अधिसूचना

चूँकि भूमि अर्जन, पुनर्वासन और पुनव्र्यवस्थापन में उचित प्रतिकर और पारदर्शिता का अधिकार अधिनियम, 2013 (अधिनियम संख्या 30 सन्‌ 2013) (जिसे आगे उक्त अधिनियम कहा गया है), की धारा 11 की उपधारा (1) के अधीन जिला गौतमबुद्धनगर के सुनियोजित विकास के प्रयोजनार्थ राज्यपाल का यह समाधान हो गया है कि लोक प्रयोजन अर्थात्‌ भारत सरकार की परियोजना दिल्ली-मुम्बई औद्योगिक कॉरिडोर (मल्टी मॉडल लॉजिस्टिक हब व इण्टीग्रेटेड ट्रान्सपोर्ट हब) के लिये गे्रटर नोएडा औद्योगिक विकास प्राधिकरण के माध्यम से महायोजना के अनुसार जिला गौतमबुद्धनगर, तहसील दादरी, परगना दादरी, ग्राम चिटेहरा में कुल 43.1535 हेक्टेयर भूमि की आवश्यकता है।

1-सामाजिक समाघात निर्धारण अभिकरण के रूप में गौतमबुद्ध विश्वविद्यालय द्वारा सामाजिक समाघात निर्धारण अध्ययन किया गया और उसने प्रदेश सरकार को अपनी संस्तुतियां प्रस्तुत कर दी हैं जिसने अपने शासनादेश संख्या 2870/77-3-20-42(एम)-20, दिनांक 31 दिसम्बर, 2020 के माध्यम से —त सामाजिक समाघात निर्धारण को अनुमोदित कर दिया है।

2-भूमि अर्जन के कारण कोई परिवार उक्त ग्राम में विस्थापित नहीं किया जा रहा है। 3-और, चूँकि, अधिसूचना संख्या 414/एक-13-2014-7क(8)-2014, दिनांक 6 अगस्त, 2014 के माध्यम से राज्यपाल ने उत्तर प्रदेश के सम्बन्धित तहसील के यथास्थिति सहायक कलेक्टर या उपकलेक्टर को उनकी अपनी-अपनी क्षेत्रीय अधिकारिता के भीतर ''पुनर्वासन एवं पुनव्र्यवस्थापन प्रशासक'' नियुक्त किया गया है।653 RPH 2021 (Audyogik Vikas Anubhag-3) Data 4e 2 उत्तर प्रदेश असाधारण गजट, 20 जनवरी, 2021 4-अतएव, अब, राज्यपाल सामान्य सूचना हेतु स्वीकृत और अधिसूचित करती हैं कि नीचे अनुसूची में उल्लिखित भूमि की लोक प्रयोजनार्थ आवश्यकता है :

5-राज्यपाल अग्रतर उक्त अधिनियम की धारा 12 के अधीन यथा उपबंधित तथा विनिर्दिष्ट रीति से भूमि अर्जन के प्रयोजन हेतु भूमि में प्रवेश करने, उसका सर्वेक्षण करने, किसी भूमि का समतलीकरण करने, उसकी खुदाई करने और कार्य के समुचित निष्पादन हेतु अपेक्षित समस्त कार्य करने हेतु आवश्यक कदम उठाये जाने के लिए कलेक्टर, जिला गौतमबुद्धनगर को प्राधिकृत करती हैं।

6-उक्त अधिनियम की धारा 15 के अधीन कोई व्यक्ति, जिसका हित प्रश्नगत भूमि में निहित हो, इस अधिसूचना के प्रकाशित किये जाने के पश्चात्‌ के 60 दिन की अवधि के भीतर अपने मुहल्ले की भूमि के अर्जन पर आपत्ति लिखित रूप में कलेक्टर, गौतमबुद्धनगर को प्रस्तुत कर सकता है।

7-उक्त अधिनियम की धारा 11 की उपधारा (4) के अधीन कोई व्यक्ति ऐसी अधिसूचना को प्रकाशित किये जाने के दिनांक से भूमि अर्जन की कार्यवाहियाँ पूर्ण किये जाने के समय तक कलेक्टर, गौतमबुद्धनगर के पूर्व अनुमोदन के बिना, प्रारम्भिक अधिसूचना में विनिर्दिष्ट उक्त भूमि का कोई संव्यवहार अर्थात्‌ क्रय/विक्रय नहीं करेगा या न करने देगा अथवा न तो ऐसी भूमि का कोई विल्लंगम सृजित करेगा।

टिप्पणी :- ऐसे अर्जन हेतु ग्रहण की गयी भूमि का स्थल नक्शा कलेक्टर, गौतमबुद्धनगर के कार्यालय में देखा जा सकता है।

IN pursuance of the provisions of clause (3) of Article 348 of the Constitution of India, the Governor is pleased to order the publication of the following English translation of notification no. 221/LXXVII-3–21-42(M)-2020, dated January 20, 2021 :

No. 221/LXXVII-3–21-42(M)-2020

Dated Lucknow, January 20, 2021

WHEREAS under sub-section (1) of section 11 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Act no. 30 of 2013) (hereinafter referred to as the said Act), the Governor for the purpose of well planned development of district Gautam Buddha Nagar is satisfied that a total of 43.1535 hectares of land is required in the Village Chitehra, Pargana Dadri, Tehsil Dadri, district Gautam Buddha Nagar for public purpose namely India Government Project Delhi-Mumbai Industrial Corridor (MMLH & MMTH) according of Master Plan through Greater Noida Industrial Development Authority.

1. Social Impact Assessment study was carried out by Gautam Buddha University as Social Impact Assessment agency and it has submitted its recommendations to the State Government which has approved the social impact assessment carried out through its Government Order no. 2870/LXXVII-3–20- 42(M)-20, dated December 31, 2020.

2. Due to land acquisition no family is being displaced in the said village.

3. AND, WHEREAS, Through Notification no. 414/I-13–2014-7ka(8)-2014 dated August 6, 2014 the Governor has appointed all Assistant Collectors or Deputy Collectors, as the case may be, of the concerned Tehsil of Uttar Pradesh as "Administrator for Rehabilitation and Resettlement" within their respective territorial Jurisdiction.

4. NOW, THEREFORE, the Governor is pleased to accept and notify for general information that land mentioned in the Schedule below is needed for public purpose.

SCHEDULE

5. The Governor is further pleased to authorize the Collector, district Gautam Buddha Nagar for the purpose of land acquisition to takes necessary steps to enter upon, conduct survey of land, take levels of any land, dig into the sub-soil and do all the acts required for the proper execution of work as provided and specified under section 12 of the said Act.

6. Under section 15 of the said Act, any person whose interest lies in the land in question may within a period of 60 days after the publication of this notification, make an objection on acquisition of land in the locality in writing to the Collector, Gautam Buddha Nagar.

7. Under sub-section (4) of section 11 of the said Act, no person without prior approval of the Collector, Gautam Buddha Nagar shall make any transaction or cause any transaction of land i.e. sale/purchase, specified in the preliminary notification or create any encumbrances on such land from the date of publication of such notification till such time as the proceedings of land acquisition is completed.

NOTE: A plan of land taken up for such acquisition can be seen in the Office of the Collector, Gautam Buddha Nagar.
