संयुक्त प्रान्त आबकारी अधिनियम, 1910 (संयुक्त प्रान्त अधिनियम संख्या 4 सन्‌ 1910) की धारा 41 के अधीन प्रदत्त शक्तियों का प्रयोग करके, आबकारी आयुक्त, उत्तर प्रदेश, राज्य सरकार की पूर्व स्वीकृति से उत्तर प्रदेश आबकारी (विदेशी मदिरा के प्रीमियम फुटकर विक्रय के लाइसेंसों का व्यवस्थापन) नियमावली, 2020, में संशोधन करने की दृष्टि से निम्नलिखित नियमावली बनाते हैं-

का व्यवस्थापन) (प्रथम संशोधन) नियमावली, 2021

1-संक्षिप्त नाम एवं प्रारम्भ-(1) यह नियमावली उत्तर प्रदेश आबकारी (विदेशी मदिरा के प्रीमियम फुटकर विक्रय के लाइसेंसों का व्यवस्थापन) (प्रथम संशोधन) नियमावली, 2021 कही जायेगी।

(2) यह गजट में प्रकाशित किये जाने के दिनांक से प्रवृत्त होगी।2 उत्तर प्रदेश असाधारण गजट, 31 मई, 2021 ई0 2-नियम-2 का संशोधन-उत्तर प्रदेश आबकारी (विदेशी मदिरा के प्रीमियम फुटकर विक्रय के लाइसेंसों का व्यवस्थापन) नियमवली, 2020, जिसे आगे उक्त नियमावली कहा गया है, में नीचे स्तम्भ-1 में दिए गए विद्यमान नियम-2 के स्थान पर स्तम्भ-2 में दिया गया नियम रख रख दिया जायेगा, अर्थात्‌-

स्तम्भ-1 विद्यमान नियम

स्तम्भ-2 एतदद्वारा प्रतिस्थापित नियम 2-परिभाषा-

2-परिभाषा-

(1) जब तक विषय या संदर्भ से कोई बात प्रतिकूल (1) जब तक विषय या संदर्भ से कोई बात न हो, इस नियमावली में-

प्रतिकूल न हो, इस नियमावली में-

(क) ''अधिनियम'' का तात्पर्य समय-समय पर यथा संशोध्ेिात संयुक्त प्रान्त आबकारी अधिनियम 1910 से है।

(क) ''अधिनियम'' का तात्पर्य समय-समय पर यथा संशोध्ेिात संयुक्त प्रान्त आबकारी अधिनियम 1910 से है;

(ख) ''आबकारी वर्ष'' का तात्पर्य दिनांक 01 अपै्रल से प्रारम्भ होकर कैलेण्डर वर्ष के 31 मार्च तक चलने वाले वित्तीय वर्ष से है।

(ख) ''आबकारी वर्ष'' का तात्पर्य दिनांक 01 अपै्रल से प्रारम्भ होकर कैलेण्डर वर्ष के 31 मार्च तक चलने वाले वित्तीय वर्ष से है;

(ग) ''परिवार'' का तात्पर्य इसमें सम्मिलित दम्पत्ति (पति-पत्नी), आश्रित पुत्र/पुत्रों, अविवाहित पुत्री/पुत्रियाें और आश्रित माता-पिता से है।

(ग) ''परिवार'' का तात्पर्य इसमें सम्मिलित दम्पत्ति (पति-पत्नी), आश्रित पुत्र/पुत्रों, अविवाहित पुत्री/पुत्रियाें और आश्रित माता-पिता से है;

(घ) ''विदेशी मदिरा'' का तात्पर्य निम्नलिखित

(घ) ''विदेशी मदिरा'' का तात्पर्य निम्नलिखित से है जिसमें निम्नलिखित सम्मिलित है-

से है जिसमें निम्नलिखित सम्मिलित है- (1) आयातित विदेशी मदिरा-बीयर और स्प्रिट, वाइन्स और लिकर्स जिन्हें भारत में मानव उपभोग के आशय से आयात किया गया हो और जिनपर ऐसे आयात के लिये सीमाशुल्क अधिनियम, 1962 के साथ पठित सीमाशुल्क टैरिफ अधिनियम, 1975 के अधीन शुल्क संदेय हो।

(1) समुद्रपार विदेशी मदिरा-बीयर और स्प्रिट, वाइन्स और लिकर्स जिन्हें भारत में मानव उपभोग के आशय से आयात किया गया हो और जिनपर ऐसे आयात के लिये सीमाशुल्क अधिनियम, 1962 के साथ पठित सीमाशुल्क टैरिफ अधिनियम, 1975 के अधीन शुल्क संदेय हो;

(2) भारत निर्मित विदेशी मदिरा (आई0एम0एफ0एल0)-भारत में निर्मित स्प्रिट या मदिरा, जिसे सुगंघ या रंग की दृष्टि से भारत में आयातित स्प्रिट या मदिरा के समान परिष्कृत किया गया हो और जिसमें माल्ट स्प्रिट, व्हिस्की, ब्रान्डी, रम, जिन, बोद्‌का व लीकर्स सम्मिलित है। इसमें भारत में निर्मित बीयर, पैक की हुयी ड्राट बीयर, पोर्टर, साइडर, ऐल, वाइन व कम तीव्रता के मादक पेय (एल0ए0बी0) भी सम्मिलित है।

(2) भारत निर्मित विदेशी मदिरा (आई0एम0एफ0एल0)-भारत में निर्मित स्प्रिट या मदिरा, जिसे सुगंधया रंग की दृष्टि से भारत में आयातित स्प्रिट या मदिरा के समान परिष्कृत किया गया हो और जिसमें माल्ट स्प्रिट, व्हिस्की, ब्रान्डी, रम, जिन, बोद्‌का व लीकर्स सम्मिलित है। इसमें भारत में निर्मित बीयर, पैक की हुयी ड्राट बीयर, पोर्टर, साइडर, ऐल, वाइन व कम तीव्रता के मादक पेय (एल0ए0बी0) भी सम्मिलित है;

(ङ) ''प्रपत्र'' का तात्पर्य इस नियमावली के

(ङ) ''प्रपत्र'' का तात्पर्य इस नियमावली के साथ संलग्न प्रपत्र से है।

स्तम्भ-1 विद्यमान नियम

स्तम्भ-2 एतदद्वारा प्रतिस्थापित नियम (छ) ''व्यक्ति'' का तात्पर्य 21 वर्ष से अन्यून

(छ) ''व्यक्ति'' का तात्पर्य 21 वर्ष से अन्यून व्यक्ति से है, जो भारत का नागरिक हो।

व्यक्ति से है, जो भारत का नागरिक हो। (ज) ''लाइसेंस'' का तात्पर्य इस नियमावली

(ज) ''लाइसेंस'' का तात्पर्य इस नियमावली के अधीन स्वीकृत लाइसेंस से है।

(झ) ''लाइसेंस प्राधिकारी'' का तात्पर्य जिला (झ) ''लाइसेंस प्राधिकारी'' का तात्पर्य जिला मजिस्ट्रेट/किसी राजस्व जिला के कलेक्टर से है। मजिस्ट्रेट/किसी राजस्व जिला के कलेक्टर से है;

() ''लाइसेंस फीस'' का तात्पर्य प्रीमियम फुटकर विक्रय में विदेशी मदिरा के फुटकर विक्रय के एकान्तिक विशेषाधिकार के लिए लाइसेंस स्वीकृत करने हेतु राज्य सरकार के परामर्श से, आबकारी आयुक्त द्वारा समय-समय पर किसी आबकारी वर्ष के लिए प्रतिफल फीस के रुप में वसूल की जाने वाली नियत धनराशि से हैः परन्तु यदि ऐसा लाइसेंस आबकारी वर्ष प्रारम्भ होने के पश्चात निर्गत किया जाता है, तो वर्ष के बाकी अवधि के लिए लाइसेंस फीस का निर्धारण आबकरी वर्ष के अवशेष बचे त्रैमासों की संख्या के अनुसार किया जायेगा। एक त्रैमास के लिए लाइसेंस फीस का निर्धारण समानुपातिक रुप से किया जायेगा।

परन्तु यह कि यदि ऐसा लाइसेंस आबकारी वर्ष प्रारम्भ होने के पश्चात निर्गत किया जाता है, तो वर्ष के बाकी अवधि के लिए लाइसेंस फीस का निर्धारण आबकरी वर्ष के अवशेष बचे त्रैमासों की संख्या के अनुसार किया जायेगा। एक त्रैमास के लिए लाइसेंस फीस का निर्धारण समानुपातिक रुप से किया जायेगा।

(ट) ''माल'' का तात्पर्य विभिन्न वस्तुओं की बिक्री हेतु बहु लाइसेंस रखने वाली एकल फर्म/कम्पनीके स्वामित्व वाले किसी परिसर में स्थित न्यूनतम 10,000 वर्ग फुट प्लिंथ क्षेत्रफल वाले किसी बडे़ भवन अथवा भवनों (क्रेताओं/ भ्रमणकर्ताओं हेतु एक ही तल अथवा विभिन्न तलों पर परस्पर मिले हुये मार्गों, सामूहिक पारगमन क्षेत्र और अग्रदीर्घा, प्रांगण, वाहन पार्किंग सुविधा सहित) जिनमें बडे़ व्यावसायिक काम्प्लेक्सों में विभिन्न प्रकार की प्रवेश योग्य दुकान/दुकानें हों, से है। इसमें विभिन्न वस्तुओं की फुटकर बिक्री के डिपार्टमेंटल स्टोर्स या सुपर मार्केट या हाइब्रिड हाइपर मार्केट भी सम्मिलित हैं।

(ट) ''माल'' का तात्पर्य विभिन्न वस्तुओं की बिक्री हेतु बहु लाइसेंस रखने वाली एकल फर्म/कम्पनीके स्वामित्व वाले किसी परिसर में स्थित न्यूनतम 10,000 वर्ग फुट प्लिंथ क्षेत्रफल वाले किसी बडे़ भवन अथवा भवनों (क्रेताओं/भ्रमणकर्ताओं हेतु एक ही तल अथवा विभिन्न तलों पर परस्पर मिले हुये मार्गों, सामूहिक पारगमन क्षेत्र और अग्रदीर्घा, प्रांगण, वाहन पार्किंग सुविधा सहित) जिनमें बडे़ व्यावसायिक काम्प्लेक्सों में विभिन्न प्रकार की प्रवेश योग्य दुकान/दुकानें हों, से है। इसमें विभिन्न वस्तुओं की फुटकर बिक्री के डिपार्टमेंटल स्टोर्स या सुपर मार्केट या हाइब्रिड हाइपर मार्केट भी सम्मिलित हैं।

(ठ) ''प्रतिभूति धनराशि'' का तात्पर्य लाइसेंस फीस के एक चौथाई धनराशि के समतुल्य धनराशि, जो सावधि जमा रसीद के माध्यम से जिला आबकारी अधिकारी के पक्ष में गिरवीकृत होगी अथवा ई-पेमेंन्ट के माध्यम से जमा की जायेगी और जो लाइसेंस संचालन में लाइसेंसधारी द्वारा किये गये किसी व्यतिक्रम की स्थिति में समपहृत किये जाने योग्य होगी, से है।

स्तम्भ-2 एतदद्वारा प्रतिस्थापित नियम (ड) ''परिवहन अनुज्ञा पत्र'' का तात्पर्य थोक

(ड) ''परिवहन अनुज्ञा पत्र'' का तात्पर्य लाइसेंस यथा एफ0एल0-2, एफ0एल0-2बी, एफ0 थोक लाइसेंस यथा एफ0एल0-2, एफ0एल0-2बी, एल0-2डी और सीमाशुल्क बंधपत्र से विदेशी मदिरा एवं बी0आई0ओ0-1 से विदेशी मदिरा के परिवहन के परिवहन हेतु जारी अनुज्ञापन से है।

हेतु जारी अनुज्ञापन से है।

(ढ) ''आस्वादन कक्ष''का तात्पर्य लाइसेंस

परिसर के भीतर एक अलग स्थान, जहांॅक्रेता को

वाइन के आस्वादन की सुविधा अनुज्ञेय हो, से है। (2) इस नियमावली में प्रयुक्त किन्तु अपरिभाषित (2) इस नियमावली में प्रयुक्त किन्तु अपरिभाषित शब्द और पदो के वही अर्थ होंगे जो अधिनियम में उनके शब्द और पदो के वही अर्थ होंगे जो अधिनियम में उनके लिए क्रमशः समनुदेशित हैं।

3-नियम-3 का संशोधन-उक्त नियमावली में नीचे स्तम्भ-1 में, दिए गए विद्यमान नियम-3 के स्थान पर स्तम्भ- 2 में दिया गया नियम रख दिया जायेगा, अर्थात्‌-

स्तम्भ-2 एतदद्वारा प्रतिस्थापित नियम 3. विदेशी मदिरा के प्रीमियम फुटकर विक्रय के 3. विदेशी मदिरा के प्रीमियम फुटकर विक्रय के लिए लाइसेंस-

लिए लाइसेंस-

मालमेंसील्ड बोतलों/पैकेटों में विदेशी मदिरा

माल में सील्ड बोतलों/पैकेटों में विदेशी की फुटकर बिक्री हेतु प्रपत्र वि0म0-4ग में लाइसेंस, मदिरा की फुटकर बिक्री हेतु प्रपत्र वि0म0-4ग में लाइसेंस प्राधिकारी द्वारा निम्नांकित शर्तों के अधीन लाइसेंस, लाइसेंस प्राधिकारी द्वारा निम्नांकित शर्तों प्रदान किये जायेंगेः

के अधीन प्रदान किये जायेंगेः

(एक) यह कि विक्रय हेतु दुकान

(एक) यह कि विक्रय हेतु दुकान न्यूनतम 500 वर्ग फुट कार्पेट क्षेत्र में होगी

न्यूनतम 500 वर्ग फुट कार्पेट क्षेत्र में होगी और दुकानों में ग्राहकों हेतु प्रवेश करने तथा

और दुकानों में ग्राहकों हेतु प्रवेश करने तथा अपनी इच्छानुसार शेल्फ से ब्राण्ड चुनने की

(दो) यह कि विक्रय हेतु दुकान अच्छी

स्तम्भ-2 एतदद्वारा प्रतिस्थापित नियम (चार) यह कि दुकान का लाइसेंसधारी

(चार) यह कि दुकान का लाइसेंसधारी केवल उन्हीं श्रेणियों की विदेशी मदिरा, जिसे

केवल उन्हीं श्रेणियों की विदेशी मदिरा, जिसे आबकारी आयुक्त द्वारा यथा स्थिति अधिकृत

आबकारी आयुक्त द्वारा यथा स्थिति प्राधिकृत किया जाय, की बिक्री सील्ड बोतलों/पैकेटों

किया जाय, की बिक्री सील्ड बोतलों/पैकेटों में व्यक्तियों को करेगा।

(पॉच) यह कि दुकान का लाइसेंसधारी व्यक्तियों को परिसर में उपभोग हेतु मदिरा की बिक्री नहीं करेगा।

(छः) यह कि दुकान का लाइसेंसधारी किसी अन्य लाइसेंसधारी को मदिरा की बिक्री नहीं करेगा।

(सात) इस संबंध में ऐसी अन्य शर्तें, जिन्हें आबकारी आयुक्त अधिरोपित करना उचित समझें।

(आठ) यह कि दुकान का लाइसेंसधारी

क्रेता को वाइन आस्वादन कक्ष की सुविधा

प्रदान करेगा।

(नौ) यह कि दुकान का लाइसेंसधारी,

मदिरा उपभोग से सम्बन्धित उपसाधन की

बिक्री कर सकेगा।

4-नियम-18 का संशोधन-उक्त नियमावली में नीचे स्तम्भ-1 में, दिए गए विद्यमान नियम-18 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात्‌-

स्तम्भ-2 एतदद्वारा प्रतिस्थापित नियम स्तम्भ-1 विद्यमान नियम

18. केवल शुल्क संदत्त विदेशी मदिरा की बिक्री- 18. केवल शुल्क संदत्त विदेशी मदिरा की बिक्री- (1) लाइसेंसधारी केवल (क)आयातित विदेशी मदिरा (1) लाइसेंसधारी केवल (क) समुद्र पार विदेशी ब्राण्डों, (ख) स्काच या इससे उच्च श्रेणी के भारत मदिरा ब्राण्डों, (ख) स्काच या इससे उच्च श्रेणी के निर्मित विदेशी मदिरा ब्राण्डों, (ग) ब्राण्डी, जिन और वाइन भारत निर्मित विदेशी मदिरा ब्राण्डों (ग) ब्राण्डी, जिन और के समस्त श्रेणियों के ब्राण्ड, (घ)वोदका एवं रम के रुपया वाइन की समस्त श्रेणियॉ, (घ) राज्य सरकार के पूर्व 700.00 तथा उससे अधिक के अधिकतम फुटकर मूल्य अनुमोदन से आबकारी आयुक्त द्वारा यथा विहित वाले ब्राण्ड, और (ड) रुपया 160.00 प्रति 500 एम0एल0 अधिकतम फुटकर मूल्य की वोदका, रम और बीयर के कैन के अधिकतम फुटकर मूल्य वाली या इसके समतुल्य ब्राण्ड और (ड) कम तीव्रता के मादक पेय के समस्त बीयर ब्राण्डों की बिक्री करेगा।

ब्राण्डकी बिक्री करेगा।

परन्तु यह कि आबकारी आयुक्त द्वारा अनुज्ञा प्राप्त

समस्त एस0के0यू0 (स्टॉक कीपिंग यूनिट) में पात्र ब्राण्डों

की बिक्री की जा सकती है।6 उत्तर प्रदेश असाधारण गजट, 31 मई, 2021 ई0 स्तम्भ-1 विद्यमान नियम

स्तम्भ-2 एतदद्वारा प्रतिस्थापित नियम (2) लाइसेंसधारी, विदेशी मदिरा, एफ0एल0 2, एफ0एल0 2बी, एफ0एल 2डी के लाइसेंस धारक से या आबकारी आयुक्त द्वारा प्राधिकृत किसी लाइसेंसधारी से प्राप्त करेगा। एफ0एल0-2, एफ0एल0-2बी, एफ0एल0-2डी के थोक लाइसेंसधारी से किसी ब्राण्ड की अनुपलब्धता की स्थिति में लाइसेंसधारी, लाइसेंस प्राधिकारी के पूर्व अनुमोदन से सीमा शुल्क बन्ध-पत्रों से विदेशी मदिरा प्राप्त कर सकता है।

(2) लाइसेंसधारी, विदेशी मदिरा, एफ0एल0 2, एफ0एल0 2बी, बी0आई0ओ0-1 लाइसेंसधारक या आबकारी आयुक्त द्वारा प्राधिकृत किसी लाइसेंसधारी से प्राप्त करेगा। आयातक इकाइयों में समुद्रपार विदेशी मदिरा के किसी प्रकार के ब्राण्डों की अनुपलब्धता की स्थिति में प्राधिकृत व्यक्तियों द्वारा आबकारी आयुक्त की विशेष अनुज्ञा के अधीन इन ब्राण्डों को उत्तर प्रदेश में समुद्रंपार की विदेशी मदिरा का आयात नियमावली, 2003 के उपबंधों के अधीनअन्य राज्यों या संघ राज्य क्षेत्रों में स्थापित कस्टम बाण्डों से प्राप्त किया जा सकता है।

(3) लाइसेंसधारी किसी व्यक्ति को भू-गृहादि के ''भीतर'' उपभोग के लिये किसी विदेशी मदिरा का विक्रय नही करेगा और कोई विदेशी मदिरा किसी अन्य लाइसेंसधारी को विक्रीत नही करेगा।

(3) लाइसेंसधारी किसी व्यक्ति को भू-गृहादि के ''भीतर'' उपभोग के लिये किसी विदेशी मदिरा का विक्रय नही करेगा और कोई विदेशी मदिरा किसी अन्य लाइसेंसधारी को विक्रय नही करेगा।

(4) लाइसेंसधारी केवल आयातित विदेशी मदिरा और भारत निर्मित विदेशी मदिरा के केवल उन्हीं ब्राण्डों की बिक्री करेगा जो आबकारी आयुक्त द्वारा अनुमोदित धारिताओं की मुहरबंद बोतलों/पैकेटों में उत्तर प्रदेश में बिक्री हेतु पंजीकृत हैं।

(5) लाइसेंसधारी अनुज्ञात थोक विक्रेताओं/सीमा शुल्क बन्ध-पत्रों से क्रय किये गये स्टाको के सिवाय किसी प्रकार की विदेशी मदिरा का संचय या विक्रय लाइसेंस प्राप्त परिसर में नहीं करेगा जिसके क्रय, संचय या बिक्री हेतु वह अधिनियम या तद्‌धीनबनाई गयी नियमावली, विनियमावली या आदेशों के उपबन्धों के अधीन प्राधिकृत न हो।

(5) लाइसेंसधारी अनुज्ञात थोक विक्रेताओं/ बी0आई0ओ0-1 से क्रय किये गये स्टाक के सिवाय किसी प्रकार की विदेशी मदिरा का संचय या विक्रय लाइसेंस प्राप्त परिसर में नहीं करेगा जिसके क्रय, संचय या बिक्री हेतु वह अधिनियम या तद्‌धीनबनाई गयी नियमावली, विनियमावली या आदेशों के उपबन्धों के अधीन प्राधिकृत न हो।

(6) लाइसेंसधारी लाइसेंस प्राप्त परिसर से भिन्न किसी स्थान पर विदेशी मदिरा संचित नही करेगा। लाइसेंसधारी लाइसेंस प्राप्त परिसर के बाहर या उसके निकट अनधिकृत रुप में रखी गयी किसी विदेशी मदिरा के लिए उत्तरदायी होगा।

(7) लाइसेंसधारी सुसंगत नियमावली के अधीन जारी परिवहन पास के माध्यम से लाइसेंस प्राप्त परिसर के लिए विदेशी मदिरा का परिवहन करेगा।

(7) लाइसेंसधारी सुसंगत नियमावली के अधीन जारी परिवहन पास के माध्यम से लाइसेंस प्राप्त परिसर के लिए विदेशी मदिरा का परिवहन करेगा। (8) दुकान मे उपलब्ध प्रत्येक विदेशी मदिरा की बोतल पर निर्माता के लेबिल और सुरक्षा कोड के अतिरिक्त ढक्कन पर आबकारी आयुक्त द्वारा विहित लेबिल चस्पा होगा।

यह लाइसेंस निम्नलिखित सामान्य और विशेष शर्तों के अध्यधीन है, जिसमेंंं से किसी का व्यतिक्रम करने पर या संयुक्त प्रान्त आबकारी अधिनियम-1910 या स्वापक औषधि एवं मनः प्रभावी पदार्थ अधिनियम 1985 के अधीन किसी अपराध के लिए लाइसेंसधारी/ लाइसेंसधारियों के दोष सिद्धि पर या उत्तर प्रदेश गुंडा नियंत्रण अधिनियम ,1970 के अधीन बहिष्कृत होने पर सुसंगत विधियों के अधीन अधिरोपित किन्हीं शास्तियों के अतिरिक्त लाइसेंस रद्‌द किये जाने योग्य होगा तथा लाइसेंस फीस और प्रतिभूति धनराशि समपहृत किए जाने योग्य होगी।

सामान्य और विशेष शर्ते सामान्य और विशेष शर्ते

एक-लाइसेंसधारी, जिला के वि0म0-2, वि0म0-2ख, वि0म0-2घ लाइसेंस धारक से अथवा आबकारी आयुक्त द्वारा प्राधिकृत किसी लाइसेंसधारी से विदेशी मदिरा की आपूर्ति, समय-समय पर उदग्रहणीय समस्त करों, प्रतिफल फीस, उपकर आदि को सम्मिलित करते हुए मदिरा के मूल्य का पूर्ण भुगतान करने के पश्चात्‌ प्राप्त करेगा। वि0 म0-2, वि0म0-2ख, वि0म0-2घ के थोक लाइसेंस में किसी ब्राण्ड की अनुपलब्धता की स्थिति में लाइसेंसधारी, लाइसेंस प्राधिकारी के पूर्व अनुमोदन से कस्टम बाण्ड वेयर हाउस से विदेशी मदिरा प्राप्त कर सकता है।

एक- लाइसेंसधारी, वि0म0-2, वि0म0-2ख, बी0आई0ओ0-1 लाइसेंस धारक अथवा आबकारी आयुक्त द्वारा प्राधिकृत किसी लाइसेंसधारी से विदेशी मदिरा की आपूर्ति, समय-समय पर उदग्रहणीय समस्त करों, प्रतिफल फीस, उपकर आदि को सम्मिलित करते हुए मदिरा के मूल्य का पूर्ण भुगतान करने के पश्चात्‌ प्राप्त करेगा। आयातक इकाइयों में समुद्रपार विदेशी मदिरा के किसी प्रकार के ब्राण्डों की अनुपलब्धता की स्थिति में प्राधिकृत व्यक्तियों द्वारा आबकारी आयुक्त की विशेष अनुज्ञा के अधीन इन ब्राण्डों को उत्तर प्रदेश में समुद्रंपार की विदेशी मदिरा का आयात नियमावली, 2003 के उपबंधों के अधीन अन्य राज्यों या संघ राज्यक्षेत्रों में स्थापित कस्टम बाण्डों से प्राप्त किया जा सकता है।उत्तर प्रदेश असाधारण गजट, 31 मई, 2021 ई0 9 स्तम्भ-1 विद्यमान नियम

स्तम्भ-2 एतदद्वारा प्रतिस्थापित नियम दो-विदेशी मदिरा की बोतलों के लेबुलों पर अधिकतम्‌ फुटकर मूल्य मुद्रित किया जायेगा। फुटकर लाइसेंसधारी मुद्रित अधिकतम्‌ फुटकर मूल्य से अधिक मूल्य नहीं प्रभारित करेगा।

दो-विदेशी मदिरा की बोतलों के लेबुलों पर अधिकतम्‌ फुटकर मूल्य मुद्रित किया जायेगा। फुटकर लाइसेंसधारी मुद्रित अधिकतम्‌ फुटकर मूल्य से अधिक मूल्य नहीं प्रभारित करेगा।

तीन-लाइसेंस प्राप्त परिसर पर विदेशी मदिरा, बीयर, वाइन एवं कम तीव्रता के मादक पेय की बिक्री केवल परिसर के बाहर उपभोग के लिए की जायेगी। परिसर में मदिरापान निषिद्ध होगा।

तीन-लाइसेंस प्राप्त परिसर पर विदेशी मदिरा, बीयर, वाइन एवं कम तीव्रता के मादक पेय की बिक्री केवल परिसर के बाहर उपभोग के लिए की जायेगी। परिसर में मदिरापान निषिद्ध होगा। चार-विहित तीब्रता और मानक धारिता की मुहरबन्द बोतलों/कैनों में जिनपर आबकारी आयुक्त द्वारा विहित सुरक्षा कोड और लेबिल चस्पा होे विदेशी मदिरा की बिक्री की जायेगी ।

चार-विहित तीब्रता और मानक धारिता की मुहरबन्द बोतलों/कैनों में जिनपर आबकारी आयुक्त द्वारा विहित सुरक्षा कोड और लेबिल चस्पा होे विदेशी मदिरा की बिक्री की जायेगी ।

पॉच-लाइसेंसधारी लाइसेंस प्राधिकारी के द्वारा विहित प्रपत्र और रजिस्टर (एफ0एल0-25ए) में नियमित और सही-सही दैनिक लेखा अनुरक्षित रखेगा। लाइसेंसधारी विक्रय आदि का भी लेखा प्रस्तुत करेगा और निरीक्षणकर्ता प्राधिकारी की अपेक्षानुसार सामग्री तथा दस्तावेजों की सुविधा प्रदान करेगा तथा उन्हें उपलब्ध करायेगा। छः-लाइसेंस धारी विदेशी मदिरा का संपूर्ण स्टाक छः-लाइसेंस धारी विदेशी मदिरा का संपूर्ण स्टाक लाइसेंसप्राप्त परिसर में ही संचित करेगा।

लाइसेंसप्राप्त परिसर में ही संचित करेगा। सात-लाइसेंसधारी दुकान के प्रवेश द्वार पर आबकारी आयुक्त द्वारा अनुमोदित प्रारूप/आकार का एक सहज दृष्य साइनबोर्ड लगाएगा, जिसपर लाइसेंसधारी का नाम, पद, दुकान की अवस्थिति, लाइसेंस की अवधि, दुकान खुलने व बन्द होने का समय और लाइसेंस प्राधिकारी द्वारा यथा विहित अन्य सूचनाएॅं भी मोटे अक्षरों में होंगी।

सात-लाइसेंसधारी दुकान के प्रवेश द्वार पर आबकारी आयुक्त द्वारा अनुमोदित प्रारूप/आकार का एक सहज दृश्य साइनबोर्ड लगाएगा, जिसपर लाइसेंसधारी का नाम, पद, दुकान की अवस्थिति, लाइसेंस की अवधि, दुकान खुलने व बन्द होने का समय और लाइसेंस प्राधिकारी द्वारा यथा विहित अन्य सूचनाएॅं भी मोटे अक्षरों में होंगी। आठ-साइन बोर्ड में निम्नलिखित सूचना भी प्रदर्शित आठ-साइन बोर्ड में निम्नलिखित सूचना भी प्रदर्शित होगीः-

स्तम्भ-2 एतदद्वारा प्रतिस्थापित नियम दस-लाइसेंसधारी किसी भी ऐसे व्यक्ति को विक्रेता के रूप में सेवायोजित नहीं करेगा, जो 21 वर्ष से कम आयु का हो या जो किसी संक्रामक रोग या छुआ-छूत रोग से ग्रस्त हो या आपराधिक पृष्ठभूमि का हो या महिला हो।

दस-लाइसेंसधारी किसी भी ऐसे व्यक्ति को विक्रेता के रूप में नियोजित नहीं करेगा, जो 21 वर्ष से कम आयु का हो या जो किसी संक्रामक रोग या छुआ-छूत रोग से ग्रस्त हो या आपराधिक पृष्ठभूमि का हो या महिला हो।

ग्यारह-लाइसेंसधारी परमिट के सिवायएक बार में राज्य सरकार के अनुमोदन से आबकारी आयुक्त द्वारा यथाविहितमात्रा से अधिक की बिक्री किसी भी क्रेता को नहीं करेगा।

ग्यारह-सिवाय जब कि अनुमति पत्र हो, लाइसेंसधारी किसी भी क्रेता को 6 लीटर भारत में भरी हुई या आयातित विदेशी मदिरा प्रत्येक अलग-अलग, जिसमें व्हिस्की, ब्राण्डी, रम, (व्हाइट रम सहित) जिन व वोदका सम्मिलित है, 3 लीटर भारत में भरी हुई या आयातित वाइन दोनों अलग-अलग, 2 लीटर अन्य भारतीय व आयातित मदिरा, 7.8 लीटर भारत में भरी व आयातित बीयर, प्रत्येक अलग-अलग और 6 लीटर कम तीव्रता के मादक पेय से अधिक की फुटकर बिक्री एक बार में नहीं करेगा,।

बारह-21 वर्ष से कम आयु के व्यक्ति या वर्दी में किसी बारह- 21 वर्ष से कम आयु के व्यक्ति या वर्दी में किसी सरकारी कर्मी को विक्री नहीं की जायेगी।

सरकारी कर्मी को विक्री नहीं की जायेगी। तेरह-लाइसेंसधारी के लिए किसी दशा में बोतलों या उनके लेबुलों, सुरक्षा कोड और पिल्फरप्रूफ मुहरों से बिगाड़ करना (विकृत करना) सर्वथा निषिद्ध है।

तेरह-लाइसेंसधारी के लिए किसी दशा में बोतलों या उनके लेबुलों, सुरक्षा कोड और पिल्फरप्रूफ मुहरों से बिगाड़ करना (विकृत करना) सर्वथा निषिद्ध है। चौदह-लाइसेंसधारी अपने लाइसेंसप्राप्त परिसर में कोई भी आसव, कैरामल, रंग, सुगंधि, सुरक्षा कोड, लेबुल, कैप्सूल, मुहर या कोई हानिकारक सामग्री नहीं रखेगा।

चौदह-लाइसेंसधारी अपने लाइसेंसप्राप्त परिसर में कोई भी आसव, कैरामल, रंग, सुगंधि, सुरक्षा कोड, लेबुल, कैप्सूल, मुहर या कोई हानिकारक सामग्री नहीं रखेगा।

पन्द्रह-लाइसेंसधारी द्वारा अपनी बिक्री बढ़ाने के लिए खरीददारों को प्रलोभन देना या आकर्षित करने का कार्य जैसे द्यूत या नृत्य कार्यक्रम कराना सर्वथा निषिद्ध है।

सोलह-लाइसेंस प्राप्त परिसर, 14 अप्रैल (अम्बेदकर जयन्ती), 15 अगस्त (स्वतंत्रता दिवस), 2 अक्टूबर (गॉंधी जयन्ती), 26 जनवरी (गणतन्त्र दिवस) और तीन ऐसे अतिरिक्त दिनाें जैसा कि लाइसेंस प्राधिकारी द्वारा बन्दी के लिए अधिसूचित किया जाय, को छोड़कर बिक्री के लिए सभी दिवसों में पूर्वान्ह 10 बजे से रात्रि 10 बजे तक खुला रहेगा। लाइसेंस प्राधिकारी सुसंगत विधियों के उपबन्धों के अधीन कानून और व्यवस्था या सामान्य निर्वाचन से सम्बन्धित क्रिया कलापों आदि के कारण से भी दुकान की प्रीमियम रिटेल बेण्ड की बन्दी के आदेश दे सकता है। उपरोक्त दिन/दिनों में प्रीमियम रिटेल वेण्ड की बन्दी के लिए कोई प्रतिकर देय नहीं होगा।

सोलह-लाइसेंस प्राप्त परिसर, 14 अप्रैल (अम्बेदकर जयन्ती), 15 अगस्त (स्वतंत्रता दिवस), 2 अक्टूबर (गॉंधी जयन्ती), 26 जनवरी (गणतन्त्र दिवस) और तीन ऐसे अतिरिक्त दिनाें जैसा कि लाइसेंस प्राधिकारी द्वारा बन्दी के लिए अधिसूचित किया जाय, को छोड़कर बिक्री के लिए सभी दिवसों में पूर्वान्ह 10 बजे से रात्रि 10 बजे तक खुला रहेगा। लाइसेंस प्राधिकारी सुसंगत विधियों के उपबन्धों के अधीन कानून और व्यवस्था या सामान्य निर्वाचन से सम्बन्धित क्रिया कलापों आदि के कारण से भी दुकान की प्रीमियम फुटकर विक्रय की बन्दी के आदेश दे सकता है। उपरोक्त दिन/दिनों में प्रीमियम फुटकर विक्रय की बन्दी के लिए कोई प्रतिकर देय नहीं होगा।उत्तर प्रदेश असाधारण गजट, 31 मई, 2021 ई0 11 स्तम्भ-1 विद्यमान नियम

स्तम्भ-2 एतदद्वारा प्रतिस्थापित नियम सत्रह-विदेशी मदिरा, बीयर, वाइन एवं एल.ए.बी. की बिक्री को छोड़कर जिसके लिए कि लाइसेंस दिया गया है, लाइसेंसधारी को लाइसेंस प्राप्त परिसर में कोई अन्य व्यवसाय चलाने की अनुज्ञा नहीं प्रदान की जायेगी।

सत्रह-विदेशी मदिरा, बीयर, वाइन एवं एल.ए.बी. की बिक्री को छोड़कर जिसके लिए कि लाइसेंस दिया गया है, लाइसेंसधारी को लाइसेंसप्राप्त परिसर में कोई अन्य व्यवसाय चलाने की अनुज्ञा नहीं प्रदान की जायेगी।

अठठारह-लाइसेंसधारी लाइसेंस की समाप्ति पर अवशेष स्टाक के निस्तारण के लिए लाइसेंस प्राधिकारी को रिपोर्ट करेगा, जिसे नियम-16 के अनुसार निस्तारित किया जायेगा।

उन्नीस-प्रीमियम रिटेल वेण्ड्‌स के लाइसेंस प्राप्त परिसर

में देशी मदिरा या अन्य किसी पदार्थ का भण्डारण नहीं किया जायेगा।

उन्नीस-प्रीमियम फुटकर विक्रय के लाइसेंस प्राप्त परिसर में देशी मदिरा या अन्य किसी पदार्थ का भण्डारण नहीं किया जायेगा।

बीस-लाइसेंसधारी विदेशी मदिरा की बिक्री हेतु डिस्पिेन्सिंग मशीन स्थापित कर सकता है। इक्कीस-लाइसेंसधारी आबकारी आयुक्त या लाइसेंस प्राधिकारी द्वारा समय-समय पर जारी सामान्य एवं विशिष्ट अनुदेशों का पालन करेगा।

बाईस-दुकान का लाइसेंसधारी क्रेता को वाइन के लिए आस्वादन कक्ष की सुविधा प्रदान करेगा।

तेइस-दुकान का लाइसेंसधारी मदिरा उपभोग से

NOTIFICATION

In exercise of powers conferred under section 41 of the United Provinces Excise Act, 1910 (U.P.

Act no. 4 of 1910), the Excise Commissioner, Uttar Pradesh with the previous sanction of the State Government, makes the following rules with a view to amending the Uttar Pradesh Excise (Settlement of Licenses for Premium Retail Vends of Foreign Liquor) Rules, 2020.

THE UTTAR PRADESH EXCISE (SETTLEMENT OF LICENSES FOR PREMIUM RETAIL VENDS OF FOREIGN LIQUOR) (FIRST AMENDMENT)

1. Short title and commencement–(1) These rules may be called the Uttar Pradesh Excise (Settlement of Licenses for Premium Retail Vends of Foreign Liquor) (First Amendment) Rules, 2021.

(2) They shall come into force with effect from the date of their publication in the Gazette.

(k)"Mall" means a large business complex which contains a variety of walk-in store(s) housed in one large building or buildings (with interconnecting pathways, on same or different floors with common passage area for buyers / visitors including the atrium or foyer, having parking facility ) with a minimum plinth area of 10,000 square feet, situated within a compound and is owned by single firm / company having multiple licenses to sell various commodities. It includes departmental stores, super markets or hybrid hyper markets for retail sale of various commodities.

(l) "Security Amount" means the amount equal to one-fourth of the amount of license fee, to be deposited through F.D.R pledged in favor of District Excise Officer or through e- payment within fifteen days of grant of license and is liable to be forfeited in case of any default committed by the licensee in the operation of license.

(m)"Transport permit" means a permit issued for transport of foreign liquor from the wholesale license such as FL-2, FL-2B,FL-2D and custom bond.

In case of non-availability of any brand from wholesale licensee of FL-2, FL-2B FL- 2D, the licensee may procure the foreign liquor from custom bonds with prior approval of licensing authority.

(2) The licensee shall procure Foreign Liquor from license holder of FL-2, FL-2B, BIO-1 or from any licensee authorized by the Excise Commissioner. In case of non-availability of any type of brands of overseas foreign liquor at importing units, authorized persons may procure these brands under special permission of Excise Commissioner from custom bonds established in other states or Union Territories under provisions of import of overseas foreign liquor in Uttar Pradesh Rules 2003.

(3) The licensee shall not sell any foreign liquor to any person for consumption "on" the premises and shall not sell any foreign liquor to any other licensee.

(4) The licensee shall sell only those brands of imported foreign liquor and IMFL which are registered for sale in Uttar Pradesh in sealed bottles/packs and sizes as approved by Excise Commissioner.

(5) The licensee shall not stock or sell in the licensed premises foreign liquor except stocks purchased from the permitted wholesalers / custom bonds, of any kind which he is not authorized to buy, stock or sell under the provisions of the Act or the rules, regulations or orders made there under.

(xiv) The licensee shall not keep in his licensed premises any spirit, caramel, colour, essence, security code, labels, capsules, seals or any other noxious material.

(xv) The licensee is strictly forbidden from having recourse to any form of blandishment or inducement to the customer with a view to increase his sales, such as dancing floors or gambling.

(xvi) The licensed premises shall remain open for sale on all days from 10.00 am to 10.00 pm except on 14th April (Ambedkar Jayanti), 15th August (Independence Day), 2nd October (Gandhi Jayanti), 26th January (Republic Day), and up to 03 more days as notified for closure by the Licensing Authority. The Licensing Authority may also order for closure of premium retail vend on account of law and order or general election related activity under the provisions of relevant laws. No compensation shall be given for the closure of premium retail vend on above dates/days.

(xvii) The licensee shall not be allowed to carry on any other business on the licensed premises except sale of foreign liquor , beer , wine and low alcoholic beverages for which license is granted.

(xviii) The licensee shall on expiry of the license, report to the licensing authority for disposal of balance stock which will be disposed of in accordance with rule-16.

(xix) No country liquor or any other substance shall be stored in licensed premises of premium retail vend.

(xx)The licensee can install a dispensing
