अधिसूचना
उत्तर प्रदेश माल और सेवा कर अधिनियम, 2017 (उत्तर प्रदेश अधिनियम संख्या 1 सन्, 2017) (जिसे आगे इस अधिसूचना में उक्त अधिनियम कहा गया है) की धारा 25 की उपधारा (6घ) द्वारा प्रदत्त शक्तियों का प्रयोग करके राज्यपाल, परिषद्् की सिफारिशाें पर और अधिसूचना सं0 436/ग्यारह-2-9(47)-17-उ0प्र0 अधि0-1-2017-आदेश(110)-2020, दिनांक 11 मई, 2020 को सिवाय ऐसी बातों के, जो ऐसे अधिक्रमण से पूर्व की गई थी या करने का लोप किया गया था, का अधिक्रमण करके एतद्द्वारा अधिसूचित करती हैं कि उक्त अधिनियम की धारा 25 की उपधारा (6ख) या उपधारा (6ग) के उपबंध ऐसे किसी व्यक्ति पर लागू नहीं होंगे जो,- (क) भारत का नागरिक नहीं है; या (ख) केन्द्रीय सरकार या राज्य सरकार का विभाग या अधिष्ठान; या (ग) स्थानीय प्राधिकरण; या (घ) सांविधिक निकाय; या (ङ) सार्वजनिक क्षेत्र का उपक्रम; या (च) उक्त अधिनियम की धारा 25 की उपधारा (9) के उपबंधों के अधीन रजिस्ट्रीकरण के लिए आवेदन करने वाला कोई व्यक्ति। 2-यह अधिसूचना दिनांक 23 फरवरी, 2021 से प्रवृत्त हुई समझी जायेगी।

IN exercise of the powers conferred by sub-section (6D) of section 25 of the Uttar Pradesh Goods and Services Tax Act, 2017 (U.P. Act no. 1 of 2017) (hereafter in this notification referred to as the said Act), the Governor, on the recommendations of the Council and in supersession of the notification no. 436/XI-2–9(47)-17-U.P.Act-1-2017-Order(110)-2020, dated 11th May, 2020, except as respects things done or omitted to be done before such supersession, hereby notifies that the provisions of sub-section (6B) or sub-section (6C) of section 25 of the said Act shall not apply to a person who is,–
(a) not a citizen of India; or
(b) a Department or establishment of the Central Government or State Government; or (c) a local authority; or
(d) a statutory body; or
(e) a Public Sector Undertaking; or
(f) a person applying for registration under the provisions of sub-section (9) of section 25 of the said Act.
2. This notification shall be deemed to have come into force with effect from 23rd day of February, 2021.
