भारत का संविधान के अनुच्छेद 229 के खण्ड (2) के अधीन शक्तियों का प्रयोग करके मुख्य न्यायमूर्ति. उच्च न्यायालय, इलाहाबाद द्वारा बनायी गयी निम्नलिखित नियमावली एत‌द्वारा समस्त सम्बंधित के सूचनार्थ प्रकाशित की जाती है ।

भारत का संविधान के अनुच्छेद 229 (2 ) के अधीन प्रदत्त शक्तियों का प्रयोग करके मुख्य न्यायमूर्ति, उच्च न्यायालय, इलाहाबाद की अधिकारिता के अधीन ई -न्यायालयों में तकनीकी संवर्ग के विभिन्न पदों पर नियुक्ति और उनकी अन्य सेवा शर्तों से सम्बंधित निम्नलिखित नियमावली बनाते हैं:-

भाग-एक-सामान्य

1-यह नियमावली उत्तर प्रदेश ई -न्यायालय केन्द्रीयित कम्प्यूटर सेवा संक्षिप्त नाम और प्रारम्भ

नियमावली, 2021" कही जाएगी।

परिभाषायें

2-जब तक संदर्भ से अन्यथा अपेक्षित न हो इस नियमावली में, -

2.1-उच्च न्यायालय के सीनियर सिस्टम आफिसर , सिस्टम आफिसर तथा सिस्टम सहायकों और जिला न्यायालय के सिस्टम आफिसरों और सिस्टम सहायकों के लिये नियुक्ति प्राधिकारी महानिबन्धक होंगे;

2.2- 'मुख्य न्यायमूर्ति' का तात्पर्य उच्च न्यायालय , इलाहाबाद के मुख्य न्यायमूर्ति से

2.3-' राज्यपाल' का तात्पर्य उत्तर प्रदेश के राज्यपाल से है:

2.5- अधीनस्थ न्यायालयों का तात्पर्य, उच्च न्यायालय , इलाहाबाद के अधीनस्थ जिला एवं उत्तर प्रदेश के बाह्य न्यायालयों से है;

2.6 -सेवा का सदस्य' का तात्पर्य उत्तर प्रदेश ई -न्यायालय केन्द्रीयित कम्प्यूटर सेवा नियमावली, 2021 के अधीन प्रदत किसी पद पर नियुक्त किसी व्यक्तिसे है;

2.7- महानिबन्धका का तात्पर्य उच्च न्यायालय, इलाहाबाद के महानिबन्धक से है।

2.8-'राज्य सरकार' का तात्पर्य उत्तर प्रदेश की राज्य सरकार से है:

2.9- सेवा' का तात्पर्य उत्तर प्रदेश ई -न्यायालय केन्द्रीयित कम्प्यूटर सेवा से है:

2.10-'भर्ती का वर्ष' का तात्पर्य प्रथम जुलाई को प्रारम्भ होने वाले और अधिसूचित भर्ती वर्ष के अगले वर्ष के 30 जून को समाप्त होने वाले वर्ष है ।

भाग-दो संवर्ग

संवर्ग की सदस्य-

संख्या

3.1 -संवर्ग की सदस्य संख्या और उसमें पदों की संख्या वही होगी जैसा कि उच्च न्यायालय द्वारा राज्यपाल के अनुमोदन से अवधारित किया जाय ।

3.2-इस नियमावली के प्रारम्भ होने के समय संवर्ग की सदस्य संख्या, उनके पद, पदनाम, श्रेणी और वेतनमान वही होंगे जैसा कि इस नियमावली की अनुसूची एक में उल्लिखित है ।

3.3 -उच्च न्यायालय , समय -समय पर राज्यपाल की संस्तुति पर उतनी संख्या में अतिरिक्त पदों का सृजन कर सकता है जैसा कि आवश्यक समझा जाय।

भाग-तीन-भर्ती

भर्ती

4-सेवा में विभिन्न पदों पर भर्ती निम्नानुसार की जायेगी:-

(क) प्रथम बार भर्ती, ई -न्यायालय परियोजना के अधीन संविदा के आधार पर कार्यरत सिस्टम सहायकों से आमेलन द्वारा नियम 9 के अनुसार एकल व्यवस्था के रूप में कीजायेगी:

(ख) तत्पश्चात् पों पर भर्ती, सीधी भर्ती द्वारा नियमावली के अधीन विहित प्रक्रिया के अनुसार की जायेगी। (2)

समूह-ख

सिस्टम आफिसर

(क) प्रथम बार भर्ती, ई -न्यायालय परियोजना के अधीन संविदा के आधार पर कार्यरत सिस्टम आफिसरों से आमेलन द्वारा नियम 9 के अनुसार एकल व्यवस्था द्वारा की जायेगी:

(ख) तत्पश्चात् पर्दा पर भर्ती 25 प्रतिशत सीधी भर्ती द्वारा तथा 75 प्रतिशत ज्येष्ठता सह योग्यता के अनुसार न्यूनतम पाँच वर्ष की निरन्तर सन्तोषजनक सेवा वाले सिस्टम सहायकों से पदोन्नति द्वारा की जायेगी :

परन्तु यह कि विद्यमान सिस्टम सहायकों की पदोन्नति के लिये पांच वर्ष की निरन्तर संतोषजनक संविदात्मक सेवा को संज्ञान में लिया जायेगा।

ज्येष्ठ सिस्टम

आफिसर-

समूह 'क'

(क) प्रथम बार भर्ती, ई -न्यायालय परियोजना के अधीन संविदा के आधार पर कार्यरत ज्येष्ठ सिस्टम आफिसर से आमेलन द्वारा नियम 9 के अनुसार एकल व्यवस्था के रूप में की जायेगी;

(ख) तत्पश्चात् पर्दो पर भर्ती. 25 प्रतिशत सीधी भर्ती द्वारा तथा 75 प्रतिशत ज्येष्ठता सह योग्यता के अनुसार न्यूनतम पांच वर्ष की निरन्तर सन्तोषजनक सेवा वाले सिस्टम आफिसरों से पदोन्नति द्वारा की जायेगीः

परन्तु यह कि विद्रद्यमान सिस्टम आफिसरों की पदोन्नति के लिए पांच वर्ष की निरन्तर सन्तोषजनक संविदात्मक सेवा का संज्ञान में लिया जायेगा ।

भाग-चार अर्हतायें

अर्हतायें 5-सिस्टम सहायक, सिस्टम आफिसर तथा ज्येष्ठ सिस्टम आफिसर के पर्दा के लिये अर्हतायें निम्नानुसार होंगी:-

(1) सिस्टम (एक) शैक्षिक अर्हता:

समूह 'ग'

केन्द्रीय अधिनियम, प्रान्तीय अधिनियम या राज्य अधिनियम द्वारा तद्दीन भारत में स्थापित या निगमित किसी विश्वविद्यालय से अथवा भारत में विधि द्वारा स्थापित किसी विश्वविद्यालय से अथवा विश्वविद्यालय अनुदान आयोग द्वारा मान्यता प्राप्त किसी संस्था से कम्प्यूटर विज्ञान या सम्बंधित विषय में स्नातक उपाधिः

अथवा

किसी केन्द्रीय अधिनियम, प्रान्तीय अधिनियम अथवा किसी राज्य अधिनियम द्वारा या तद्दीन भारत में स्थापित या निगमित किसी विश्वविद्यालय से या भारत में विधि द्वारा स्थापित किसी विश्वविद्यालय से या विश्वविद्यालय अनुदान आयोग द्वारा मान्यता प्राप्त किसी संस्था से स्नातक उपाधि के साथ विश्वविद्यालय अनुदान आयोग द्वारा मान्यता प्राप्त किसी संस्था से कम्प्यूटर एप्लीकेशन में स्नातकोत्तर डिप्लोमा (पी0जी 0डी0सी0ए0) ;

अथवा

किसी केन्द्रीय अधिनियम , प्रान्तीय अधिनियम या किसी राज्य अधिनियम द्वारा या तद्दीन भारत में स्थापित या निगमित किसी विश्वविद्यालय से अथवा भारत में विधि द्वारा स्थापित किसी विश्वविद्यालय से अथवा विश्वविद्यालय अनुदान आयोग द्वारा मान्यता प्राप्त किसी संस्था से स्नातक उपाधि के साथ राष्ट्रीय इलेक्ट्रानिक एवं सूचना प्रौ‌द्योगिकी संस्थान ( एन0 आई 0ई 0 एल0आई0 टी0) से 'ए' स्तरीय पाठ्यक्रम।

(दो) वान्छनीय अनुभवः

आपरेटिंग सिस्टम, आफिस एप्लीकेशन, सूट्स हार्डवेयर तथा नेटवर्किंग

का कार्य अनुभव।

(2) सिस्टम (एक) शैक्षणिक अर्हताः

आफिसर

समूह- ख

लाईनेक्स ओपेन सोर्स साफ्टवेयर/विंडोज/आर० डी० बी० एम० एस० पैकेजेस/प्रोग्रामिंग भाषाओं का कार्य अनुभव के साथ निम्नांकित न्यूनतम शैक्षणिक अर्हताः-

बी० ई 0/बी0 टेक ( कम्प्यूटर विज्ञान, आई ० टी० अथवा सम्बंधित विषय) या किसी केंद्रीय अधिनियम, प्रान्तीय अधिनियम या राज्य अधिनियम द्वारा या तद्दीन भारत में स्थापित या निगमित किसी विश्वविद्यालय से अथवा भारत में विधि द्वारा स्थापित किसी विश्वविद्यालय से अथवा विश्वविद्यालय अनुदान आयोग द्वारा मान्यता प्राप्त किसी संस्था से समकक्ष अर्हता;

अथवा

किसी केंद्रीय अधिनियम, प्रान्तीय अधिनियम या राज्य अधिनियम द्वारा या तद्दीन भारत में स्थापित या निगमित किसी विश्वविद्यालय से अथवा भारत में विधि द्वारा स्थापित किसी विश्वविद्यालय से अथवा विश्वविद्यालय अनुदान आयोग द्वारा मान्यता प्राप्त किसी संस्था से एम०सी० ए ०/ एम० एस० सी० (कम्प्यूटर विज्ञान , आई ०टी ० या सम्बंधित विषय):

अथवा

किसी केंद्रीय अधिनियम, प्रान्तीय अधिनियम या राज्य अधिनियम द्वारा या तद्दीन भारत में स्थापित या निगमित किसी विश्वविद्यालय से अथवा भारत में विधि द्वारा स्थापित किसी विश्वविद्यालय से अथवा विश्वविद्यालय अनुदान आयोग द्वारा मान्यता प्राप्त किसी संस्था से स्नातक उपाधि के साथ राष्ट्रीय इलेक्ट्रानिक एवं सूचना प्रौ‌द्योगिकी संस्थान ( एन0आई ०ई ० एल ०आई ०टी० ) से ' बी' स्तरीय पाठ्यक्रम प्रमाणपत्र।

(3) ज्येष्ठ (एक) शैक्षणिक अर्हताः

सिस्टम

लाईनेक्स ओपेन सोर्स साफ्टवेयर/विंडोज/आर० डी० बी० एम ० एस ० आफिसर

पैकेजेस/प्रोग्रामिंग भाषाओं का कार्य अनुभव के साथ निम्नांकित न्यूनतम

शैक्षिक अर्हताः-

समूह'क'

किसी केंद्रीय अधिनियम, प्रान्तीय अधिनियम या राज्य अधिनियम द्वारा या तद्दीन भारत में स्थापित या निगमित किसी विश्वविद्यालय से अथवा भारत में विधि द्वारा स्थापित किसी विश्वविद्यालय से अथवा विश्वविद्यालय अनुदान आयोग द्वारा मान्यता प्राप्त किसी संस्था से बी0 ई 0/बी0 टेक (कम्प्यूटर विज्ञान, आई ० टी० या सम्बंधित विषय) या समकक्ष अर्हताः

अथवा

किसी केंद्रीय अधिनियम, प्रान्तीय अधिनियम या राज्य अधिनियम द्वारा या तद्दीन भारत में स्थापित या निगमित किसी विश्वविद्यालय से अथवा भारत में विधि द्वारा स्थापित किसी विश्वविद्यालय से अथवा विश्वविद्यालय अनुदान आयोग द्वारा मान्यता प्राप्त किसी संस्था से एम ०सी० ए०/ एम०एस०सी० ( कम्प्यूटर विज्ञान, आई० टी० या सम्बंधित विषय);

अथवा

किसी केंद्रीय अधिनियम, प्रान्तीय अधिनियम या राज्य अधिनियम द्वारा या तद्दीन भारत में स्थापित या निगमित किसी विश्वविद्यालय से अथवा भारत में विधि द्वारा स्थापित किसी विश्वविद्यालय से अथवा विश्वविद्यालय अनुदान आयोग द्वारा मान्यता प्राप्त किसी संस्था से स्नातक उपाधि के साथ राष्ट्रीय इलेक्ट्रानिक एवं सूचना प्रौ‌द्योगिकी संस्थान से ' बी' स्तरीय पाठ्यक्रम प्रमाणपत्र।

(दो) अनुभवः

किसी सरकारी विभाग अथवा सरकारी उपक्रम वाली संस्थाओं में सिस्टम आफिसर या समकक्ष के रूप में पांच वर्ष का अनुभव।

नियुक्तिके लिए

आयु सीमा

6-सीधी भर्तीद्वारा नियुक्ति हेतु प्रत्येक अभ्यर्थी के लिए अगले भर्ती वर्ष के प्रथम जुलाई को अट्ठारह वर्ष की आयु प्राप्त करना और चालीस वर्ष की आयु से अधिक न होना आवश्यक है:

परन्तु यह कि अनुसूचित जातियों, अनुसूचित जनजातियों , अन्य पिछड़े वर्गों और अन्य श्रेणियों के अभ्यर्थियों के लिए लागू अधिकतम आयु सीमा, इस निमित जारी शासनादेशों, जैसा कि उच्च न्यायालय द्वारा अंगीकृत हो, के अनुसार होगी:

परन्तु यह और कि यह खण्ड उन व्यक्तियों के लिए लागू नहीं होगा जो ई -न्यायालय परियोजना के अधीन पहले से ही कार्यरत हाँ।

भाग-पांच भर्ती की प्रक्रिया

रिक्तियोंका

अवधारण

7-नियुक्ति प्राधिकारी भर्ती वर्ष के प्रक्रम दौरान भरी जाने वाली रिक्तियों की संख्या और लागू चक्रानुक्रम के अनुसार और इस नियमावली के नियम 15 के अनुरूप अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों तथा अन्य श्रेणियों के अभ्यर्थियों के लिए आरक्षित की जाने वाली रिक्तियों की संख्या को भी अवधारित करेगा।

चयन पद्धति

8.1-नियुक्ति प्राधिकारी चयन कर सकता है या ऐसा करने के लिए अपने द्वारा नामनिर्दिष्ट चयन समिति नियुक्त कर सकता है।

8.2-पद के लिए अभ्यर्थियों की योग्यता का अवधारण , लिखित परीक्षा के आधार पर किया जायेगा ।

8.3- यदि लिखित परीक्षा में दो या दो से अधिक अभ्यर्थियों द्वारा प्राप्त कुल अंकों का योग समान हो तो ऐसे मामले में योग्यता क्रम का निर्धारण निम्नलिखित आधार पर किया जायेगाः-

(एक) अभ्यर्थी द्वारा वर्णनात्मक परीक्षा में प्राप्त उच्चतम अंक और (दो) तत्पश्चात् उनकी आयु के आधार पर अधिक आयु वाला या वाले व्यक्ति योग्यता क्रम में उच्चतर स्थान पर रखा जायेगा/ रखे जायेंगे ।

8.4-चयन सूची, परिणाम घोषित किये जाने के दिनांक से एक वर्ष के लिए या अगले भर्ती वर्ष के लिये भर्ती की अधिसूचना तक, जो भी पहले हो, विधिमान्य होगी ।

भाग-छः

आमेलन नियुक्ति, परिवीक्षा, स्थायीकरण स्थानांतरण तथा ज्येष्ठता

वि‌द्यमान आफिसरों तथा कर्मचारिवृंद का आमेलन 9.1-ऐसे सीनियर सिस्टम आफिसर, सिस्टम आफिसरों तथा सिस्टम सहायकों, जो पूर्व में भारतीय न्यायपालिका में आई ०सी ०टी० के कार्यान्वयन के लिए राष्ट्रीय नीति और कार्य योजना में निर्धारित ई - समिति, उच्चतम न्यायालय, भारत , नई दिल्ली द्वारा तैयार किये गये मार्गदर्शक सिद्धान्तों के अधीन संविदा के आधार पर भर्ती किये गये थे, का सम्बधित पदों पर आमेलन. उत्तर प्रदेश ( उत्तर प्रदेश लोक सेवा आयोग के क्षेत्र के बाहर) समूह 'ग' और समूह 'घ' के पर्दा पर सरकारी विभागों में दैनिक मजदूरी या कार्य प्रभार या संविदा पर कार्य कर रहे व्यक्तियों की विनियमितीकरण नियमावली, 2016 के अनुसार किया जा सकता है:

परन्तु यह कि ऐसे व्यक्ति, नियुक्ति प्राधिकारी/ चयन समिति द्वारा परीक्षित की जाने वाली निरन्तर उपयोगिता और उपयुक्तता के अध्यधीन अपनी प्रारम्भिक नियुक्ति के समय भारत के उच्चतम न्यायालय की ई- समिति द्वारा विहित अपेक्षित अर्हताएं धारित करते हो ।

9.2-उल्लिखित विद्यमान सीनियर सिस्टम आफिसर, सिस्टम आफिसरों और सिस्टम सहायकों के आमेलन का प्रयोग सीधी भर्ती अथवा पदोन्नति द्वारा नियुक्तियां करने की कोई प्रक्रिया ग्रहण करने के पूर्व किया जाने वाला एकल प्रयोग होगा । ई -न्यायालय परियोजना के अधीन नियुक्त विद्यमान संविदात्मक कर्मचारिवृंद के आमेलन के प्रयोजनार्थ अधिकतम आयु सीमा में शिथिलता प्रदान की जायेगी।

9.3-प्रत्येक संवर्ग में शेष रिक्त पद इस नियमावली के भाग-तीन में विहित प्रक्रिया के अनुसार सीधी भर्ती द्वारा भरे जायेंगे।

10.1-नियुक्तियाँ, चयन के समय तैयार की गयी योग्यता सूची के अनुसार की जायेगी । नियुक्तिऔर परिवीक्षा 10.2-किसी अभ्यर्थी को एक वर्ष की अवधि के लिए परिवीक्षा पर रखा जाएगा ।

10.3-नियुक्ति प्राधिकारी लिखित रूप में अभिलिखित किये जाने वाले कारों से परिवीक्षा अवधि को बढ़ा सकता हैः परन्तु यह कि कुल परिवीक्षा अवधि, जिसमें बढ़ायी गयी परिवीक्षा अवधि सम्मिलित हो, तीन वर्ष से अधिक नहीं होगी।

स्थायीकरण 11-किसी परीवीक्षाधीन व्यक्ति को परिवीक्षा अवधि या बढ़ायी गयी परिवीक्षा अवधि समाप्त होने पर स्थायी कर दिया जाएगा, यदि उसकी सत्यनिष्ठा प्रमाणित हो , उसका कार्य और आचरण संतोषजनक हो, और नियुक्ति प्राधिकारी का समाधान हो जाय कि वह स्थायी किए जाने के लिए अन्यथा उपयुक्त है।

स्थानांतरण 12-मुख्य न्यायमूर्ति अथवा मुख्य न्यायमूर्ति द्वारा नामनिर्दिष्ट कोई न्यायाधीश, उच्च न्यायालय या अधीनस्थ न्यायालयों में कार्यरत किसी सीनियर सिस्टम आफिसर, सिस्टम आफिसरों अथवा सिस्टम सहायकों को स्थानान्तरित कर सकता है।

ज्येष्ठता 13-इस नियमावली के अधीन आमेलित सीनियर सिस्टम आफिसर, सिस्टम आफिसरों और सिस्टम सहायकों की ज्येष्ठता का अवधारण, उच्च न्यायालय द्वारा उनकी प्रारम्भिक नियुक्ति के समय अनुरक्षित योग्यता के अनुसार किया जायेगा । नियम -9.1 के अधीन यथा उपबंधित विद्रद्यमान कर्मचारिवृंद के आमेलन के पश्चात नियुक्त सीनियर सिस्टम आफिसर, सिस्टम आफिसरों तथा सिस्टम सहायकों को उनकी योग्यता/ज्येष्ठता क्रम में उनके नीचे रखा जायगा।

वेतन भते तथा सुविधायें 14.1-इस नियमावली के प्रारम्भ होने के दिनांक को विभिन्न पर्दो के वेतनमान अनुसूची एक में दिये गये हैं , परन्तु यह कि वेतनमान समय - समय पर मुख्य न्यायमूर्ति द्वारा राज्यपाल के अनुमोदन से संशोधित किये जा सकते हैं ।

14.2-सेवा के सदस्य, ऐसे भत्तों और अन्य सुविधाओं के हकदार होगें जैसा कि उसी वेतनमान/ग्रेड में उच्च न्यायालय/ उच्च न्यायालय, इलाहाबाद के अधीनस्थ जिला न्यायालय में अन्य सेवाओं के सदस्यों को अनुमन्य हैं ।

14.3-गतिरोध से बचने के उ‌द्देश्य से यथा प्रयोज्य अगला उच्चतर ग्रेड वेतनमान वेतन ग्रेड समय- समय पर जारी शासनादेशों के अनुसार सेवा के सदस्यों को स्वीकृत किया जा सकता है।

भाग-सात अन्य उपबंध

आरक्षण 15-अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछडे वर्गों और अन्य श्रेणियों के सदस्यों के लिए पद इस सीमा तक और ऐसी रीति से आरक्षित किये जायेंगे जैसा कि समय -समय पर इस निमित जारी शासनादेशों, जैसा कि उच्च न्यायालय द्वारा अंगीकृत हो , द्वारा विनिर्दिष्ट किया जाय परन्तु यह कि आरक्षण आदेश, नियम 9.1 के अधीन अनुध्यात एक बार आमेलन के मामले में लागू नहीं होगा।

16.1-सेवा के सभी सदस्य उच्च न्यायालय के अधीक्षण एवं नियन्त्रण के अध्यधीन होंगे। अन्य मामलों का विनियमन 830 RPH 2021 (Nyaya- 2 ) Data-4e 6

16.2-सेवा के सदस्यों की सेवा शर्तों, जिनमें उनके आचरण , नियंत्रण तथा अनुशासन से सम्बंधित मामले सम्मिलित हैं, से सम्बंधित समस्त मामलों में तत्समय प्रवृत तथा उत्तर प्रदेश सरकार में समवर्ती पद धारण करने वाले सरकारी सेवकों के लिए लागू नियम तथा आदेश, ऐसे उपान्तरण, अन्तर तथा अपवाद यदि कोई हो, जैसा कि उच्च न्यायालय समय -समय पर विनिर्दिष्ट करे, के अध्यधीन लागू होंगे।

16.3-राज्य सरकार में किसी पद के तत्स्थानी पद होने के संबंध में किसी संदेह की स्थिति में, मामले का विनिश्चय मुख्य न्यायामूर्ति द्वारा किया जाएगा ।

नियमों को शिथिल करने की शक्ति

17-आपवादिक मामलों में जहां मुख्य न्यायमूर्ति का यह समाधान हो जाय कि आयु से सम्बंधित या भर्ती के लिये अनुभव की अपेक्षा से सम्बंधित नियमों के प्रवर्तन से किसी विशिष्ट मामले में अनुचित कठिनाई उत्पन्न होती है अथवा जहां मुख्य न्यायमूर्ति की यह राय हो कि किसी व्यक्ति की आयु या अनुभव के सम्बंध में इस नियमावली के किसी उपबंध को शिथिल करना आवश्यक या समीचीन है वहां वह इस नियमावली के सुसंगत उपबंधों को इस सीमा तक और ऐसी शर्त के अध्यधीन अभिमुक्त कर सकता है और उन्हें शिथिल कर सकता है जैसा कि वह मामले को अवशिष्ट शक्तिया

न्याय संगत तथा साम्यपूर्ण रीति से व्यवहृत करने के लिए उचित समझे। 18-मुख्य न्यायमूर्ति, इस नियमावली से आनुषंगिक या संबधित मामलों के संबंध में आदेश जारी कर सकते हैं जैसा कि समय - समय पर उचित समझा जाय ।

THE following rules framed by the Chief Justice of the High Court of Judicature at Allahabad in exercise ofthe powers under clause (2 ) of Article 229 of the Constitution of India are hereby published for the information of all concerned.

UTTAR PRADESH E- COURTS CENTRALIZED COMPUTER SERVICE RULES , 2021

IN exercise of the powers conferred under Article 229(2 ) of the Constitution of India, the Chief Justice is pleased to make the following rules regulating the appointment and other conditions of service of various posts of the Technical Cadre in the E- Courts under the Jurisdiction of High Court of Judicature at Allahabad.

PART-I

GENERAL

Short Title and Commencement 1. These Rules may be called the " Uttar Pradesh E-Courts Centralized Computer Service Rules , 2021 " .

Definitions 2.In these Rules, unless the context otherwise requires:

2.1. The 'Appointing Authority' for the Senior System Officer, System Officers and System Assistants for the High Court and System Officers and System Assistants in the District Courts shall be the Registrar General;

2.2.'Chief Justice' means the Chief Justice of the High Court of Judicature atAllahabad;

2.3. 'Governor' means the Governor of Uttar Pradesh;

2.4.'High Court' means the High Court of Judicature at Allahabad;

2.5.'Subordinate Courts ' means the District and Outlying Courts of Uttar Pradesh subordinate to High Court of Judicature at Allahabad;

2.6. 'Member of the service' means , a person appointed on a post provided under Uttar Pradesh E- Courts Centralized Computer Service Rules , 2021;

2.7. ' Registrar General ' means the Registrar General of the High Court of Judicature at Allahabad;

2.8. 'State Government' means the State Government of Uttar Pradesh;

2.9. 'Service' means the Uttar Pradesh E- Courts Centralized Computer Service;

2.10. 'Year of recruitment ' means the year commencing from 1 " July and ending on 30th June next year of the year in which the recruitment is notified.

PART-II

CADRE

Cadre Strength 3.1. The Cadre strength and the number of the posts there in shall be as determined by the High Court with the approval of the Governor;

3.2. The Cadre strength at the time of the commencement of these Rules along with their Posts , Designation, Grade, and Pay Scale shall be such as mentioned in Schedule - I to these Rules:

3.3 . The High Court may, from time to time, with the approval of the Governor, create such number of additional posts , as may be considered necessary.

PART-III

RECRUITMENT

Recruitment

4.The recruitment to the various posts in the service shall be as follows:

(a) For the first time recruitment shall be made by absorption from System Assistants working on Contract basisunder E-Courts Project in accordance with Rule 9 as one time arrangement .

(b) There after, recruitment to the posts shall be made by direct recruitment in accordance with the procedure prescribed under these Rules .

(2) Group-B System Officer

(a) For the first time recruitment shall be made by absorption from System Officers working on Contract basis under E-Courts Project in accordance with Rule 9 as one time arrangement.

(b) There after, recruitment to the posts shall be made 25%by direct recruitment and 75% by promotion from the System Assistants having a minimum of five years continuous satisfactory service according to seniority-cum- merit:

Provided that for promotion of the existing System Assistants, five years continuous satisfactory contractual service shall be taken into account.

(3) Senior System Officer Group-A

(a) For the first time recruitment shall be made by absorption from Sr. System Officer working on Contract basis under E -Courts Project in accordance with Rule 9 as onetime arrangement.

(b) There after , recruitment to the posts shallbe made 25%by direct recruitment and 75%by promotion from the System Officers having a minimum of five years continuous satisfactory service according to seniority-cum-merit: Provided that for promotion of the existing System Officers , five years continuous satisfactory contractual service shall be taken into account .

PART- IV

QUALIFICATIONS

Qualifications

5. The qualifications for the post of System Assistant, System Officer and Senior System Officer shall be as follows:

(1) System Assistant Group-C

( i) Educational qualification : Bachelor Degree in Computer Science or related subject from a University in India established or incorporated by or under a Central Act , Provincial Act or a State Act or from any University established by law in India or from any Institution recognised by the University Grants Commission;

Bachelor Degree from a University in India established or incorporated by or under a Central Act, Provincial Act or a State Act or from any University established by law in India or from any Institution recognisedby the University Grants Commission , with Post graduate Diploma in Computer Applications (PGDCA) from any Institution recognised by the University Grants Commission;

Bachelor Degree from a University in India established or incorporatedby or under a Central Act, Provincial Act or a State Act or from any University established by law in India or from any Institution recognised by the University Grants Commission with "A" Level Course from National Institute of Electronics & Information Technology (NIELIT) .

(ii) Desirable Experience : Working knowledge of Operating Systems, Office Applications Suites , Hardware and Networking .

(2) System OfficerGroup -B

( i) Educational qualification : Working Knowledge of Linux/ Open Source Software/Windows/ RDBMS Packages / Programming Languages with the following minimum educational qualification.

* B.E./B.Tech (Computer Science , IT or related subject ) or equivalent from a University in India established or incorporated by or under a Central Act, Provincial Act or a State Act or from any University established by law in India or from any Institution recognised by the University Grants Commission;

*M.C.A. /M.Sc . (Computer Science, IT or related subject ) from a University in India established or incorporated by or under a Central Act, Provincial Act or a State Act or from any University established by law in India or from any Institution recognised by theUniversityGrants Commission;

* Bachelor Degree from a University in India established or incorporated by or under a Central Act, Provincial Act or a State Act or from any University established by law in India or from any Institution recognised by the University Grants Commission with "B" Level course certificate from National Institute of Electronics & Information Technology (NIELIT) .

(3) Senior System Officer Group - A

(i) Educational qualification: Working Knowledge of Linux/Open Source Software / Windows RDBMS Packages/ Programming Languages with the following minimum educational qualification.

* B.E./B.Tech ( Computer Science, IT or related subject ) or equivalent from a University in India established or incorporated by or under a Central Act , Provincial Act or a State Act or from any University established by law in India or from any Institution recognised by the University Grants Commission;

* M.C.A. /M.Sc . (Computer Science , IT or related subject ) from aUniversity in India established or incorporated by or under a Central Act, Provincial Act or a State Act or from any University established by law in India or from any Institution recognised by the University Grants Commission;

*Bachelor Degree from a University in India established or incorporated by or under a Central Act, Provincial Act or a State Act or from any University established by law in India or from any Institution recognised by the University Grants Commission with "B " Level course certificate from National Institute of Electronics & Information Technology (NIELIT).

(ii) Experience: 5 years as System Officer or equivalent in anyGovernment Department or Government Undertaking Institutions.

Age limit for appointment

6.Every Candidate for appointment by direct recruitment must have attained the age of eighteen years and not have crossed the age of forty years on first July of next year of recruitment:

Provided that the maximum age limit applicable to a candidate for Scheduled Caste, Scheduled Tribes, Other Backward Classes and other categories shall be, as per the Government Orders , issued in this behalf, as adopted by the High Court:

Provided further that this clause shall not apply to those persons who are already working under thee -Courts Project and are considered for absorption.

PART-V

PROCEDURE FOR RECRUITMENT

Determination of vacancies

7. The Appointing Authority shall determine the number of vacancies to be filledduring the course of the year of recruitment as also the number of vacancies to be reserved for candidates belonging to the Scheduled Castes , Scheduled Tribes , Other Backward Class and other categories , as per the applicable roster and in coherence with Rule 15 of these Rules.

Method of Selection

8.1.TheAppointing Authority may make the selections or through appoint a Selection Committee nominated by it.

8.2. The merit of candidates for the post shall be determined on the basis of aWrittentest.

8.3. If the aggregate of total marks secured in Written test by two or more Candidates are equal , the order of merit in respect of such candidates shall be fixed onthe basis of:

(i) the highest marks obtained by the candidate in Descriptive test ; and (ii ) thereafter, on the basis of their age ; the person or persons older in age shall be placed higher in order ofmerit.

8.4. The select list shall be valid for one year from the date of declaration of the result or till the notification of recruitment for the next year of recruitment, whichever is earlier.

PART-VI

ABSORPTION , APPOINTMENT, PROBATION , CONFIRMATION,

TRANSFER AND SENIORITY

Absorption ofexisting officers and staff

9.1. The Senior System Officer , System Officers and System Assistants, who were earlier recruited on contractual basis under the guidelines laid down in the National Policy and Action Plan for implementation of ICT in the Indian Judiciary as prepared by the e -Committee , Supreme Court of India, New Delhi may be absorbed on the respective posts in accordance with the Uttar Pradesh Regularisation of Persons working on daily wages or on work charge or on contract in Government Departments on Group 'C' and Group 'D' Posts (Outside the preview ofthe Uttar Pradesh Public Service Commission ) Rules , 2016:

11 Provided that such persons possess the required qualifications prescribed by the e- Committee of Supreme Court of India at the time of their initial engagement. subject to their continued utility and suitability to be examined by the Appointing Authority/Selection Committee.

9.2.The exercise for absorption of the existing Senior System Officer, System Officers and System Assistants mentioned shall be a one time exercise to be carried out before any process is undertaken for making appointmentsby direct recruitment or promotion. For the purpose of absorption of the existing contractual staff appointed under the E-Courts Project, the maximum age limit would be relaxed.

9.3 . The remaining vacant posts in each cadre shall be filled by the direct recruitment in accordance with the procedure prescribed in the PART- III of these Rules.

10.1. The appointments shall be made according to the merit list prepared at the time ofthe selection .

Appointment and Probation 10.2.Acandidate shall be placed on probation for a period of one year.

10.3. The Appointing Authority may, for reasons to be recorded in writing, extend the period of probation; provided that the total period of probation, including the extended period of probation , shall not exceed three years .

Confirmation 11. Aprobationer may be confirmed at the end of the period of probation or extended period of probation if, his integrity is certified, his work and conduct is satisfactory and the Appointing Authority is satisfied that he is otherwise suitable for confirmation.

Transfer

12. The Chief Justice or any Judge nominated by the Chief Justice can transfer any Senior System Officer, System Officers and System Assistants working in the High Court or the Subordinate Courts.

Seniority

13.The Seniority of the Senior System Officer, System Officers and System Assistants absorbed under these Rules shall be determined as per the merit maintained by the High Court at the time of their initial appointment . The Senior System Officer, System Officers and System Assistants appointed after the absorption of the existing staff as provided under Rules 9.1 shall be placed below them in order of their merit/ seniority and so on.

andFacilities Pay. Allowances, 14.1 . The pay- scales for different posts , on the date of the commencement of these rules , are given in Schedule - 1; provided the pay- scales can be revised from time to time by the Chief Justice with the approval ofthe Governor.

14.2. The members of the service shall be entitled to pay, allowances and other facilities as are admissible to the members of other Services in the High Court/District Court subordinate to High Court of Judicature at Allahabad in the same pay- scale/grade.

14.3. In order to avoid stagnation , the next higher grade Pay Scale/Pay grade as applicable may be granted to the members of the Service as per the Government Orders issued from time to time .

PART-VII

OTHER PROVISIONS

Reservation 15. Posts shall be reserved for members of the Scheduled Caste , Scheduled Tribes, Other Backward Class and other categories to such extent and in such manner asmay be specifiedby the Government Orders issued in this behalf from time to time as adopted by the High Court provided that reservation order shall not apply in the case of one time absorption contemplated under Rule 9.1 .

Regulation of othermatter

16.1 . All members of the service shall be subject to the superintendence and control ofHigh Court.

16.2. In respect of all matters regarding the conditions of service of the members ofthe service, including matters relating to their conduct, control and discipline , the rule and orders for the time in force and applicable to the Government Servant holding corresponding post in the Government of Uttar Pradesh shall apply subject to such modification , variation and exceptions, if any, as High Court may, from time to time specify.

16.3 In case of any doubt regarding any post being corresponding to a post in the StateGovernment, the matter will be decided by the ChiefJustice.

Powertorelax theRules

17. In exceptional cases where the Chief Justice is satisfied that operation of the Rules relating to age or regarding requirement of experience for recruitment causes undue hardship in any particular case or where the Chief Justice is of the opinion that it is necessary or expedient to relax any of the provisions of these rules with respect to age or experience of any person, he mayby order dispense with and relax the relevant provisions of these rules to such extent and subject to such condition as he may consider necessary fordealing with the case in a just and equitable manner.

Residuary Powers

18. The Chief Justice may issue orders in regard to the matters incidental or ancillary to these rules as may be deemed fit from time to time .
