उत्तर प्रदेश साधारण खण्ड अधिनियम, 1904 (उत्तर प्रदेश अधिनियम संख्या 1 सन्‌ 1904) की धारा 21 के साथ पठित संयुक्त प्रान्त आबकारी अधिनियम, 1910 (संयुक्त प्रान्त अधिनियम संख्या 4 सन्‌ 1910) की धारा 41 के अधीन शक्तियों का प्रयोग करके, आबकारी आयुक्त, उत्तर प्रदेश, राज्य सरकार की पूर्व स्वीकृति से उक्त अधिनियम सन्‌ 1910 की धारा 18 के खण्ड (घ) के अधीन निर्धारित लाइसेंस शुुल्क पर विदेशी मदिरा के बंधित गोदाम के लाइसेंस देने के लिए उत्तर प्रदेशआबकारी (विदेशी मदिरा बंधित गोदाम के लाइसेंसो का व्यवस्थापन) नियमावली, 2011 में संशोेधन करने की दृष्टि से निम्नलिखित नियमावली बनाते हैं-

व्यवस्थापन) (सप्तम्‌संशोधन) नियमावली, 2021

1-संक्षिप्त नाम और प्रारम्भ-(1) यह नियमावली उत्तर प्रदेश आबकारी (विदेशी मदिरा बंधित गोदाम के लाइसेंसों का व्यवस्थापन) (सप्तम्‌ संशोधन) नियमावली, 2021 कही जायेगी;

(2) यह गजट में प्रकाशित किये जाने के दिनांक से प्रवृत्त होगी।2 उत्तर प्रदेश असाधारण गजट, 31 मई, 2021 ई0 2-नियम-3 का सशाेंधन-उत्तर प्रदेश आबकारी (विदेशी मदिरा बंधित गोदाम के लाइसेंसों का व्यवस्थापन) नियमावली, 2011, जिसे आगे उक्त नियमावली कहा गया है में, नीचे स्तम्भ-एक में, दिए गए विद्यमान नियम-3 के स्थान पर स्तम्भ-दो में दिया गया नियम रख दिया जायेगा, अर्थात्‌-

स्तम्भ-1 विद्यमान नियम

स्तम्भ-2 एतदद्वारा प्रतिस्थापित नियम 3-लाइसेंस की स्वीकृति-

3-लाइसेंस की स्वीकृति-

(1) आबकारी आयुक्त या उसके द्वारा प्राधिकृत अधिकारी, जो संयुक्त आबकारी आयुक्त से निम्न श्रेणी का न हो, के द्वारा विदेशी शराब के बंधित गोदाम के लिये विदेशी शराब के थोक विक्रय का लाइसेंस निर्धारित संलग्न प्रारूप-

(1) आबकारी आयुक्त या उसके द्वारा प्राधिकृत अधिकारी, जो संयुक्त आबकारी आयुक्त से निम्न श्रेणी का न हो, के द्वारा विदेशी मदिरा के बंधित गोदाम के लिये विदेशी मदिरा के थोक विक्रय का लाइसेंस निर्धारित संलग्न प्रारूप-

(बी0डब्लू0एफ0एल0-2ए,

बी0डब्लू0एफ0एल0-2बी,

बी0डब्लू0एफ0एल0-2सी,

बी0डब्लू0एफ0एल0-2डी) लाइसेंस शुल्क का भुगतान किये जाने, प्रतिभूति धनराशि जमा कियेे जाने और आबकारी आयुक्त के पक्ष में प्रपत्र बी0डब्ल्यू0एफ0एल0-3 में सामान्य बन्ध-पत्र निष्पादित किये जाने पर स्वीकृत/नवीकृत किया जायेगा। बी0डब्लू0एफ0एल0-2डी) लाइसेंस शुल्क का भुगतान किये जाने, प्रतिभूति धनराशि जमा कियेे जाने और आबकारी आयुक्त के पक्ष में प्रपत्र बी0डब्ल्यू0एफ0एल0-3 में सामान्य बन्ध-पत्र निष्पादित किये जाने पर स्वीकृत/नवीकृत किया जायेगा।

(2) विदेशी मदिरा, बीयर, वाइन एवं कम तीब्रता के मादक पेय के थोक विक्रय के लिये विदेशी मदिरा के बंधित गोदाम का लाइसेंस, लाइसेंस प्राप्त अन्य राज्यों की आसवनियों, यवासवनियों, द्राक्षासवनियों को दिया जायेगा। अन्य राज्य के बाटलिंग प्लान्ट का लाइसेंसधारक भी लाइसेंस के लिये अर्ह होगा परन्तु ऐसे लाइसेंसधारक की बाटलिंग इकाई निम्नलिखित मानदण्डों को पूरा करती हो-

(2) विदेशी मदिरा, बीयर, वाइन एवं कम तीव्रता के मादक पेय के थोक विक्रय के लिये विदेशी मदिरा के बंधित गोदाम का लाइसेंस, लाइसेंस प्राप्त अन्य राज्यों की आसवनियों, यवासवनियों, द्राक्षासवनियों को दिया जायेगा। अन्य राज्य के बाटलिंग प्लान्ट का लाइसेंसधारक भी लाइसेंस के लिये अर्ह होगा परन्तु ऐसे लाइसेंसधारक की बाटलिंग इकाई निम्नलिखित मानदण्डों को पूरा करती हो-

(एक) बाटलिंग इकाई की वार्षिक कारबार व्यापारावर्त रुपये 100 करोड़ (राजस्व/आबकारी शुल्क सहित) से कम न हो;

(दो) बाटलिंग इकाई की वार्षिक उत्पादन

(तीन) बाटलिंग इकाई का कारवार कम से कम 03 राज्यों में हो, जिसमें प्रत्येक की जनसंख्या एक करोड़ से कम न हो;

(3) लाइसेंस की स्वीकृति हेतु आवेदन प्रपत्र बी0डबलू0एफ0एल0-1 में किया जायेगा। यदि राज्य के बाहर की कोई इकाई विभिन्न जिलों में बाण्ड लेना चाहे तो ऐसा एकल आवेदन के द्वारा किया जा सकता है। उक्त इकाई प्रत्येक जिला/लाइसेंस हेतु पृथक-पृथक लाइसेंस फीस प्रभारित करेगी।

स्तम्भ-2 एतदद्वारा प्रतिस्थापित नियम (4) प्रतिभूति धनराशि आबकारी आयुक्त द्वारा राज्य सरकार की पूर्व अनुमति से निर्धारित की जायेगी, जो आबकारी आयुक्त, उत्तर प्रदेश के पक्ष में गिरवीकृत सावधि जमा रसीद के रूप में अथवा ई-पेमेन्ट के माध्यम से जमा की जायेगी ।

(4) प्रतिभूति धनराशि आबकारी आयुक्त द्वारा राज्य सरकार की पूर्व अनुमति से निर्धारित की जायेगी, जो आबकारी आयुक्त, उत्तर प्रदेश के पक्ष में गिरवीकृत सावधि जमा रसीद के रूप में अथवा ई-पेमेन्ट के माध्यम से जमा की जायेगी ।

(5) लाइसेंस फीस, लाइसेंसधारी द्वारा ई-पेमेन्ट के माध्यम से सरकारी कोषागार में या राष्ट्रीयकृत बैंक द्वारा निर्गत बैंक ड्राफ्ट, जो आबकारी आयुक्त को संदेय हो, जमा की जायेगी।

(6) लाइसेंस की अवधि एक आबकारी वर्ष अथवा उसके आंशिक भाग के लिए होगी, जिसके लिये लाइसेंस स्वीकृत किया गया हो।

(7) लाइसेंसधारी को लाइसेंस किसी अन्य व्यक्ति (7) लाइसेंसधारी को लाइसेंस किसी अन्य व्यक्ति को अन्तरित करने अथवा उप-पट्‌टे पर देने की अनुमति नहीं होगी।

(8) राज्य के बाहर की किसी इकाई, जिसकी अन्य राज्यों में कई इकाईयां हाें,जो उत्तर प्रदेश में बाण्ड लाइसेंस लेकर अपनी विभिन्न इकाईयों एवं एफ0एल0-1 और एफ0एल0-1ए को सम्मिलित करते हुए एक मास्टर वेयर हाउस से विनिर्मित आई0एम0एफ0एल0/बीयर/ वाइन/एल0ए0बी0 की बिक्री एक ही परिसर से करना चाहती हों, को प्रत्येक इकाई के लिये विहित लाइसेंस फीस प्रभारित करने के पश्चात्‌ अनुमति प्रदान की जायेगी। प्रतिबन्ध यह है विभिन्न इकाईयों के पारेषण उन परिसरों में पृृथक-पृथक भण्डारित किये जायेेंगे। परन्तु यह और कि प्रपत्र वि0म0-2 एवं वि0म0-2ख में लाइसेंसधारण करने व कोई थोक लाइसेंसधारक, एकल मांग पत्र के अन्तर्गत भारत निर्मित विदेशी मदिरा/ बीयर/वाइन/ कम तीब्रता के मादक पेय के विभिन्न ब्राण्डों की आपूर्ति ऐसे मास्टर वेयरहाउस से प्राप्त कर सकता है।

परन्तु यह और कि प्रपत्र वि0म0-2 एवं वि0म0-2ख में लाइसेंसधारण करने व कोई थोक लाइसेंसधारक, एकल मांग पत्र के अन्तर्गत भारत निर्मित विदेशी मदिरा/ बीयर/वाइन/कम तीब्रता के मादक पेय के विभिन्न ब्राण्डों की आपूर्ति ऐसे मास्टर वेयरहाउस से प्राप्त कर सकता है।

प्रपत्र बी0 डब्लू एफ0 एल0-2ए, बी0 डब्लू एफ0 एल0-2बी, बी0 डब्लू एफ0 एल0-2सी एवं बी0 डब्लू एफ0 एल0-2डी में लाइसेंस का नवीकरण, आबकारी आयुक्त अथवा उसके द्वारा प्राधिकृत अधिकारी राज्य सरकार द्वारा विहित निबन्धन एवं शर्तों के अध्यधीन कर सकता है।

प्रपत्र बी0डब्लूएफ0एल0-2ए, बी0डब्लू0एफ0एल0-2बी, बी0डब्लूएफ0एल0-2सी एवं बी0डब्लू0एफ0एल0-2डी एवं मास्टर वेयर हाउस में लाइसेंस का नवीकरण, आबकारी आयुक्त अथवा उसके द्वारा प्राधिकृत अधिकारी, राज्य सरकार द्वारा विहित निबन्धन एवं शर्तों के अध्यधीन कर सकता है।

(9) नवीकरण की स्थिति में पूर्व में नकद अथवा राष्ट्रीय बचत पत्र के माध्यम से जमा की गयी प्रतिभूति तब तक स्वीकार्य होगी, जब तक इसकी वापसी न कर दी जाय।

(9) नवीकरण की स्थिति में पूर्व में नकद अथवा राष्ट्रीय बचत पत्र के माध्यम से जमा की गयी प्रतिभूति तब तक स्वीकार्य होगी, जब तक इसकी वापसी न कर दी जाय।4 उत्तर प्रदेश असाधारण गजट, 31 मई, 2021 ई0 3-नियम-10 का संशोधन-उक्त नियमावली में नीचे स्तम्भ-1 में दिये गये विद्यमान नियम-10 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात्‌-

स्तम्भ-1 विद्यमान नियम

स्तम्भ-2 एतदद्वारा प्रतिस्थापित नियम 10-मदिरा का संग्रह-जब तक आबकारी आयुक्त अन्यथा आदेश न दे समस्त शराब बंधित गोदाम में सील बन्द बोतलों में संग्रहण की जायेगी।

10-मदिरा का भण्डारण-जब तक आबकारी आयुक्त अन्यथा आदेश न दे, समस्त मदिरा बंधित गोदाम में सील बन्द बोतलों, कैनों/टेट्रा पैक्स में भण्डारित की जायेगी।

परन्तु विदेशी मदिरा के भण्डारण के लिए अस्थायी गोदाम परिसर,आबकारी आयुक्त द्वारा विहित फीस के भुगतान पर प्रदान किये जा सकेंगे।

4-नियम-18 का संशोधन-उक्त नियमावली में, नीचे स्तम्भ-1 में दिये गये विद्यमान नियम-18 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात-

तथा ब्राण्ड रजिस्ट्रीकरण व लेबुल अनुमोदन- लाइसेंसधारी ब्राण्ड पंजीयन, लेबुल अनुमोदन, अधिकतम्‌ थोक विक्रय मूल्य अधिकतम्‌ थोक विक्रय मूल्य व अधिकतम्‌ फुटकर विक्रय मूल्य के अनुमोदन हेतु लेबुल, समस्त ब्राण्डों तथा एक्स बाण्ड दर की विस्तृत सूची आबकारी आयुक्त को प्रस्तुत करेगा। वर्ष के दौरान थोक विक्रय मूल्य और अधिकतम्‌ फुटकर विक्रय मूल्य में कोई परिवर्तन जब तक आबकारी आयुक्त द्वारा आदेश न किया जाय, नहीं किया जायेगा। आबकारी आयुक्त द्वारा अनुमोदित अधिकतम्‌ फुटकर विक्रय मूल्य बोतलों के लेबुलों पर मुद्रित करायेगा।

लाइसेंसधारी ब्राण्ड रजिस्ट्रीकरण, लेबुल अनुमोदन, अधिकतम्‌ थोक विक्रय मूल्य व अधिकतम्‌ फुटकर विक्रय मूल्य के अनुमोदन हेतु लेबुल, समस्त ब्राण्डों तथा एक्स बाण्ड दर की विस्तृत सूची आबकारी आयुक्त को प्रस्तुत करेगा। वर्ष के दौरान थोक विक्रय मूल्य और अधिकतम्‌ फुटकर विक्रय मूल्य में कोई परिवर्तन स्वीकार्य नहीं होगा जब तक विशिष्टतया आबकारी आयुक्त द्वारा अनुज्ञात नही किया जाय। आबकारी आयुक्त द्वारा अनुमोदित अधिकतम्‌ फुटकर विक्रय मूल्य बोतलों के लेबुलों पर मुद्रित करायेगा।

उत्तर प्रदेश में आयात की जाने वाली विदेशी मदिरा की पेटियों (कार्टन) की समस्त छः सतहों (फेस) पर लाल रंग की डेढ इंच चौड़ी पट्‌टी पर न्यूनतम एक इंच आकार के काले रंग के अक्षरों ''फार सेल इन यूपी'' इन बोतलों पर अंतःव्यापित मुद्रित कराया जायेगा।

परन्तु यदि राज्य के बाहर की केाई ईकाई विभिन्न जिलों में बाण्ड लाइसेंस प्राप्त करना चाहे, तो ब्राण्ड, लेबुलअधिकतम थोक विक्रय मूल्य एवं अधिकतम फुटकर विक्रय मूल्य का अनुमोदन एक ही बार कराया जायेगा एंव ऐसे प्रत्येक बाण्ड हेतु पृथक अनुमोदन की आवश्यकता नही होगी।

NOTIFICATION

In exercise of the powers under section-41 of the United Provinces Excise Act, 1910 (U.P. Act no IV of 1910), read with section 21 of the Uttar Pradesh General Clauses Act, 1904 (U.P. Act no 1 of 1904) the Excise Commissioner, Uttar Pradesh with the previous sanction of the State Government, makes the following rules with a view to amending the Uttar Pradesh Excise (Settlement of Licenses for Foreign Liquor Bonded Warehouses) Rules, 2011 for the grant of licenses of Foreign Liquor Bonded Warehouse under clause(d) of section 18 of the said Act of 1910 on fixed license fee in supersession of all the previous rules published in this behalf to the extent of their inconsistency with these rules.

THE UTTAR PRADESH EXCISE (SETTLEMENT OF LICENSESFOR FOREIGN LIQUOR BONDED WAREHOUSE ) (SEVENTH AMENDMENT) RULES, 2021

1. Short title and Commencement–(1) These rules may be called the Uttar Pradesh Excise (Settlement of Licenses for Foreign Liquor Bonded Warehouse) (Seventh amendment) Rules, 2021.

(2) They shall come into force with effect from the date of their publication in the Gazette.

2. Amendment of rule-3–In the Uttar Pradesh Excise (Settlement of Licenses for Foreign Liquor Bonded Warehouses) Rules, 2011hereafter referred to as the said rules, for existing rule 3 set out in Column I below, the rule as set out in Column II shall be substituted, namely :

(1) The Licenses for Foreign liquor bonded warehouse on a defined format of annexed (BWFL- 2A, BWFL-2B, BWFL-2C and BWFL-2D) for issue of Foreign liquor in wholesale shall be granted/renewed by Excise Commissioner or an Officer authorized by him, not below the rank of Joint Excise Commissioner on payment of License fee, deposit of the security amount and execution of general bond in form BWFL-3 in favour of the Excise Commissioner.

10. Storage of Liquor-All liquor shall be stored in the bonded warehouse in sealed glass bottles, cans/tetrapacks unless the Excise Commissioner orders otherwise.

Provided that temporary ware house premises for storage of foreign liquor may be granted by Excise Commissioner on payment of fee prescribed .

4. Amendment of Rule-18–In the said rules for existing rule-18 set out in Column I below, the rule as setout in Column II shall be substituted, namely–

Brand Registration and Label Approval– The licensee shall furnish an exhaustive list of all the brands, its labels and the ex-bond rates to the Excise Commissioner for approval of Brand Registration, Label approval, MWP and MRP. No change in wholesale price and maximum retail price shall be allowed during the year unless specially permitted by the Excise Commissioner. The maximum retail price approved by the Excise Commissioner shall be printed on the labels of bottles.

On all the six faces of the cartons of foreign liquor to be imported in Uttar Pradesh, "For Sale in U.P.", embeddedon the bottles itself, shall be printed in the minimum size of one inch black letters on a red strip of one and a half inch broad.

Provided that if any out of state unit desires to obtain bond licenses in various districts, approval of Brand, Label, MWP and MRPshall be done only once and no separate approvals are required for each such bond.
