चूंकि प्रारम्भिक अधिसूचना संख्या 2723/77-3-2020-138(एम)-2018, दिनांक 23 दिसम्बर, 2020 लोक प्रयोजन, अर्थात्‌ उत्तर प्रदेश एक्सप्रेसवे औद्योगिक विकास प्राधिकरण के माध्यम से पूर्वांचल एक्सप्रेसवे परियोजना हेतु जिला आजमगढ़, तहसील सदर/फूलपुर/निजामाबाद के ग्राम फखरूद्‌दीनपुर में 4.9821 हेक्टेयर, सठियांव में 3.1892 हेक्टेयर, समसाबाद में 0.4528 हेक्टेयर, मैनुद्‌दीनपुर में 0.4432 हेक्टेयर, पूराकोदई में 0.0956 हेक्टेयर, रैदा में 1.2651 हेक्टेयर, फरीदपुर में 0.0041 हेक्टेयर, ओहनी में 0.4707 हेक्टेयर, चकजोरावर में 0.0618 हेक्टेयर, बैरमपुर में 0.0356 हेक्टेयर कुल 11.0002 हेक्टेयर भूमि के संबंध में भूमि अर्जन, पुनर्वासन और पुनव्र्यवस्थापन में उचित प्रतिकर और पारदर्शिता का अधिकार अधिनियम, 2013 (अधिनियम संख्या 30 सन्‌ 2013) (जिसे आगे उक्त अधिनियम कहा गया है) की धारा 11 की उपधारा (1) के अधीन जारी की गई थी और अन्ततः दिनांक 29 दिसम्बर, 2020 को प्रकाशित की गयी थी। आजमगढ़ के कलेक्टर को परियोजना से प्रभावित परिवारों के पुनर्वासन और पुनव्र्यवस्थापन के प्रयोजनार्थ प्रशासक नियुक्त किया गया था; अतएव, अब, उक्त अधिनियम की धारा 15 की उपधारा (2) के अधीन उपबन्धों के अनुसरण में प्रस्तुत की गयी कलेक्टर की रिपोर्ट पर विचार करने के पश्चात्‌, राज्यपाल उक्त अधिनियम की धारा 19 की उपधारा (1) के अधीन घोषणा करती हैं कि उनका यह समाधान हो गया है कि नीचे अनुसूची "क" में उल्लिखित भूमि का क्षेत्रफल लोक प्रयोजन के लिए आवश्यक है और अनुसूची "ख" में यथा-प्रदत्त ग्राम, परगना और जिला मेें कोई भूमि विस्थापित परिवारों के पुनर्वासन और पुनव्र्यवस्थापन के लिए चिन्हांकित नहीं की गयी है (इस परियोजना हेतु भूमि अर्जन के कारण किसी परिवार का विस्थापित होना सम्भाव्य नहीं है)।2 उत्तर प्रदेश असाधारण गजट, 24 मार्च, 2021 राज्यपाल अग्रतर उक्त अधिनियम की धारा 19 की उपधारा (2) के अधीन कलेक्टर को इस आशय की घोषणा प्रकाशित करने के साथ पुनर्वासन और पुनव्र्यवस्थापन योजना को संक्षिप्त रूप में प्रकाशित करने के लिए निदेश देती हैं। पुनर्वासन और पुनव्र्यवस्थापन योजना का सारांश इसके साथ संलग्न है। (जिला आजमगढ़ में पूर्वांचल एक्सप्रेसवे परियोजना हेतु भूमि अर्जन से किसी परिवार का विस्थापित होना संभाव्य नहीं है। अतएव, पुनर्वासन और पुनव्र्यवस्थापन हेतु कोई भूमि चिन्हित करने और पुनर्वासन एवं पुनव्र्यवस्थापन योजना का सारांश प्रकाशित किये जाने की कोई आवश्यकता नहीं है।)

Dated Lucknow, March 24, 2021

WHEREAS preliminary notification no. 2723/LXXVII-3–2020-138(M)-2018, dated December 23, 2020 was issued under sub-section (1) of section 11 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Act no. 30 of 2013) (hereinafter referred to as the said Act), in respect of total 11.0002 Hectares of land in the Village Fakharuddinpur 4.9821 Hect., Sathiyan 3.1892 Hect., Samasabad 0.4528 Hect., Mainuddinpur 0.4432 Hect., Pura Kodai 0.0956 Hect., Raida 1.2651 Hect., Faridpur 0.0041 Hect., Ohani 0.4707 Hect., Chak Jorawar 0.0618 Hect., Bairampur 0.0356 Hect. in Tehsil Sadar/Phoolpur/Nizamabad, District Azamgarh for public purpose namely, Purvanchal Expressway Project through Uttar Pradesh Expressways Industrial Development Authority and lastly published on December 29, 2020. The Collector, Azamgarh was appointed as Administrator for the purpose of Rehabilitiation and Resettlement of the project affected families;

NOW, THEREFORE, after considering the report of the Collector submitted in pursuance to provision under sub-section (2) of section 15 of the said Act, the Governor is pleased to declare under sub-section (1) of section 19 of the said Act that the area of the land mentioned in the Schedule "A" below is needed for public purpose and no land in the Village, Pargana and District as given in Schedule "B" has been identified for rehabilitation and resettlement of the displaced families (No family is likely to be displaced due to land acquisition for this project).

The Governor is further pleased under sub-section (2) of section 19 of the said Act to direct the Collector to publish a summary of the Rehabilitation and Resettlement Scheme with publication of the declaration to this effect. The summary of the Rehabilitation and Resettlement Scheme is attached herewith. (No family is likely to be displaced due to land acquisition for Purvanchal Expressway Project in district Azamgarh. Hence, there is no need for identification of any land for Rehabilitation and Resettlement and publication of summary of Rehabilation and Resettlement Scheme.)

NOTE –A plan of land may be inspected in the Office of the Collector, Azamgarh for the purpose of acquisition.
