उत्तर प्रदेश साधारण खण्ड अधिनियम, 1904 (उत्तर प्रदेश अधिनियम संख्या 1 सन्‌ 1904) की धारा 21 के साथ पठित संयुक्त प्रान्त आबकारी अधिनियम, 1910 (अधिनियम संख्या 4 सन्‌ 1910) की धारा 24-ख और 41 के अधीन शक्तियों का प्रयोग करके, आबकारी आयुक्त, उत्तर प्रदेष राज्य सरकार की पूर्व स्वीकृति से आबकारी आयुक्त की अधिसूचना संख्या 17951/दस-लाइसेंस-33/एफ0एल0, माडल शाप/2003-04 दिनांक 03 सितम्बर, 2003 (समय- समय पर यथा संषोधित) द्वारा प्रकाषित उत्तर प्रदेष आबकारी (विदेषी मदिरा की माडल शाप के लिए फुटकर अनुज्ञापनों का व्यवस्थापन) नियमावली, 2003 में संषोधन करने की दृष्टि से निम्नलिखित नियमावली बनाते हैं :

(एक) यह नियमावली उत्तर प्रदेश आबकारी (विदेशी मदिरा की माडल शाप के

लिये अनुज्ञापनों का व्यवस्थापन) (चौदहवां संशोधन) नियमावली, 2021 कही जायेगी।

(दो) यह गजट में प्रकाषित किये जाने के दिनांक से प्रवृृत्त होगी।2 उत्तर प्रदेश असाधारण गजट, 8 अप्रैल, 2021 ई0 उत्तर प्रदेष आबकारी (विदेषी मदिरा की माडल शाप के लिये फुटकर अनुज्ञापनों का व्यवस्थापन) नियमावली, 2003, जिसे आगे उक्त नियमावली कहा गया है, में नीचे स्तम्भ-1 में दिये गये नियम-2 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात्‌-

विद्यमान नियम

एतद्‌द्वारा प्रतिस्थापित नियम 2-परिभाषाएं-

2-परिभाषाएं-

(1) जब तक विषय या संदर्भ से कोई बात प्रतिकूल न हो, इस नियमावली में-

(क) ''अधिनियम'' का तात्पर्य समय-समय पर यथा संषोधित संयुक्त प्रान्त आबकारी अधिनियम, 1910 से है;

(ख) "दैनिक लाइसेंस फीस" का तात्पर्य सम्पूर्ण वर्ष के लिए निर्धारित लाइसेंस फीस के 1/365 वें भाग से हैै।

(ग) ''विदेषी मदिरा'' का तात्पर्य भारत में आयातित स्प्रिट या मदिरा अथवा भारत में बनाई गई स्प्रिट या मदिरा से है और इस प्रकार परिष्कृत या रंजित स्प्रिट या मदिरा जिससे कि वह सुगंध या रंग में भारत में आयातित मदिरा के सदृश्य हो और उसमें माल्ट स्प्रिट, व्हिस्की, रम, ब्राण्डी, जिन, बोदका, वाइन और मदिरा (लिक्युअर) सम्मिलित हैं और इसमें भारत में किण्वित बीयर, ड्राट बीयर तथा कम तीब्रता के मादक पेय भी सम्मिलित है। (ग) ''विदेषी मदिरा'' का तात्पर्य भारत में आयातित स्प्रिट या मदिरा अथवा भारत में बनाई गई स्प्रिट या मदिरा से है और इस प्रकार परिष्कृत या रंजित स्प्रिट या मदिरा जिससे कि वह सुगंध या रंग में भारत में आयातित मदिरा के सदृश्य हो और उसमें माल्ट स्प्रिट, व्हिस्की, रम, ब्राण्डी, जिन, बोदका, वाइन और मदिरा (लिक्युअर) सम्मिलित हैं और इसमें भारत में किण्वित बीयर, ड्राट बीयर तथा कम ती ता के मादक पेय भी सम्मिलित है।

(घ) ''आबकारी वर्ष'' का तात्पर्य दिनांक एक अप्रैल से प्रारम्भ होकर आगामी कलेण्डर वर्ष के 31 मार्च तक चलने वाले वित्तीय वर्ष से है।

(ङ) ''परिवार'' का तात्पर्य इसमें दम्पति (पति या पत्नी), आश्रित पुत्र/पुत्रों, अविवाहित पुत्री/पुत्रियां और आश्रित माता-पिता सम्मिलित हैं।

(च) ''प्रपत्र'' का तात्पर्य इस निमयावली के साथ संलग्न (च) ''प्रपत्र'' का तात्पर्य इस निमयावली के साथ प्रपत्र से है।

(छ) ''लाइसेंस प्राधिकारी'' का तात्पर्य जिले के कलेक्टर (छ) ''लाइसेंस प्राधिकारी'' का तात्पर्य जिले के कलेक्टर से है।

(ज) ''लाइसेंस फीस'' का तात्पर्य किसी माडल शाप में विदेशी मदिरा, बियर, वाइन, कम तीव्र्रता के मादक पेय के विक्रय के लिये एकान्तिक विशेषाधिकार के लाइसेंस प्रदान करने के प्रतिफल स्वरुप निकायवार यथानियत किसी धनराशि से है और बार की सुविधायें प्रदान करने के लिये, समय समय पर निर्धारित अतिरिक्त लाइसेंस फीस इसमें सम्मिलित होगी।

एतद्‌द्वारा प्रतिस्थापित नियम (झ) "प्रतिभूति धनराशि" का तात्पर्य लाइसेंस फीस के (झ) "प्रतिभूति धनराशि" का तात्पर्य लाइसेंस फीस के अनुसार राज्य सरकार द्वारा यथा निर्धारित धनराशि से है, जो जिला आबकारी अधिकारी के पक्ष में गिरवीकृत सावधि जमा रसीद के माध्यम से अथवा ई-पेमेन्ट के माध्यम से जमा की जायेगी तथा जो राज्य सरकार के समस्त दावों और देयों के अन्तिम निस्तारण के पश्चात्‌ वापस किये जाने योग्य है।

अनुसार राज्य सरकार द्वारा यथा निर्धारित धनराशि से है, जो जिला आबकारी अधिकारी के पक्ष में गिरवीकृत सावधि जमा रसीद के माध्यम से अथवा ई-पेमेन्ट के माध्यम से जमा की जायेगी तथा जो राज्य सरकार के समस्त दावों और देयों के अन्तिम निस्तारण के पश्चात्‌ वापस किये जाने योग्य है।

परन्तु नवीकरण की स्थिति में पूर्व में नगद अथवा राष्ट्रीय बचत पत्र के माध्यम से जमा की गयी प्रतिभूति तब तक स्वीकार्य होगी, जब तक इसकी वापसी न कर दी जाय।

(ञ) ''राज्य'' का तात्पर्य उत्तर प्रदेश राज्य से है। (ञ) ''राज्य'' का तात्पर्य उत्तर प्रदेश राज्य से है। (ट) ''अतिरिक्त प्रतिफल शुल्क'' का तात्पर्य विदेशी मदिरा एवं बियर के अधिकतम फुटकर मूल्य को 10 रूपये के अगले गुणांक तक पूर्णाकिंत किये जाने के फलस्वरूप प्राप्त अन्तर की धनराशि से है, जो आसवनी/यवासवनी स्तर पर संदेय होगी तथा आसवनी/यवासवनी द्वारा थोक आपूर्तिकर्ता से एक्स डिस्टिलरी लागत के अतिरिक्त वसूलनीय होगी एवं जो थोक आपूर्तिकर्ता द्वारा फुटकर लाइसेंसधारी से अधिकतम थोक लागत के अतिरिक्त वसूल की जा सकेगी।

(ट) ''अतिरिक्त प्रतिफल शुल्क'' का तात्पर्य विदेशी मदिरा एवं बियर के अधिकतम फुटकर मूल्य को 10 रूपये के अगले गुणांक तक पूर्णाकिंत किये जाने के फलस्वरूप प्राप्त अन्तर की धनराशि से है, जो आसवनी/यवासवनी स्तर पर संदेय होगी तथा आसवनी/यवासवनी द्वारा थोक आपूर्तिकर्ता से एक्स डिस्टिलरी लागत/एक्स ब्रिवरी लागत के अतिरिक्त वसूलनीय होगी एवं जो थोक आपूर्तिकर्ता द्वारा फुटकर लाइसेंसधारी से अधिकतम थोक लागत के अतिरिक्त वसूल की जा सकेगी। (ठ) 'धरोहर धनराशि' का तात्पर्य लाइसेंस की स्वीकृति के लिये पात्रता की शर्तों की पूर्ति सुनिश्चित किये जाने के लिये आवेदन पत्र के साथ जमा की जाने वाली लाइसेंस फीस की धनराशि के 1/10 वें भाग के बराबर धनराशि से है, जो व्यतिक्रम की दशा में इस नियमावली के नियम-10 के उपबन्धों के अधीन जब्त किये जाने योग्य होगी।

(ठ) 'धरोहर धनराशि' का तात्पर्य लाइसेंस की स्वीकृति के लिये पात्रता की शर्तों की पूर्ति सुनिश्चित किये जाने के लिये आवेदन पत्र के साथ जमा की जाने वाली लाइसेंस फीस की धनराशि के 1/10 वें भाग के बराबर धनराशि से है, जो व्यतिक्रम की दशा में इस नियमावली के नियम-10 के उपबन्धों के अधीन जब्त किये जाने योग्य होगी।

(ड) 'अनुक्रम' का तात्पर्य ई-लाटरी प्रक्रिया के माध्यम से लाइसेंसधारी के चयन आधार के रूप में तात्पर्यित दुकानों की धरोहर धनराशि के अवरोही क्रम से है।

(ड) 'अनुक्रम' का तात्पर्य ई-लाटरी प्रक्रिया के माध्यम से लाइसेंसधारी के चयन आधार के रूप में तात्पर्यित दुकानों की धरोहर धनराशि के अवरोही क्रम से है। (ढ़) ''पोर्टल'' का तात्पर्य मदिरा विनिर्मित करने से लेकर उसके वितरण के अन्तिम स्तर तक की प्रक्रिया से सम्बंधित विहित प्रपत्र में सूचना अपलोड किये जाने के प्रयोजनार्थ विनिर्दिष्ट रुप से सृजित इलेक्ट्रानिक प्लेटफार्म से है।

(ढ़) ''पोर्टल'' का तात्पर्य मदिरा विनिर्मित करने से लेकर उसके वितरण के अन्तिम स्तर तक की प्रक्रिया से सम्बंधित विहित प्रपत्र में सूचना अपलोड किये जाने के प्रयोजनार्थ विनिर्दिष्ट रुप से सृजित इलेक्ट्रानिक प्लेटफार्म से है।

(ण) ''ऋणशोधन क्षमता'' का तात्पर्य फुटकर लाइसेंस की स्वीकृति के लिये आवेदन करने हेतु आवेदक के लिये निर्धारित वित्तीय अर्हता के मानदण्ड से है।

(ण) ''ऋणशोधन क्षमता'' का तात्पर्य फुटकर लाइसेंस की स्वीकृति के लिये आवेदन करने हेतु आवेदक के लिये निर्धारित वित्तीय अर्हता के मानदण्ड से है4 उत्तर प्रदेश असाधारण गजट, 8 अप्रैल, 2021 ई0 स्तम्भ-1 स्तम्भ-2 विद्यमान नियम

एतद्‌द्वारा प्रतिस्थापित नियम (त) ''व्यक्ति '' का तात्पर्य ऐसे व्यक्ति से है जो आवेदन करने के समय इक्कीस वर्ष की आयु से अन्यून, भारत का नागरिक हो।

(त) ''व्यक्ति'' का तात्पर्य ऐसे व्यक्ति से है जो आवेदन करने के समय इक्कीस वर्ष की आयु से अन्यून, भारत का नागरिक हो।

(थ) ''व्यवस्थापन'' का तात्पर्य नवीकरण, ई.लाटरी (थ) ''व्यवस्थापन'' का तात्पर्य नवीकरण, ई.लाटरी अथवा ई-टेण्डर के माध्यम से दुकानों के व्यवस्थापन अथवा पुनव्र्यवस्थापन से है, जो समाचार पत्र एवं आबकारी विभाग की वेबसाइट के माध्यम से पूर्व नोटिस एवं संसूचना देकर सप्ताह के किसी दिन में हो सकता है। आगामी वर्ष के लिये दुकानों का व्यवस्थापन विगत वित्तीय वर्ष की समाप्ति के पूर्व किया जा सकता है।

अथवा ई-टेण्डर के माध्यम से दुकानों के व्यवस्थापन अथवा पुनव्र्यवस्थापन से है, जो समाचार पत्र एवं आबकारी विभाग की वेबसाइट के माध्यम से पूर्व नोटिस एवं संसूचना देकर सप्ताह के किसी दिन में हो सकता है। आगामी वर्ष के लिये दुकानों का व्यवस्थापन विगत वित्तीय वर्ष की समाप्ति के पूर्व किया जा सकता है।

(द) ''प्रतिफल शुल्क'' का तात्पर्य आबकारी अधिनियम की धारा 30 के अधीन विदेशी मदिरा, बियर, वाइन और कम तीव्र्रता के मादक पेय हेतु राज्य सरकार द्वारा यथानिर्धारित शुल्क से है, जो विदेशी मदिरा, बियर, वाइन और कम तीव्र्रता के मादक पेय की आपूर्ति से पूर्व लाइसेंसधारी द्वारा सरकारी कोषागार में जमा की जाएगी। (2) इस नियमावली में अपरिभाषित किन्तु अधिनियम में परिभाषित श्शब्दों और पदों के वही अर्थ होंगे, जो अधिनियम में क्रमषः उनके लिये समनुदेषित हैं।

(ध) ''त्रैमासिक न्यूनतम प्रत्याभूत राजस्व'' का तात्पर्य आबकारी आयुक्त द्वारा जारी सामान्य या विनिर्दिष्ट अनुदेशों के अनुसार लाइसेंस प्राधिकारी द्वारा यथा नियत और लाइसेंसधारी द्वारा फुटकर बिक्री के प्रयोजनार्थ किसी आबकारी वर्ष के त्रैमास में अपनी फुटकर दुकान के लिये उठाये जाने हेतु प्रत्याभूत विदेशी मदिरा, बीयर वाइन और कम तीव्रता के मादक पेय से प्राप्त समान राजस्व से है।

(2) इस नियमावली में अपरिभाषित किन्तु अधिनियम में परिभाषित शब्दों और पदों के वही अर्थ होंगे जो अधिनियम में क्रमषः उनके लिये समनुदेषित हैं। -उक्त नियमावली में नीचे स्तम्भ-1 में दिये गये विद्यमान नियम-12 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात-

विद्यमान नियम

एतद्‌द्वारा प्रतिस्थापित नियम 12. मदिरा/बीयर का उठान- (क) इस नियमावली के अधीन लाइसेंसधारी विदशी मदिरा और बियर के लागत मूल्य का पूर्ण भुगतान, जिसके अन्तर्गत सभी कर, प्रतिफल शुल्क (अतिरिक्त प्रतिफल शुल्क सहित), जो समय-समय पर उद्‌ग्रहीत किये जाय, जमा करने के पश्चात्‌

12. मदिरा/बीयर का उठान- (क) इस नियमावली के अधीन लाइसेंसधारी विदशी मदिरा और बियर के लागत मूल्य का पूर्ण भुगतान, जिसके अन्तर्गत सभी कर, प्रतिफल शुल्क (अतिरिक्त प्रतिफल शुल्क सहित), जो समय-समय पर उद्‌ग्रहीत किये जाय, जमा करने के पश्चात्‌उत्तर प्रदेश असाधारण गजट, 8 अप्रैल, 2021 ई0 5 स्तम्भ-1 स्तम्भ-2 विद्यमान नियम

एतद्‌द्वारा प्रतिस्थापित नियम जिले के किसी थोक लाइसेंसधारी (वि0श0-2/2ख) और राज्य के एफ0एल0-2डी से विदेशी मदिरा और बियर के समस्त प्रचलित रजिस्ट्रीकृत ब्राण्डों की पर्याप्त आपूर्ति प्राप्त करेगा। यदि सम्बन्धित जिला में (वि0म0-2/वि0 म0-2 ख) लाइसेंस स्वीकृत नहीं है, तो लाइसेंसधारी आबकारी आयुक्त की पूर्वानुमति से अन्य जिला/जिलों के थोक बिक्री लाइसेंस (वि0म0-2/वि0 म0-2 ख) से विदेशी शराब (वाइन सहित) और बीयर और कम तीव्रता के साथ मादक पेय के साथ आपूर्ति प्राप्त करेगा। किसी जिला में अपर्याप्त आपूर्ति की स्थिति में जिला आबकारी अधिकारी, आबकारी आयुक्त से आदेश प्राप्त कर 24 घण्टे के अन्दर आपूर्ति सुनिश्चित करेगा।

जिले के किसी थोक लाइसेंसधारी (वि0श0-2/2ख) से विदेशी मदिरा और बियर के समस्त प्रचलित रजिस्ट्रीकृत ब्राण्डों की पर्याप्त आपूर्ति प्राप्त करेगा। यदि सम्बन्धित जिला में (वि0म0-2/वि0 म0-2 ख) लाइसेंस स्वीकृत नहीं है, तो लाइसेंसधारी आबकारी आयुक्त की पूर्वानुमति से अन्य जिला/जिलों के थोक बिक्री लाइसेंस (वि0म0-2/वि0 म0-2 ख) से विदेशी शराब (वाइन सहित) और बीयर और कम तीव्रता के साथ मादक पेय के साथ आपूर्ति प्राप्त करेगा। किसी जिला में अपर्याप्त आपूर्ति की स्थिति में जिला आबकारी अधिकारी, आबकारी आयुक्त से आदेश प्राप्त कर 24 घण्टे के अन्दर आपूर्ति सुनिश्चित करेगा।

(ख) लाइसेंसधारी को, उपभोगताआें की मौसमी आवष्यकताआें की पूर्ति के साथ-साथ बाजार में नकली, आपूर्ति के किन्ही अवसरों को दूर करने हेतु स्थिर तथा निरन्तर गुणवत्ता को सुनिष्चित करने के लिए लगातार विदेषी मदिरा व बीयर का उठान करना अनिवार्य होगा। उसे निरन्तर, पोर्टल पर लिखित मॉगपत्र अथवा संदेष थोक विक्रेता को प्रस्तुत करना होगा। इस क्रम में उपरोक्त आवष्यकताओं की प्राप्ति हेतु लाइसेंसधारी को कम से कम गत वर्ष के प्रत्येक त्रैमास में उठाई गयी विदेषी मदिरा व बीयर की अलग अलग मात्रा में निहित प्रतिफल शुल्क के बराबर की विदेषी मदिरा एवं बीयर की अलग-अलग मात्रा का उठान करना अनिवार्य होगा।

(ख) लाइसेंसधारी को, उपभोक्ताआें की मौसमी आवष्यकताआें की पूर्ति के साथ-साथ बाजार में नकली, आपूर्ति के किन्ही अवसरों को दूर करने हेतु स्थिर तथा निरन्तर गुणवत्ता को सुनिष्चित करने के लिए लगातार विदेषी मदिरा, बीयर, वाइन एवं कम तीव्रता के मादक पेय (एल0ए0बी0) का उठान करना अनिवार्य होगा। उसे निरन्तर, पोर्टल पर लिखित मॉगपत्र अथवा संदेष थोक विक्रेता को प्रस्तुत करना होगा। उपयुक्त अपेक्षाओं की पूर्ति करने के उद्‌देश्य से लाइसेंसधारी को कम से कम गत वर्ष के प्रत्येक त्रैमास में उठाई गयी विदेषी मदिरा, बीयर, वाइन एवं कम तीव्रता के मादक पेय (एल0ए0बी0) की मात्रा में सम्मिलित प्रतिफल शुल्क के समतुल्य की विदेषी मदिरा, बीयर, वाइन एवं कम तीव्रता के मादक पेय (एल0ए0बी0)की मात्रा का उठान करना बाध्यकारी होगा। (ग) (एक) यदि लाइसेंसधारी किसी त्रैमास में कम से कम अपने त्रैमासिक न्यूनतम प्रत्याभूत राजस्व के समतुल्य मदिरा (विदेशी मदिरा, बीयर, वाइन एवं कम तीव्रता के मादक पेय) (एल0ए0बी0) का उठान करने में विफल रहता है, तो अगले त्रैमास हेतु उठान रोक दी जायेगी।

(दो) लाइसेंसधारी विलम्बमर्षण हेतु एवं उस त्रैमास के त्रैमासिक न्यूनतम प्रत्याभूत राजस्व में कमी के समतुल्य मदिरा उठाने के लिए एक शपथ पत्र के साथ अनुरोध करेगा। विलम्ब मर्षित किये जाने पर लाइसेंसधारी, त्रैमासिक न्यूनतम प्रत्याभूत राजस्व में कमी के समतुल्य अतिरिक्त प्रतिभूति जमा करेगा।

(तीन) इस प्रकार जमा की गयी अतिरिक्त प्रतिभूति, अगले त्रैमास के त्रैमासिक न्यूनतम प्रत्याभूत राजस्व सहित गत त्रैमास में इस प्रकार हुयी कमी के बराबर मदिरा का उठान किये जाने के पश्चात्‌ वापस कर दी जायेगी।6 उत्तर प्रदेश असाधारण गजट, 8 अप्रैल, 2021 ई0 स्तम्भ-1 स्तम्भ-2 विद्यमान नियम

एतद्‌द्वारा प्रतिस्थापित नियम

(चार) यदि लाइसेंसधारी वित्तीय वर्ष की समाप्ति से पहले एक या अधिक त्रैमासों की त्रैमासिक न्यूनतम प्रत्याभूत राजस्व के बराबर मदिरा का उठान करने में विफल रहता है तो उसके द्वारा जमा की गयी अतिरिक्त प्रतिभूति एवं प्रतिभूति राजस्व की ऐसी कमी के सापेक्ष समायोजित कर ली जायेगी और शेष प्रतिभूति वापस कर दी जायेगी।

यदि जमा की गयी अतिरिक्त प्रतिभूति और प्रतिभूति राजस्व में कमी के सापेक्ष समायोजन के लिए अपर्याप्त हो तो शेष राजस्व की वसूली उसी प्रकार से की जायेगी मानों यह भू-राजस्व का बकाया हो।

(घ) (एक) त्रैमासिक न्यूनतम प्रत्याभूत राजस्व, जिसे वह उठाने में सक्षम न हो, उसी प्रकार के अन्य लाइसेंसधारी को अन्तरित करना चाहने वाले लाइसेंसधारी को, किसी आबकारी जिला के भीतर त्रैमासिक आधार पर ऐसे अंश (कोटा) का अंतरण करने की अनुज्ञा प्रदान की जा सकती है।

(दो) अंतरणकर्ता लाइसेंसधारी, अंतरिती लाइसेंसधारी की सहमति से जिला में जिला आबकारी अधिकारी से अनुरोध करेगा। अंतरण की निबन्धनों का विनिश्चय, दोनों अंतरणकर्ता और अंतरिती लाइसेंसधारियों द्वारा पारस्परिक रूप से किया जायेगा।

(तीन) अंतरणकर्ता लाइसेंसधारी के अनुरोध का अनुमोदन किये जाने पर उसके द्वारा अंतरित किये जाने हेतु करारकृत कोटा को उसके मासिक न्यूनतम प्रत्याभूत राजस्व में से घटा दिया जायेगा और उसे उठा लिया गया समझा जायेगा तथा उसे अंतरिती लाइसेंसधारी के लेखा में अंतरित मासिक न्यूनतम प्रत्याभूत राजस्व के रूप में जोड़ दिया जायेगा। यह मात्रा अंतरिती लाइसेंसधारी के मूल मासिक न्यूनतम प्रत्याभूत राजस्व के अतिरिक्त होगी और उसका मूल कोटा उठाये जाने से सम्बन्धित उसका दायित्व प्रभावित नहीं होगा।

(चार) राज्य सरकार के पूर्व अनुमोदन से आबकारी आयुक्त द्वारा यथाविहित कोटा अंतरण फीस, अंतरणकर्ता लाइसेंसधारी द्वारा ऐसा अनुरोध किये जाने के समय संदेय होगी।

परन्तु, यह कि इस उपबंध के अधीन अंतरित कुल कोटा, अंतरणकर्ता लाइसेंसधारी के त्रैमासिक न्यूनतम प्रत्याभूत राजस्व के 20 प्रतिशत से अधिक नहीं होगा। उसी प्रकार से, अंतरिती लाइसेंसधारी अपने त्रैमासिक न्यूनतम प्रत्याभूत राजस्व के 20 प्रतिशत से अधिक ऐसा अन्तरित कोटा प्राप्त करने का हकदार नहीं होगा।उत्तर प्रदेश असाधारण गजट, 8 अप्रैल, 2021 ई0 7 प्रपत्र एफ0एल0-4 (क) और एफ0एल0-4(क)(1) का संशोधन-उक्त नियमावली में, नीचे स्तम्भ-1 में दिये गये विद्यमान प्रपत्र एफ0एल0-4(क)और एफ0एल0-4(क)(1) के स्थान पर स्तम्भ-2 में दिये गये प्रपत्र रख दिये जायेंगे, अर्थात्‌-

एतद्‌द्वारा प्रतिस्थापित नियम परिसर के बाहर व परिसर में उपभोग के लिए मानक बोतलों/केन्स/टेट्रापैक में विदेशी मदिरा/ बीयर/ वाइन/कम तीव्रता के मादक पेय परिसर के अंदर ड्राट बीयर वाइन की फुटकर बिक्री के लिए माडल शाप लाइसेंस एतद्‌द्वारा उपर्युक्त लाइसेंस धारकों को जिला......................................के अन्तर्गत.................................... स्थान, पुलिस थाना..........................., तहसील........................ के लिए दिनांक ...........................से 31 मार्च 20...... तक के लिए, जिसके लिए नियम-3 के अनुसार लाइसेंस फीस और प्रतिभूति धनराशि जमा कर दी गई है, प्रदान किया जाता है। यह लाइसेंस निम्नलिखित सामान्य और विशेष शर्तों के अधीन रहते हुए प्रदान किया जाता है, उसमें से किसी का व्यतिक्रम करने पर या संयुक्त प्रान्त आबकारी अधिनियम, 1910 या स्वापक ओषधि एवं मनः प्रभावी पदार्थ अधिनियम, 1985 के अधीन किसी अपराध के लिए दोषसिद्ध होने पर लाइसेंसधारी के लाइसेंस पर नियमावली के अनुसार प्रषमन/निलम्बन/निरस्तीकरण की कार्यवाही की जायेगी और लाइसेंसधारक सुसंगत विधियों के अधीन अधिरोपित किन्हीं शास्तियों के अतिरिक्त अपने लाइसेंस और प्रतिभूति निक्षेप का समपहरण किए जाने के लिए दायी होगा।

परिसर के बाहर व परिसर में उपभोग के लिए मानक बोतलों/केन्स/टेट्रापैक में विदेशी मदिरा/ बीयर/ वाइन/कम तीव्रता के मादक पेय परिसर के अंदर ड्राट बीयर वाइन की फुटकर बिक्री के लिए माडल शाप लाइसेंस एतद्‌द्वारा उपर्युक्त लाइसेंस धारकों को जिला....................................के अन्तर्गत....................................... स्थान, पुलिस थाना..........................., तहसील........................ के लिए दिनांक ...........................से 31 मार्च 20...... तक के लिए, जिसके लिए नियम-3 के अनुसार लाइसेंस फीस और प्रतिभूति धनराशि जमा कर दी गई है, प्रदान किया जाता है। यह लाइसेंस निम्नलिखित सामान्य और विशेष शर्तों के अधीन रहते हुए प्रदान किया जाता है, उसमें से किसी का व्यतिक्रम करने पर या संयुक्त प्रान्त आबकारी अधिनियम, 1910 या स्वापक ओषधि एवं मनः प्रभावी पदार्थ अधिनियम, 1985 के अधीन किसी अपराध के लिए दोषसिद्ध होने पर लाइसेंसधारी के लाइसेंस पर नियमावली के अनुसार प्रषमन/निलम्बन/निरस्तीकरण की कार्यवाही की जायेगी और लाइसेंसधारक सुसंगत विधियों के अधीन अधिरोपित किन्हीं शास्तियों के अतिरिक्त अपने लाइसेंस और प्रतिभूति निक्षेप का समपहरण किए जाने के लिए दायी होगा। 1- लाइसेंसधारी समय-समय पर उदग्रहणीय समस्त करों, प्रतिफल फीस (अतिरिक्त प्रतिफल फीस सहित) तथा उपकर आदि को सम्मिलित करते हुए विदेशी मदिरा/वियर/वाइन/कम तीव्रता के मादक पेय की कीमत का पूर्ण भुगतान अधिमानतः ई-पेमेन्ट के माध्यम से करने के पश्चात्‌ जिले के विदेशी मदिरा थोक लाइसेंसधारक (वि0ष0- 2/2ख) और परिक्षेत्र या राज्य के एफ0एल0-2डी लाइसेंस से विदेशी मदिरा/ वियर/वाइन/कम तीव्रता के मादक पेय की आपूर्ति प्राप्त करेगा।

1- लाइसेंसधारी समय-समय पर उदग्रहणीय समस्त करों, प्रतिफल फीस (अतिरिक्त प्रतिफल फीस सहित) तथा उपकर आदि को सम्मिलित करते हुए विदेशी मदिरा/बीयर/वाइन/कम तीव्रता के मादक पेय जिसमें अन्य देशों से आयातीत मदिरा सम्मिलित हो, की कीमत का पूर्ण भुगतान अधिमानतः ई-पेमेन्ट के माध्यम से करने के पश्चात्‌ जिले के विदेशी मदिरा थोक लाइसेंसधारक (वि0ष0-2/2ख) लाइसेंस से विदेशी मदिरा/ वियर/वाइन/कम तीव्रता के मादक पेय की आपूर्ति प्राप्त करेगा। यदि सम्बन्धित जिला में विदेशी मदिरा-2/ विदेशी मदिरा-2बी) लाइसेंस स्वीकृत नहीं किया जाता है तो लाइसेंसधारी को आबकारी आयुक्त की पूर्वानुमति से अन्य जिला/ जिलों के थोक लाइसेंसधारी (विदेशी मदिरा-2/ विदेशी मदिरा-2बी) से विदेशी मदिरा, बीयर, वाइन तथा कम तीव्रता के मादक पेय की आपूर्ति प्राप्त करनी होगी।

2- लाइसेंसधारी अपर्याप्त आपूर्ति की स्थिति में जिला आबकारी अधिकारी को अवगत करायेगा, जो आबकारी आयुक्त से आदेश प्राप्त करेगा। 2- लाइसेंसधारी अपर्याप्त आपूर्ति की स्थिति में जिला आबकारी अधिकारी को अवगत करायेगा, जो आबकारी आयुक्त से आदेश प्राप्त करेगा।उत्तर प्रदेश असाधारण गजट, 8 अप्रैल, 2021 ई0 9 3- विदेशी मदिरा/बियर/वाइन/कम तीव्रता के मादक पेय की बोतलों/कैन्स/टेट्रा पैक्स के लेबुलों पर अधिकतम्‌ फुटकर मूल्य मुद्रित किया जायेगा। फुटकर लाइसेंसधारी छपे हुए अधिकतम्‌ फुटकर मूल्य से अधिक नहीं वसूल करेगा।

3- विदेशी मदिरा/बियर/वाइन/कम तीव्रता के मादक पेय की बोतलों/कैन्स/टेट्रा पैक्स के लेबुलों पर अधिकतम्‌ फुटकर मूल्य मुद्रित किया जायेगा। फुटकर लाइसेंसधारी छपे हुए अधिकतम्‌ फुटकर मूल्य से अधिक नहीं वसूल करेगा। 4- लाइसेंस प्राप्त परिसर मे बिक्री परिसर के बाहर उपभोग के लिए व परिसर में उपभोग के लिए की जायेगी तथा ठोस अपशिष्ट प्रबन्धन नियम 2016 के अनुसार दुकानों पर उपभोग किये जाने के बाद खाली हुई पेट/शीशे की बोतलों/कैन्स/ टेट्रा पैक्स एवं उन पर प्रयुक्त ढक्कनों को नष्ट करके हटाने की जिम्मेदारी दुकान के विक्रेता/ लाइसेंसधारी की होगी।

4- लाइसेंस प्राप्त परिसर मे बिक्री परिसर के बाहर उपभोग के लिए व परिसर में उपभोग के लिए की जायेगी तथा ठोस अपशिष्ट प्रबन्धन नियम 2016 के अनुसार दुकानों पर उपभोग किये जाने के बाद खाली हुई पेट/शीशे की बोतलों/कैन्स/ टेट्रा पैक्स एवं उन पर प्रयुक्त ढक्कनों को नष्ट करके हटाने की जिम्मेदारी दुकान के विक्रेता/ लाइसेंसधारी की होगी।

5- किसी भी व्यक्ति को 60 मि0ली0 की एक मानक निप बोतल से कम मात्रा की विक्री नहीं की जायेगी।

6- विहित तीब्रता और मानक क्षमता की मुहरबन्द बोतलों/कैन्स/टेट्रा पैक्स में बिक्री की जायेगी और जिन पर प्रतिफल फीस के भुगतान के प्रमाण के रूप में आबकारी विभाग द्वारा अनुमोदित सुरक्षा कोड चस्पा हो। लाइसेंसधारी मदिरा पान की व्यवस्था भी रखेगा तथा गिलास, पानी, बर्फ, सोडा, स्नैक्स व विभिन्न खाद्य पदार्थ पका कर भी उपलब्ध करायेगा।

6- विहित तीव्रता और मानक क्षमता की मुहरबन्द बोतलों/कैन्स/टेट्रा पैक्स में बिक्री की जायेगी और जिन पर प्रतिफल फीस के भुगतान के प्रमाण के रूप में आबकारी विभाग द्वारा अनुमोदित सुरक्षा कोड चस्पा हो। लाइसेंसधारी मदिरा पान की व्यवस्था भी रखेगा तथा गिलास, पानी, बर्फ, सोडा, स्नैक्स व विभिन्न खाद्य पदार्थ पका कर भी उपलब्ध करायेगा।

7- लाइसेंसधारी विहित प्रपत्र और रजिस्टर (एफ0एल0-25क) में, जैसा लाइसेंस प्राधिकारी द्वारा निर्धारित किया गया हो, नियमित एवं सही-सही दैनिक हिसाब रखेगा एवं उसका विभागीय वेबसाइट (upexcise.in) पोर्टल पर अपलोड करेगा तथा जब कभी सक्षम निरीक्षण प्राधिकारी द्वारा मांगा जायेगा तो लेखा रजिस्टर को प्रस्तुत करेगा और निरीक्षण प्राधिकारी द्वारा अपेक्षित सामग्री और दस्तावेजों को उपल्ब्ध करायेगा।

7- लाइसेंसधारी विहित प्रपत्र और रजिस्टर (एफ0एल0-25क) में, जैसा लाइसेंस प्राधिकारी द्वारा निर्धारित किया गया हो, नियमित एवं सही-सही दैनिक हिसाब रखेगा एवं उसका विभागीय वेबसाइट (www.upexcise.in) पोर्टल पर अपलोड करेगा तथा जब कभी सक्षम निरीक्षण प्राधिकारी द्वारा मांगा जायेगा तो लेखा रजिस्टर को प्रस्तुत करेगा और निरीक्षण प्राधिकारी द्वारा अपेक्षित सामग्री और दस्तावेजों को उपल्ब्ध करायेगा।

8- लाइसेंसधारी विदेशी मदिरा/वाइन/बीयर/कम तीव्रता के मादक पेय के सम्पूर्ण स्टाक का भण्डारण केवल लाइसेंस प्राप्त परिसर में ही करेगा। उससे ट्रैक एण्ड ट्रेस प्रणाली के अधीन यथा विहित सुरक्षा कोड के अनुसार बोतलों की स्कैनिंग के लिए दुकान पर यथाविनिर्दिष्ट पी0ओ0एस0 (प्वाइंट ऑफ सेल) यंत्र अनुरक्षित रखने की अपेक्षा की जायेगी।10 उत्तर प्रदेश असाधारण गजट, 8 अप्रैल, 2021 ई0 9- लाइसेंसधारी दुकान के प्रवेश द्वार पर आबकारी आयुक्त द्वारा अनुमोदित प्रपत्र/आकार का एक सहज दृष्य साइनबोर्ड लगाएगा, जिसके ऊपर लाइसेंसधारी का नाम, पदनाम, दुकान की अवस्थिति, लाइसेंस की अवधि, दुकान खुलने व बन्द होने का समय और लाइसेंस प्राधिकारी द्वारा यथा विहित अन्य सूचनाएॅं भी मोटे अक्षरों में मुद्रित की जायेंगी। साइन बोर्ड में निम्नलिखित सूचना को प्रदर्षित करना होगाः-

9- लाइसेंसधारी दुकान के प्रवेश द्वार पर आबकारी आयुक्त द्वारा अनुमोदित प्रपत्र/आकार का एक सहज दृश्य साइनबोर्ड लगाएगा, जिसके ऊपर लाइसेंसधारी का नाम, पदनाम, दुकान की अवस्थिति, लाइसेंस की अवधि, दुकान खुलने व बन्द होने का समय और लाइसेंस प्राधिकारी द्वारा यथाविहित अन्य सूचनाएँ भी मोटे अक्षरों में मुद्रित की जायेंगी। साइन बोर्ड में निम्नलिखित सूचना को प्रदर्षित करना होगाः-

''झ'' दुकान के बाहर आस-पास या सार्वजनिक स्थान पर शराब पीना वर्जित है। इस संबंध में कोई भी उल्लंघन दण्डनीय होगा।

दुकान के बाहर आस-पास या सार्वजनिक स्थान पर शराब पीना वर्जित है। इस संबंध में कोई भी उल्लंघन दण्डनीय होगा।

शराब पीकर गाड़ी चलाना जानलेवा हो शराब पीकर गाड़ी चलाना जानलेवा हो सकता सकता है। कृपया शराब पीकर गाड़ी न चलायें।''

है। कृपया शराब पीकर गाड़ी न चलायें।'' 10- लाइसेंसधारी किसी भी व्यक्ति को विक्रेता के रूप में सेवायोजित नहीं करेगा, जो 21 वर्ष से कम आयु का हो या जो किसी संक्रामक रोग और/ या छुआ-छूत रोग से ग्रस्त हो या आपराधिक, पृष्ठभूमि का हो या महिला हो। लाइसेंसधारी जिला आबकारी अधिकारी द्वारा निर्गत बिक्रेता का फोटोयुक्त पहचान पत्र प्राप्त करेगा तथा जिसे निरीक्षणकर्ता प्राधिकारियों के मांगने पर प्रस्तुत करना अनिवार्य होगा।

10- लाइसेंसधारी किसी भी व्यक्ति को विक्रेता के रूप में सेवायोजित नहीं करेगा, जो 21 वर्ष से कम आयु का हो या जो किसी संक्रामक रोग और/ या छुआ-छूत रोग से ग्रस्त हो या आपराधिक पृष्ठभूमि का हो या महिला हो। लाइसेंसधारी जिला आबकारी अधिकारी द्वारा निर्गत विक्रेता का फोटोयुक्त पहचान पत्र प्राप्त करेगा तथा जिसे निरीक्षणकर्ता प्राधिकारियों के मांगने पर प्रस्तुत करना अनिवार्य होगा।

11- लाइसेंसधारी किसी के्रता को विदेशी मदिरा व्हिस्की, ब्राण्डी, रम (व्हाइट रम सहित), जिन, वोदका, वाइन, एल0ए0बी0 (कम तीव्रता के मादक पेय) और भारत में बोतल भराई की गयी और एक ही समय में पृथक-पृथक आयातित अन्य प्रकार की मदिरा की अधिसूचित मात्रा से अधिक मात्रा में बिक्री किसी अनुज्ञा पत्र के बिना नहीं करेगा। 11- लाइसेंसधारी किसी भी क्रेता को 6 लीटर भारत में भरी हुई व 6 लीटर आयातित विदेशी मदिरा प्रत्येक अलग-अलग (जिसमें व्हिस्की, ब्राण्डी, रम (व्हाइट रम सहित) जिन व वोदका सम्मिलित है) 3 लीटर भारत में भरी हुई व आयातित वाइन दोनों अलग-अलग, 7.8 लीटर भारत में भरी हुई व आयाातित बीयर प्रत्येक अलग-अलग, 2 लीटर अन्य भारतीय व आयातित मदिरा तथा 6 लीटर, कम तीव्रता के मादक पेय से अधिक मात्रा में फुटकर बिक्री एक बार में नहीं करेगा, जब तक कि अन्यथा अनुमति प्राप्त न हो।

12- 21 वर्ष से कम आयु के व्यक्ति, उप निरीक्षक की श्रेणी से नीचे के पुलिसकर्मी या सैनिक या वर्दी में किसी सरकारी कर्मी को बिक्री नहीं की जायेगी । 12- 21 वर्ष से कम आयु के व्यक्ति, उप निरीक्षक की श्रेणी से नीचे के पुलिसकर्मी या सैनिक या वर्दी में किसी सरकारी कर्मी को बिक्री नहीं की जायेगी ।

13- लाइसेंसधारी के लिए किसी भी दशा में जो भी हो बोतलों या उसके लेबुलों, सुरक्षा प्रणाली के अन्तर्गत लगा हुआ सुरक्षा कोड, पिल्फरप्रूफ मुहरों से बिगाड़ करना, विकृत करना सर्वथा कड़ाई से निषिद्व है।

14- लाइसेंसधारी अपने अनुज्ञापित परिसर में कोई भी दुग्ध, शर्करा (चाश्नी), रंग, सुगंधि, सुरक्षा कोड निर्मित करने वाला यंत्र, लेबुल, कैप्सूल, मुहर या कोई अपायकर (हानिकर) सामग्री नहीं रखेगा। 14- लाइसेंसधारी अपने अनुज्ञापित परिसर में कोई भी दुग्ध, शर्करा (चाश्नी), रंग, सुगंधि, सुरक्षा कोड निर्मित करने वाला यंत्र, लेबुल, कैप्सूल, मुहर या कोई अपायकर (हानिकर) सामग्री नहीं रखेगा।उत्तर प्रदेश असाधारण गजट, 8 अप्रैल, 2021 ई0 11 15- परिसर जिसमें दुकान स्थित है, का उपयोग आवास के स्थान के रुप में लाइसेंसधारी/विक्रेता के सिवाय नहीं किया जायेगा।

15- परिसर जिसमें दुकान स्थित है, का उपयोग आवास के स्थान के रुप में लाइसेंसधारी/विक्रेता के सिवाय नहीं किया जायेगा।

16- लाइसेंसधारी द्वारा अपनी बिक्री बढ़ाने की दृष्टि से ग्राहक को प्रलोभन देने या आकर्षित करने जैसे द्यूत व नृत्य कार्यक्रम का आश्रय लेना कड़ाई से निषिद्ध है।

17- लाइसेंस प्राप्त परिसर, 14 अप्रैल (आंबेडकर जयन्ती), 15 अगस्त (स्वतंत्रता दिवस), 2 अक्टूबर (गॉंधी जयन्ती), 26 जनवरी (गणतन्त्र दिवस) और तीन ऐसे अतिरिक्त दिन जैसा कि लाइसेंस प्राधिकारी द्वारा बन्दी के लिए अधिसूचित किया जाय, को छोड़कर बिक्री के लिए सभी दिवसों पर प्रातः 10 से रात्रि 10 बजे तक खुला रहेगा। लाइसेंस प्राधिकारी सुसंगत विधियों के अधीन कानून व्यवस्था या सामान्य निर्वाचन से सम्बन्धित क्रिया कलापों आदि के कारण से भी दुकान की बन्दी का आदेश दे सकता है। उपरोक्त आधार पर दुकान की बन्दी के लिए कोई प्रतिकर नही प्रदान किया जायेगा।

17- लाइसेंस प्राप्त परिसर, 14 अप्रैल (अंबेडकर जयन्ती), 15 अगस्त (स्वतंत्रता दिवस), 2 अक्टूबर (गॉंधी जयन्ती), 26 जनवरी (गणतन्त्र दिवस) और तीन ऐसे अतिरिक्त दिन जैसा कि लाइसेंस प्राधिकारी द्वारा बन्दी के लिए अधिसूचित किया जाय, को छोड़कर बिक्री के लिए सभी दिवसों पर प्रातः 10 से रात्रि 10 बजे तक खुला रहेगा। लाइसेंस प्राधिकारी सुसंगत विधियों के अधीन कानून व्यवस्था या सामान्य निर्वाचन से सम्बन्धित क्रियाकलापों आदि के कारण से भी दुकान की बन्दी का आदेश दे सकता है। उपरोक्त आधार पर दुकान की बन्दी के लिए कोई प्रतिकर नही प्रदान किया जायेगा।

परिसर के बाहर व परिसर में उपभोग के लिए मानक बोतलों/केन्स/टेट्रापैक में विदेशी मदिरा/ बीयर/ वाइन/कम तीव्रता के मादक पेय परिसर के अंदर ड्राट बीयर वाइन की फुटकर बिक्री के लिए माडल शाप लाइसेंस एतद्‌द्वारा उपर्युक्त लाइसेंस धारकों को जिला.............................के अन्तर्गत......................................... स्थान, पुलिस थाना..........................., तहसील........................ के लिए दिनांक ...........................से 31 मार्च 20...... तक के लिए, जिसके लिए नियम-3 के अनुसार लाइसेंस फीस और प्रतिभूति धनराशि जमा कर दी गई है, प्रदान किया जाता है। यह लाइसेंस निम्नलिखित सामान्य और विशेष शर्तों के अधीन रहते हुए प्रदान किया जाता है, उसमें से किसी का व्यतिक्रम करने पर या संयुक्त प्रान्त आबकारी अधिनियम, 1910 या स्वापक ओषधि एवं मनः प्रभावी पदार्थ अधिनियम, 1985 के अधीन किसी अपराध के लिए दोषसिद्ध होने पर लाइसेंसधारी के लाइसेंस पर नियमावली के अनुसार प्रषमन/निलम्बन/निरस्तीकरण की कार्यवाही की जायेगी और लाइसेंसधारक सुसंगत विधियों के अधीन अधिरोपित किन्हीं शास्तियों के अतिरिक्त अपने लाइसेंस और प्रतिभूति निक्षेप का समपहरण किए जाने के लिए दायी होगा। 1- लाइसेंसधारी समय-समय पर उदग्रहणीय समस्त करों, प्रतिफल फीस (अतिरिक्त प्रतिफल फीस सहित) तथा उपकर आदि को सम्मिलित करते हुए विदेशी मदिरा/वियर/वाइन/कम तीव्रता के मादक पेय की कीमत का पूर्ण भुगतान अधिमानतः ई-पेमेन्ट के माध्यम से करने के पश्चात्‌ जिले के विदेशी मदिरा थोक लाइसेंसधारक (वि0ष0-2/2ख) और परिक्षेत्र या राज्य के एफ0एल0-2डी लाइसेंस से विदेशी मदिरा/ वियर/वाइन/कम तीव्रता के मादक पेय की आपूर्ति प्राप्त करेगा।

2- लाइसेंसधारी अपर्याप्त आपूर्ति की स्थिति में जिला आबकारी अधिकारी को अवगत करायेगा, जो आबकारी आयुक्त से आदेश प्राप्त करेगा। 2- लाइसेंसधारी अपर्याप्त आपूर्ति की स्थिति में जिला आबकारी अधिकारी को अवगत करायेगा, जो आबकारी आयुक्त से आदेश प्राप्त करेगा।14 उत्तर प्रदेश असाधारण गजट, 8 अप्रैल, 2021 ई0 3- विदेशी मदिरा/बियर/वाइन/कम तीव्रता के मादक पेय की बोतलों/कैन्स/टेट्रा पैक्स के लेबुलों पर अधिकतम्‌ फुटकर मूल्य मुद्रित किया जायेगा। फुटकर लाइसेंसधारी छपे हुए अधिकतम्‌ फुटकर मूल्य से अधिक नहीं वसूल करेगा।

8- लाइसेंसधारी विदेशी मदिरा/वाइन/बीयर/कम तीव्रता के मादक पेय के सम्पूर्ण स्टाक का भण्डारण केवल लाइसेंस प्राप्त परिसर में ही करेगा। उससे ट्रैक एण्ड ट्रेस प्रणाली के अधीन यथा विहित सुरक्षा कोड के अनुसार बोतलों की स्कैनिंग के लिए दुकान पर यथाविनिर्दिष्ट पी0ओ0एस0 (प्वाइंट ऑफ सेल) यंत्र अनुरक्षित रखने की अपेक्षा की जायेगी।उत्तर प्रदेश असाधारण गजट, 8 अप्रैल, 2021 ई0 15 9- लाइसेंसधारी दुकान के प्रवेश द्वार पर आबकारी आयुक्त द्वारा अनुमोदित प्रपत्र/आकार का एक सहज दृष्य साइनबोर्ड लगाएगा, जिसके ऊपर लाइसेंसधारी का नाम, पदनाम, दुकान की अवस्थिति, लाइसेंस की अवधि, दुकान खुलने व बन्द होने का समय और लाइसेंस प्राधिकारी द्वारा यथा विहित अन्य सूचनाएॅं भी मोटे अक्षरों में मुद्रित की जायेंगी। साइन बोर्ड में निम्नलिखित सूचना को प्रदर्षित करना होगाः-

सकता है। कृपया शराब पीकर गाड़ी न चलायें।'' 10- लाइसेंसधारी किसी भी व्यक्ति को विक्रेता के रूप में सेवायोजित नहीं करेगा, जो 21 वर्ष से कम आयु का हो या जो किसी संक्रामक रोग और/ या छुआ-छूत रोग से ग्रस्त हो या आपराधिक, पृष्ठभूमि का हो या महिला हो। लाइसेंसधारी जिला आबकारी अधिकारी द्वारा निर्गत बिक्रेता का फोटोयुक्त पहचान पत्र प्राप्त करेगा तथा जिसे निरीक्षणकर्ता प्राधिकारियों के मांगने पर प्रस्तुत करना अनिवार्य होगा।

14- लाइसेंसधारी अपने अनुज्ञापित परिसर में कोई भी दुग्ध, शर्करा (चाश्नी), रंग, सुगंधि, सुरक्षा कोड निर्मित करने वाला यंत्र, लेबुल, कैप्सूल, मुहर या कोई अपायकर (हानिकर) सामग्री नहीं रखेगा। 14- लाइसेंसधारी अपने अनुज्ञापित परिसर में कोई भी दुग्ध, शर्करा (चाश्नी), रंग, सुगंधि, सुरक्षा कोड निर्मित करने वाला यंत्र, लेबुल, कैप्सूल, मुहर या कोई अपायकर (हानिकर) सामग्री नहीं रखेगा।16 उत्तर प्रदेश असाधारण गजट, 8 अप्रैल, 2021 ई0 15- परिसर जिसमें दुकान स्थित है, का उपयोग आवास के स्थान के रुप में लाइसेंसधारी/विक्रेता के सिवाय नहीं किया जायेगा।

17- लाइसेंसप्राप्त परिसर, 14 अप्रैल (आंबेडकर जयन्ती), 15 अगस्त (स्वतंत्रता दिवस), 2 अक्टूबर (गॉंधी जयन्ती), 26 जनवरी (गणतन्त्र दिवस) और तीन ऐसे अतिरिक्त दिन जैसा कि लाइसेंस प्राधिकारी द्वारा बन्दी के लिए अधिसूचित किया जाय, को छोड़कर बिक्री के लिए सभी दिवसों पर प्रातः 10 से रात्रि 10 बजे तक खुला रहेगा। लाइसेंस प्राधिकारी सुसंगत विधियों के अधीन कानून व्यवस्था या सामान्य निर्वाचन से सम्बन्धित क्रिया कलापों आदि के कारण से भी दुकान की बन्दी का आदेश दे सकता है। उपरोक्त आधार पर दुकान की बन्दी के लिए कोई प्रतिकर नही प्रदान किया जायेगा।

In exercise of the powers under sections 24-B and 41 of the United Provinces Excise Act, 1910 (U.P. Act no-IV of 1910), read with section 21 of the Uttar Pradesh General Clauses Act, 1904 (U.P. Act no. 1 of 1904), the Excise Commissioner, Uttar Pradesh with the previous sanction of the State Government hereby makes the following rules with a view to amending the Uttar Pradesh Excise (Settlement of Retail Licenes for Model Shop of Foreign Liquor) Rules,2003 published vide Excise Commissioner notification no. 17951/X-Licence-33/F.L. Model Shop/2003-2004, dated September 03, 2003 (as amended from time to time).

THE UTTAR PRADESH EXCISE (SETTLEMENT OF RETAIL LICENSES FOR MODEL SHOP OF FOREIGN LIQUOR) (FOURTEENTH AMENDMENT) RULES, 2021 1. Short title and commencement–(1) These rules may be called the Uttar Pradesh Excise (Settlement of Retail Licenses for Model Shop of Foreign Liquor) (Fourteenth Amendment) Rules, 2021.

(2) They shall come into force with effect from the date

of their publication in the Gazette.

2. Amendment of Rule 2– In the Uttar Pradesh Excise (Settlement of Retail Licenses for Model Shop of Foreign Liquor) Rules, 2003 hereinafter referred to as the said rules, for rule-2 setout in Column I below, the rule as setout in Column II shall be substituted, namely:-

(d) "Excise Year" means the financial year commencing from 1st April to 31st March of the next calendar year;

(e) "family" means and includes spouse (husband or wife), dependent son (s), unmarried daughter (s) and dependent parents;

(h) "License fee" means a sum fixed in consideration of the grant of the license as body wise for exclusive privilege for selling of foreign liquor, beer, Wine and low alcoholic brewages in a Model Shop and for giving facilities of bar, additional license fee fixed from time to time shall also be included thereto.

(i) "Security amount" means a amount as fixed by the State Government according to the licence fee to be deposited through Fixed Deposit Receipt pledged in favor of District Excise Officer or through e-payment refundable after the final settlement of all the claims and dues to the State Government. Provided, in case of renewal security deposited prior in cash or through National Saving certificate shall be acceptable till it is not refunded.

(k) "Additional Consideration fee" means difference amount obtained as a result of rounding off the maximum retail price of foreign liquor and beer to the next multiple of 10 rupees, which shall be payable at Distillery/Brewery level and recoverable by distillery/brewery from wholesale supplier in addition to Ex-Distillery Price/Ex-Brewery price and which in turn could be recovered by wholesale supplier from retail licensee in addition to maximum wholesale price;

(k) "Additional Consideration fee" means difference amount obtained as a result of rounding off the maximum retail price of foreign liquor and beer to the next multiple of 10 rupees, which shall be payable at Distillery/Brewery level and recoverable by distillery/brewery from wholesale supplier in addition to Ex-Distillery Price/Ex- Brewery price and which in turn could be recovered by wholesale supplier from retail licensee in addition to maximum wholesale price;

(l) "Earnest money" means the amount equal to one-tenth of the amount of licence fee, to be tendered with application form, for ensuring the fulfillment of the eligibility conditions for the grant of licence and is liable to be forfeited in case of default under provisions of rule-10 of these rules;

(n) "Portal" means the electronic platform created specifically for the purpose of uploading information in the prescribed form with regard to the process of manufacturing liquor up to the terminal stage of its distribution;

(o) "Solvency" means financial eligibility criteria set for an applicant applying for the grant of retail license;

(p) 'Individual' means a person who is the citizen of India not below the age of twenty-one years;

(q) "Settlement" means settlement or re- settlement of shops through renewal, e-lottery or e- tender which may take place on any day of the week by giving prior notice and intimation through the newspaper and website of the excise department. The settlement of shops for the forthcoming year may also be done prior to the cessation of preceding financial year;

(s) "Quarterly Minimum Guaranteed Revenue" means the equivalent revenue from Foreign liquor, Beer, Wine and low alcoholic beverages as fixed by the licensing authority in accordance with the general or specific instructions issued by the Excise Commissioner and guaranteed by the licensee to be lifted by him for his retail shop during a quarter of an Excise year for the purpose of retail sale.

(2) Words and expressions not defined in these rules but defined in the Act, shall have the meanings respectively assigned to them in the Act.

3. Amendment of rule-12-- In the said rules, for existing rule-12 set out in Column-I below, the rule as set out in Column-II shall be substituted, namely:-

12. Lifting of liquor/beer (a) The licensee under these rules shall obtain sufficient supplies of all prevalent registered brands of foreign liquor/wine and beer/low alcoholic beverages from any wholesale licence (F.L.2/FL-2B ) of the Districts & FL- 2D of State after making full payment of cost price of Foreign Liquor and beer including all Taxes, Consideration fee (including additional consideration fee) as levied from time to time.

12. Lifting of liquor/beer (a) The licensee under these rules shall obtain sufficient supplies of all prevalent registered brands of foreign liquor/wine/beer/low alcoholic beverages from any wholesale license (F.L.2/FL- 2B) of the Districts after making full payment of cost price of Foreign Liquor and beer including all Taxes, Consideration fee (including additional consideration fee) as levied from time to time. In case of insufficient supply of any district, district excise officer shall seek the orders from Excise Commissioner and ensure supply within twenty four hours.

If the (F.L.2/ FL-2B ) license is not sanctioned in the concerned district, the licensee shall obtain supplies of foreign liquor including wine, beer and low alcoholic beverages from wholesale license (F.L.2/FL-2B) of other district/districts with prior permission of the Excise Commissioner. In order to meet the above requirements the licensee shall be under obligation to lift in each quarter, foreign liquor and beer separately, at least equivalent to the consideration fee involved in the quantity of foreign liquor and beer lifted separately in the preceding year."

(b) "Licensee shall be under obligation to regularly lift Foreign Liquor, Beer, Wine and LAB to ensure steady and continuous quality supply as per the seasonal requirements of the customers as well as to remove any chances of spurious supplies in the market. He shall regularly place written indents on portal or messages to the wholesaler. In order to meet the above requirements the licensee shall be under obligation to lift in each quarter, Foreign Liquor, Beer, Wine and LAB at least equivalent to the consideration fee involved in the quantity of Foreign Liquor, Beer, Wine and LAB lifted in the preceding year."

(c) (i) Provided, In case the licensee fails to lift liquor(Foreign Liquor, Beer, Wine and LAB) at least equivalent to his Quarterly Minimum Guaranteed Revenue in a quarter, lifting for the next quarter shall be withheld.

(ii) The licensee shall make a request for condonation of delay and for lifting of liquor equivalent to the shortfall in Quarterly Minimum Guaranteed Revenue of that quarter along with an affidavit. Upon condonation, the licensee shall deposit an additional security equivalent to the shortfall in Quarterly Minimum Guaranteed Revenue.

(iii) Additional security so deposited shall be refunded after lifting of liquor equivalent to such shortfall in previous quarter along with Quarterly Minimum Guaranteed Revenue of the next quarter.

(iv) In case licensee fails to lift liquor equivalent to the Quarterly Minimum Guaranteed Revenue of one or more quarters before the end of financial year, then the additional security and security deposited by him shall be adjusted against such shortfall of revenue and the remaining security shall be refunded.

(d)(i) The licensee desiring to transfer Quarterly

Minimum Guaranteed Revenue, which he is not

able to lift, to another licensee of the same type,

may be allowed such transfer of such

portion(quota) on a quarterly basis, within an

excise district.

(ii) The transferor licensee shall make a request

along with the consent of the transferee licensee

to the District Excise Officer of the district. The

terms of transfer shall be decided by both the

transferor and transferee licensees mutually.

(iii) On approval of the request of the transferor

licensee, the quota agreed upon to be transferred

by him shall be deducted from his Quarterly

Minimum Guaranteed Revenue and shall be

deemed to have been lifted and it will be added as

a transfer Quarterly Minimum Guaranteed

Revenue in the account of the transferee licensee.

This quantity will be over and above the original

Quarterly Minimum Guaranteed Revenue of the

transferee licensee and his obligation regarding

lifting of his original quota shall not be affected.

(iv) A quota transfer fee as prescribed by the Excise

Commissioner with the previous approval of the

State Government, shall be payable by the

transferor licensee at the time of making such

request.

Provided that the total quota transferred under this

provision shall not exceed 20% of the Quarterly

Minimum Guaranteed Revenue of the transferor

licensee. Similarly, the transferee licensee shall

not be entitled to receive such transferred quota,

in excess of 20% of his Quarterly Minimum

Guaranteed Revenue.
