------- संख्या 457/79-वि-1-21-1-क -13-21 लखनऊ, 10 मार्च, 2021 ------- अधिसूचना ''भारत का संविधान'' के अनुच्छेद 200 के अधीन राज्यपाल महोदय ने उत्तर प्रदेश विनियोग विधेयक, 2021, जिससे वित्त (आय-व्ययक) अनुभाग-1 प्रशासनिक रूप से सम्बन्धित है, पर दिनांक 10 मार्च, 2021 को अनुमति प्रदान की और वह (उत्तर प्रदेश अधिनियम संख्या 11 सन्‌ 2021) के रूप में सर्वसाधारण की सूचनार्थ इस अधिसूचना द्वारा प्रकाशित किया जाता है :-

31 मार्च, 2022 ई0 को समाप्त होने वाले वर्ष में व्यय के लिए राज्य की समेकित निधि

में से कतिपय धनराशियों के भुगतान और विनियोग का अधिकार देने की व्यवस्था करने के लिये अधिनियम भारत गणराज्य के बहत्तरवें वर्ष में निम्नलिखित अधिनियम बनाया जाता हैः- 1-यह अधिनियम उत्तर प्रदेश विनियोग अधिनियम, 2021 कहा जायेगा। संक्षिप्त नाम

2021-2022 के लिए

585910,42,77,000 रुपये

का निकाला जाना 2-ऐसे विविध परिव्यय चुकाने के निमिा जो 31 मार्च, 2022 को समाप्त होने वाले वर्ष के भीतर अनुसूची के स्तम्भ- 2 में दी हुई सेवाओं और प्रयोजनों के सम्बन्ध में देने पडें़गे, उत्तर प्रदेश की समेकित निधि में से इतना रुपया दिया और काम में लाया जा सकता है जो अनुसूची के स्तम्भ-3 में दी हुई धनराशियों से, जिनका कुल योग 585910,42,77,000 रुपये (रुपये पाँच लाख पचासी हजार नौ सौ दस करोड़ बयालीस लाख सतहत्तर हजार मात्र) होता है, अधिक न हो।

787 RPH (Viniyog Vidheyak) 2021 data-4e2 उत्तर प्रदेश असाधारण गजट, 10 मार्च, 2021 विनियोग 3-इस अधिनियम द्वारा उत्तर प्रदेश की समेकित निधि में से, जिन धनराशियों को देने और काम में लाने का अधिकार दिया गया है, उनका विनियोग 31 मार्च, 2022 को समाप्त होने वाले वर्ष के सम्बन्ध में उन्हीं सेवाओं और प्रयोजनों के लिये किया जायेगा जो अनुसूची में दिये गये हैं।

उद्‌देश्य और कारण

भारत का संविधान के अनुच्छेद 204 इस बात की अपेक्षा करता है कि विधान सभा द्वारा अनुदानों की मांगें स्वी—त किये जाने के बाद राज्य के विधान मण्डल में एक विनियोग विधेयक पुरःस्थापित किया जाय।

तद्‌नुसार उत्तर प्रदेश विनियोग विधेयक, 2021 को जो उत्तर प्रदेश की समेकित निधि में से 31 मार्च, 2022 को समाप्त होने वाले वर्ष के सम्बन्ध में उत्तर प्रदेश विधान सभा द्वारा स्वी—त अनुदानों तथा राज्य की समेकित निधि पर भारित व्यय के लिये अपेक्षित समस्त धनराशियों के विनियोग की व्यवस्था करता है, पुरःस्थापित किया जाता है।

IN pursuance of the provisions of clause (3) of Article 348 of the Constitution of India, the Governor is pleased to order the publication of the following English translation of the Uttar Pradesh Viniyog Adhiniyam, 2021 (Uttar Pradesh Adhiniyam Sankhya 11 of 2021) as passed by the Uttar Pradesh Legislature and assented to by the Governor on March 10, 2021. The Vitt (Aay-Vyayak) Anubhag-1 is administratively concerned with the said Adhiniyam:

THE UTTAR PRADESH APPROPRIATION ACT, 2020

[As passed by the Uttar Pradesh Legislature]

ACT

to provide for authorising payment and appropriation of certain sums from and out of the Consolidated Fund of the State to the services for the year ending on thirty-first day of March, 2022.

IT IS HEREBY enacted in the Seventy Second Year of the Republic of India as follows:–

Short title 1. This Act may be called the Uttar Pradesh Appropriation Act, 2021.

Issue of Rs.

2. From and out of the Consolidated Fund of the State of Uttar Pradesh there may 585910,42,77,000

be paid and applied sums not exceeding those specified in Column-3 of the Schedule out of the

amounting in the aggregate to the sums of Rs. 585910,42,77,000 (Rs. Five lakh eighty Consolidated Fund

five thousand nine hundred ten crore forty two lakh seventy seven thousand only) of Uttar Pradesh

for the year towards defraying the several charges which will come in course of payment during the 2020-2021

year ending on the thirty-first day of March, 2022 in respect of the services and purposes specified in Column-2 of the Schedule.

Appropriation 3. The sums authorised to be paid and applied from and out of the Consolidated Fund of Uttar Pradesh by this Act shall be appropriated for the services and purposes expressed in the Schedule in relation to the year ending on the thirty-first day of March, 2022.

STATEMENT OF OBJECTS AND REASONS

Article 204 of the Constitution of India requires that an Appropriation Bill should be introduced in the State Legislature after the demands for Grants have been assented to by the Legislative Assembly.

The Uttar Pradesh Appropriation Bill, 2021 which provides for the appropriation from and out of the Consolidated Fund of Uttar Pradesh of all moneys required to meet the grants made by the Uttar Pradesh Legislative Assembly and the expenditure charged on the Consolidated Fund of the State in respect of the year ending on the thirty-first day of March, 2022, is introduced accordingly.
