साधारण खण्ड अधिनियम, 1897 (अधिनियम संख्या 10 सन् 1897) की धारा 21 के साथ पठित भ्रष्टाचार निवारण अधिनियम, 1988 (अधिनियम संख्या 49 सन् 1988) जिसे आगे "उक्त अधिनियम" कहा गया है, में निर्दिष्ट धारा 3 की उपधारा (1) और धारा 4 की उपधारा (2) एवं (3) के अधीन शक्तियों का प्रयोग करके राज्यपाल नीचे अनुसूची के स्तम्भ-3 में उल्लिखित अपर जिला एवं सत्र न्यायाधीश द्वारा अपना कार्यभार ग्रहण करने के दिनांक स,े उक्त अधिनियम सन् 1988 की धारा 3 की उपधारा (1) में यथा विनिर्दिष्ट ऐसे अपराधों, जिनमें एतद्पश्चात् उनके न्यायालयों में आरोप-पत्र दाखिल किये गये हों, के विचारण के लिये उक्त अनुसूची के स्तम्भ-5 में उल्लिखित क्षेत्रों के लिए पीठाासीन अधिकारी/विशेष न्यायाधीश के रूप में नियुक्त करती हैं और यह निदेश देती हैं कि उक्त क्षेत्रों के भीतर उद्भूत होने वाले ऐसे अन्य मामलों, जिनमें उक्त अधिनियम के अधीन नियुक्त किसी अन्य विशेष न्यायाधीश के समक्ष आरोप-पत्र पहले से ही दाखिल किये गये हों, का भी विचारण और निस्तारण, सम्बन्धित अपर जिला एवं सत्र न्यायाधीश द्वारा किया जायेगा और उनके न्यायालय, उक्त अनुसूची के स्तम्भ-4 में यथा विनिर्दिष्ट रूप में अभिहित किये जायेंगे।
राज्यपाल, अग्रतर नीचे अनुसूची के स्तम्भ-3 में यथा उल्लिखित विशेष न्यायालय, भ्रष्टाचार निवारण, वाराणसी में कार्यरत अधिकारी को, समस्त और साथ ही साथ ऐसे मामलों, जो उक्त अनुसूची के स्तम्भ-5 में यथा उल्लिखित अधिकारिता क्षेत्र के लिए भविष्य में दायर किये जा सकते हैं, का निस्तारण करने के लिये तत्काल प्रभाव से सशक्त करती हैं, और भविष्य में उक्त विशेष न्यायालय के पदधारी द्वारा प्रभार का त्याग किये जाने पर पद में उनके उत्तरवर्ती, समस्त और साथ ही साथ ऐसे मामलों जो, उक्त अनुसूची के स्तम्भ-5 में यथा उल्लिखित अधिकारिता क्षेत्र के लिए भविष्य में दायर किये जा सकते हैं, का विचारण और निस्तारण करेंगे। 2 उत्तर प्रदेश असाधारण गजट, 13 मई, 2021

IN pursuance of the provisions of clause (3) of Article 348 of the Constitution of India, the Governor is pleased to order the publication of the following English translation of notification no. U.O.-41/VI-P-9–21- 332G-91T.C.-Nyay-2, dated May 13, 2021:

IN exercise of the powers under sub-section (1) of section 3 and sub-section (2) and (3) of section 4 of the Prevention of Corruption Act, 1988 (Act no. 49 of 1988) hereinafter referred to as the "said Act" read with section 21 of the General Clauses Act, 1897 (Act no. 10 of 1897), the Governor is pleased to appoint from the date of his taking over charge, the Additional District and Sessions Judge mentioned in Column-3 of the Schedule below as Presiding Officer/Special Judge for the areas mentioned in Column-5 of the said Schedule for trial of such offences as specified in sub-section (1) of section 3 of the said Act of 1988 in which charge sheets are filed hereinafter in his Court and to direct that such other cases arising within the said area in which charge sheets have already been filed before any other Special Judge appointed under the said Act shall also be tried and disposed of by the Additional District and Session Judge concerned and the courts thereof shall be designated as specified in Column-4 of said Schedule.
The Governor is further pleased to empower the officer mentioned in Column–3 of the Schedule below holding the Special Court, prevention of Corruption, Varanasi for disposing of all, as well as cases उत्तर प्रदेश असाधारण गजट, 13 मई, 2021 3 which may be filed in future for the area of jurisdiction as mentioned in Column-5 of the said Schedule with immediate effect and in future, upon relinquishing the charge by the incumbent of the said Special Court, his successor in office will try and dispose all, as well cases which may be filed in future for the area of jurisdiction as mentioned in Column-5 of the said Schedule.
