उत्तर प्रदेश साधारण खण्ड अधिनियम, 1904 (उत्तर प्रदेश अधिनियम संख्या 1 सन् 1904) की धारा 21 के साथ पठित उत्तर प्रदेश भू-राजस्व अधिनियम, 1901 (उत्तर प्रदेश अधिनियम संख्या 3 सन् 1901) की धारा 234 की उपधारा (1) के खण्ड (ख) और (घ) के अधीन शक्तियों का प्रयोग करके, राज्यपाल उत्तर प्रदेश अधिकारों का अभिलेख (कम्प्यूटरीकरण) नियमावली, 2005 को संशोधित करने की दृष्टि से निम्नलिखित नियमावली बनाती हैं।
उत्तर प्रदेश अधिकारों का अभिलेख (कम्प्यूटरीकरण) (चतुर्थ संशोधन)
नियमावली, 2021
1-(1) यह नियमावली उत्तर प्रदेश अधिकारों का अभिलेख (कम्प्यूटरीकरण) संक्षिप्त नाम, विस्तार और प्रारम्भ (चतुर्थ संशोधन) नियमावली, 2021 कही जायेगी।
(2) यह उन सभी क्षेत्रों में लागू होगी जहाँ उत्तर प्रदेश भू-राजस्व अधिनियम, 1901
या कोई सहायक नियम लागू है।
(3) यह गजट में प्रकाशित किये जाने के दिनांक से प्रवृत्त होगी।
2- उत्तर प्रदेश अधिकारों का अभिलेख (कम्प्यूटरीकरण) नियमावली, 2005 में, नियम 6 का संशोधन नियम 6 में, नीचे स्तम्भ-1 में दिये गये उपनियम (3) और (4) के स्थान पर स्तम्भ-2 में दिये गये उपनियम रख दिये जायेंगे, अर्थात् :-
2 उत्तर प्रदेश असाधारण गजट, 11 फरवरी, 2021 स्तम्भ-1 स्तम्भ-2(3) कोई आवेदक आवेदन पत्र के साथ
रू0 15/- के प्रयोक्ता प्रभारों का संदाय करके तहसील काउन्टर से कम्प्यूटरीकृत खतौनी की एक डिजिटल रूप से हस्ताक्षरित प्रति प्राप्त कर सकता है : परन्तु यह कि पांच से अधिक पृष्ठों की खतौनी हेतु रू0 1.00 प्रति पृष्ठ की दर से अतिरिक्त प्रयोक्ता प्रभार संदेय होंगे। ऐसे उद्धरण पर काउन्टर पर उपस्थित पदधारी का नाम और दिनांक सहित हस्ताक्षर अंकित होगा।
(3) किसी आवेदक द्वारा आवेदन पत्र के साथ राज्य सरकार द्वारा विहित प्रयोक्ता प्रभार जमा करके कम्प्यूटरीकृत खतौनी का एक उद्धरण तहसील काउन्टर से तत्काल प्राप्त किया जा सकता है। ऐसे उद्धरण पर काउन्टर पर उपस्थित कार्मिक का नाम और दिनांक सहित हस्ताक्षर अंकित होगा। किसी आवेदक द्वारा इन्टरनेट के माध्यम से विभागीय वेबसाइट का उपयोग कर, कम्प्यूटरीकृत खतौनी का इलेक्ट्रानिकली हस्ताक्षरित उद्धरण प्राप्त किया जा सकता है, जिस हेतु राज्य सरकार द्वारा विहित प्रयोक्ता प्रभार एवं सेवा प्रदाता का प्रभार लिया जायेगा।
आवेदन द्वारा इन्टरनेट के माध्यम से विभागीय वेबसाइट का उपयोग कर, कम्प्यूटरीकृत खतौनी का इलेक्ट्रानिकली हस्ताक्षरित उद्धरण प्राप्त किया जायेगा, जिस हेतु राज्य सरकार द्वारा विहित प्रयोक्ता प्रभार एवं सेवा प्रदाता प्रभार लिया जायेगा।
(4) बैंक में एक पृथक खाता रखा जायेगा, जिसका संचालन परगना मजिस्ट्रेट द्वारा किया जायेगा और उपनियम (3) के अधीन प्राप्त धनराशि प्रतिदिन इस खाते में जमा की जायेगी। इस धनराशि का व्यय राजस्व परिषद के निर्देश के अधीन तहसील कम्प्यूटर केन्द्र तथा राजस्व न्यायालयों के सुदृढ़़ीकरण, आधुनिकीकरण, अनुरक्षण एवं संचालन संबंधी कार्यों पर किया जायेगा, किन्तु इस धनराशि का व्यय तहसील परिसर के अन्तर्गत निर्माण या मरम्मत आदि संबंधी किसी अन्य कार्य पर नहीं किया जायेगा।
(4) किसी बैंक में एक पृथक खाता रखा जायेगा, जिसका संचालन परगना मजिस्ट्रेट द्वारा किया जायेगा और उपनियम (3) के अधीन प्राप्त धनराशि प्रतिदिन इस खाते में जमा की जायेगी। इस धनराशि का व्यय, राजस्व परिषद के अनुदेशों के अधीन राजस्व परिषद/मण्डल/जिला/तहसील कम्प्यूटर केन्द्रों, राजस्व न्यायालयों तथा राजस्व अभिलेखागारों के सुदृढ़ीकरण, आधुनिकीकरण, अनुरक्षण और संचालन से संबंधित क्रियाकलापों पर और भू-अभिलेखों के अनुरक्षण, अद्यतनीकरण एवं आधुनिकीकरण पर किया जायेगा, किन्तु इस धनराशि का व्यय निर्माण या मरम्मत संबंधी किसी अन्य क्रियाकलाप पर नहीं किया जायेगा।

IN exercise of powers under clauses (b) and (d) of sub-section (1) of section 234 of the Uttar Pradesh Land Revenue Act, 1901 (U.P. Act no. III of 1901) read with section 21 of the Uttar Pradesh General Clauses Act, 1904 (U.P. Act no. 1 of 1904), the Governor is pleased to make the following rules with a view to amend the Uttar Pradesh Record of Rights (Computerization) Rules, 2005.
THE UTTAR PRADESH RECORD OF RIGHTS (COMPUTERIZATION) (FOURTH AMENDMENT) RULES, 2021
1.(1) These rules may be called the Uttar Pradesh Record of Rights (Computerization) (Fourth Amendment) Rules, 2021.
Short title, extent and commencement
(2) They shall apply to all those areas where the Uttar Pradesh Land Revenue Act, 1901 or any subsidiary rules are applicable.
(3) They shall come into force with effect from the date of publication in the Gazette.
Amendment of rule 6
2. In the Uttar Pradesh Record of Rights (Computerization) Rules, 2005 in rule 6 for sub-rules (3) and (4) set out in Column-1 below, the sub-rules as set out in Column-2 shall be substituted, namely :-
उत्तर प्रदेश असाधारण गजट, 11 फरवरी, 2021 3 COLUMN-1 COLUMN-2 Existing sub-rules Sub-rules as hereby substituted(3) An extract of Computerized Khatauni can be obtained immediately by an applicant by deposting user charges prescribed by the State Government along with the application from the Tehsil counter. Such extract will bear the name and dated signature of the official present at the counter. An electronically signed extract of Computerized Khatauni can also be obtained by an applicant through Internet by visiting the departmental website for which user charges prescribed by the State Government would be taken.
(4) A separate account shall be maintained in a Bank to be operated by the Sub-Divisional Magistrate and the amount received under sub- rule (3) shall be deposited every day in this account. This amount shall be spent on activities related to strengthening, modernization, maintenance and operation of Tehsil Computer Center and Revenue Courts under the instruction of the Board of Revenue, but this amount shall not be spent on any other activity related to construction or repairing in Tehsil campus, etc.
(3) An applicant can get a digitally signed copy of the Computerized Khatauni from Tehsil counter on payment of user charges of Rs. 15/- along with the application :
Provided that for a Khatauni having more than five pages, for every page in excess of five pages, additional user charges at the rate of Rs. 1.00 per page shall be payable. Such extract will bear the name and signature of the official present at the counter along with the date.
An electronically signed extract of Computerized Khatauni can also be obtained by an applicant through the Internet by visiting the department website for which user charges and service provider charges prescribed by the State Government would be taken.
(4) A separate account shall be maintained in a Bank which shall be operated by the Sub-Divisional Magistrate and the amount received under sub-rule (3) shall be deposited every day in this account. This amount shall be spent, under the instructions of the Board of Revenue on activities related to strengthening, modernization, maintenance and operation of Computer Centers, Revenue Courts, Revenue Archives of the Board of Revenue/ Commissionery/District/Tehsil and on maintenance, updation and modernization of land records but this amount shall not be spent on any other activity related to construction or repair.
