उत्तर प्रदेश साधारण खण्ड अधिनियम, 1904 (उत्तर प्रदेश अधिनियम, संख्या 1 सन्‌ 1904) की धारा 21 के साथ पठित संयुक्त प्रान्त आबकारी अधिनियम, 1910 (संयुक्त प्रान्त अधिनियम, संख्या 4 सन्‌ 1910) की धारा 24-ख और 41 के अधीन शक्तियों का प्रयोग करके, आबकारी आयुक्त, उत्तर प्रदेश एतद्‌द्वारा, राज्य सरकार की पूर्व स्वीकृति से आबकारी आयुक्त की अधिसूचना संख्या 10806/दस-97बी/संसाधन दिनांक 08 मार्च, 2001 (समय-समय पर यथासंशोधित) द्वारा प्रकाशित उत्तर प्रदेश आबकारी विदेशी शराब (बीयर और वाइन को छोड़कर) की फुटकर बिक्री के अनुज्ञापनों की व्यवस्थापन नियमावली, 2001 में संशोधन करने की दृष्टि से निम्नलिखित नियमावली बनाते हैंः-

(1) यह नियमावली उत्तर प्रदेश आबकारी विदेशी शराब (बीयर को छोड़कर)

की फुटकर बिक्री के अनुज्ञापनों का व्यवस्थापन (उन्नीसवॉ संशोधन) नियमावली, 2021 कही जायेगी।

(2) यह गजट में प्रकाशित किये जाने के दिनांक से प्रवृृत्त होगी।2 उत्तर प्रदेश असाधारण गजट, 8 अप्रैल, 2021 ई0 - उत्तर प्रदेश आबकारी विदेशी शराब (बीयर को छोड़कर) की फुटकर बिक्री के अनुज्ञापनों का व्यवस्थापन नियमावली, 2001, जिसे आगे उक्त नियमावली कहा गया है, में नीचे स्तम्भ-1 में दिये गये नियम-2 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात्‌ :-

विद्यमान नियम

एतदद्वारा प्रतिस्थापित नियम 2(1) परिभाषाएं-जब तक विषय या संदर्भ से कोई बात प्रतिकूल न हो, इस नियमावली में-

2(1) परिभाषाएं-जब तक विषय या संदर्भ से कोई बात प्रतिकूल न हो, इस नियमावली में-

(क) "अधिनियम" का तात्पर्य समय-समय पर यथासंशोधित संयुक्त प्रान्त आबकारी अधिनियम, 1910 से है।

(क) "अधिनियम" का तात्पर्य समय-समय पर यथासंशोधित संयुक्त प्रान्त आबकारी अधिनियम, 1910 से है;

(ख) "दैनिक लाइसेंस फीस" का तात्पर्य सम्पूर्ण (ख) "दैनिक लाइसेंस फीस" का तात्पर्य सम्पूर्ण आबकारी वर्ष के लिए निर्धारित लाइसेंस फीस के 1/365 वें भाग से हैै।

आबकारी वर्ष के लिए निर्धारित लाइसेंस फीस के 1/365 वें भाग से हैै;

(ग) "विदेशी शराब" का तात्पर्य और इसमें भारत में आयात की गई स्प्रिट या मदिरा अथवा भारत में बनाई गई इस प्रकार परिष्कृत या रंजित स्प्रिट या मदिरा, जिससे कि वह सुगन्ध और रंग में भारत में आयातित मदिरा के सदृश्य मालूम हो और उसमें माल्ट स्प्रिट, व्हिस्की, रम, ब्राण्डी, जिन, बोदका, वाइन और मदिरा (लिक्युअर्स) सम्मिलित हैं,

(ग) "विदेशी शराब" का तात्पर्य और इसमें भारत में आयात की गई स्प्रिट या मदिरा अथवा भारत में बनाई गई इस प्रकार परिष्कृत या रंजित स्प्रिट या मदिरा, जिससे कि वह सुगन्ध और रंग में भारत में आयातित मदिरा के सदृश्य मालूम हो और उसमें माल्ट स्प्रिट, व्हिस्की, रम, ब्राण्डी, जिन, बोदका, वाइन, मदिरा (लिक्युअर्स) और कम तीव्रता के मादक पेय सम्मिलित हैं;

(घ) "आबकारी वर्ष" का तात्पर्य एक अप्रैल से प्रारम्भ होकर आगामी कलेण्डर वर्ष के 31 मार्च तक चलने वाले वित्तीय वर्ष से है।

(घ) "आबकारी वर्ष" का तात्पर्य एक अप्रैल से प्रारम्भ होकर आगामी कलेण्डर वर्ष के 31 मार्च तक चलने वाले वित्तीय वर्ष से है;

(ङ) "परिवार" का तात्पर्य इसमें दम्पत्ति (पति या पत्नी), आश्रित पुत्र/पुत्रों, अविवाहित-पुत्री/पुत्रियॉं और आश्रित माता-पिता सम्मिलित हैं।

(ङ) "परिवार" का तात्पर्य इसमें दम्पत्ति (पति या पत्नी), आश्रित पुत्र/पुत्रों, अविवाहित-पुत्री/पुत्रियॉं और आश्रित माता-पिता सम्मिलित हैं;

(च) "प्रपत्र" का तात्पर्य इस नियमावली के साथ (च) "प्रपत्र" का तात्पर्य इस नियमावली के साथ संलग्न प्रपत्र से है।

संलग्न प्रपत्र से है;

(छ) "लाइसेंस प्राधिकारी" का तात्पर्य जिला के (छ) "लाइसेंस प्राधिकारी" का तात्पर्य जिला के कलेक्टर से है।

कलेक्टर से है;

(ज) "लाइसेंस फीस" का तात्पर्य अधिनियम की धारा 24-क के अधीन फुटकर बिक्री की दुकान से विदेशी मदिरा एवं वाइन की बिक्री के एकान्तिक विशेषाधिकार के लिए, राज्य सरकार के परामर्श से, आबकारी आयुक्त द्वारा समय-समय पर सम्पूर्ण आबकारी वर्ष या उसके आंशिक भाग के लिए लाइसेंस दिये जाने हेतु प्रतिफल फीस के रुप में ली जाने वाली नियत राशि से है।

परन्तु यदि ऐसी दुकान का व्यवस्थापन/ पुनव्र्यवस्थापन मध्य सत्र में अवशेष अवधि के लिये किया जाता है, तो दुकान के लिए लाइसेंस फीस की देयताआें का निर्धारण वर्ष की शेष आबकारी अवधि के समानुपातिक किया जायेगा।

एतदद्वारा प्रतिस्थापित नियम (झ) "प्रतिभूति धनराशि" का तात्पर्य लाइसेंस फीस के दस प्रतिशत के बराबर धनराशि से है, जो जिला आबकारी अधिकारी के पक्ष में गिरवीकृत सावधि जमा रसीद के माध्यम से अथवा ई-पेमेन्ट द्वारा जमा की जायेगी जो राज्य सरकार के समस्त दावों और देयों के अन्तिम निस्तारण के पश्चात्‌ वापस किये जाने योग्य है।

(झ) "प्रतिभूति धनराशि" का तात्पर्य लाइसेंस फीस के दस प्रतिशत के बराबर धनराशि से है, जो जिला आबकारी अधिकारी के पक्ष में गिरवीकृत सावधि जमा रसीद के माध्यम से अथवा ई-पेमेन्ट द्वारा जमा की जायेगी जो राज्य सरकार के समस्त दावों और देयों के अन्तिम निस्तारण के पश्चात्‌ वापस किये जाने योग्य है;

परन्तु नवीकरण की स्थिति में पूर्व में नगद या राष्ट्रीय बचत पत्र (एन0एस0सी0) के माध्यम से जमा की गयी प्रतिभूति तब तक मान्य होगी, जब तक इसकी वापसी न कर दी जाय।

(ञ) राज्य का तात्पर्य उत्तर प्रदेश राज्य से है। (ञ) राज्य का तात्पर्य उत्तर प्रदेश राज्य से है;

(ट) ''अतिरिक्त प्रतिफल शुल्क'' का तात्पर्य अधिकतम फुटकर मूल्य को 10 रूपये के अगले गुणक तक पूर्णाकिंत किये जाने के फलस्वरूप प्राप्त अन्तर की धनराशि से है, जो आसवनी स्तर पर देय होगी तथा आसवनी द्वारा थोक आपूर्तिकर्ता से एक्स-फैक्ट्री प्राइस के अतिरिक्त वसूली योग्य होगी तथा थोक लाइसेंसधारी द्वारा फुटकर लाइसेंसधारी से अधिकतम थोक मूल्य के अतिरिक्त वसूल की जा सकेगी।

(ठ) 'धरोहर धनराशि' का तात्पर्य लाइसेंस की स्वीकृति के लिये पात्रता की शर्तों की पूर्ति सुनिश्चित किये जाने के लिये आवेदन पत्र के साथ जमा की जाने वाली लाइसेंस फीस की धनराशि के 1/10 वेें भाग के बराबर धनराशि से है, जो व्यतिक्रम की दशा में इस नियमावली के नियम-12 के उपबन्धों के अधीन जब्त किये जाने योग्य होगी।

(ड) 'अनुक्रम' का तात्पर्य ई-लाटरी प्रक्रिया के माध्यम से लाइसेंसधारी के चयन के लिये आधार के रुप में तात्पर्यित दुकानों की धरोहर धनराशि के अवरोही क्रम से है।

(ढ़) ''पोर्टल'' का तात्पर्य विशेष रूप से निर्मित इलेक्ट्रानिक प्लेटफार्म, जिस पर मदिरा निर्माण की प्रक्रिया से सम्बन्घित इसके वितरण के समाप्य अवस्था तक की सूचनाओं को विहित प्रारूप में अपलोड किया जायेगा, से है (ण) ''ऋणशोधन क्षमता'' का तात्पर्य फुटकर लाइसेंस की स्वीकृति के लिये आवेदन करने हेतु आवेदक के लिये निर्धारित वित्तीय अर्हता के मानदण्ड से है।

(ण) ''ऋणशोधन क्षमता'' का तात्पर्य फुटकर लाइसेंस की स्वीकृति के लिये आवेदन करने हेतु आवेदक के लिये निर्धारित वित्तीय अर्हता के मानदण्ड से है।

(त) ''व्यक्ति'' का तात्पर्य ऐसे व्यक्ति से है जो आवेदन करने के समय इक्कीस वर्ष की आयु से अन्यून, भारत का नागरिक हो।

(त) ''व्यक्ति'' का तात्पर्य ऐसे व्यक्ति से है जो आवेदन करने के समय इक्कीस वर्ष की आयु से अन्यून, भारत का नागरिक हो4 उत्तर प्रदेश असाधारण गजट, 8 अप्रैल, 2021 ई0 विद्यमान नियम

एतदद्वारा प्रतिस्थापित नियम (थ) ''व्यवस्थापन'' का तात्पर्य नवीकरण, ई-लाटरी (थ) ''व्यवस्थापन'' का तात्पर्य नवीकरण, ई-लाटरी अथवा ई-टेण्डर के माध्यम से दुकानों के व्यवस्थापन अथवा पुनव्र्यवस्थापन से है, जो समाचार पत्र एवं आबकारी विभाग की वेबसाइट के माध्यम से पूर्व नोटिस एवं संसूचना देकर सप्ताह के किसी दिन में हो सकता है। आगामी वर्ष के लिये दुकानों का व्यवस्थापन विगत वित्तीय वर्ष की समाप्ति के पूर्व किया जा सकता है।

अथवा ई-टेण्डर के माध्यम से दुकानों के व्यवस्थापन अथवा पुनव्र्यवस्थापन से है, जो समाचार पत्र एवं आबकारी विभाग की वेबसाइट के माध्यम से पूर्व नोटिस एवं संसूचना देकर सप्ताह के किसी दिन में हो सकता है। आगामी वर्ष के लिये दुकानों का व्यवस्थापन विगत वित्तीय वर्ष की समाप्ति के पूर्व किया जा सकता है (द) ''प्रतिफल शुल्क'' का तात्पर्य अधिनियम की धारा 30 के अधीन विदेशी मदिरा और वाइन पर राज्य सरकार द्वारा यथानिर्धारित शुल्क से है, जो विदेशी मदिरा और वाइन की आपूर्ति से पूर्व लाइसेंसधारी द्वारा सरकारी कोषागार में जमा की जाएगी।

(द) ''प्रतिफल शुल्क'' का तात्पर्य अधिनियम की धारा 30 के अधीन विदेशी मदिरा और वाइन पर राज्य सरकार द्वारा यथानिर्धारित शुल्क से है, जो विदेशी मदिरा और वाइन की आपूर्ति से पूर्व लाइसेंसधारी द्वारा सरकारी कोषागार में जमा की जाएगी।

(ध) ''कम तीव्रता के मादक पेय (एल0ए0बी0)'' का तात्पर्य कारबोनेट युक्त मादक पेय से है, जिसमें 5 प्रतिशत वी/वी तक तीव्रता और 5 प्रतिशत वी/वी से अधिक 10 प्रतिशत वी/वी तक तीव्रता एल्कोहल हो, जो एक्सट्रा न्यूट्रल अल्कोहल (ई0एन0ए0) से निर्मित की गई हो और जो वासक या रंजक द्रव्य या दोनों या अन्य किसी द्रव्य को मिलाकर परिष्कृत की गयी हो जिससे कि वह विशिष्ट स्वाद वाली हो जाय ;

(न) ''त्रैमासिक न्यूनतम प्रत्याभूत राजस्व'' का तात्पर्य आबकारी आयुक्त द्वारा जारी सामान्य या विनिर्दिष्ट अनुदेशों के अनुसार लाइसेंस प्राधिकारी द्वारा यथा नियत और लाइसेंसधारी द्वारा फुटकर बिक्री के प्रयोजनार्थ आबकारी वर्ष के त्रैमास में अपनी फुटकर दुकान के लिये उठाये जाने हेतु प्रत्याभूत विदेशी मदिरा, वाइन और कम तीव्रता के मादक पेय से प्राप्त समान राजस्व से है।

(2) इस नियमावली में अपरिभाषित किन्तु अधिनियम में परिभाषित शब्दों और पदों के वही अर्थ होंगे जो अधिनियम में क्रमशः उनके लिए समनुदेशित हों।

(2) इस नियमावली में अपरिभाषित किन्तु अधिनियम में परिभाषित शब्दों और पदों के वही अर्थ होंगे जो अधिनियम में क्रमशः उनके लिए समनुदेशित हों। 3- विद्यमान नियम

एतदद्वारा प्रतिस्थापित नियम नियम-13 शराब का उठान-(क) इस नियमावली के अधीन लाइसेंसधारी विदेशी शराब (वाइन सहित) के लागत मूल्य का पूर्ण भुगतान, जिसके अन्तर्गत सभी कर, प्रतिफल शुल्क (अतिरिक्त प्रतिफल शुल्क सहित) जो समय-समय पर उदग्रहीत किये जाय, अधिमानतः

नियम-13 शराब का उठान-(क) इस नियमावली के अधीन लाइसेंसधारी विदेशी शराब (वाइन सहित) के लागत मूल्य का पूर्ण भुगतान, जिसके अन्तर्गत सभी कर, प्रतिफल शुल्क (अतिरिक्त प्रतिफल शुल्क सहित) जो समय-समय पर उदग्रहीत किये जाय, अधिमानतः5 उत्तर प्रदेश असाधारण गजट, 8 अप्रैल, 2021 ई0 एतदद्वारा प्रतिस्थापित नियम ई-पेमेन्ट प्लेटफार्म के माध्यम से जमा करने के पश्चात्‌ जिला के किसी थोक लाइसेंसधारी ( विदेशी मदिरा-2/ विदेशी मदिरा-2बी) से आपूर्ति प्राप्त करेगा। यदि सम्बन्धित जिला में विदेशी मदिरा-2/विदेशी मदिरा-2बी का लाइसेंस स्वीकृत नहीं है या आपूर्ति बाधित है तोे लाइसेंसधारी, आबकारी आयुक्त की पूर्वानुमति से अन्य जिला/जिलों के थोक बिक्री लाइसेंसधारी (विदेशी मदिरा-2/विदेशी मदिरा-2बी) से विदेशी शराब (वाइन सहित) की आपूर्ति प्राप्त करेगा।

विद्यमान नियम ई-पेमेन्ट प्लेटफार्म के माध्यम से जमा करने के पश्चात्‌ जिला के किसी थोक लाइसेंसधारी (विदेशी मदिरा-2) से एवं जिला/प्रभार/राज्य के एफ0एल0-2डी लाइसेंसधारी से आयातित विदेशी मदिरा की आपूर्ति प्राप्त करेगा। यदि सम्बन्धित जिले में विदशी मदिरा-2 का लाइसेंस स्वीकृत नहीं है या आपूर्ति बाधित है तोे लाइसेंसधारी, आबकारी आयुक्त की पूर्वानुमति से अन्य जिला/जिलों के थोक बिक्री लाइसेंसधारी (विदेशी मदिरा-2) से विदेशी शराब (वाइन सहित) की आपूर्ति प्राप्त करेगा।

किसी जिला में अपर्याप्त आपूर्ति की स्थिति में जिला आबकारी अधिकारी, आबकारी आयुक्त से आदेश प्राप्त करेगा।

(ख) लाइसेंसधारी के लिए ग्राहकों की मौसमी आवश्यकताओं के अनुसार स्थिर तथा निरन्तर गुणवत्तापूर्ण आपूर्ति सुनिश्चित करने और साथ ही साथ बाजार में नकली आपूर्तियों के किन्ही अवसरों को दूर करने हेतु लगातार विदेशी मदिरा का उठान करना बाध्यकारी होगा। उसे निरन्तर पोर्टल पर लिखित मांगपत्र अथवा संदेश थोक विक्रेता को प्रस्तुत करना होगा। इस क्रम में उपरोक्त आवश्यकताओं की पूर्ति हेतु लाइसेंसधारी को कम से कम गत वर्ष के प्रत्येक त्रैमास में उठायी गयी विदेशी मदिरा की मात्रा निहित प्रतिफल शुल्क के बराबर की विदेशी मदिरा की मात्रा का उठान करना बाध्यकारी होगा।

(ख) लाइसेंसधारी के लिए ग्राहकों की मौसमी आवश्यकताओं के अनुसार स्थिर तथा निरन्तर गुणवत्तापूर्ण आपूर्ति सुनिश्चित करने और साथ ही साथ बाजार में नकली आपूर्तियों के किन्ही अवसरों को दूर करने हेतु लगातार विदेशी मदिरा का उठान करना बाध्यकारी होगा। उसे निरन्तर पोर्टल पर लिखित मांगपत्र अथवा संदेश थोक विक्रेता को प्रस्तुत करना होगा। इस क्रम में उपरोक्त आवश्यकताओं की पूर्ति हेतु लाइसेंसधारी को कम से कम गत वर्ष के प्रत्येक त्रैमास में उठायी गयी विदेशी मदिरा की मात्रा में निहित प्रतिफल शुल्क के बराबर की विदेशी मदिरा की मात्रा का उठान करना बाध्यकारी होगा।

(ग) (एक) यदि लाइसेंसधारी किसी त्रैमास में कम से कम अपने त्रैमासिक न्यूनतम प्रत्याभूत राजस्व के समतुल्य मदिरा (विदेशी मदिरा, वाइन एवं कम तीव्रता के मादक पेय का उठान करने में विफल रहता है, तो अगले त्रैमास हेतु उठान रोक दी जायेगी।

(दो) लाइसेंसधारी विलम्बमर्षण हेतु एवं उस त्रैमास के त्रैमासिक न्यूनतम प्रत्याभूत राजस्व में कमी के समतुल्य मदिरा उठाने के लिए एक शपथ पत्र के साथ अनुरोध करेगा। विलम्ब मर्षित किये जाने पर लाइसेंसधारी, त्रैमासिक न्यूनतम प्रत्याभूत राजस्व में कमी के समतुल्य अतिरिक्त प्रतिभूति जमा करेगा।

(तीन) इस प्रकार जमा की गयी अतिरिक्त प्रतिभूति, अगले त्रैमास के त्रैमासिक न्यूनतम प्रत्याभूत राजस्व सहित गत त्रैमास में इस प्रकार हुयी कमी के बराबर मदिरा का उठान किये जाने के पश्चात्‌ वापस कर दी जायेगी।6 उत्तर प्रदेश असाधारण गजट, 8 अप्रैल, 2021 ई0 विद्यमान नियम

एतदद्वारा प्रतिस्थापित नियम

(चार) यदि लाइसेंसधारी वित्तीय वर्ष की समाप्ति से पहले एक या अधिक त्रैमासों की त्रैमासिक न्यूनतम प्रत्याभूत राजस्व के बराबर मदिरा का उठान करने में विफल रहता है तो उसके द्वारा जमा की गयी अतिरिक्त प्रतिभूति एवं प्रतिभूति को राजस्व की ऐसी कमी के सापेक्ष समायोजित कर ली जायेगी और शेष प्रतिभूति वापस कर दी जायेगी।

यदि जमा की गयी अतिरिक्त प्रतिभूति और प्रतिभूति राजस्व में कमी के सापेक्ष समायोजन के लिए अपर्याप्त हो तो शेष राजस्व की वसूली उस प्रकार से की जायेगी मानों यह भू-राजस्व का बकाया हो।

(घ) (एक) त्रैमासिक न्यूनतम प्रत्याभूत राजस्व, जिसे वह उठाने में सक्षम न हो, उसी प्रकार के अन्य लाइसेंसधारी को अन्तरित करना चाहने वाले लाइसेंसधारी को, किसी आबकारी जिला के भीतर त्रैमासिक आधार पर ऐसे अंश (कोटा) का अंतरण करने की अनुज्ञा प्रदान की जा सकती है।

(दो) अंतरणकर्ता लाइसेंसधारी, अंतरिती लाइसेंसधारी की सहमति से जिला के जिला आबकारी अधिकारी से अनुरोध करेगा। अंतरण की निबन्धनाें का विनिश्चय, दोनों अंतरणकर्ता और अंतरिती लाइसेंसधारियों द्वारा पारस्परिक रुप से किया जायेगा।

(तीन) अंतरणकर्ता लाइसेंसधारी के अनुरोध का अनुमोदन किये जाने पर उसके द्वारा अंतरित किये जाने हेतु करारकृत कोटा को उसके मासिक न्यूनतम प्रत्याभूत राजस्व में से घटा दिया जायेगा और उसे उठा लिया गया समझा जायेगा तथा उसे अंतरिती लाइसेंधारी के लेेखा में अंतरित मासिक न्यूनतम प्रत्याभूत राजस्व के रुप में जोड़ दिया जायेगा। यह मात्रा अंतरिती लाइसेंसधारी के मूल मासिक न्यूनतम प्रत्याभूत राजस्व के अतिरिक्त होगी और उसका मूल कोटा उठाये जाने से सम्बन्धित उसका दायित्व प्रभावित नहीं होगा।

(चार) राज्य सरकार के पूर्व अनुमोदन से आबकारी आयुक्त द्वारा यथाविहित कोटा अंतरण फीस, अंतरणकर्ता लाइसेंसधारी द्वारा ऐसा अनुरोध किये जाने के समय संदेय होगी। परन्तु यह कि इस उपबन्ध के अधीन अंतरित कुल कोटा, अंतरणकर्ता लाइसेंसधारी के त्रैमासिक न्यूनतम प्रत्याभूत राजस्व के 20 प्रतिशत से अधिक नहीं होगा। उसी प्रकार से, अंतरिती लाइसेंसधारी अपने त्रैमासिक न्यूनतम प्रत्याभूत राजस्व के 20 प्रतिशत से अधिक ऐसा अंतरित कोटा प्राप्त करने का हकदार नहीं होगा।7 उत्तर प्रदेश असाधारण गजट, 8 अप्रैल, 2021 ई0 4- - - -उक्त नियमावली में, नीचे स्तम्भ-1 में दिये गये विद्यमान प्रपत्र एफ0एल0-5 (घ) और एफ0एल0 5घ (1) के स्थान पर स्तम्भ-2 में दिये गये प्रपत्र रख दिये जायेंगे, अर्थात्‌- विद्यमान नियम विदेशी मदिरा-5 (घ)

एतदद्वारा प्रतिस्थापित नियम 7-लाइसेंसधारी विहित प्रपत्र और रजिस्टर (एफ0एल0-25ए) जो लाइसेंस प्राधिकारी के द्वारा विहित किया गया हो, में नियमित और सही-सही दैनिक लेखा रखेगा एवं एस.एम.एस. के माध्यम से यूपीएक्साइज.इन पोर्टल पर अपलोड करेगा और जब कभी सक्षम निरीक्षण प्राधिकारी द्वारा मांगा जायेगा, तो लेखा रजिस्टर को प्रस्तुत करेगा और निरीक्षण प्राधिकारी द्वारा यथा अपेक्षित सामग्री और दस्तावेजों को उपलब्ध करायेगा।

7-लाइसेंसधारी विहित प्रपत्र और रजिस्टर (एफ0एल0-25ए) जो लाइसेंस प्राधिकारी के द्वारा विहित किया गया हो, में नियमित और सही-सही दैनिक लेखा रखेगा एवं एस.एम.एस. के माध्यम से यूपीएक्साइज.इन पोर्टल पर अपलोड करेगा और जब कभी सक्षम निरीक्षण प्राधिकारी द्वारा मांगा जायेगा, तो लेखा रजिस्टर को प्रस्तुत करेगा और निरीक्षण प्राधिकारी द्वारा यथा अपेक्षित सामग्री और दस्तावेजों को उपलब्ध करायेगा। 8-लाइसेंसधारी विदेशी मदिरा (वाइन सहित) की सम्पूर्ण मात्रा का भण्डारण केवल लाइसेंस प्राप्त परिसर में ही करेगा। उससे ट्रैक एण्ड ट्रेस प्रणाली के अन्तर्गत विहित सुरक्षा कोड के अनुसार बोतलों/कैन्स/टेट्रापैक की स्कैनिंग के लिए दुकान पर यथाविनिर्दिष्ट पी0ओ0एस0 (प्वाइंट ऑफ सेल) यंत्र रखने की अपेक्षा की जायेगी।

8-लाइसेंसधारी विदेशी मदिरा (वाइन सहित) की सम्पूर्ण मात्रा का भण्डारण केवल लाइसेंस प्राप्त परिसर में ही करेगा। उससे ट्रैक एण्ड ट्रेस प्रणाली के अन्तर्गत विहित सुरक्षा कोड के अनुसार बोतलों/कैन्स/टेट्रापैक की स्कैनिंग के लिए दुकान पर यथाविनिर्दिष्ट पी0ओ0एस0 (प्वाइंट ऑफ सेल) यंत्र रखने की अपेक्षा की जायेगी।

9-लाइसेंसधारी दुकान के प्रवेश द्वार पर आबकारी आयुक्त द्वारा अनुमोदित प्रपत्र/आकार का एक सहज दृश्य साइन बोर्ड लगाएगा, जिसके ऊपर लाइसेंसधारी का नाम, दुकान की अवस्थिति, लाइसेंस की अवधि, दुकान खुलने व बन्द होने का समय और लाइसेंस प्राधिकारी द्वारा यथा विहित अन्य सूचनाएॅं भी मोटे अक्षरों में मुद्रित की जायेंगी। साइन बोर्ड में निम्नलिखित सूचना को प्रदर्शित करना होगा-

9-लाइसेंसधारी दुकान के प्रवेश द्वार पर आबकारी आयुक्त द्वारा अनुमोदित प्रपत्र/आकार का एक सहज दृश्य साइनबोर्ड लगाएगा, जिसके ऊपर लाइसेंसधारी का नाम, दुकान की अवस्थिति, लाइसेंस की अवधि, दुकान खुलने व बन्द होने का समय और लाइसेंस प्राधिकारी द्वारा यथा विहित अन्य सूचनाएॅं भी मोटे अक्षरों में मुद्रित की जायेंगी। साइन बोर्ड में निम्नलिखित सूचना को प्रदर्शित करना होगा-

**> दुकान के बाहर, आस-पास या सार्वजनिक स्थान पर शराब पीना वर्जित है। इस संबंध में कोई भी उल्लंघन दण्डनीय होगा।

**> दुकान के बाहर आस-पास या सार्वजनिक स्थान पर शराब पीना वर्जित है। इस संबंध में कोई भी उल्लंघन दण्डनीय होगा। > शराब पीकर गाड़ी चलाना जानलेवा हो > शराब पीकर गाड़ी चलाना जानलेवा हो

सकता है। कृपया शराब पीकर गाड़ी न चलायें।'' सकता है। कृपया शराब पीकर गाड़ी न चलायें।'' 10-लाइसेंसधारी किसी भी व्यक्ति को विक्रेता के रूप में सेवायोजित नहीं करेगा जो 21 वर्ष से कम आयु का हो या किसी संक्रामक रोग और या छुआ-छूत से ग्रस्त हो या आपराधिक पृष्ठभूमि का हो या महिला हो। लाइसेंसधारी को जिला आबकारी अधिकारी द्वारा निर्गत विक्रेता का फोटोयुक्त पहचान पत्र प्राप्त करना होगा तथा जब निरीक्षण प्राधिकारियों द्वारा मांगा जाये तब उसे प्रस्तुत करना अनिवार्य होगा।

10-लाइसेंसधारी किसी भी व्यक्ति को विक्रेता के रूप में सेवायोजित नहीं करेगा, जो 21 वर्ष से कम आयु का हो या किसी संक्रामक रोग और या छुआ-छूत से ग्रस्त हो या आपराधिक, पृष्ठभूमि का हो या महिला हो। लाइसेंसधारी को जिला आबकारी अधिकारी द्वारा निर्गत बिक्रेता का फोटोयुक्त पहचान पत्र प्राप्त करना होगा तथा जब निरीक्षण प्राधिकारियों द्वारा मांगा जाये तब उसे प्रस्तुत करना अनिवार्य होगा।

11-लाइसेंसधारी किसी भी के्रता को 6 लीटर 11-लाइसेंसधारी किसी के्रता को विदेशी मदिरा, व्हिस्की, ब्राण्डी, रम(व्हाइट रम सहित), जिन, वोदका, वाइन, एल0ए0बी0 (कम तीव्रता के मादक पेय) और भारत में बोतल भराई की गयी और एक ही समय में पृथक-पृथक आयातित अन्य प्रकार की मदिरा की अधिसूचित मात्रा से अधिक मात्रा में बिक्री किसी अनुज्ञापत्र के बिना नहीं करेगा।

भारत में भरी हुई (बी आई आई) व 6 लीटर आयातित विदेशी मदिरा प्रत्येक अलग-अलग जिसमें व्हिस्की, ब्राण्डी, रम (व्हाइट रम सहित) जिन व वोदका सम्मिलित है; 3 लीटर भारत में भरी हुई व आयातित वाइन दोनों अलग-अलग तथा 2 लीटर अन्य भारतीय व आयातित मदिरा से अधिक मात्रा की फुटकर बिक्री एक बार में नहीं करेगा, जब तक अन्यथा अनुमति प्राप्त न हो।उत्तर प्रदेश असाधारण गजट, 8 अप्रैल, 2021 ई0 11 विद्यमान नियम

एतदद्वारा प्रतिस्थापित नियम 12-उप निरीक्षक की श्रेणी से नीचे के पुलिसकर्मी या सैनिक या वर्दी में किसी सरकारी कर्मी या 21 वर्ष से कम आयु के व्यक्तियों को बिक्री नहीं करेगा।

14-लाइसेंसधारी अपने लाइसेंस प्राप्त परिसर में कोई भी स्प्रिट, दुग्ध, शर्करा (चाश्नी), रंग, सुगंधि (अर्क), सुरक्षा कोड निर्माण करने वाले यंत्र, लेबुल, कैप्सूल, मुहर या कोई अपायकर सामग्री नहीं रखेगा।

15-सिवाय लाइसेंसधारी/विक्रेता और उसके परिवार द्वारा, परिसर, जिसमे दुकान स्थित है, का प्रयोग आवास के स्थान के रूप में नहीं करेगा।

17-लाइसेंस प्राप्त परिसर, 14 अप्रैल (अंबेडकर जयन्ती), 15 अगस्त (स्वतंत्रता दिवस), 2 अक्टूबर (गॉंधी जयन्ती), 26 जनवरी (गणतन्त्र दिवस) और तीन ऐसे अतिरिक्त दिनाें जैसा कि लाइसेंस प्राधिकारी द्वारा बन्दी के लिए अधिसूचित किया जाय, को छोड़कर बिक्री के लिए सभी दिवसों पर प्रातः 10 से रात्रि 10 बजे तक खुला रहेगा। लाइसेंस प्राधिकारी सुसंगत विधियों के अधीन कानून और व्यवस्था या सामान्य निर्वाचन से सम्बन्धित क्रियाकलापों आदि के कारण से भी दुकान की बन्दी के आदेश दे सकता है। उपरोक्त आधार पर दुकान की बन्दी के लिए कोई प्रतिकर नही प्रदान किया जायेगा।

17-लाइसेंस प्राप्त परिसर, 14 अप्रैल (आंबेडकर जयन्ती), 15 अगस्त (स्वतंत्रता दिवस), 2 अक्टूबर (गॉंधी जयन्ती), 26 जनवरी (गणतन्त्र दिवस) और तीन ऐसे अतिरिक्त दिनाें जैसा कि लाइसेंस प्राधिकारी द्वारा बन्दी के लिए अधिसूचित किया जाय, को छोड़कर बिक्री के लिए सभी दिवसों पर प्रातः 10 से रात्रि 10 बजे तक खुला रहेगा। लाइसेंस प्राधिकारी सुसंगत विधियों के अधीन कानून और व्यवस्था या सामान्य निर्वाचन से सम्बन्धित क्रिया कलापों आदि के कारण से भी दुकान की बन्दी के आदेश दे सकता है। उपरोक्त आधार पर दुकान की बन्दी के लिए कोई प्रतिकर नही प्रदान किया जायेगा।

18-विदेशी मदिरा की बिक्री को छोड़कर जिसके लिए कि लाइसेंस दिया गया है, लाइसेंसधारी को लाइसेंस प्राप्त परिसर में कोई अन्य व्यवसाय चलाने की अनुमति नहीं दी जायेगी।

19-लाइसेंसधारी लाइसेंस की समाप्ति पर अवशेष स्टाक के निस्तारण के लिए जिला आबकारी अधिकारी को रिपोर्ट करेगा, जिसे नियम-16 के अनुसार निस्तारित किया जायेगा।

यह लाइसेंस निम्नलिखित विशेष और सामान्य शर्तों के अधीन रहते हुए प्रदान किया जाता है, उनमेंं से किसी का व्यतिक्रम करने पर या संयुक्त प्रान्त आबकारी अधिनियम, 1910 और स्वापक ओषधि एवं मनः प्रभावी पदार्थ अधिनियम, 1985 के अधीन किसी अपराध के लिए दोष सिद्ध होने पर लाइसेंस धारक सुसंगत विधियों के अधीन अधिरोपित किन्हीं शास्तियों के अतिरिक्त अपने लाइसेंस और प्रतिभूति निक्षेप का समपहरण किए जाने के लिए दायी होगा।

यह लाइसेंस निम्नलिखित विशेष और सामान्य शर्तों के अधीन रहते हुए प्रदान किया जाता है, उनमेंं से किसी का व्यतिक्रम करने पर या संयुक्त प्रान्त आबकारी अधिनियम-1910 और स्वापक ओषधि एवं मनः प्रभावी पदार्थ अधिनियम 1985 के अधीन किसी अपराध के लिए दोष सिद्ध होने पर लाइसेंस धारक सुसंगत विधियों के अधीन अधिरोपित किन्हीं शास्तियों के अतिरिक्त अपने लाइसेंस और प्रतिभूति निक्षेप का समपहरण किए जाने के लिए दायी होगा। 1-लाइसेंसधारी, जिला के विदेशी मदिरा थोक लाइसेंसधारी (विदेशी मदिरा-2/विदेशी मदिरा-2बी) से विदेशी मदिरा (वाइन सहित) की आपूर्ति अधिमानतः ई पेमेन्ट के माध्यम से समय-समय पर उदग्रहणीय समस्त करों, प्रतिफल फीस, उपकर आदि को सम्मिलित करते हुए मदिरा की कीमत का पूर्ण भुगतान करने के पश्चात्‌ प्राप्त कर सकेगा। यदि सम्बन्धित जिला में विदेशी मदिरा-2/विदेशी मदिरा-2बी) लाइसेंस स्वीकृत नहीं है, तो लाइसेंसधारी आबकारी आयुक्त की पूर्वानुमति से अन्य जिला/जिलों के थोक लाइसेंसधारी (विदेशी मदिरा-2/ विदेशी मदिरा-2बी) से विदेशी शराब (वाइन सहित) की आपूर्ति प्राप्त करेगा।

1-लाइसेंसधारी, जिला के विदेशी मदिरा थोक लाइसेंसधारी (विदेशी मदिरा-2) एवं जिला/ प्रभार/ राज्य के एफ0एल0-2डी लाइसेंसधारी से विदेशी मदिरा (वाइन सहित) की आपूर्ति अधिमानतः ई पेमेन्ट के माध्यम से समय-समय पर उदग्रहणीय समस्त करों, प्रतिफल फीस, उपकर आदि को सम्मिलित करते हुए मदिरा की कीमत का पूर्ण भुगतान करने के पश्चात्‌ प्राप्त कर सकेगा। यदि सम्बन्धित जिला में विदेशी मदिरा-2 लाइसेंस स्वीकृत नहीं है, तो लाइसेंसधारी आबकारी आयुक्त की पूर्वानुमति से अन्य जिला/जिलों के थोक लाइसेंसधारी (विदेशी मदिरा-2) से विदेशी शराब (वाइन सहित) की आपूर्ति प्राप्त करेगा।14 उत्तर प्रदेश असाधारण गजट, 8 अप्रैल, 2021 ई0 2-लाइसेंसधारी अपर्याप्त आपूर्ति की स्थिति में जिला आबकारी अधिकारी को अवगत करायेगा, जो आबकारी आयुक्त से आदेश प्राप्त करेगा।

2-लाइसेंसधारी अपर्याप्त आपूर्ति की स्थिति में जिला आबकारी अधिकारी को अवगत करायेगा, जो आबकारी आयुक्त से आदेश प्राप्त करेगा। 3-विदेशी मदिरा एवं वाइन की बोतलों/कैन्स/ टेट्रापैक्स के लेबुलों पर अधिकतम्‌ फुटकर मूल्य मुद्रित किया जायेगा। फुटकर लाइसेंसधारी छपे हुए अधिकतम्‌ फुटकर मूल्य से अधिक नहीं वसूल करेगा।

3-विदेशी मदिरा एवं वाइन की बोतलों कैन्स/ टेट्रापैक्स के लेबुलों पर अधिकतम्‌ फुटकर मूल्य मुद्रित किया जायेगा। फुटकर लाइसेंसधारी छपे हुए अधिकतम्‌ फुटकर मूल्य से अधिक नहीं वसूल करेगा। 4-लाइसेंस प्राप्त परिसर पर बिक्री केवल परिसर के बाहर उपभोग के लिए की जायेगी। कोई भी मदिरा परिसर में उपभोग नहीं की जायेगी।

4-अनुज्ञप्ति प्राप्त परिसर पर बिक्री केवल परिसर के बाहर उपभोग के लिए की जायेगी। कोई भी मदिरा परिसर में उपभोग नहीं की जायेगी।

5-किसी भी व्यक्ति को 60 मि0ली0 की एक मानक पौवा बोतल से कम मात्रा की धारिता में विदेशी मदिरा की बिक्री नहीं की जायेगी।

6-विहित तीव्रता और मात्रा की विदेशी मदिरा एवं वाइन की मानक धारिता की मुहरबन्द बोतलों/कैन्स/ टेट्रापैक में अर्थात्‌ 2000 मि.ली., 1000 मि.ली., 750 मि. ली., 500 मि.ली., 375 मि.ली., 180 मि.ली. सहित 90 मि. ली. (रेगुलर एवं उसके ऊपर की श्रेणियों में) तथा 60 मि.ली. (प्रीमियम और उसके ऊपर की श्रेणियों में) शीशे की बोतलों के साथ-साथ सिरोंग पैक में और विदेशी मदिरा एवं वाइन की सुसंगत नियमावलियों में निर्धारित धारिता में बिक्री की जायेगी और जिन पर शुल्क के भुगतान के प्रमाण के रूप में आबकारी विभाग द्वारा अनुमोदित सुरक्षा कोड चस्पा हो।

9-लाइसेंसधारी दुकान के प्रवेश द्वार पर आबकारी आयुक्त द्वारा अनुमोदित प्रपत्र/आकार का एक सहज दृश्य साइनबोर्ड लगाएगा, जिसके ऊपर लाइसेंसधारी का नाम, दुकान की अवस्थिति, लाइसेंस की अवधि, दुकान खुलने व बन्द होने का समय और लाइसेंस प्राधिकारी द्वारा यथा विहित अन्य सूचनाएॅं भी मोटे अक्षरों में मुद्रित की जायेंगी। साइन बोर्ड में निम्नलिखित सूचना को प्रदर्शित करना होगाः-

**> दुकान के बाहर आस-पास या सार्वजनिक स्थान पर शराब पीना वर्जित है। इस संबंध में कोई भी उल्लंघन दण्डनीय होगा।

10-लाइसेंसधारी किसी भी व्यक्ति को विक्रेता के रूप में सेवायोजित नहीं करेगा, जो 21 वर्ष से कम आयु का हो या किसी संक्रामक रोग और या छुआ-छूत से ग्रस्त हो या आपराधिक, पृष्ठभूमि का हो या महिला हो। लाइसेंसधारी को जिला आबकारी अधिकारी द्वारा निर्गत विक्रेता का फोटोयुक्त पहचान पत्र प्राप्त करना होगा तथा जब निरीक्षण प्राधिकारियों द्वारा मांगा जाये तब उसे प्रस्तुत करना अनिवार्य होगा।

11-लाइसेंसधारी किसी भी के्रता को 6 लीटर 11-लाइसेंसधारी किसी के्रता को विदेशी मदिरा, भारत में भरी हुई (बी आई आई) व 6 लीटर आयातित व्हिस्की, ब्राण्डी, रम(व्हाइट रम सहित), जिन, वोदका, विदेशी मदिरा प्रत्येक अलग-अलग जिसमें व्हिस्की, वाइन, एल0ए0बी0 (कम तीव्रता के मादक पेय) और ब्राण्डी, रम (व्हाइट रम सहित) जिन व वोदका सम्मिलित भारत में बोतल भराई की गयी और एक ही समय में है; 3 लीटर भारत में भरी हुई व आयातित वाइन दोनों पृथक-पृथक आयातित अन्य प्रकार की मदिरा की अलग-अलग तथा 2 लीटर अन्य भारतीय व आयातित अधिसूचित मात्रा से अधिक मात्रा में बिक्री किसी

अनुज्ञापत्र के बिना नहीं करेगा। मदिरा से अधिक मात्रा की फुटकर बिक्री एक बार में

नहीं करेगा, जब तक अन्यथा अनुमति प्राप्त न हो।

12-उप निरीक्षक की श्रेणी से नीचे के पुलिसकर्मी 12-उप निरीक्षक की श्रेणी से नीचे के पुलिसकर्मी

17-लाइसेंस प्राप्त परिसर, 14 अप्रैल (अंबेडकर जयन्ती), 15 अगस्त (स्वतंत्रता दिवस), 2 अक्टूबर (गॉंधी जयन्ती), 26 जनवरी (गणतन्त्र दिवस) और तीन ऐसे अतिरिक्त दिनाें जैसा कि लाइसेंस प्राधिकारी द्वारा बन्दी के लिए अधिसूचित किया जाय, को छोड़कर बिक्री के लिए सभी दिवसों पर प्रातः 10 से रात्रि 10 बजे तक खुला रहेगा। लाइसेंस प्राधिकारी सुसंगत विधियों के अधीन कानून और व्यवस्था या सामान्य निर्वाचन से सम्बन्धित क्रियाकलापों आदि के कारण से भी दुकान की बन्दी के आदेश दे सकता है। उपरोक्त आधार पर दुकान की बन्दी के लिए कोई प्रतिकर नहीं प्रदान किया जायेगा।

NOTIFICATION

In exercise of the powers under sections 24-B and 41 of the United Provinces Excise Act, 1910 (U.P. Act no-IV of 1910), read with section 21 of the Uttar Pradesh General Clauses Act, 1904 (U.P. Act no.1 of 1904), the Excise Commissioner, Uttar Pradesh with the previous sanction of the State Government hereby makes the following rules with a view to amending the Uttar Pradesh Excise Settlement of licences for Retail Sale of Foreign Liquor (Excluding Beer and Wine) Rules, 2001 published vide Excise Commissioner notification no. 10806/X- 97B/Sansdhan dated March 08, 2001 (as amended time to time).

THE UTTAR PRADESH EXCISE SETTLEMENT OF LICENCES FOR RETAIL SALE OF FOREIGN LIQUOR (EXCLUDING BEER) (NINETEENTH AMENDMENT) RULES, 2021.

1. Short title and commencement–(1) These rules may be called the Uttar Pradesh Excise Settlement of Licenses for Retail Sale of Foreign Liquor) (Excluding Beer) (Nineteenth Amendment) Rules, 2021.

(2) They shall come into force with effect from the date of their publication in the Gazette.

2. Amendment of rule-2–In the Uttar Pradesh Excise Settlement of Licenses for Retail Sale of Foreign Liquor) (Excluding Beer) (Nineteenth Amendment) Rules, 2001, hereinafter referred to as the said rules, for rule-2 set out in Column-I below, the rule as set out in Column-II shall be substituted, namely:-

In these rules, unless there is anything repugnant in the subject or context:-

(d) "Excise Year" means the financial year commencing from 1st April to 31st March of the next calendar year.

(e) "family" means and included spouse (husband or wife), dependent son (s), unmarried daughter (s) and dependent parents;

Provided that if such shop is settled/ re- settled during middle session for the remaining period of the year, then license fee for shop shall be determined in proportion to the remaining period of the excise year.

(i) "Security amount" means a sum equal to ten percent of the licence fee to be deposited through Fixed deposit receipt pledged in favor of District Excise Officer or through e- payment refundable after the final settlement of all the claims and dues to the State Government.

Provided that in case of renewal security deposited prior in cash or through National Saving Certificate (N.S.C.) shall be acceptable till it is not refunded.

(j) "State" means the State of Uttar Pradesh.

(k) "Additional Consideration fee" means difference amount obtained as a result of rounding off the maximum retail price of foreign liquor to the next multiple of ten rupees, which shall be payable at Distillery level and recoverable by distillery from wholesale supplier in addition to Ex-Distillery Price and which in turn could be recovered by wholesale supplier from retail licensee in addition to maximum wholesale price.

(k) "Additional Consideration fee" means difference amount obtained as a result of rounding off the maximum retail price of foreign liquor to the next multiple of ten rupees, which shall be payable at Distillery level and recoverable by distillery from wholesale supplier in addition to Ex- Distillery Price and which in turn could be recovered by wholesale supplier from retail licensee in addition to maximum wholesale price.

(l) "Earnest money" means the amount equal to 1/10 of the amount of licence fee, to be tendered with application form, for ensuring the fulfillment of the eligibility conditions for the grant of licence and is liable to be forfeited in case of default under provisions of rule-12 of these Rules.

(p) 'Individual' means a person who is the citizen of India not below the age of twenty-one years at the time of application.

(q) "Settlement" means settlement or re-settlement of shops through renewal, e-lottery or e- tender which may take place on any day of the week by giving prior notice and intimation through the newspaper and website of the excise department. The settlement of shops for the forthcoming year may also be done prior to the cessation of preceding financial year.

(s) "Low-strength Alcoholic Beverages (LAB)" means the carbonated alcoholic beverages having alcohol up to 5% v/v and above 5% v/v to 10% v/v manufactured from Extra Neutral alcohol (E.N.A.) and sophisticated by addition of flavoring or coloring matter or both and any other material so as to give it a special flavor. (t) "Quarterly Minimum Guaranteed Revenue" means the equivalent revenue from Foreign liquor, Wine and LAB as fixed by the licensing authority in accordance with the general or specific instructions issued by the Excise Commissioner and guaranteed by the licensee to be lifted by him for his retail shop during a quarter of an Excise year for the purpose of retail sale.

(2) Words and expressions not defined in these rules but defined in the Act shall have the meanings respectively assigned to them in the Act.

3. Amendment of rule-13--In the said rules, for existing rule-13 set out in Column-I below, the the rule as setout in Column-II shall be substituted, namely:-

Form as hereby substituted 13-Lifting of liquor- The licensee under these rules shall obtain supplies of foreign liquor including wine from any wholesale licence (F.L.2) of the districts & FL-2D of district/charge/state after making full payment of cost price of Foreign Liquor including all Taxes, Consideration fee (including additional consideration fee) as levied from time to time preferably through e- payment platform. If the F.L.-2 licence is not sanctioned or supply interrupts in the concerned district, the licensee shall obtain supplies of foreign liquor including wine from wholesale licence (F.L.2) of other district/districts with prior permission of the Excise Commissioner

13-Lifting of liquor- The licensee under these rules shall obtain supplies of Foreign liquor including Wine from any wholesale licence (F.L.2/ F.L.2B) of the district after making full payment of cost price of Foreign Liquor, including all Taxes, Consideration fee (including additional consideration fee) as levied from time to time preferably through e- payment platform. If the F.L.-2 /F.L.2B licence is not sanctioned or supply interrupts in the concerned district, the licensee shall obtain supplies of Foreign liquor including wine , from wholesale licence (F.L.2/ F.L.2B) of other district/districts with prior permission of the Excise Commissioner

In case of insufficient supply of any district, District excise officer shall seek the orders from Excise Commissioner.

In order to meet the above requirements the licensee shall be under obligation to lift in each quarter foreign liquor, at least equivalent to the consideration fee involved in the quantity of foreign liquor lifted in the preceding year.''

(b) "Licensee shall be under obligation to regularly lift Foreign liquor to ensure steady and continuous quality supply as per seasonal, requirements of the customers as well as to remove any chances of spurious supplies in the market. He shall regularly place written indents on portal or, message to the wholesaler. In order to meet the above requirements the licensee shall be under obligation to lift in each quarter foreign liquor, at least equivalent to the consideration fee involved in the quantity of foreign liquor lifted in the preceding year.''

(C)(i) Provided, In case the licensee fails to lift liquor (foreign liquor, wine and LAB) at least equivalent to his Quarterly Minimum Guaranteed Revenue in a quarter, lifting for the next quarter shall be withheld.

(ii) The licensee shall make a request for condonation of delay and for lifting of liquor equivalent to the shortfall in Quarterly Minimum Guaranteed Revenue of that quarter along with an affidavit. Upon condonation, the licensee shall deposit an additional security equivalent to the shortfall in Quarterly Minimum Guaranteed Revenue. (iii) Additional security so deposited shall be refunded after lifting of liquor equivalent to such shortfall in previous quarter along with Quarterly Minimum Guaranteed Revenue of the next quarter.

(iv) In case licensee fails to lift liquor equivalent to the Quarterly Minimum Guaranteed Revenue of one or more quarters before the end of financial year, then the additional security and security deposited by him shall be adjusted against such shortfall of revenue and the remaining security shall be refunded.

If the additional security and security deposited is insufficient for adjustment against the shortfall in revenue, the revenue remaining shall be recovered as if it were arrears of land revenue .

(d)(i) The licensee desiring to transfer Quarterly Minimum Guaranteed Revenue, which he is not able to lift, to another licensee of the same type, may be allowed such transfer of such portion(quota) on a quarterly basis, within an excise district.

(ii) The transferor licensee shall make a request along with the consent of the transferee licensee to the District Excise Officer of the district. The terms of transfer shall be decided by both the transferor and transferee licensees mutually.

(iii) On approval of the request of the transferor licensee, the quota agreed upon to be transferred by him shall be deducted from his Quarterly Minimum Guaranteed Revenue and shall be deemed to have been lifted and it will be added as a transfer Quarterly Minimum Guaranteed Revenue in the account of the transferee licensee. This quantity will be over and above the original Quarterly Minimum Guaranteed Revenue of the transferee licensee and his obligations regarding lifting of his original quota shall not be affected.

(iv) A quota transfer fee as prescribed by the Excise Commissioner with the previous approval of the State Government, shall be payable by the transferor licensee at the time of making such request.

Provided that the total quota transferred under this provision shall not exceed 20% of the Quarterly Minimum Guaranteed Revenue of the transferor licensee. Similarly, the transferee licensee shall not be entitled to receive such transferred quota, in excess of 20% of his Quarterly Minimum Guaranteed Revenue.

The sale shall be made in sealed bottles /cans/ tetra packs of standard capacity viz 2000ml, 1000ml, 750ml, 500ml, 375ml, 180ml including 90ml (in the categories of Regular and above ) and 60 ml (in the categories of Premium and above) in glass bottles along with syrong pack of Foreign liquor and Wine in capacities as provided in relevant rules of above mentioned capacities with prescribed strength and quantity and which is affixed with security code approved by Excise Department, as proof of payment of consideration fee.

7. The licensee shall maintain a regular and accurate daily account in the form and register (FL- 25A), as prescribed by the Licensing Authority and the account register shall be uploaded on the upexciseonline.in portal through sms produced for inspection whenever asked by the competent inspecting authority. The licensee shall also furnish account of sales etc. and facilitate and provide the material and documents as required by the inspecting authority.

GENERAL AND SPECIAL CONDITIONS GENERAL AND SPECIAL CONDITIONS 8. The licensee shall store entire stock of Foreign Liquor (including wine) in the licenced premises only. He shall be required to maintain requisite equipment for scanning of bottles/cans/tetra packs as per prescribed security code under the Track and Trace System.

9. The licensee shall affix conspicuous signboard at the entrance to the shop in the form/size approved by the Excise Commissioner on which the name of the licensee, designation, location of shop, period of license, opening and closing time of shop and such other information as prescribed by Licensing Authority in bold letters shall be printed.

The signboard will also display the following information :-

">Consumption of liquor is prohibited outside near the premises of shop or at public places. Any contravention in this regard shall be punishable.

>Drunken driving can be fatal, please do not drink and drive."

10. The licensee shall not employ any person as salesmen who is below 21 years of age or is suffering from any infectious and /or contagious diseases, or has criminal background or a woman. The Licensee shall have to obtain identity cards of the salesmen bearing their photographs duly issued by the District Excise Officer, which shall be produced as and when demanded by inspecting authorities.

11. Licensee shall not sell to any purchaser in quantity more than 6 litres of foreign liquor, Bottled In India (BII) and imported, each separately inclusive of whisky, brandy, rum (including white rum), gin and vodka; 3 litres of wine, bottled in India and imported separately; 2 litres of other kind of Indian/imported liquor at a time, except under a permit.

12. The sale should not be made to police personal below the rank of sub inspector or to a soldier or a official in uniform or persons below 21 years.

13. The licensee is strictly forbidden under any pretext whatsoever from tampering with bottles/cans/ tetrapacks in the prescribed capacity of 2000ml, 1000ml, 750ml, 500ml, 375ml, 180ml, 90ml and 60ml their labels and security Code affixed under security System, pilfer proof caps or seals etc.

The licensed premises shall remain open for sale on all days from 10 a.m. to 10 p.m. except on 14th April (Ambedkar Jayanti), 15th August (Independence Day), 2nd October (Gandhi Jayanti), 26th January (Republic Day), and upto 3 more days as notified for closure by the Licensing Authority. Licensing Authority may also order for closure of shop on account of law and order or General Election related activity under the provisions of relevant laws. No compensation shall be given for the closure of shop on above grounds.
