उत्तर प्रदेश साधारण खण्ड अधिनियम, 1904 (उत्तर प्रदेश अधिनियम संख्या 1 सन्‌ 1904) की धारा 21 के साथ पठित उत्तर प्रदेश गन्ना (पूर्ति तथा खरीद विनियमन) अधिनियम, 1953 (उत्तर प्रदेश अधिनियम संख्या 24 सन्‌ 1953) की धारा 28 के अधीन शक्तियों का प्रयोग करके, राज्यपाल उत्तर प्रदेश गन्ना (पूर्ति तथा खरीद विनियमन) नियमावली, 1954 को संशोधित करने की दृष्टि से निम्नलिखित नियमावली बनाती हैं :-

संक्षिप्त नाम और 1-(1) यह नियमावली उत्तर प्रदेश गन्ना (पूर्ति तथा खरीद विनियमन) (तीसवाँ

प्रारम्भ

संशोधन) नियमावली, 2021 कही जायेगी।

(2) यह दिनांक 15 फरवरी, 2021 से प्रवृत्त होगी।

नियम 49 का 2-उत्तर प्रदेश गन्ना (पूर्ति तथा खरीद विनियमन) नियमावली, 1954 में, नीचे

संशोधन

स्तम्भ-एक में दिये गये नियम 49 के स्थान पर, स्तम्भ-दो में दिया गया नियम रख दिया

जायेगा, अर्थात्‌ :-

49-किसी फैक्टरी का अध्यासी, 49-किसी फैक्टरी का अध्यासी, खरीदे गये गन्ने पर भारत सरकार द्वारा खरीदे गये गन्ने पर भारत सरकार द्वारा निर्धारित न्यूनतम सांविधिक गन्ना मूल्य, निर्धारित न्यूनतम सांविधिक गन्ना मूल्य, जिसे संप्रति उचित एवं लाभकारी मूल्य जिसे संप्रति उचित एवं लाभकारी मूल्य (एफ0आर0पी0) के रूप में जाना जाता है, (एफ0आर0पी0) के रूप में जाना जाता है, के तीन प्रतिशत की दर से अंशदान देगा, के तीन प्रतिशत की दर से अंशदान देगा, जिसमें से पचहत्तर प्रतिशत गन्ना जिसमें से पचहत्तर प्रतिशत गन्ना उत्पादकों की सहकारी समिति को और उत्पादकों की सहकारी समिति को और पच्चीस प्रतिशत परिषद्‌ को संदेय होगा : पच्चीस प्रतिशत परिषद्‌ को संदेय होगा :

परन्तु पेराई सीजन 2019-20 के परन्तु पेराई सीजन 2020-21 के दौरान खरीदे गये गन्ने पर संदेय अंशदान दौरान खरीदे गये गन्ने पर संदेय कमीशन का भुगतान उचित एवं लाभकारी मूल्य का भुगतान उचित एवं लाभकारी मूल्य (एफ0आर0पी0) के तीन प्रतिशत के स्थान (एफ0आर0पी0) के तीन प्रतिशत के स्थान पर पाँच रूपये पचास पैसे प्रति कुन्तल की पर पाँच रूपये पचास पैसे प्रति कुन्तल की दर से किया जायेगा।

IN pursuance of the provisions of clause (3) of Article 348 of the Constitution of India, the Governor is pleased to order the publication of the following English translation of notification no. 01/2021-419–46-3-2021-1607-2004, dated March 24, 2021 :

In exercise of the powers under section 28 of the Uttar Pradesh Sugarcane (Regulation of Supply and Purchase) Act, 1953 (U.P. Act No. XXIV of 1953) read with section 21 of the Uttar Pradesh General Clauses Act, 1904 (U.P. Act no. 1 of 1904), the Governor is pleased to make the following rules with a view to amending the Uttar Pradesh Sugarcane (Regulation of Supply and Purchase) Rules, 1954 :-

THE UTTAR PRADESH SUGARCANE (REGULATION OF SUPPLY AND

PURCHASE) (THIRTIETH AMENDMENT) RULES, 2021

Short title and

1. (1) These rules may be called the Uttar Pradesh Sugarcane (Regulatin of commencement

Supply and Purchase) (Thirtieth Amendment) Rules, 2021.

(2) They shall come into force with effect from 15th February, 2021.

Amendment of

2. In the Uttar Pradesh Sugarcane (Regulation of Supply and Purchase) Rules, rule 49

1954 for rule 49 set out in Column-I below, the rule as set out in column-II shall be substituted, namely :-
