साधारण खण्ड अधिनियम, 1897 (अधिनियम संख्या 10 सन् 1897) की धारा 21 के साथ पठित उत्तर प्रदेश में उसकी प्रवृत्ति के सम्बन्ध में यथा संशोधित भारतीय स्टाम्प अधिनियम, 1899 (अधिनियम संख्या 2 सन् 1899) की धारा 9 की उपधारा (1) के खण्ड (क) के अधीन शक्तियों का प्रयोग करके, राज्यपाल इस अधिसूचना के गजट में प्रकाशित किये जाने के दिनांक से नोएडा औद्योगिक विकास प्राधिकरण क्षेत्र, जनपद गौतमबुद्ध नगर, उ0प्र0 में मेसर्स सैमसंग इण्डिया इलेक्ट्रानिक्स लिमिटेड (एस0आइ0ई0एल0) द्वारा मेसर्स सैमसंग डिस्पले नोएडा प्राइवेट लिमिटेड के पक्ष में निष्पादित अन्तरण विलेख में सम्बन्धित सम्पत्ति पर स्थित नवीन निर्माण के मूल्य पर संदेय स्टाम्प शुल्क में छूट प्रदान करती हैं।
:-
1- नवीन निर्माण का तात्पर्य सम्बन्धित सम्पति पर वर्ष 2019 एवं 2020 में किये गये निर्माण से है, परंतु यह कि जिला का जिला मजिस्टे्रट, ऐसे लिखत पर इस तथ्य की पुष्टि करने के प्रयोजन हेतु साक्षी के रूप में हस्ताक्षर करेगा कि अन्तरण विलेख में दर्शित नवीन निर्माण वर्ष 2019 के पूर्व का नही है; तथा 2-उपरोक्त छूट, सम्बन्धित सम्पति पर वर्ष 2019 से पूर्व किये गये निर्माण के मूल्य पर संदेय स्टाम्प शुल्क हेतु उपलब्ध नहीं होगी। 2 उत्तर प्रदेश असाधारण गजट, 22 दिसम्बर, 2020 IN pursuance of the provisions of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of notification no. 13/2020/1459/94- S. R.-2–2020-700(21)-2020, dated December 22, 2020:

IN exercise of the powers under clause (a) of sub-section (1) of section 9 of the Indian Stamp Act, 1899 (Act no. 2 of 1899) as amended in its application to Uttar Pradesh read with section 21 of the General Clauses Act, 1897 (Act no. 10 of 1897), the Governor is pleased to remit with effect from the date of publication of this notification, in the Gazette, the stamp duty payable on the value of new construction situated on the concerned property in the area of Noida Industrial Development Authority, district Gautambuddh Nagar, U.P., in the transfer deed executed by M/S Samsung India Electronic Limited (S.I.E.L.) in Favour of M/S Samsung Display Noida Private Limited.
Explanation: –
1- New construction means construction made on the concerned property, in the year 2019 and 2020, provided that the District Magistrate of the District sign such instrument as witness for the purpose of confirming the fact that the new construction shown in the transfer deed is not of before the year 2019; and
2-The remission above shall not be available to the stamp duty payable on the value of the construction made on the concerned property before 2019.
