संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करके और इस विषय पर समस्त विद्यमान नियमों और आदेशों का अधिक्रमण करके राज्यपाल, प्रमुख सचिव, संसदीय कार्य, उत्तर प्रदेश के पद पर नियुक्त व्यक्तियों की भर्ती और सेवा शर्तों को विनियमित करने के लिये निम्नलिखित नियमावली बनाती हैं :-
1-(क) यह नियमावली उत्तर प्रदेश, प्रमुख सचिव, संसदीय कार्य (भर्ती और सेवा संक्षिप्त नाम और प्रारम्भ शर्त) नियमावली, 2021 कही जायेगी।
(ख) यह गजट में प्रकाशित होने के दिनांक से प्रवृत्त होगी।
2-उत्तर प्रदेश प्रमुख सचिव, संसदीय कार्य सेवा एक ऐसी सेवा है, जिसमें समूह 'क' सेवा की प्रास्थिति का पद समाविष्ट है।
3-जब तक विषय या सन्दर्भ में कोई प्रतिकूल बात न हो, इस नियमावली में :- परिभाषाएँ (क) 'नियुक्ति प्राधिकारी' का तात्पर्य राज्यपाल से है; (ख) 'संविधान' का तात्पर्य भारत का संविधान से है; (ग) 'सरकार' का तात्पर्य उत्तर प्रदेश राज्य सरकार से है; (घ) 'राज्यपाल' का तात्पर्य उत्तर प्रदेश के राज्यपाल से है; (ङ) 'सेवा का सदस्य' का तात्पर्य नियम-5 (दो) के अधीन मौलिक रूप से नियुक्त
किसी व्यक्ति से है;
(च) 'भर्ती का वर्ष' का तात्पर्य किसी कलेण्डर वर्ष की पहली जुलाई से प्रारम्भ होने
वाली बारह माह की अवधि से है। 2 उार प्रदेश असाधारण गजट, 12 मार्च, 2021 अर्हता 4-कोई व्यक्ति, जो राज्य सरकार में प्रमुख सचिव या उसके ऊपर की श्रेणी का अधिकारी अथवा भारत सरकार में अपर सचिव रहा हो और उसके पास सिविल प्रशासन या न्यायपालिका का अनुभव हो, नियुक्ति के लिये अर्ह होगा।
भर्ती की पद्धति 5-उक्त पद पर भर्ती निम्नलिखित दो पद्धतियों में से किसी पद्धति से की जायेगी :-
(एक) ऐसे अधिकारियों की तैनाती के लिये अनुसरण किये गये सामान्य प्रक्रम में कोई पात्र सेवारत आई0ए0एस0/एच0जे0एस0 अधिकारी तैनात किया जा सकता है। उसकी नियुक्ति और सेवा शर्तें वही होंगी जो उस सेवा, जिससे वह सम्बन्धित हो, के लिये लागू हों।
या
(दो) यदि जहाँ सरकार, इस पद के लिये किसी सेवानिवृत्त व्यक्ति का चयन करने के लिये विनिश्चय करती है, वहाँ नियुक्ति, निम्नलिखित चयन समिति की संस्तुति पर और इस नियमावली में अग्रतर विस्तृत रूप में यथा उल्लिखित उपबंधों के अधीन की जायेगी :-
(क) मुख्य सचिव, उत्तर प्रदेश; - अध्यक्ष (ख) अपर मुख्य सचिव/प्रमुख सचिव, वित्त विभाग; - सदस्य (ग) अपर मुख्य सचिव/प्रमुख सचिव, मा0 मुख्यमंत्री; - सदस्य (घ) प्रमुख सचिव, न्याय विभाग; - सदस्य (ङ) अपर मुख्य सचिव/प्रमुख सचिव, कार्मिक; - सदस्य
- सदस्य (च) प्रमुख सचिव की श्रेणी से अनिम्न अनुसूचित जाति/ अनुसूचित जनजाति का एक अधिकारी, जो अध्यक्ष द्वारा नाम निर्दिष्ट हो, यदि अध्यक्ष या सदस्यों में से कम से कम एक सदस्य अनुसूचित जाति/जनजाति का न हो;
- सदस्य (छ) प्रमुख सचिव की श्रेणी से अनिम्न अन्य पिछड़े वर्गों का एक अधिकारी, जो अध्यक्ष द्वारा नाम निर्दिष्ट हो, यदि अध्यक्ष या सदस्यों में से कम से कम एक सदस्य अन्य पिछड़े वर्गों का न हो।
चयन प्रक्रिया 6-(एक) समिति, प्रमुख सचिव, संसदीय कार्य के रूप में नियुक्ति हेतु संस्तुत किये जाने वाले व्यक्ति का चयन करने के लिये अपनी स्वयं की प्रक्रिया अपनायेगी। चयन समिति विशिष्टतः अंतिम 10 वर्षों की वार्षिक गोपनीय रिपोर्ट, सतर्कता अनापत्ति और अन्य सुसंगत अभिलेखों, जिन्हें समिति आवश्यक समझे, का परीक्षण करेगी। ऐसे अभ्यर्थियों को अधिमान प्रदान किया जायेगा, जिनके पास संसदीय कार्य, विधायी या न्याय विभाग में कार्य करने का पूर्ण अनुभव हो।
(दो) नियम-5 (दो) के अधीन की गयी नियुक्ति के मामले में भरी जाने वाली रिक्त, नियुक्ति प्राधिकारी द्वारा व्यापक प्रसार वाले कम से कम दो ख्याति प्राप्त दैनिक समाचार पत्रों में और ऑनलाइन भी उसे नियुक्ति विभाग, उत्तर प्रदेश की वेबसाइट पर प्रदर्शित करते हुए विज्ञापन जारी करके अधिसूचित की जायेगी।
आरक्षण 7-अनुसूचित जातियों/अनुसूचित जनजातियों और अन्य श्रेणियों के अभ्यर्थियों के लिये आरक्षण, भर्ती के समय प्रवृत्त राज्य सरकार के नियमों तथा आदेशों के अनुसार किया जायेगा। पदावधि और अधिवर्षिता
8-नियम 5 (दो) के अधीन चयन समिति के माध्यम से प्रमुख सचिव, संसदीय कार्य, उत्तर प्रदेश के रूप में नियुक्त कोई व्यक्ति, 65 वर्ष की आयु तक या 05 वर्ष के लिये, जो भी पहले हो, पद धारण करेगा। नियुक्ति 9-नियम 5 (दो) के अधीन की गई नियुक्ति के मामले में, राज्य सरकार चयन समिति की संस्तुति के आधार पर प्रमुख सचिव, संसदीय कार्य की नियुक्ति करेगी। उार प्रदेश असाधारण गजट, 12 मार्च, 2021 3 अन्य मामलों का विनियमन 10-ऐसे विषयों, जो इस नियमावली या विशेष आदेशों द्वारा विनिर्दिष्ट रूप से आच्छादित न हों, के सम्बन्ध में उपरोक्त पद पर नियुक्त व्यक्ति, राज्य के कार्यों के सम्बन्ध में वेतनमान 182200-224100 (पे-मैट्रिक्स में लेवल-15) में सेवारत सामान्यतः सरकारी सेवकों के लिये लागू नियमों, विनियमों और आदेशों द्वारा शासित होंगे। वेतन और भत्ते 11-नियम-5 (दो) के अधीन प्रमुख सचिव, संसदीय कार्य के पद पर नियुक्त कोई व्यक्ति, वित्त विभाग, उत्तर प्रदेश शासन द्वारा जारी विद्यमान नियमों या आदेशों के अनुसार वेतन और भत्ते आहरित करने के लिये हकदार होगा। दण्ड 12-नियम-5 (दो) के अधीन की गई नियुक्ति के मामले में, नियुक्त कोई व्यक्ति, प्रमुख सचिव, संसदीय कार्य के रूप में अपने कार्यकाल के दौरान किसी अवचार का दोषी पाया जाता है तो जांच और दण्ड की प्रक्रिया वही होगी, जो राज्य सरकार के नियमों के अधीन लागू है।
दण्ड प्राधिकारी 13-संविधान के अनुच्छेद-311 के उपबंधों के अध्यधीन कोई दण्ड अधिरोपित करने की शक्ति, नियुक्ति प्राधिकारी में निहित होगी। इस सम्बन्ध में नियुक्ति प्राधिकारी का विनिश्चय अंतिम होगा और अधिकारी पर बाध्यकारी होगा।
पुनरीक्षण 14-ऐसे किसी व्यक्ति, जिसे कोई दण्ड अधिरोपित किया जाय, के पास ऐसे दण्ड के आदेश के विरूद्ध केवल एक अपील करने का अधिकार होगा और ऐसी अपील, नियुक्ति प्राधिकारी को की जायेगी जिसके पास अपने विनिश्चय का पुनरीक्षण करने का अधिकार होगा।

IN exercise of the powers conferred by the Proviso to Article 309 of the Constitution and in supersession of all the existing rules and orders on the subject, the Governor is pleased to make the following rules regulating recruitment and conditions of service of persons appointed to the post of Principal Secretary, Parliamentary Affairs, Uttar Pradesh.
THE UTTAR PRADESH, PRINCIPAL SECRETARY, PARLIAMENTARY AFFAIRS (RECRUITMENT AND CONDITIONS OF SERVICE) RULES, 2021
PART-I PRELIMINARY
1. (a) These rules may be called the Uttar Pradesh, Principal Secretary, Short title and commencement Parliamentary Affairs (Recruitment and Conditions of Service) Rules, 2021.
(b) They shall come into force with effect from the date of their publication
in the Gazette.
Status of Service 2. The Uttar Pradesh, Principal Secretary, Parliamentary Affairs service is a
service comprising group "A" post.
3. In these rules, unless there is anything repugnant in the subject or context : Definitions (a) 'Appointing Authority' means the Governor;
(b) 'Constitution' means the Constitution of India;
(c) 'Government' means the Sate Government of Uttar Pradesh;
(d) 'Governor' means the Governor of Uttar Pradesh;
(e) 'Member of Service' means a person substantively appointed
under rule 5(ii);
(f) 'Year of Recruitment' means a period of twelve months commencing on
the first day of July of a calendar year.

A person who has been an officer of the state government in the rank of Principal Secretary or above or an Additional Secretary in the Government of India and has experience in civil administration or judiciary shall be eligible for appointment.
Method of
5. Appointment shall be made to the post by either of the following two Recruitment
methods–
(i) An eligible serving IAS/HJS officer may be posted in the normal course followed for posting of such officers. His appointment and service conditions shall be as applicable to the service, he belongs to.
or
(ii) In case where the Government decides to select a retired person to this post then the appointment shall be made on the recommendation of the following selection committee and under the provisions as detailed further in these rules :-
(a) The Chief Secretary of Uttarr Pradesh; Chairman (b) Additional Chief Secretary/Principal Secretary, Finance Member Department;
(c) Additional Chief Secretary/Principal Secretary, to Member Hon'ble Chief Minister;
(d) Principal Secretary, Law Department; Member (e) Additional Chief Secretary/Principal Secretary, Member Personnel;
(f) An officer belonging to Schedule Cast/Schedule Tribe Member not bellow the rank of Principal Secretary, nominated by the
chairman if the chairman or atleast one of the members does not
belong to Schedule Cast/Schedule Tribe;
(g) An officer belonging to other Backward Classes not Member bellow the rank of Principal Sccretary, nominated by the chairman if
the chairman or atleast one of the members does not belong to Other
Backward Classes.
Procedure of
6. (i) The committee shall devise its own procedure for selecting the person to Selection
be recommended for appointment as Principal Secretary Parliamentary Affairs. The Selection Committee shall in particular examine the Annual Confidential Reports of last 10 years, vigilance clearance and other relevant records that the committee may deem necessary. Preference may be given to candidates having prior working experience in Parliamentary Affairs, Legislative or Law department.
(ii) In case of appointment made under rule 5(ii), the vacancy to be filled shall be notified by the appointing authority by issuing advertisement in atleast two prominent daily news papers having wide circulation and also online, by displaying it on the website of Appointment Department of Uttar Pradesh.
Reservation 7. Reservation for the candidates belonging to Schedule Caste/Schedule Tribes and other categories shall be in accordance with the rules and orders of the state government in force at the time of the recruitment.
Term of office
8. A person appointed as Principal Secretary Parliamentary Affairs, Uttar and
Pradesh through the selection committee under rule 5(ii), shall hold office till the age of superannuation
65 years or for 5 years, whichever is earlier.
उार प्रदेश असाधारण गजट, 12 मार्च, 2021 5 PART-III APPOINTMENT Appointment9. In case of appointment made under rule 5(ii), the State Government shall appoint the Principal Secretary Parliamentary Affairs on the basis of the recommendation of the selection committee.
Regulation of Other
matters
10. In regard to the matters not specifically covered by these rules or special orders, persons appointed to the above post shall be governed by the rules, regulation and orders applicable generally to government servants in the pay scale of 182200- 224100 (Level 15 in Pay Matrix), serving in connection with the affairs of the State.
PART IV-PAY
Pay and Allowances 11. A person appointed on the post of Principal Secretary, Parliamentary Affairs under rule 5(ii) shall be entitled to draw pay and allowances in accordance with the extant rules or orders issued by the finance department, Government of Uttar Pradesh.
PART V-DISCIPLINARY ACTION, PUNISHMENT AND APPEAL
Punishment 12. In case of appointment made under rule 5(ii), a person appointed is found guilty of some misconduct during his tenure as Principal Secretary, Parliamentary Affairs then the procedure for the inquiry and punishment shall be as applicable under state Government rules.
Punishing Authority 13. Subject to the provisions of Article 311 of the Constitution, the power to inflict any punishment shall vest in the appointing authority. The decision of the Appointing Authority in this regard shall be final and shall be binding on the officer.
Review
14. A person on whom any punishment is inflicted shall have the right to only one appeal against such order of punishment and such appeal shall be to the Appointing Authority who will have right to review his decision.
