अधिसूचना

चूंकि प्रारम्भिक अधिसूचना संख्या 2026/77-3-2019-140(एम)-2019 दिनांक 14 अक्टूबर, 2020 लोक प्रयोजन, अर्थात्‌ उत्तर प्रदेश एक्सप्रेसवेज औद्योगिक विकास प्राधिकरण (यूपीडा) के माध्यम से बुन्देलखण्ड एक्सप्रेसवे परियोजना के लिए तहसील ताखा, परगना भरथना, जिला इटावा के ग्राम ताखा में 0.5322 हे0, बेलाहार में 0.8470 हे0, कुदरैल में 0.1605 हे0, और ककराई में 0.0304 हे0, कुल 1.5701 हे0, भूमि के सम्बन्ध में भूमि अर्जन, पुनर्वासन और पुनव्र्यवस्थापन में उचित प्रतिकर और पारदर्शिता का अधिकार अधिनियम, 2013, (अधिनियम संख्या 30 सन्‌ 2013) जिसे आगे उक्त अधिनियम कहा गया है, की धारा 11 की उपधारा (1) के अधीन जारी की गई थी और अंततः दिनांक 23 अक्टूबर, 2020 को प्रकाशित की गयी थी। उप कलेक्टर/सहायक कलेक्टर, तहसील ताखा, जिला इटावा को परियोजना से प्रभावित परिवारों के पुनर्वासन और पुनव्र्यवस्थापन के प्रयोजनार्थ प्रशासक नियुक्त किया गया था।

अतएव, अब, अधिनियम की धारा 15 की उपधारा (2) के अनुसरण में प्रस्तुत की गयी कलेक्टर की रिपोर्ट पर विचार करने के पश्चात्‌, राज्यपाल उक्त अधिनियम की धारा 19 की उपधारा (1) के अधीन घोषणा करती हैं कि उनका यह समाधान हो गया है कि नीचे अनुसूची "क" में उल्लिखित कुल 1.4096 हेक्टेअर भूमि लोक प्रयोजन के लिए आवश्यक है और अनुसूची "ख" में यथा-प्रदत्त ग्राम-शून्य, परगना-शून्य और जिला-शून्य मेें शून्य हेक्टेयर भूमि विस्थापित परिवारों के पुनर्वासन और पुनव्र्यवस्थापन के प्रयोजनार्थ चिन्हांकित की गयी है (इस परियोजना हेतु भूमि अर्जन के कारण किसी परिवार का विस्थापित होना सम्भाव्य नहीं है)।639 RPH (Audyoghik vikas -3) Data 8 d-2021 2 उत्तर प्रदेश असाधारण गजट, 13 जनवरी, 2021 राज्यपाल अग्रतर उक्त अधिनियम की धारा 19 की उपधारा (2) के अधीन अग्रतर इटावा के कलेक्टर को इस आशय की घोषणा प्रकाशित करने के साथ पुनर्वासन और पुनव्र्यवस्थापन योजना को संक्षिप्त रूप में प्रकाशित करने के लिए निदेश देती हैं। पुनर्वासन और पुनव्र्यवस्थापन योजना का सारांश इसके साथ संलग्न है। (पूवांचल एक्सप्रेसवे हेतु भूमि अर्जन में कोई परिवार विस्थापित नही हुआ है। अतएव पुनर्वासन और पुनव्र्यवस्थापन हेतु कोई भूमि चिन्हित किये जाने और पुनर्वासन तथा पुनव्र्यवस्थापन योजना का सारांश प्रकाशित किये जाने की आवश्यकता नहीं है।)

IN pursuance of the provisions of clause (3) of Article 348 of the Constitution of India the Governor is pleased to order the publication of the following English translation of notification no. 122/LXXVII-3–2021-140(M)-2019, dated January 13, 2021:

No. 122/LXXVII-3–2021-140(M)-2019

Dated Lucknow, January 13, 2021

WHEREAS preliminary notification no 2026/LXXVII-3–2019-140(M)-2019 dated October 14, 2020 was issued under sub-section (1) of section 11 of the Right to Fair Compensation and Transparency in Land Acquisition Rehabilitation and Resettlement Act, 2013 (Act no. 30 of 2013) hereinafter referred to as the "said Act", in respect of total 1.5701 Hectares of land required in the village Takha area 0.5322 Hectares, Belahar area 0.8470 Hectares, Kudrail area 0.1605 Hectares, and Kakrahi area 0.0304 Hectares, pargana Bharthana, Tehsil Takha, district Etawah for public purpose, namely Bundelkhand Expressway Project through the Uttar Pradesh Expressways Industrial Development Authority (UPEIDA) and lastly published on 23 October, 2020. Deputy Collector/Assistant Collector Tehsil Takha, district Etawah was appointed as Administrator for the purpose of Rehabilitiation and Resettlement of the project affected families.

NOW, THEREFORE, after considering the report of the Collector submitted in pursuance of sub-section (2) of section 15 of the said Act, the Governor is pleased to declare under sub-section (1) of section 19 of the said Act that she is satisfied that total 1.4096 hectares of land mentioned in Schedule A below is needed for public purpose and land to the extent of nil Hectare in the Village-nil, Pargana-nil and District-nil as given in Schedule B has been identified for rehabilitation and resettlement of the displaced families (No family is likely to be displaced due to land acquisition for this project).

The Governor is further pleased under sub-section (2) of section 19 of the said Act to direct the Collector of Etawah to publish a summary of the Rehabilitation and Resettlement Scheme with publication of the declaration to this effect. The summary of the Rehabilitation and Resettlement scheme is attached herewith. (No family is displaced in land acquisition for Purvanchal Expressway. Hence, there is no need for identification of any land for Rehabilitation and Resettlement and publication of summary of Rehabilation and Resettlement Scheme.)
