अधिसूचना
''भारत का संविधान'' के अनुच्छेद 200 के अधीन राज्यपाल महोदय ने उत्तर प्रदेश पेंशन हेतु अर्हकारी सेवा तथा विधिमान्यकरण विधेयक, 2021 जिससे वित्त (सामान्य) अनुभाग-3 प्रशासनिक रूप से सम्बन्धित है, पर दिनांक 4 मार्च, 2021 को अनुमति प्रदान की और वह उत्तर प्रदेश अधिनियम संख्या 1 सन् 2021 के रूप में सर्वसाधारण की सूचनार्थ इस अधिसूचना द्वारा प्रकाशित किया जाता है।
उत्तर प्रदेश पेंशन हेतु अर्हकारी सेवा तथा विधिमान्यकरण अधिनियम, 2021 (उत्तर प्रदेश अधिनियम संख्या 1 सन् 2021) [जैसा उत्तर प्रदेश विधान मण्डल द्वारा पारित हुआ]
पेंशन हेतु अर्हकारी सेवा और इस निमित्त —त कतिपय कार्यवाहियों का
विधिमान्यकरण और उससे सम्बन्धित या आनुषंगिक मामलों का उपबन्ध करने के लिये
अधिनियम
भारत गणराज्य के बहत्तरवें वर्ष में निम्नलिखित अधिनियम बनाया जाता है :-
1-(1) यह अधिनियम उत्तर प्रदेश पेंशन हेतु अर्हकारी सेवा तथा विधिमान्यकरण संक्षिप्त नाम, विस्तार और प्रारम्भ
अधिनियम, 2021 कहा जायेगा।
(2) यह सम्पूर्ण उत्तर प्रदेश राज्य में लागू होगा।
(3) यह दिनांक 1 अप्रैल, 1961 को प्रवृत्त हुआ समझा जायेगा।2 उत्तर प्रदेश असाधारण गजट, 5 मार्च, 2021 पेंशन हेतु अर्हकारी सेवा
2-किसी अधिकारी को पेंशन के हक के प्रयोजनार्थ किसी नियम, विनियम या शासनादेश में अन्तर्विष्ट किसी बात के होते हुए भी ''अर्हकारी सेवा'' का तात्पर्य सरकार द्वारा विहित सेवा नियमावली के उपबन्धों के अनुसार किसी अस्थायी या स्थायी पद पर नियुक्त किसी अधिकारी द्वारा उक्त पद के लिए की गई सेवाओं से है।
विधिमान्यकरण 3-किसी न्यायालय के किसी निर्णय, डिक्री या आदेश के होते हुये भी इस अधिनियम के प्रारम्भ होने के पूर्व उत्तर प्रदेश रिटायरमेन्ट बेनीफिट रूल्स, 1961 के नियम 3 के उपनियम (8) के सम्बन्ध में या तद्धीन —त या की गई तात्पर्यित कोई कार्यवाही, इस अधिनियम के उपबन्धों के अधीन किये जाने हेतु और सदैव से —त या की गई समझी जायेगी और वे उतनी ही विधिमान्य होंगी तथा सदैव से विधिमान्य—त समझी जायेंगी, मानो इस अधिनियम के उपबन्ध दिनांक 1 अप्रैल, 1961 से समस्त सारवान समयों पर प्रवृत्त थे।
अध्यारोही प्रभाव 4-अन्यथा उपबन्धित के सिवाय, तत्समय प्रवृत्त किसी अन्य विधि में अथवा तत्समय प्रवृत्त किसी विधि के आधार पर प्रभावी किसी लिखत में अन्तर्विष्ट इस अधिनियम से असंगत किसी बात के होते हुये भी इस अधिनियम के उपबन्ध प्रभावी होंगे।
5-(1) उत्तर प्रदेश पेंशन हेतु अर्हकारी सेवा तथा विधिमान्यकरण
निरसन और व्यावृत्ति
अध्यादेश, 2020 एतद्द्वारा निरसित किया जाता है।

(2) ऐसे निरसन के होते हुए भी उपधारा (1) में निर्दिष्ट अध्यादेश द्वारा यथा संशोधित मूल अधिनियम के उपबंधों के अधीन —त कोई कार्यवाही, इस अधिनियम द्वारा यथा संशोधित मूल अधिनियम के सह प्रत्यर्थी उपबंधों के अधीन —त या की गई समझी जायेगी मानो इस अधिनियम के उपबंध सभी सारवान समयों में प्रवृत्त थे।

उद्देश्य और कारण
किसी सेवानिवृत्त सरकारी सेवक को अनुज्ञेय पेंशन और उपदान का अवधारण, सरकारी सेवक की अर्हकारी सेवा की अवधि के संबंध में किया जाता है। यद्यपि पद "अर्हकारी सेवा" का वर्णन, उत्तर प्रदेश सिविल सेवा विनियमावली और उत्तर प्रदेश सेवानिवृत्तिक प्रसुविधा नियमावली, 1961 में है तथापि उक्त पद की परिभाषा विषयनिष्ठ निर्वचन के लिये खुली है, जिससे प्रशासनिक कठिनाइयाँ उत्पन्न होती हैं। अतएव, पद "अर्हकारी सेवा" को परिभाषित करने और उक्त परिभाषा को दिनांक 01 अप्रैल, 1961, जो उत्तर प्रदेश सेवानिवृत्तिक प्रसुविधा नियमावली, 1961 के प्रारम्भ होने का दिनांक है, से विधिमान्य—त करने के लिये एक विधि बनाये जाने का विनिश्चय किया गया है।
चूँकि राज्य विधान मण्डल सत्र में नहीं था और पूर्वोक्त विनिश्चय को क्रियान्वित करने के लिये तत्काल विधायी कार्यवाही की जानी आवश्यक थी, अतः राज्यपाल द्वारा दिनांक 21 अक्टूबर, 2020 को उत्तर प्रदेश पेंशन हेतु अर्हकारी सेवा और विधिमान्यकरण अध्यादेश, 2020 (उत्तर प्रदेश अध्यादेश संख्या 19 सन् 2020) प्रख्यापित किया गया।
यह विधेयक पूर्वोक्त अध्यादेश को प्रतिस्थापित करने के लिये पुरःस्थापित किया जाता है।

IN pursuance of the provisions of clause (3) of Article 348 of the Constitution of India, the Governor is pleased to order the publication of the following English translation of the Uttar Pradesh Pension Hetu Aharkari Seva Tatha Vidhimanyakaran Adhiniyam, 2021 (Uttar Pradesh Adhiniyam Sankhya 1 of 2021) as passed by the Uttar Pradesh Legislature and assented to by the Governor on March 4, 2021. The Vitt (Samanya) Anubhag-3 is administratively concerned with the said Adhiniyam.
THE UTTAR PRADESH QUALIFYING SERVICE FOR PENSION AND
VALIDATION ACT, 2021
(U.P. Act no. 1 of 2021)
[As passed by the Uttar Pradesh Legislature]
AN
ACT
to provide for qualifying service for pension and to validate certain actions
taken in this behalf and for matters connected therewith or incidental thereto.
IT IS HEREBY enacted in the Seventy-second Year of the Republic of India as
follows :–
1. (1) This Act may be called the Uttar Pradesh Qualifying Service for
Pension and Validation Act, 2021.
Short title, extent and commencement (2) It shall extend to the whole of the State of Uttar Pradesh.
(3) It shall be deemed to have come into force on April 1, 1961.
Qualifying
2. Notwithstanding anything contained in any rule, regulation or Government
Service for
order for the purposes of entitlement of pension to an officer, "Qualifying Service"
Pension
means the services rendered by an officer appointed on a temporary or permanent post
in accordance with the provisions of the service rules prescribed by the Government for
the post.
Validation
3. Notwithstanding any Judgement, decree or order of any Court, anything
done or purporting to have been done and any action taken or purporting to have been
taken under or in relation to sub-rule (8) of rule 3 of the Uttar Pradesh Retirement
Benefit Rules, 1961 before the commencement of this Act, shall be deemed to be and
always to have been done or taken under the provisions of this Act and to be and always
to have been valid as if the provisions of this Act were in force at all material times with
effect from April 1, 1961.
Overriding effect 4. Save as otherwise provided, the provisions of this Act shall have effect,
notwithstanding anything inconsistent therewith contained in any other law for the time
being in force or in any instrument having effect by virtue of any law for the time being
in force other than this Act.

Repeal and
5. (1) The Uttar Pradesh Qualifying Service for Pension and
no. 19 of 2020
saving
Validation Ordinance, 2020 is hereby repealed.
(2) Notwithstanding such repeal, anything done or any
action taken under the provisions of the principal Act as amended by
the Ordinance referred to in sub-section (1) shall be deemed to have
been done or taken under the corresponding provisions of the
principal Act as amended by this Act as if the provisions of this Act
were in force at all material times.
4 उत्तर प्रदेश असाधारण गजट, 5 मार्च, 2021STATEMENT OF OBJECTS AND REASONS
Pension and gratuity admissible to a retired Government servant are determined in relation to the length of qualifying service of the Government servant. Although the term "Qualifying Service" is described in the Uttar Pradesh Civil Service Regulation and the Uttar Pradesh Retirement Benefit Rules, 1961, however the definition of the said term is open to subjective interpretation which leads to administrative difficulties.
It has, therefore, been decided to make a law defining the term "Qualifying Service" and to validate such definition with effect from April 1, 1961 which is the date of commencement of the Uttar Pradesh Retirement Benefit Rules, 1961.
Since the State Legislature was not in session and immediate legislative action was necessary to implement the aforesaid decision, the Uttar Pradesh Qualifying Service for Pension and Validation Ordinance, 2020 (U.P. Ordinance no. 19 of 2020) was promulgated by the Governor on October 21, 2020.
This Bill is introduced to replace the aforesaid Ordinance.
