें लागू होंगी-

(1) प्रत्येक कलेण्डर मास के अन्तिम कार्य दिवस को, उस दिन के समस्त संव्यवहार किये जाने के पश्चात्‌, प्रभारी आबकारी निरीक्षक, बोतल भराई भाण्डागार में बोतलों में न भरी गयी तथा बोतलों में भरी गई मदिरा के स्टाक को बोतल भराई भाण्डागार में भण्डारित करेगा, उसे विहित रजिस्टर में प्रविष्ट करेगा और बोतल भराई की संक्रियाओं तथा बंधित भाण्डागार में भण्डारण करने में हुई स्प्रिट के छीजन को सुनिश्चित करेगा;

(2) (क)बोतल भराई तथा भण्डारण करने में वास्तविक हानि के लिए एक मास की अवधि के दौरान भाण्डारित स्प्रिट की कुल मात्रा पर 0.8 प्रतिशत तक की छूट दी जा सकती है। लाइसेंसधारी, माह में 0.8 प्रतिशत से अधिक छीजन पर 36% वी/वीतीव्रताके अनुसार प्रति बल्क लीटर हेतु उद्‌ग्रहणीय प्रतिफल शुल्क के आधार पर आगणित प्रतिफल शुल्क के संदाय हेतु उत्तरदायी होगा;

(ख) जब छीजन, विहित सीमा से अधिक न हो, तो प्रभारी अधिकारी द्वारा कोई कार्यवाही करने की आवश्यकता नहीं है, किन्तु यदि मासिक स्टाक उठान के समय छीजन अधिक पायी जाय तो प्रभारी अधिकारी, अगले मास की पांचवीं तारीख तक सम्बन्धित प्रभार के उप आबकारी आयुक्त को प्रपत्र सी0एल0बी0-9 में एक विवरण प्रेषित करेगा, जिसमें छीजन की वास्तविक मात्रा तथा लाइसेंसधारी द्वारा अतिरिक्त छीजन पर संदत्त किये जाने वाला प्रतिफल शुल्क दर्शित होगा।विवरण प्राप्त होने पर उप आबकारी आयुक्त,देशी मदिरा पर दायी प्रतिफल शुल्क की दर पर लाइसेंसधारी से प्रतिफल शुल्क वसूल करेगा;

(ग) राज्य सरकार बोतल भराई के बंधित भांडागार मेें भण्डारित किसी स्प्रिट की आग या चोरी या माप या प्रूफ अथवा अन्य किसी कारण जो भी हो, से नुकसान, हानि या क्षति के लिए उत्तरदायी नहीं होगी। आग या अन्य दुर्घटना की स्थिति में, प्रभारी अधिकारी दिन या रात किसी भी समय भू-गृहादि को खोलने के लिए तुरंत उपस्थित रहेगा;

(3) देशी मदिरा की बोतल भराई हेतु बंधित भांडागार केवल उन व्यक्तियों के प्रवेश तथा निकास के लिए खुलेगा, जिनको उनके अन्दर काम हो। आबकारी विभाग के अधिकारियों तथा अन्य सरकारी विभागाें के वरिष्ठ अधिकारियों, लाइसेंसधारी,उसके सेवकों तथा ऐसे लाइसेंसप्राप्त विक्रेताओं को, जो क्रय करने के लिए आये हों, के अलावा अन्य किसी को किसी भी बहाने लाइसेंसप्राप्त भू-गृहादि में प्रवेश करने की अनुज्ञा नहीं दी जायेगी। लाइसेंसधारी द्वारा सेवायोजित समस्त व्यक्तियों के नामों के सम्बन्ध मेंं एक रजिस्टर रखा जायेगा। लाइसेंसधारी के समस्त कर्मचारियों का प्रभार के उप आबकारी आयुक्त द्वारा प्रतिवर्ष अनुमोदन किया जायेगा;

(4) देशी मदिरा की बोतल भराई के लिए बंधित भांडागार में प्रवेश करने वाले समस्त व्यक्ति, अपने आचरण के सम्बन्ध में और भांडागार के भीतर कार्यवाहियों के लिए आबकारी निरीक्षकों और अन्य वरिष्ठ अधिकारियों के आदेशों के अधीन होंगे और वे भू-गृहादि से निकासी के समय आबकारी निरीक्षक एवं अन्य वरिष्ठ आधिकारियों के विवेक पर तलाशी हेतु उत्तरदायीं होंगे;

(5) यदि लाइसेंसधारी के संज्ञान में यह बात आती है कि उसके द्वारा सेवायोजित किसी व्यक्ति ने आबकारी विधियों का या अपने द्वारा कृत वचन-बंधों का उल्लंघन किया है, तो यह उसका कर्तव्य होगा कि वह सहायक आबकारी आयुक्त को मामले की रिपोर्ट करे और ऐसे व्यक्ति को सेवा में बनाये रखने से सम्बन्धित निर्देशों का पालन करे;

(6) देशी मदिरा की बोतल भराई हेतु बंधित भांडागार के आबकारी निरीक्षक एवं अन्य वरिष्ठ अधिकारी किसी ऐसे व्यक्ति को, जिसके सम्बन्ध में उसे यह विश्वास करने का कारण हो कि उसने इन नियमों या आबकारी अधिनियम के किसी उपबंध का उल्लंघन किया है या करने वाला है, जो या तो नशे में है या अनुशासनहीन है, भू-गृहादि से निकाल एवं बहिष्कृत कर सकता है। इस नियम के अधीन कृत समस्त कार्यवाहियाँ, उसके द्वारा तत्काल लिखित रूप में, अपनी सरकारी डायरी में अपने वरिष्ठों के सूचनार्थ अभिलिखित की जायेंगी;

(7) लाइसेंसधारी देशी मदिरा की बोतल भराई हेतु बंधित भांडागार के प्रबन्ध हेतु और वहाँ से देशी मदिरा की निकासी हेतु समस्त सामान्य नियमों, जो पहले से ही प्रवृत्त हाें या जो विद्यमान आबकारी विधियों या एतद्‌पश्चात्‌ अधिनियमित की जाने वाली किन्हीं अन्य विधियों के अधीन विहित की जाय या किसी बंधित भण्डागार के सम्बन्ध में आबकारी आयुक्त द्वारा जारी किये गये विशेष आदेशों से बाध्य होगा और वह अपने द्वारा मदिरा बोतल भराई या मदिरा निकासी आदि में सेवायोजित समस्त व्यक्तियों से ऐसे समस्त नियमों का पालन करायेगा;

(8) कोई मदिरा, इस निमित्त सशक्त अधिकारी द्वारा स्वीकृत प्रपत्र सी0एल0बी0-11में पास के सिवाय हटायी नहीं जायेगी। पास, प्रतिफल शुल्क का पूर्ण संदाय करने के प्रमाण पर जारी किया जायेगा। यह तीन प्रतियों में होगा, एक प्रति लाइसेंसधारी को परिवहन को आवरित करने के लिए दी जायेगी, दूसरी प्रति गन्तव्य जिले के जिला आबकारी अधिकारी को अग्रसारित की जायेगी और तीसरी प्रति अभिलेख के लिए रख ली जायेगी। अभिहित पोर्टल पर दैनिक आनलाइन डिजिटल अभिलेख भी अनुरक्षित एवं प्रस्तुत किया जायेगा;

(9) बोतल भरी गयी मदिरा की सम्पूर्ण मात्रा का परिवहन एक परेषण में किया जायेगा और अभिवहन में विभाजित नहीं किया जायेगा तथा परेषण का संचालन सी0एल0बी0-11पास में विनिर्दिष्ट मार्ग से विचलित नहीं किया जायेगा। इसका व्यतिक्रमण किये जाने पर लाइसेंसधारी पर सरकार द्वारा यथा अधिकथित कठोर शास्ति अधिरोपित की जायेगी;

(10) यदि कोई लाइसेंसधारी एक ही विधिमान्य पास पर एक से अधिक बार परेषण का अभिवहन करने के लिए पास का कपट एवं छद्‌मपूर्ण प्रयोग करने में लिप्त पाया जाता है तो आसवनी का प्रभारी अधिकारी और साथ ही साथ लाइसेंसधारी कठोर दण्ड के भागी होंगे।

19-देशी मदिरा की निकासी-प्रतिफल शुल्क का पूर्ण संदाय करने पर देशी मदिरा की बोतल भराई के बंधित भांडागार से केवल बोतल में भरी गयी देशी मदिरा की निकासी, देशी शराब के थोक लाइसेंसधारी को की जा सकती है।

1. लाइसेंसधारी,आबकारी आयुक्त द्वारा यथा अनुमोदित मात्रा से अधिक मदिरा की बोतल भराई के लिए हकदार नहीं होगा;

2. लाइसेंसधारी, आबकारी आयुक्त, उत्तर प्रदेश से स्वीकृति प्राप्त करने के पश्चात्‌ अपने द्वारा भरी गयी बोतलों के लेबिलों पर अपना स्वयं का ब्राण्ड नाम अंकित करने के लिए हकदार होगा;

3. आबकारी आयुक्त की विशेष अनुज्ञा के सिवाय स्प्रिट का रंगना, समिश्रण करना (ब्लेंडिंग), सुवासित करना और तीव्रतावरोह करना (रेडक्शन) निषिद्ध होगा;

4. लाइसेंसधारी, कांच या पेट बोतलों पर उभरे हुए शब्दों में ' यू0पी0ई0', मात्रा तथा वर्ष के अन्तिम दो डिजिट का अंकन करने हेतु प्रबन्ध करेगा;

5. लाइसेंसधारी, अपने स्वयं के उत्पादों की बोतल में भराई के पश्चात्‌ अलग से स्टाक रखेगा;

6. लाइसेंसधारी द्वारा समस्त तकनीकी सूचनाएं, विभाग को समयानुसार उपलब्ध करायी जायेगी;

7. उत्तर प्रदेश के देशी मदिरा के थोक लाइसेंसधारियों को प्रतिफल शुल्क एवं अन्य देयों का पूर्ण भुगतान करने पर समस्त निकासियाँ दी जायेंगी;

8. लाइसेंसधारी, ऐसे किसी व्यक्ति को कर्मचारी के रूप में सेवायोजित नहीं करेगा, जो 21 वर्ष से कम आयु का हो या किसी संक्रामक रोग से ग्रस्त हो या वह आपराधिक पृष्ठभूमि का हो;

9. आबकारी आयुक्त द्वारा नामनिर्दिष्ट सक्षम प्राधिकारी द्वारा सी0एल0बी-1भू-गृहादि का तकनीकी निरीक्षण किया जायेगा और संतोषजनक रिपोर्ट पाये जाने के पश्चात्‌ बोतल भराई कार्य प्रारम्भ किया जायेगा;

10. लाइसेंस प्राप्त परिसर से बोतल में भरी गयी देशी मदिरा की उत्तर प्रदेश में बिक्री हेतु निकासी तब तक नहीं दी जायेगी, जब तक कि उन पर आबकारी विभाग द्वारा अनुमोदित सुरक्षा कोड न लगाया गया हो;

11. लाइसेंसधारी, उत्तर प्रदेश में बिक्री की जाने वाली देशी मदिरा के लेबिलों पर आबकारी आयुक्त द्वारा अनुमोदित अधिकतम फुटकर विक्रय मूल्य मुद्रित करेगा, जो सरलता से दृश्य हो;

12. लाइसेंसधारी, देशी मदिरा की बोतल भराई से सम्बन्घित नियमों और विनियमों तथा देशी मदिरा के निर्गम, धारण एवं परिवहन से सम्बन्धित नियमों का, जैसा कि संयुक्त प्रान्त आबकारी अधिनियम, 1910 और तद्‌धीन बनायी गयी निमयावली में दिये गये हैं, कठोरता से पालन करेगा।

2. लाइसेंसधारी, जैसी और जब केवल थोक में आसवक से अपेक्षित हो, बोतल भराई हेतु देशी मदिरा प्रचलित दर पर शुल्क का संदाय करके उस आसवक से प्राप्त करेगा, जिसने उसे बोतल में भरने के अपने विशेषाधिकार को पट्‌टे पर दिया हो या समनुदेशित किया हो;

3. लाइसेंसधारी, इस प्रकार पट्‌टे पर दी गयी या समनुदेशित की गयी मात्रा से अधिक देशी स्प्रिट की बोतल भराई के लिये हकदार नहीं होगा;

4. लाइसेंसधारी, कांच या पेट बोतलों पर उभरे हुए शब्द में 'यू0पी0ई0', मात्रा तथा वर्ष के अन्तिम दो डिजिट का अंकन करने हेतु प्रबन्ध करेगा;

5. लाइसेंसधारी, आबकारी आयुक्त, उत्तर प्रदेश से अनुमोदन प्राप्त करने के पश्चात्‌ अपने द्वारा भरी गयी बोतलों के लेबिलों पर अपना ब्राण्ड नाम अंकित करने के लिए हकदार होगा;

10. लाइसेंसधारी द्वारा देशी मदिरा की भरी हुई बोतलों की बिक्री उत्तर प्रदेश में की जायेगी;

11. उत्तर प्रदेश में देशी मदिरा के थोक लाइसेंसधारियों को प्रतिफल शुल्क एवं अन्य देयों का पूर्ण संदाय करने पर समस्त निकासियाँ दी जायेंगी;

12. लाइसेंसधारी, ऐसे किसी व्यक्ति को कर्मचारी के रूप में सेवायोजित नहीं करेगा, जो 21 वर्ष से कम आयु का हो या जो किसी संक्रामक रोग से ग्रस्त हो या आपराधिक पृष्ठभूमि का हो;

13. आबकारी आयुक्त द्वारा नामनिर्दिष्ट सक्षम प्राधिकारी द्वारा सी0एल0बी-2 भू-गृहादि का तकनीकी निरीक्षण किया जायेगा और संतोषजनक रिपोर्ट पाये जाने के पश्चात्‌ बोतलभराई कार्य प्रारम्भ किया जायेगा;

14. लाइसेंसधारी, आबकारी आयुक्त द्वारा यथा अनुमोदित मात्रा से अधिक मदिरा की बोतल भराई के लिए हकदार नहीं होगा;

15. लाइसेंसप्राप्त भू-गृहादि से बोतल में भरी गयी किसी मदिरा की उत्तर प्रदेश में बिक्री हेतु निकासी तब तक नहीं दी जायेगी, जब तक कि उन पर आबकारी विभाग द्वारा अनुमोदित सुरक्षा कोड न लगाया गया हो;

16. लाइसेंसधारी, उत्तर प्रदेश में बिक्री की जाने वाली देशी मदिरा के लेबिलों पर आबकारी आयुक्त द्वारा अनुमोदित अधिकतम फुटकर विक्रय मूल्य मुद्रित करेगा, जो सरलता से दृश्य हो।

मैं/हम ..........................................................................................(जिसे/जिन्हें आगे बाध्यताधारी (बाध्यताधारीगण) कहा गया है)उत्तर प्रदेश के राज्यपाल को ................................. रुपये की धनराशि का भुगतान करने के लिए उत्तर प्रदेश राज्यपाल के प्रति संयुक्त रूप से तथा पृथक रूप से आबद्व हॅूंँ/हैं और इस भुगतान के लिए मैं /हम संयुक्त रुप से तथा पृथक रुप से अपने को और अपने विधिक प्रतिनिधियों को आबद्ध करता हॅूं/करते हैं; चूँकि उपर्युक्त बंधित बाध्यताधारी (बाध्यताधारीगण) ने देशी शराब की बोतल भराई हेतु लाइसेंस स्थान .............. .......................... के लिए प्राप्त किया है; चूँंकि, आबकारी आयुक्त, उत्तर प्रदेश (जिसे आगे आयुक्त कहा गया है) ने बाध्यताधारी (बाध्यताधारियों) से इस बन्ध पत्र की धनराशि के निमित्त प्रतिभूति जमा करने की अपेक्षा की है, जिसकीएतद्‌पश्चात्‌ उल्लिखित कुल अंकित मूल्य .......................रुपये की धनराशि/प्रतिभूति धनराशि आयुक्त के पक्ष में पृष्ठांकित की गयी है और चूँकि बाध्यताधारी (बाध्यताधारियों) ने आयुक्त के पास पूर्वोल्लिखित नकद प्रतिभूतियाँ जमा करके ऐसी प्रतिभूतिप्रस्तुत किया है; इस बंध पत्र की शर्त यह है कि बाध्यताधारी (बाध्यताधारीगण) और उसके/उनके विधिक प्रतिनिधि, संयुक्त प्रान्त आबकारी अधिनियम,1910 और प्रतिफल शुल्क का भुगतान करने से संबंधित तदधीन बनाये गये नियमों के समस्त उपबन्धों का पालन करेंगे और या तो उस समस्त मदिरा को प्रतिफल शुल्क के भुगतान के लिए प्रस्तुत करेंगें, जिस पर शुल्क का भुगतान न किया गया हो और जिसे बोतल भराई हेतु बंधित भांडागार में लाया गया अथवा ऐसी मदिरा को किसी ऐसे भण्डार या अन्य भण्डारण स्थल में रखेंगे जो उत्तर प्रदेश देशी शराब को बोतल में भरने की नियमावली 2020 या उसमें किसी उपान्तरण के अधीन आयुक्त द्वारा अनुमोदित हो अथवा आयुक्त के समाधान पर्यन्त ऐसी मदिरा का अन्यथा रूप में लेखा जोखा देंगे और कोई मदिरा उक्त नियमावली में यथा उपबन्धित के सिवाय अनुमोदित भू-गृहादि से या भण्डार कक्ष या अन्य भण्डारण स्थल से समुचित प्रतिफल शुल्क भुगतान किये जाने से पूर्व नहीं हटायेंगे। यदि बोतल भराई संक्रिया एवं भण्डारणमें देशी मदिरा का छीजन विहित सीमा से अधिक होता है तो मै/हम देशी मदिरा पर प्रति बल्क लीटर 36 प्रतिशत वी/वी की दर से उदग्रहणीय प्रतिफल शुल्क जमा करूँगा/करेंगे। और यदि बाध्यताधारी (बाध्यताधारीगण) या उसके/उनके विधिक प्रतिनिधि कोषागार में आयुक्त के लेखे में समस्त देयों का चाहे वह प्रतिफल शुल्क हो अथवा अन्य विधिक परिव्यय हों, जो बाध्यताधारी (बाध्यताधारीगण) से अभियाचनीय होंगे जैसा कि प्रभारी अधिकारी के अभिलेखों में दर्शाया गया हो, उक्त अधिकारी द्वारा लिखित रुप से मांग किये जाने के दिनांक से दस दिन के भीतर भुगतान कर देगा/कर देंगे; तो उक्त बाध्यता शून्य हो जायेगी; अन्यथा तथा इस शर्त के किसी भाग के उल्लंघन करने अथवा उसका अनुपालन करने में विफल होने पर वह पूर्णरुप से प्रवृत्त होगा; और उत्तर प्रदेश के राज्यपाल, अपने विवेक पर, प्रतिभूति जमा की धनराशि से अथवा उपर्युक्त लिखित बन्धपत्र के अधीन या दोनों के द्वारा अपने अधिकारों को प्रवर्तित करके समस्त हानि अथवा क्षतियों की पूर्ति करने के लिए सक्षम होंगे और विधि द्वारा अथवा इस बन्धपत्र द्वारा उपबन्धित किये गये किसी अन्य उपाय पर प्रतिकूल प्रभाव डाले बिना उत्तर प्रदेश के राज्यपाल उक्त समस्त देयों को बंधित बाध्यताधारी (बाध्यताधारियों) से भू-राजस्व के बकाया की भांति वसूल कर सकते हैं; मैं/हम यह घोषणा करता हूँ/करते हैं कि यह बन्धपत्र ऐसे किसी कार्य के निष्पादन के लिए राज्य सरकार के आदेशों के अधीन दिया गया है जिसमें जनता का हित हो।

NOTIFICATION In exercise of the powers conferred under section 41 of the United Provinces Excise Act, 1910 (U.P. Act. no. IV of 1910), read with section 21 of the Uttar Pradesh General Clauses Act, 1904 (U.P. Act. no. 1 of 1904), the Excise Commissioner, Uttar Pradesh with the previous sanction of the State Government, makes the following rules relating to licenses for the bottling of country liquor in supersession of all previous Rules published in this behalf to the extent of their inconsistency with these rules.

THE UTTAR PRADESH BOTTLING OF COUNTRY LIQUOR RULES, 2020.

1. Short title and commencement–(1) These rules may be called the Uttar Pradesh Bottling of Country Liquor Rules, 2020.

(2) They shall come into force with effect from the date of

their publication in the Gazette.

2. Definitions-(1) In these rules, unless there is anything repugnant in the subject or context,- (a) "Act'' means the United Provinces Excise Act, 1910 as amended form time to time;

(b) "Blending" means the mixing together of two or more spirits or liquors of different alcoholic strengths or different qualities or grades;

(c) "Bond" means an obligation authorized or required by or under any law or regulation for the time being in force;

(d) "Bonded Warehouse" means approved warehouse which is used for the storage of excisable articles brought thither under bond for payment of consideration fee at the time of issue from such warehouse;

(e) "Coloring and Sophistication" means addition of coloring and flavoring material in Spirit or reduced Spirit;

(f) "Country liquor" means plain or spiced spirit containing alcohol mild or strong and which has been manufactured from Extra Neutral Alcohol;

(g) "Excise Year" means the financial year commencing from 1st April and ending with 31st March of the next calendar year;

(h) "Form" means form appended to these rules;

(i) "License" means the license granted under these rules;

(j) "Licensing Authority" means the Excise Commissioner, Uttar Pradesh;

(k) "License fee" means the consideration for the grant of license for exclusive privilege of bottling country liquor, which shall be paid through E-payment in the Government Treasury by the licensee before the license is granted to him, on such rates as may be fixed from time to time by the Excise Commissioner with the previous sanction of the State Government; (l) "Officer In charge" means officer of Excise Department not below the rank of Assistant Excise Commissioner appointed by the Excise Commissioner for conducting the work of the License under reference;

(m) "Plain Spirit" means 'spirit' to which no flavor has been communicated and to which no coloring or flavoring matter or other material or ingredient has been added;

(n) "Portal" means the electronic platform created specifically for the purpose of uploading information in the prescribed form with regard to the process of manufacturing liquor up to the terminal stage of its distribution;

(o) "Receiver" means any vessel into which the worm of a still discharges;

(p) "Reduction of Spirits" means the dilution of higher strength of ENA by addition of water;

(q) "Security Code" means security code as approved by excise department which shall be affixed on each carton (case) and bottle or any other container as a proof of payment of consideration fee;

(r) "Spiced Spirit" means 'spirit' obtained after the addition of flavors and spices to plain spirit;

(s) "State" means the State of Uttar Pradesh;

(t) "Strength" means such strength of country liquor as may be fixed by the Excise Commissioner with prior sanction of the State Government from time to time and which is indicated by the alcohol meter;

(u) "To bottle" means to transfer liquor from a vat or tank to a bottle or similar receptacle for the purpose of sale. Bottling includes rebottling;

(v) "To gauge" means to determine the quantity of spirits contained in or taken from any receptacle, container, vat or tank or determine the capacity of a vat or other receptacle;

(w) "Vat " Means any fixed vessel used for the storage of liquor;

(x) "Warehouse" means the part of a licensed premises for bottling of country liquor in which spirit in a fit state for issue and consumption is stored under excise control.

(2) Words and expressions not defined in these rules, but defined in the Act, shall have the meanings respectively assigned to them in the Act.

3. Grant of Licence--(1) A bottling license in form C.L.B-1 may be granted by the Excise Commissioner to:

(a) A distiller to bottle Country Liquor;

(b) A company or a unit holding PD-33 license to establish a potable distillery, having a minimum investment of Rs. 50crore and a minimum capacity of 40 KLPD, on giving an assurance and commitment by an affidavit supported by Bank Guarantee for rupees twenty five Lakhs that it shall install potable distillery within two years by depositing Rs. 25/- per kilolitre of sanctioned capacity from the date of grant of C.L.B-1license to bottle country liquor. If the unit fails to establish the potable distillery within the specified period, the aforesaid Bank Guarantee shall be forfeited in favor of the State Government by the Excise Commissioner and the bottling license shall be held in suspended stage until the distillery is commissioned;

(2) The holder of a license in form C.L.B-1 may assign whole or any part of his bottling privilege to- (a) Another distiller of Uttar Pradesh.

(b) A distiller of another state or union Territory in India.

Provided that no such assignee shall exercise any right as such unless a license in C.L.B-2 has been granted to him by the Excise Commissioner on an application made by the holder of C.L.B-1 license.

(3) A bottling license in Form C.L.B-2 may be granted by the Excise Commissioner to a distiller subject to the following conditions:

(a) A distiller shall be entitled to put his own brand name on the labels of the spirit bottled by him after obtaining the approval of the Excise Commissioner.

(b) Coloring, blending, flavoring or reduction of spirit except under and in accordance with a special permission of the Excise Commissioner shall be prohibited.

4. License Fee--The Licence in form C.L.B-1 may be granted on payment of license fee of rupees two lakhs for the year or part thereof. The license in form C.L.B-2 may be granted on payment of license fee of rupees five lakhs for the year or part thereof.

Provided that a franchise fee of Rs. 5,00,000/- (Five Laks) shall be payable for the grant of new licence in form C.L.B-2 for the year or part thereof.

5. Process of Application-(1) A person, applying for a bottling license under Rule-3, shall upload application on the designated Portal and he shall also along-with the application furnish the following particulars to the Excise Commissioner, Uttar Pradesh namely.

(a) a valid distillery license in the state in case of C.L.B-1 license; or

(b) a valid PD-33Licence and documentary evidence in support of fulfilling criteria as laid down in Rule 3 (1)(b).

(c) in case of C.L.B-2 Licence, a valid distillery licence in the state or another state or union Territory.

(d) the place and premises in which bottling shall be carried on along with Geo tagging showing latitude and longitude.

(e) copy of the document showing the applicant's right, title and interest on the proposed site or the area.

(f) the approximate number of days in a week or month during which bottling shall be carried on;

(g) a detailed plan of the premises in triplicate showing the different rooms or compartments and all the permanent fixtures therein.

(h) Affidavit of the intent that he is not in the arrear of public dues or Government dues.

(2) The Excise Commissioner, if satisfied on enquiry that the applicant is a fit person to hold the required license and the premises in which such person proposes to carry on bottling are suitable, may, grant the license. Every such licensee shall deposit Rs. One lakh as security in form FDR or TDR pledged in the name of the Excise Commissioner, before issue of license. The licensee shall be allowed to draw, as it falls due, the interest accruing on them.

6. Bond and Security for conducting the Licence-The Licensee shall execute a bond in form CLB with such security as may be fixed by the Excise Commissioner. The security shall be furnished either in cash or in interest bearing securities, Government Promissory Notes, National Savings Certificate, Post Office Savings, Bank Pass Book or Post Office Cash Certificates or in fixed deposit receipts of the State Bank of India or any other Bank duly approved by the State Government. The security is liable to be increased or decreased by the Excise Commissioner at any time, should he consider for any reason, that the amount so fixed is inadequate or excessive.

7. Renewal of Bottling license.- (1) Application for the renewal of bottling license shall be made in Form C.L.B-3to the Excise Commissioner, Uttar Pradesh on or before February 28 of the year of expiry of the license. Unless the fee or any part thereof is in arrear or there be any other sufficient reason, a bottling license in Form C.L.B-1and C.L.B-2may be renewed by the Excise Commissioner for two years, but the license shall be valid only till the period of validity of concerning PD-2/PD-33 License.

(2) Renewal Fee shall be payable for the renewal of C.L.B-1and C.L.B-2licenses as below-

Provided that a franchisee fee equivalent to half of the renewal fee shall also be payable for renewal of C.L.B-2 license. The presumptive annual bottled liquor shall be calculated on the basis of total quantity of liquor bottled in the ten months preceding the end of the month of January.

8- Terms and conditions of Licence-- Every license granted in form C.L.B-1 and C.L.B-2shall be subject to the following terms and conditions-

(1) the Licensee shall carry the operations of bottling in the premises which is previously approved by the Excise Commissioner or officer authorized by him and duly endorsed on the License. This premises shall not be used for any other purpose except for bottling and storage of country liquor;

(2) the Licensee shall make no addition or alterations in the said premises without the previous approval of the Excise Commissioner. All such addition and alterations shall be shown in the plan and blue print filed by him;

(3) bottling shall be conducted in separate room(s) set apart for the purpose. The Licensee shall erect bottling vats in bottling room(s) for storage of liquor. He may setup in the bottling room(s) such apparatus for filtration, bottling and processes connected there with as may be necessary;

(4) bottled liquor shall be stored in separate room(s) ;

(5) every room shall bear on the outside a board on which shall be painted legibly the purpose for which the room is used;

(6) Blending or Reducing is prohibited except under and in accordance with the special permission of Excise Commissioner;

(7) addition of any flavoring or coloring material or any other substance in country liquor is prohibited except under and in accordance with the special sanction of the Excise Commissioner;

(8) in special circumstances, a bottling hall approved by the Excise Commissioner for bottling of Indian Made Foreign Liquor, can also be used for bottling of country liquor with prior permission of Excise Commissioner provided that in any case at the time of bottling of country liquor , bottling of Indian Made Foreign liquor shall not be carried out;

(9) the licensee shall bottle country liquor in bottles or other containers of such capacities and strength as are prescribed by the Excise Commissioner with the previous approval of the State Government; (10) the licensee shall comply with the directions issued by the Excise Commissioner in respect of bottles or other containers used for bottling of country liquor;

(11) the glass bottle/PET bottle shall be embossed with the words "UPE" along with the last two digit of the year on the chest of the bottle;

(12) immediately after the bottles have been filled up, they shall be corked, capsuled, labeled and affixed with security code before removing to the room for storage of bottled liquor. A distinctive serial number to be known as the batch number shall be assigned to each bottling operation and this batch number shall be noted on the label. A digital record will also be maintained and submitted online on designated portal of Excise Department daily;

(13) labels on the bottles shall be so affixed as to be easily distinguishable. No label shall be pasted over the words, letters and figures molded or sand blasted thereon.

(14) the licensee shall print the maximum retail price on the label of country liquor to be sold in Uttar Pradesh which shall be easily visible;

(15) bottling unit shall make all such arrangements as prescribed in solid Waste Management Rules, 2016 for recycling and management of solid wastes.

9. Application of the security code- The licensee shall apply security code as approved by Excise Department on each carton (case) and bottle or any other container, immediately after bottling and before issuing country liquor as a proof of payment of consideration fees. All these records will also be maintained in the digital form and submitted daily online on designated portal of Excise Department. The licensee shall make all necessary arrangements for compliance of directions issued by the Excise Commissioner in this regard.

10. Bottling operation-Bottling operation shall be subject to the following conditions-

(1) no bottle shall be filled with liquor except in the joint presence of the Excise Inspector and a representative of the licensee and under watch of CCTV Camera with IP Address. Bottling can be done continuously as per requirements;

(2) the Excise Commissioner shall decide the strength of Excise personnel necessary for the proper supervision of the operations connected with bottling and his decision shall be binding on the Licensee;

(3) the Licensee shall provide quarters to the Excise staff to the satisfaction of the Excise Commissioner in the vicinity of the bonded warehouse for bottling of country liquor at a rent not exceeding ten percent per month of the salary of each member of the staff;

(4) The Licensee shall be bound to keep the quarters and their appurtenances in proper repair and not to interrupt or annoy any officer residing therein, in his use or enjoyment thereof. If residential facility is not available with the Licensee then he shall arrange accommodation in nearby locality or town according to post and pay the rent thereof. In case of dispute of place sufficiency of accommodation or rent, the matter shall be referred to the Excise Commissioner and his decision shall be binding on all concerned;

(5) the Excise inspector in-charge of bonded warehouse for the bottling of country liquor will, unless otherwise directed, work under the supervision of and correspond with the Assistant Excise Commissioner of the distillery. Regarding all ordinary matters of the bottling operation, the licensee should, in first instance, apply to the Excise Inspector in-charge who will, if necessary, secure higher orders;

(6) the shift and hours of attendance of the inspectors posted to a bonded warehouse for the bottling of Country liquor will be fixed by the Assistant Excise Commissioner;

(7) operation connected with bottling shall be conducted in separate rooms called bottling rooms set apart for the purpose within the premises near the country liquor store. In these rooms the licensee may set up such apparatus for filtering, bottling and processes connected therewith as may be necessary. In the bottling rooms vats shall be erected for the storage of country liquor. Bottled liquor shall be stored in separate rooms.

All the rooms shall be well ventilated. The windows and ventilators shall be securely barred with iron bar embedded in cement and they shall be wire netted with the net having a mesh of not more than 25 mm. Every room shall bear on the outside a board on which shall be painted legibly the purpose for which the room is used. All the rooms shall remain under the separate locks and keys of the licensee and the Excise Inspector;

(8) liquor required for bottling in a distillery shall be measured out and brought into bottling rooms by a permanently fixed pipe fitted within the liquor store with a cock and fastening for Excise Locks or Digital Locks or such other Electronic devices/ means as may be approved by the Excise Commissioner; (9) the holidays allowed to the Excise Staff posted at the bonded warehouse for the bottling of country liquor are mentioned as below:-

Sundays, Republic Day (26 January), Good Friday, Mahatma Gandhi's birthday (2nd October), Independence day (15 August), Christmas day (25 December), Holi (The day following the burning of holi), Janamashtmi, Dussehra ( Principal day) Diwali (Principal day), Idulfitr (Principal day) Idul-zuha, Moharram (10th day) and Shabe-E- Barat;

Other gazetted holidays shall only be allowed if the Licensee himself closes down on special grounds with the sanction of the Excise Commissioner.

(1) no bottle shall be filled with liquor except in the joint presence of the Excise Inspector and a representative of the licensee and under watch of CCTV Camera with IP Address. Bottling can be done continuously as per requirements;

(2) the Excise Commissioner shall decide the strength of Excise personnel necessary for the proper supervision of the operations connected with bottling and his decision shall be binding on the Licensee;

(3) the Licensee shall provide quarters to the Excise staff to the satisfaction of the Excise Commissioner in the vicinity of the bonded warehouse for bottling of country liquor at a rent not exceeding ten percent per month of the salary of each member of the staff;

The Licensee shall be bound to keep the quarters and their appurtenances in proper repair and not to interrupt or annoy any officer residing therein, in his use or enjoyment thereof. If residential facility is not available with the Licensee then he shall arrange accommodation in nearby locality or town according to post and pay the rent thereof. In case of dispute of place sufficiency of accommodation or rent, the matter shall be referred to the Excise Commissioner and his decision shall be binding on all concerned;

(4) the Excise inspector in-charge of bonded warehouse for the bottling of country liquor will, unless otherwise directed, work under the supervision of and correspond with the Assistant Excise Commissioner of the distillery. Regarding all ordinary matters of the bottling operation, the licensee should, in first instance, apply to the Excise Inspector in-charge who will, if necessary, secure higher orders;

(5) the shift and hours of attendance of the inspectors posted to a bonded warehouse for the bottling of Country liquor will be fixed by the Assistant Excise Commissioner;

(6) operation connected with bottling shall be conducted in separate rooms called bottling rooms set apart for the purpose within the premises near the country liquor store. In these rooms the licensee may set up such apparatus for filtering, bottling and processes connected therewith as may be necessary. In the bottling rooms vats shall be erected for the storage of country liquor. Bottled liquor shall be stored in separate rooms.

All the rooms shall be well ventilated. The windows and ventilators shall be securely barred with iron bar embedded in cement and they shall be wire netted with the net having a mesh of not more than 25 mm. Every room shall bear on the outside a board on which shall be painted legibly the purpose for which the room is used. All the rooms shall remain under the separate locks and keys of the licensee and the Excise Inspector;

(7) liquor required for bottling in a distillery shall be measured out and brought into bottling rooms by a permanently fixed pipe fitted within the liquor store with a cock and fastening for Excise Locks or Digital Locks or such other Electronic devices/ means as may be approved by the Excise Commissioner; (8) the holidays allowed to the Excise Staff posted at the bonded warehouse for the bottling of country liquor are mentioned as below-

(8) Sundays, Republic Day (26 January), Good Friday, Mahatma Gandhi's birthday (2nd October), Independence day (15 August), Christmas day (25 December), Holi (The day following the burning of holi), Janamashtmi, Dussehra ( Principal day) Diwali ( Principal day), Idulfitr (Principal day) Idul-zuha, Moharram (10th day) and Shabe-E- Barat;

11. Chemical analysis of country spirit-(1) The Licensee shall provide two bottles of country spirit after filling in bottles of different capacity from each batch free of cost to the Officer–in–Charge of the bonded warehouse for analysis and declaration of the true strength by the Chemical Examiner or Assistant Chemical Examiner authorized by the Excise Commissioner;

(2) In case, any variation is detected in the strength of country spirit of particular batch supplied, the licensee shall be liable to pay the difference amount of Consideration fee leviable on the quantity manufactured in that batch along with a penalty up to two times the amount of such Consideration fee.

12. Conditions of vats and receivers.- Vats and receivers in the plant shall be so placed that contents of them may be gauged or measured accurately.

13. Marking and numbering of rooms and vessels.- (1) The licensee shall paint the outside wall of every room or place of his plant with color;

(2) The licensee shall also paint and number the vessels and utensils of the bottling plant in such manner as may be directed by the Excise Commissioner.

14. Vessels for storage.- No spirit shall be stored in a bottling plant except in round vessels, each vessel containing spirit shall bear a serial number painted or engraved thereon, and the external part of each such vessel shall be clearly visible.

15. Installation, use and maintenance of electronic devices for bottling and measurement of spirit both by volume and strength at a country Liquor bottling plant .

(1)The Bottler shall install automatic /semi automatic bottling lines in the bottling room to the satisfaction of the Excise Commissioner.

(2) The licensee shall neither alter the dipping place or level of any vessel containing spirit nor use any other means to deceive or mislead the Officer-in-Charge taking the gauge of spirit in any vessel.

(3) (a) there shall be at least two Mass Flow Meters at a country spirit bottling plant, one for receipt of blended country liquor and the other to ensure bottling of potable country spirit at desired strength and measure;

(b) there shall be Radar based Level Transmitters to be mounted on all the storage vats and bottling vats to record the level of spirit stored in these tanks;

(c) there shall be two electronic bottle counters at a country spirit bottling plant. The first one shall be installed on the bottling line just after the automatic filling unit and the second one shall also be on the same line just after the affixation of Security Code. Concerned distillers/bottlers shall install and maintain these bottle counters at country spirit bottling plant at their own cost;

(d) the details of technical specifications and guidelines related to installation and use of Mass Flow Meters, Radar Based Level Transmitters, sensor based electronic bottle counters & other appliances / accessories, and the specified parameters required to be measured, recorded and archived through these devices shall be prescribed in the Standard Operating Procedure (SOP) issued by the Excise Commissioner from time to time;

(e) the licensee of a country spirit bottling plant shall be responsible for regular maintenance of these electronic devices and other allied accessories. The accounts in the country spirit bottling plant showing the quantity and strength of spirits received in, issued from and remaining in the plant shall be available from these instruments on continuous basis to the officer-in-charge and the officers of the Excise Department. Any malfunctioning of these instruments detected by the Officer-in-Charge of the bottling plant or any inspecting officer, shall be corrected forthwith and the Deputy Excise Commissioner shall also be intimated about this. The operation of the plant shall remain suspended till the restoration of these instruments to its designated standard;

(f) the Officer-in-Charge of the bottling plant shall ensure calibration of all the Mass Flow Meters used in the country spirit bottling plant once in a financial year by any accredited institution authorized by the Excise Commissioner and preserve the certificate of such calibration for at least three years.;

(g) immediately on arrival of a consignment at the bottling plant the Officer-in-Charge shall make necessary arrangement to receive the said country liquor through the Mass Flow Meter. The Officer-in-Charge shall record the volume and strength of country liquor, imported or transported, from the data shown by the Mass Flow Meter. The process of fetching data from Mass Flow Meter shall be guided by the SOP as prescribed. He shall also endorse the volume and strength on the Pass, covering the consignment. One copy of the Pass with the entries of receipt in the form of Excise verification certificate (EVC) shall be immediately returned to the officer, who issued the consignment and the other copy with the entries thereon shall be kept in the plant;

(h) extra Neutral Alcohol or reduced Alcohol in a bottling plant shall be stored in vats or in any other receptacles approved by the Excise Commissioner. All the storage vats and reduction vats shall be mounted with Radar based Level Transmitter to record the level of spirit in tanks as well and there shall be PLC (Programmable Logic Controller) attached to the level transmitter to display the volume of spirit in Bulk litre in accordance with the updated 'level-volume' table certified by the authorized authority in this regard.

(4) The licensee shall install these devices within the timeframe fixed by the Excise Commissioner with prior approval of the State Government.

16. Permission for bringing spirit from other distilleries.- (1) No licensee shall be allowed to bring spirit in a bottling plant except with a written permission from the Excise Commissioner, UP and under the cover of a valid permit/pass. Consignment of spirit issued from the distilleries of the outside state shall be covered under relevant passes of the concerning state, whereas consignment of spirit issued from the distilleries situated within the state shall be covered under passesPD-25 / PD-26;

(2) The licensee shall apply to the Excise Commissioner for grant of a permit for the supply of spirit/ ENA from other distilleries to the bottling plant. Application shall be made in form CLB-20 along with due recommendation of Officer In-charge.

17. Registers and Statements-The officer in-charge of bottling Plant shall ensure to maintain the following registers-

(1)(a) Register in form CLB-4 in which the licensee shall enter the quantity, description and strength of liquor received/issued for bottling;

(b) Register in form CLB-5 in which the licensee shall enter the bottling operation carried on by him;

(c) Register in form CLB-6 in which the licensee shall enter daily account of country liquor bottled and stored in the licensed premises;

(d) Ledger in form CLB-7 in which the licensee shall enter the abstract of all the transactions in the licensed premises;

(e) Register in form CLB-8 in which the licensee shall enter the stock of bulk (un-bottled) and bottled liquor at the end of a month;

(f) statement in form CLB-9 showing the storage and bottling wastage;

(g) Application in form CLB-10 for issue of country liquor against advance deposit;

(h) Pass in form C.L.B.-11covering issues of country liquor from the bottling bonded warehouse to wholesale license (C.L.-2);

(i) Gauge register of vats in form CLB-12;

(j) Vat wise dip book in form CLB-13;

(k) Indent register in form CLB-14;

(l) Daily diary of officer in-charge in form CLB-15;

(m) Inspection book in form CLB-16;

(n) Defect register in form CLB-17.

(o) Register of Advance deposit of consideration fee in form CLB-18;

(p) Daily issue register in form CLB-19.

(q) Application in form CLB-20 for grant of a permit for supply of spirit/ENA from other distilleries to the licensed bottling premises.

(2) The licensee shall also maintain account in the aforesaid registers excluding daily diary of officer in charge in form CLB-15;

(3) These forms shall also be maintained in digital form and submitted daily online on designated portal of the Excise Department.

18. Other Restrictions.-Following additional special conditions shall be applicable to bottling of Country Liquor under C.L.B-1or C.L.B-2License.

(1) On the last working day of every calendar month, after all the transactions for that day are made, the Excise Inspector in-charge shall take the stock of un-bottled and bottled spirit stored in the bottling warehouse, enter into the prescribed register and ascertain the wastage of spirit in the bottling operations and storage in the bonded warehouse;

(2) (a) an allowance up to 0.8% may be made on the total quantity of spirit stored during a month for actual loss in bottling and storage. The licensee shall be responsible for the payment of consideration fee calculated on the basis of consideration fee leviable for every bulk litre in terms of strength 36% v/v on wastage in excess of 0.8% in a month;

(b) when the wastage does not exceed the prescribed limit, no action need be taken by the Officer In-Charge but if an excess is found at the time of monthly stock taking the Officer In- Charge shall submit a statement in form CLB-9 to the Deputy Excise Commissioner of the concerned charge by the fifth day of the next month showing the quantity of actual wastage and the consideration fee to be paid by the licensee on the excess wastage. On receipt of the statement the Deputy Excise Commissioners hall recover the consideration fee from the licensee at the rate of consideration fee liable on Country liquor;

(c) the State Government shall not be liable for the destruction, loss or damage of any sprit stored in the bottling bonded warehouse by fire or theft, or by gauging, or proof , or by any other cause whatsoever. In case of fire or other accident , the officer in-charge shall immediately attend to open the premises at any hour by day or night;

(3) Bonded Warehouse for the bottling of country liquor shall be open only for the entrance and exit of persons who have business within it. No one except officers of the Excise department and the superior officer, of other Government Departments, Licensee, his servants and licensed vendors who have come to purchase shall be allowed to enter the licensed premises on any pretext. A register shall be kept in respect of the names of all persons employed by Licensee. All employees of the Licensee shall be approved every year by the Deputy Excise Commissioner of the Charge;

(4) All the persons entering a bonded warehouse for the bottling of country liquor shall be under the orders of the Excise Inspectors and other superior officers in respect of their conduct and proceeding within the warehouse and shall be liable to search on their exiting the premises at the discretion of the Excise Inspector and other superior officers;

(5) If it comes to the knowledge of a Licensee that any person employed by him has committed any breach of the excise laws or the engagements entered into by him, it shall be his duty to report the matter to the Assistant Excise Commissioner and to comply with his directions regarding the continued employment of such person;

(6) The Excise Inspector or other superior officers of a bonded warehouse for bottling of country liquor may eject and exclude from the premises any person as to whom he has reason to believe that he has committed or is about to commit any breach of these rules or of the provisions of the Excise Act or who is intoxicated or disorderly. All actions under this rule shall forthwith be recorded by him in writing in his official diary for the information of his superiors;

(7) The Licensee shall be bound by all the general rules for the management of bonded warehouse for bottling of country liquor and for the issue of country liquor there from which may already be in force or which may hereafter be prescribed under the existing Excise law or under any law which may hereafter be enacted or by special orders issued by the Excise Commissioner with regard to bonded warehouse, and shall cause all persons employed by him in the bottling, issue etc. of liquor to obey all such rules;

(8) No liquor shall be removed except under a pass in form CLB-11 granted by the officer empowered in this behalf. The pass shall be issued on proof of full payment of consideration fee. It shall be in triplicate, one copy shall be made over to the Licensee to cover the transport and second forwarded to the District Excise Officer of the destination district and third retained for record. A digital record shall also be maintained and submitted daily online on the designated portal;

(9) The entire quantity of bottled liquor shall be transported in one consignment and shall not be broken in transit and the movement of consignment shall not be deviated from the route specified in the CLB-11 pass, the infraction of this may entail on the licensee imposition of severe penalty as laid down by the Government;

(10) If any Licensee is found to be involved in a deceptive and fraudulent use of pass for transiting consignment more than once on the valid pass, the Officer in-charge of distillery, as well as licensee, shall be liable to severe punishment. 19. Issue of Country Liquor.- Only bottled country liquor may be issued to wholesale licensee of Country Liquor from the Bonded warehouse of the bottling of country liquor on full payment of consideration fee.

The infraction of any of the rules hereinbefore enumerated shall involve forfeiture of the license in addition to such other penalties as may be prescribed under the U.P.Excise Act 1910.
