अधिसूचना

चू ंकि मोटर यान अधिनियम, 1988 (अधिनियम संख्या 59 सन् 1988) की धारा 88 की उपधारा (5) की अपेक्षानुसार उत्तर प्रदेश सरकार और हिमाचल प्रदेश सरकार के मध्य किए जाने वाले प्रस्तावित करार का प्रारूप, अभ्यावेदन आमंत्रित किये जाने की दृष्टि से सरकारी अधिसूचना संख्या-02/2019/85/तीस- 4-2019-8(5)पी/1981, दिनांक 23 जनवरी, 2019 द्वारा उत्तर प्रदेश के गजट में और करार द्वारा आच्छादित होने वाले प्रस्तावित क्षेत्र या मार्ग में परिचालित प्रादेशिक भाषाओं के विभिन्न समाचार-पत्रों में प्रकाशित किया गया था;

और चू ंकि प्रस्तावित करार के सम्बन्ध में कोई अभ्यावेदन प्राप्त नहीं हुआ है;

और चू ंकि उत्तर प्रदेश सरकार और हिमाचल प्रदेश सरकार के मध्य निम्नलिखित करार किया जा चुका है;

अतएव, अब, उक्त अधिनियम की धारा 88 की उपधारा (6) के अधीन शक्तियों का प्रयोग करके और अधिसूचना संख्या-200टी/तीस-4-8(5)पी-81, दिनांक 06 मई, 1985 का अधिक्रमण करके राज्यपाल उक्त करार निम्नानुसार प्रकाशित करते हैं :

उत्तर प्रदेश और हिमाचल प्रदेश सरकारों के मध्य पारस्परिक परिवहन करार84_RPH_ Data 4_(Parivahan Folder) anu-4-2021 2 उत्तर प्रदेश असाधारण गजट, 11 जून, 2021 यह करार आज दिनांक 01 अप्रैल, 2021 को प्रमुख सचिव (परिवहन), उत्तर प्रदेश सरकार के माध्यम से उत्तर प्रदेश के राज्यपाल (जिन्हें आगे ''उत्तर प्रदेश सरकारʼʼ कहा गया है, जिस अभिव्यक्ति में उनके पदासीन उत्तराधिकारी भी सम्मिलित हैं) प्रथम पक्ष और प्रमुख सचिव (परिवहन) हिमांचल प्रदेश सरकार के माध्यम से हिमाचल प्रदेश के राज्यपाल (जिन्हें आगे ʼʼहिमाचल प्रदेशʼʼ कहा गया है, जिस अभिव्यक्ति में उनके पदासीन उत्तराधिकारी भी सम्मिलित हैं) द्वितीय पक्ष के बीच किया गया है। चू ँकि हिमाचल प्रदेश और उत्तर प्रदेश राज्यों की समीपस्थता और देश के त्वरित आथिक विकास को ध्यान में रखते हुए यह समीचीन समझा गया कि हिमाचल प्रदेश और उत्तर प्रदेश राज्यों के बीच यात्रियों और माल के अन्तर्राज्यिक परिवहन को प्रोत्साहित किया जाय और उनके प्रचालन को विनियमित, समन्वित और नियंत्रित किया जाय, इसलिए दोनों राज्यों के बीच पारस्परिक करार करना आवश्यक है। और चू ँकि, हिमाचल प्रदेश और उत्तर प्रदेश राज्यों के बीच उक्त विषय पर हुए समस्त पूर्ववर्ती करारों का अधिक्रमण करके समान्यतः लोकहित में नया पारस्परिक करार एतद्पश्चात उपसंजात होने वाले निबंधनों एवं शर्तों पर करना आवश्यक है।

उपयु र्क्त पक्षकारों द्वारा और उनके मध्य पारस्परिक रूप से निम्नलिखित करार किया जाता हैः यह कि यह पारस्परिक करार सरकारी गजट में इस करार के प्रकाशित होने के दिनांक से प्रवृत्त होगा तथा अगले 20 वर्षों या उस समय तक जब तक कि दोनों राज्यों के बीच पक्षकारों के मध्य होने वाले नये करार के समय तक या इस करार को किसी भी पक्षकार द्वारा छः माह की पूर्व नोटिस पर लिखित रूप में इंगित किये जाने वाले कारणों से समीक्षा किये जाने तक या उसे विखण्डित किये जाने तक यह विधिमान्य होगा।

1- यह करार सरकारी गजट में प्रकाशित होने के दिनांक से प्रवृत्त होगा।

2- माल यान

(एक) मोटर यान अधिनियम, 1988 की धारा 79 के अधीन जारी अनुज्ञा-पत्र :

प्रत्येक राज्य द्वारा जारी माल यानों के अनुज्ञापत्रों पर अन्य सम्पूर्ण राज्य हेतु सम्बन्धित राज्य परिवहन प्राधिकारी की सिफारिश पर अन्य राज्य के सम्भागीय/राज्य परिवहन प्राधिकरण द्वारा प्रतिहस्ताक्षर किया जाएगा। प्रतिहस्ताक्षर निम्नलिखित शर्तो के अध्यधीन होगाः-

(क) माल यान अनुज्ञापत्र, अधिनियम की धारा 79 में यथा विनिदिष्ट और सम्बन्धित राज्य में प्रवृत्त राज्य मोटर यान नियमावली के अधीन ऐसी शर्तो जिन्हें सम्बन्धित परिवहन प्राधिकारी अधिरोपित करने के लिए उचित समझे, के अध्यधीन होंगे।

(ख) यह कि प्रतिहस्ताक्षर द्वारा आच्छादित यान का उपयोग व्यतिकारी राज्य के क्षेत्र के भीतर किन्हीं दो बिन्दुओं पर माल लादने और उतारने के लिए नहीं किया जाएगा अर्थात ऐसे यान, व्यतिकारी राज्य के क्षेत्र के भीतर अनन्य रूप से परिवहन कारबार किये जाने से प्रतिषिद्ध होंगे।

(ग) यह कि प्रतिहस्ताक्षर द्वारा आच्छादित यानों को अधिनियम एवं नियमावली और समय- समय पर जारी किये गये न्यायालयों के निदेशों के अन्तर्गत व्यतिकारी राज्यों द्वारा समय-समय पर अधिरोपित किसी युक्तियुक्त निर्बंधन का अनुपालन करना होगा।

(दो) मोटर यान अधिनियम,1988 की धारा 87 के अधीन जारी अस्थायी अनुज्ञा-पत्र। एक बार में अनधिक तीस दिन की अवधि के लिए विधिमान्य अस्थायी अनुज्ञापत्र किसी राज्य के परिवहन प्राधिकारी द्वारा इस समझ के साथ जारी किये जा सकते हैं कि बिना प्रतिहस्ताक्षर और उनकी संख्या को सीमित किये बिना अनुज्ञापत्र जारी करने हेतु उत्तर प्रदेश राज्य और हिमाचल प्रदेश के परिवहन प्राधिकारियों के मध्य सहमति विद्यमान है। इन अनुज्ञापत्रों द्वारा आच्छादित यानों द्वारा अन्य राज्य के क्षेत्र के भीतर किन्हीं दो बिन्दुओं के मध्य माल लादा और उतारा नहीं जाएगा। अनुज्ञापत्र की विद्यमानता के दौरान यानों द्वारा लगाये जाने वाले फे रों की संख्या की कोई सीमा नहीं होगी। 3- ठेका गाड़ी

(क) मोटरयान अधिनियम, 1988 की धारा-74 के अधीन जारी अनुज्ञा-पत्र :

दोनों राज्यों द्वारा उक्त अधिनियम की धारा-88 के अधीन अस्थायी अनुज्ञा-पत्र या विशेष अनुज्ञा- पत्र से भिन्न कोई अन्तर्राज्यिक ठेका गाडी़ अनुज्ञा-पत्र स्वीकृ त और/या प्रतिहस्ताक्षर नहीं किया जायेगा। (ख) मोटरयान अधिनियम, 1988 की धारा-87 के अधीन जारी अस्थायी अनुज्ञा-पत्र :

अस्थायी अनुज्ञा-पत्र, यथास्थिति राज्य/संभागीय परिवहन प्राधिकरण, हिमाचल प्रदेश और राज्य/संभागीय परिवहन प्राधिकरण, उत्तर प्रदेश सरकार द्वारा इस समझ के साथ कि व्यतिकारी राज्यों के परिवहन प्राधिकारियों के मध्य सहमति विद्यमान है, अधिनियम की धारा-87 की उपधारा-(1) के खण्ड (ग) के अधीन ही जारी किये जा सकते है। ऐसे अनुज्ञा-पत्र निम्नलिखित शर्तों के अध्यधीन होंगेः84_RPH_ Data 4_(Parivahan Folder) anu-4-2021 उत्तर प्रदेश असाधारण गजट, 11 जून, 2021 3 (एक) यान एक ही पार्टी द्वारा भाडे ़़ पर लिया जाएगा और उसका उपयोग के वल एक वापसी फे रे के लिए किया जायेगा।

(दो) अनुज्ञा-पत्र की विधिमान्यता एक बार में 15 (पन्द्रह) दिन से अधिक नहीं होगी।

(तीन) ऐसे अस्थायी अनुज्ञा-पत्रों में यात्रा के प्रारम्भ का दिनांक और यात्रा की वापसी का दिनांक स्पष्ट रूप से विनिदिष्ट हो। यदि किसी अस्थायी अनुज्ञा-पत्र के आधार पर किसी ठेका गाड़ी को लेने वाली कोई पार्टी, अनुज्ञा-पत्र स्वीकृ त होने के पश्चात वापसी यात्रा के दिनांक में परिवर्तन चाहती है तो वह संबन्धित राज्य की सामान्य फीस और करों के भुगतान पर परिवहन प्राधिकारी, जिसकी अधिकारिता में उस समय ठेका गाड़ी हो, से इस आशय की लिखित अनुज्ञा प्राप्त करेगा।

(ग) मोटरयान अधिनियम, 1988 की धारा 88(8) के अधीन जारी विशेष अस्थायी अनुज्ञा-पत्रः पर्यटकों की आवश्यकता के अनुसार ऐसे अनुज्ञा-पत्र प्रत्येक राज्य के परिवहन प्राधिकारी द्वारा दूसरे राज्य के परिवहन प्राधिकारी की पूर्व सहमति के बिना जारी किये जा सकते हैं। अनुज्ञा-पत्र में प्रारम्भ और वापसी की यात्रा को दर्शाते हुए यात्रा का विस्तृत कार्यक्रम अन्तविष्ट होगा और वह क्रम भी दिया होगा जिसमें विभिन्न स्‍थानों का भ्रमण किया जायेगा, प्रत्येक स्‍थान से आवागमन और प्रस्थान के समुचित दिनांक का संके त भी होगा। अनुज्ञा-पत्र में यान में यात्रा करने वाले यात्रियों की सूची भी होगी।

4- मोटरयान अधिनियम, 1988 की धारा-72 के अधीन मंजिली गाड़ी के अनुज्ञा-पत्र

(एक) हिमाचल प्रदेश सरकार और उत्तर प्रदेश सरकार के मध्य अन्तर्राज्यिक मार्गों पर मंजिली गाड़ी के प्रचालन के सम्बन्ध में पारस्परिक करार, अनुलग्नक-। एवं अनुलग्नक-।। के अनुसार होगा। इन मार्गों पर, हिमाचल सड़क परिवहन निगम (एचआरटीसी) और उत्तर प्रदेश राज्य सड़क परिवहन निगम(यूपीएसआरटीसी) द्वारा स्वामित्व प्राप्त बसों का प्रचालन किया जाएगा। राज्य में आने वाले भाग के लिए सम्बन्धित राज्यों द्वारा नियत दरों के अनुसार यात्री किराया प्रभारित किया जाएगा।

(दो) अनुलग्नक-। एवं अनुलग्नक-।। में उल्लिखित मार्गों का तात्पर्य दोनों राज्यों में स्थित उनमें उल्लिखित स्‍थानों से होकर जाने वाले दोनों टमिनलों को जोड़ने वाले सबसे छोटे सीधे मार्गों से है। उक्त अनुलग्नक में दर्शाये गये मार्गों के नामों या उनकी लम्बाई में बाद में पायी गयी किसी विसंगति को व्यतिकारी राज्य के राज्य परिवहन प्राधिकारियों के मध्य पत्राचार के माध्यम से शीघ्रतापूर्वक ठीक किया जाएगा और उसे करार में किसी प्रकार का उपांतरण नहीं समझा जाएगा।

(तीन) अनुलग्नक-। एवं अनुलग्नक-।। में उल्लिखित मार्गों की समय-सारिणी, सम्बंधित राज्यों के सम्बन्धित राज्य परिवहन उपक्रमों से परामर्श करके दोनों राज्यों के अनुज्ञा-पत्र जारी करने वाले प्राधिकारियों द्वारा नियत की जाएगी।

(चार) पारस्परिक करार के अधीन आने वाले दोनों राज्यों के मंजिली गाड़ी के अनुज्ञापत्रों पर, एकल बिन्दु कराधान के आधार पर प्रतिहस्ताक्षर किया जाएगा जिसका तात्पर्य है कि ऐसा प्रत्येक अनुज्ञापत्र धारक को के वल यात्री कर/अतिरिक्त कर/विशेष मार्ग कर इत्यादि (चाहे जिस नाम से अधिरोपित किया जाय) का भुगतान करना होगा।

(पाँच) यदि किसी कारण से समाप्त होने से पूर्व अनुज्ञापत्र के नवीकरण हेतु किसी आवेदन पत्र का विनिश्चय करना सम्भव न रहा हो तो गृह राज्य अधिनियम की धारा 87 (1) (घ) के अधीन, व्यतिकारी राज्य को सूचित करके चार माह तक की अवधि के लिए अस्थायी अनुज्ञापत्र जारी कर सकता है और नीचे दिये गये परन्तुक के अध्यधीन ऐसे अस्थायी अनुज्ञापत्रों के लिए व्यतिकारी राज्य का प्रतिहस्ताक्षर अपेक्षित होगा और मोटर यान को एकल बिन्दु कराधान के आधार पर चलाने के लिए प्राधिकृ त कर दिया जाएगाः परन्तु यह कि अनुज्ञापत्रों के नवीकरण के लिए आवेदन पत्र, उक्त अधिनियम की धारा 81(2) के अधीन नवीकरण आवेदन प्रस्तुत करने के लिए अनुज्ञात समय के भीतर सम्बन्धित प्राधिकारी को प्रस्तुत कर दिया गया हो।

(छः) इस करार के अधीन अन्यथा उपबंधित के सिवाय किसी भी राज्य परिवहन उपक्रम द्वारा किसी योजना के अधीन भाड़े पर ली गई किसी निजी बस को, अनुलग्नक-। एवं ।। में उल्लिखित किसी अन्तर्राज्यिक मार्ग पर नहीं चलने दिया जाएगा।

(सात) व्यतिकारी राज्यों के सचिव/प्रमुख सचिव, आवश्यक विधिक अपेक्षाओं को पूरा करने के पश्चात नये मार्गों पर प्रचालन की व्यवस्था कर सकते हैं और विद्यमान मार्गों पर फे रों में वृद्धि कर सकते हैं और उनके द्वारा की गयी ऐसी कार्यवाही को इस करार का अंग समझा जाएगा।

5- अस्थायी अनुज्ञापत्रों के लिए सामान्य उपबंध84_RPH_ Data 4_(Parivahan Folder) anu-4-2021 4 उत्तर प्रदेश असाधारण गजट, 11 जून, 2021 (एक) प्रत्येक माह में जारी किये गये विभिन्न प्रकार के अस्थायी अनुज्ञापत्रों (माल यान और/या ठेका गाड़ी) की एक पृथक सूची, प्रत्येक राज्य के परिवहन आयुक्त को दूसरे राज्य द्वारा प्रस्तुत की जाएगी। (दो) समस्त अस्थायी अनुज्ञापत्र, जहां कहीं लागू हो, दोहरे बिन्दु कराधान के आधार पर होंगे जिसका तात्पर्य है कि ऐसे प्रत्येक अनुज्ञापत्र धारक को दोनों करों अर्थात मार्गकर और यात्रीकर/अतिरिक्त कर/विशेष मार्ग कर, (जिस भी नाम से अधिरोपित किया जाय) का भुगतान करना होगा।

(तीन) करारकर्ता राज्यों के प्रतिनिधि, पारस्परिक परिवहन करार को प्रभावी करने की समीक्षा एवं समस्यायें, यदि कोई हों, के निदान हेतु वाषिक बैठक कर सकते हैं।

6- कराधान

(एक) विभिन्न प्रकार के अनुज्ञापत्रों के आधार पर चलने वाले विभिन्न प्रकार के यानों के सम्बन्ध में व्यतिकारी राज्यों के कर, सम्बन्धित राज्यों के कराधान अधिनियम और नियमावली के उपबंधों के अनुसार संदेय होंगे।

(दो) परन्तु, वाणिज्यिक प्रयोजनों के लिए उपयोग किये जाने वाले यानों से भिन्न सभी प्रकार के मोटरयानों को, जो अनन्यतः एक राज्य के स्वामित्व द्वारा और सरकार के प्रयोजनों के लिए उपयोग किये जांय, करारकर्ता राज्य में उद्ग्रहणीय समस्त करों के भुगतान से छू ट प्राप्त होगी।

7. करों के संदाय का ढंग

(एक) अनुज्ञा-पत्र जारी करने वाला प्राधिकारी यह सुनिश्चित करेगा कि करारकर्ता राज्य के समस्त कर अग्रिम रूप से ई-भुगतान या डिमान्ड ड्राफ्ट, जो भारत के किसी भी राष्ट्रीयकृ त बैंक में भुगतान योग्य हो, द्वारा संदत्त कर दिये गये हैं। आगे की यात्रा से पूर्व कर संग्रह के न्द्रों या सीमा से निकटतम संभागीय परिवहन अधिकारी/सहायक संभागीय परिवहन अधिकारी के कार्यालय या परिवहन विभाग के मोबाइल प्रवर्तन दल, जो सीमा से नजदीक हो, पर करारकर्ता राज्य अपने करों की वसूली की अपेक्षा करेगा। ई-भुगतान या डिमान्ड ड्राफ्ट द्वारा करों के अग्रिम भुगतान की स्थिति में ई-भुगतान का विवरण अथवा प्रत्येक डिमान्ड ड्राफ्ट जिनके द्वारा दूसरे राज्य के करों का भुगतान किया गया हो, की संख्या, दिनांक व धनराशि का विवरण अनुज्ञा-पत्र के मुखपृष्ठ पर स्पष्ट रूप से पृष्ठांकित किया जायेगा और उसे परिवहन आयुक्त उत्तर प्रदेश, लखनऊ या परिवहन आयुक्त, हिमाचल प्रदेश, शिमला जैसी भी स्थिति हो, को भेजा जायेगा।

प्रत्येक राज्य का परिवहन प्राधिकारी, ई-पेमेन्ट द्वारा अग्रिम भुगतान न किये जाने की स्थिति में ऐसा अनुज्ञा-पत्र जारी करते समय स्वामी/चालक को आगे की यात्रा प्रारम्भ करने से पहले सम्बन्धित परिवहन विभाग के कर संग्रह के न्द्रों या सीमा के निकटतम संभागीय परिवहन अधिकारी/सहायक संभागीय परिवहन अधिकारी के कार्यालय या मोबाइल प्रवर्तन दल, जो सीमा से नजदीक हो, को करों के भुगतान हेतु निर्देशित करेगा।

(दो) सभी अस्थायी अनुज्ञा-पत्रों और विशेष अनुज्ञा-पत्रों की प्रतियां, ई-भुगतान अथवा भारत के किसी निर्धारित राष्ट्रीयकृ त बैंक में भुगतान योग्य डिमान्ड ड्राफ्ट का विवरण एवं अन्य सम्बन्धित सूचनायें परिवहन आयुक्त, उत्तर प्रदेश, लखनऊ और/या परिवहन आयुक्त, हिमाचल प्रदेश, शिमला, जैसी भी स्थिति हो, को मासिक अन्तराल में भेजा जायेगा।

8- प्रतिहस्ताक्षर

एक राज्य द्वारा पारस्परिक परिवहन समझौते के अन्तर्गत जारी अनुज्ञा पत्र, सम्बन्धित राज्य के सचिव, संभागीय/राज्य परिवहन प्राधिकरण की संस्तुति के आधार पर संभागीय/राज्य परिवहन प्राधिकरण के समक्ष प्रस्तुत किये जाने पर सम्बन्धित राज्य की प्रतिहस्ताक्षर फीस व अन्य देय करों के भुगतान के अध्यधीन सामान्यतया तत्काल निस्तारित/प्रतिहस्ताक्षरित किया जायेगा।

इसके पक्षकारों ने पूर्व में ऊपर उल्लिखित दिनांक और वर्ष को इस करार पर निम्नलिखित साक्षीगण की उपस्थिति में हस्ताक्षर किये है :

IN pursuance of the provisions of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of notification no. 2/2021/653/XXX-4- 2021-8(5)P-1981, dated June 11, 2021.

Whereas, as per requirement of sub section (5) of section 88 of the Motor Vehicles Act,1988 (Act no. 59 of 1988) proposed draft of the agreement to be entered into between the Government of Uttar Pradesh and the Government of Himachal Pradesh was published vide Government notification no. 02/2019/85/xxx-4-2019-8(5)P/1981, dated January 23, 2019 in the Gazette of Uttar Pradesh and in different news papers in regional language circulating in the area or route proposed to be covered by the agreement with a view to inviting representation;

AND WHEREAS no representation so received in respect of proposed agreement;

AND WHEREAS Government of Uttar Pradesh and Government of Himachal Pradesh have entered into an agreement as follows;

NOW THEREFORE, in exercise of the powers under sub section (6) of section 88 of the said Act and in supersession of notification no. 200T/ XXX-4-8(5)P-81, dated May 06, 1985, the Governor is pleased to publish the said agreement as given hereunder.

(RECIPROCAL TRANSPORT AGREEMENT BETWEEN THE GOVERNMENTS OF UTTAR

PRADESH AND HIMACHAL PRADESH)

This Agreement is made on the 1st day of April, 2021between the Governor of Uttar Pradesh through Principal Secretary, Department of Transport, Government of Uttar Pradesh (hereinafter referred to as "the Government of Uttar Pradesh", which expression shall include his successors in office) one part and Governor of Himachal Pradesh through Principal Secretary, Department of Transport, Government of84_RPH_ Data 4_(Parivahan Folder) anu-4-2021 12 उत्तर प्रदेश असाधारण गजट, 11 जून, 2021 Himachal Pradesh (hereinafter referred to as "the Government of "Himachal Pradesh", which expression shall include its successors in office of the second part.

WHEREAS, it is expedient in view of the contiguity of the States of Himachal Pradesh and Uttar Pradesh and rapid economic development of the country, to encourage the interstate transport of the passengers and goods between the States of Himachal Pradesh and Uttar Pradesh and to regulate, coordinate and control their operations, it is necessary to make a Reciprocal Agreement between the two States,

AND WHEREAS, it is necessary in the interest of the public in general to enter into a fresh Reciprocal Agreement, in super-session of all previous agreements on the subject, between the State of Himachal Pradesh and Uttar Pradesh on the terms and conditions hereinafter appearing.

IT IS NOW MUTUALLY AGREED BY AND BETWEEN

THE ABOVE PARTIES AS FOLLOWS

That this Reciprocal Agreement shall come into force from the date of publication of this agreement in Official Gazette and shall be valid up to for next 20 years or till such time as a new agreement between the parties hereto Which ever is earlier and this Agreement is reviewed or rescinded for reasons to be given in writing by either party on six months prior notice.

1. This Agreement shall come into force from the date of publication of this agreement in Official Gazette.

2. GOODS CARRIAGES

(i) Permits issued under Section 79 of the Motor Vehicles Act, 1988

Permits for goods carriages issued by each State shall be countersigned by the Regional/ State Transport Authority of the other state on the recommendation of the State Transport Authority concerned for the whole of the other State. The counter-signature shall be subject to the following conditions:-

(a) Goods carriage permit shall be subject to such conditions as specified in Section 79 of the Act and under the State Motor Vehicles Rules in force in the State concerned as the transport authority concerned may deem fit to impose.

(b) That the vehicle covered by the counter-signature shall not be used for picking up and setting down the goods at any two points within the territory of the Reciprocating State i.e. such vehicles shall be prohibited from carrying on transport business exclusively within the territory of the Reciprocating State.

(c) That the vehicles covered by the counter-signature will have to abide by any reasonable restriction imposed by the Reciprocating States from time to time, within the framework of Act & Rules and directions of Courts issued from time to time.

(ii) Temporary Permits issued under Section 87 of the Motor Vehicles Act, 1988

Temporary Permits valid for a period not exceeding thirty days at a time may be issued by the Transport Authority of either State with an understanding that a concurrence exists between Transport authorities of the States of Uttar Pradesh and Himachal Pradesh to issue the permits without counter- signature and without restriction on their number. The vehicles covered by these permits shall not pick up and set down goods between any two points within the territory of the other State. There will be no restriction on the number of the trips that may be performed by the vehicles during the validity of the permit.

3. CONTRACT CARRIAGES

(a) Permits issued under Section 74 of Motor Vehicles Act, 1988

No inter state contract carriage permit other than temporary permit or special permit shall be granted and/or countersigned under section 88 of the Act by both the States.

(b) Temporary Permits issued under Section 87 of the Motor Vehicles Act, 1988

Temporary permits may be issued strictly under clause (c) of sub-section (1) of Section 87 of the Act by the State/Regional Transport Authority, Government of Himachal Pradesh and State/ Regional Transport Authority Government of Uttar Pradesh, as the case may be, with an understanding that a84_RPH_ Data 4_(Parivahan Folder) anu-4-2021 उत्तर प्रदेश असाधारण गजट, 11 जून, 2021 13 concurrence exists between Transport Authorities of the Reciprocating States to issue such permits without counter-signature and without restriction of their number. Such permits shall be subject to following conditions:-

(i) The vehicle shall be hired by a single party and shall be used for a single return trip only.

(ii) The validity of the permit shall not exceed 15 (fifteen) days at a time.

(iii) Such temporary permits shall clearly specify the date of the outward journey and the date of the return journey. In case a party engaging in a contract carriage on a temporary permit wishes to change the date of the return journey subsequent to the grant of the permit, it shall obtain permission, in writing, to that effect from the Transport Authority within whose jurisdiction the contract carriage happens to be at that time, on payment of usual fees and taxes of the State concerned.

(c) Special Temporary Permits issued under Section 88(8) of the Motor Vehicles Act, 1988

These permits may be issued by the Transport Authority of each State without prior concurrence of the Transport Authority of the other State, according to the need of the tourist. The permit shall contain the detailed programme of the tour, showing the dates of onward and return journeys alongwith the order in which the various places shall be visited and indication of the appropriate date of the arrival and the departure from each such place. The permit shall also contain list of passengers traveling in the vehicle.

4. STAGE CARRIAGE PERMIT UNDER SECTION 72 OF THE MOTOR VEHICLE ACT, 1988:-

(i) Reciprocal Agreement with regard to operations of stage carriage on Interstate routes between Government of Himachal Pradesh and Government of Uttar Pradesh shall be as per Annexure-I & Annexure-II. These routes shall be operated by buses owned by Himachal Road Transport Corporation (HRTC) and Uttar Pradesh State Road Transport Corporation (UPSRTC). Passenger fare shall be charged according to the rates fixed by the respective States for the portion lying in the State.

(ii) The route mentioned in Annexure-„I" and Annexure-„II" shall always mean the shortest direct routes connecting the two terminals lying in the two states through the places mentioned therein.

Any discrepancy discovered later in the name or length of routes shown in the said Annexure shall promptly be corrected through correspondence between the State Transport Authorities of the Reciprocating State and shall not be treated as any modification of the Agreement.

(iii) The time-table for the routes mentioned in Annexure-„I" & Annexure-„II" shall be fixed by the permit issuing authorities of the two states in consultation with concerned State Transport Undertakings of the respective States and others, if any.

(iv) The stage carriage permits of both the States falling under Reciprocal Agreement shall be counter-signed on the single point taxation basis that means every such permit holder will have to pay only Passenger Tax/Additional Tax/Special Road Tax etc. (by whatever name it is imposed).

(v) If for any reason, it has not been possible to decide an application for the renewal of the permit before its expiry, the home State may issue temporary permits under Section 87(1) (d) of the Act for a period up to four months under intimation to the Reciprocating State and such temporary permits, subject to proviso set out below, shall require counter-signature of the Reciprocating State and the Motor Vehicle will be authorized to ply on single point taxation basis:

Provided, that the application for renewal of permits has been submitted to the concerned authority within the time allowed for submission of renewal applications under section 81(2) of the Act. (vi) Except otherwise provided under the Act no private bus under any scheme hired by either State Transport Undertakings shall be allowed to operate on an Interstate route mentioned in Annexure „I" and „II".

(vii) The Secretary/Principal Secretary of the Reciprocating States may, after completing necessary legal requirement, provide for operation on new routes and increase the trips on existing routes and such action taken by them shall be deemed to be part of this Agreement.

5. GENERAL PROVISIONS FOR TEMPORARY PERMITS

(i) Separate list of different type of temporary permits (Goods Carriage and/or Contract Carriage) issued in each month shall be submitted to the Transport Commissioner of each State by the other State.

(ii) All temporary permits shall be on double point taxation wherever applicable that means every such permit holder will have to pay both the taxes i.e. Road Tax and Passenger Tax/Additional Tax/ Special Road Tax (by whatever name it is imposed)

(iii) Representatives of the Reciprocating States may meet annually to review the implementation of the Reciprocal Agreement and to remove difficulties, if any.

6. Taxation

(i) The taxes of the reciprocating State in respect of different types of vehicle operating on various class of permits will be payable as per provisions of Taxation Act and Rules of the respective State.

(ii) However, all types of motor vehicles other than those used for commercial purposes exclusively owned by and used for the purposes of Government of one State shall be exempted from payment of all the taxes leviable in the reciprocating State.

7. Mode of Payment of Taxes

(i) The permit issuing authority shall ensure that all taxes of the reciprocating State are paid in advance either by e-payment or Demand Drafts drawn on any Nationalised Bank of India. Reciprocating State shall require recovery of its taxes at Tax Collection Centres or border touching office of RTO/ARTO or mobile enforcement squad of the Transport Department which is nearest from the border before commencing the further journey.

In case advance payment of taxes either by e-payment or Demand Draft the details of e-payment or the number, date and amount of each Demand Draft through which taxes of the other State has been remitted shall be clearly endorsed on the face of the permits and same be sent to the Transport Commissioner, Uttar Pradesh, Lucknow or the Transport Commissioner, Himanchal Pradesh, Shimla as the case may be.

In case where advance payment has not been made through e-payment, the Transport Authority of each State granting such permit shall direct the owner/driver to pay the taxes at the Tax Collection Centres or border touching office of RTO/ARTO or mobile enforcement squad of the Transport Department of concerned State which is nearest from the border before commencing the further journey.

(ii) Copies of all temporary permits and special permits together with details of e-payment or Demand Drafts drawn on any Nationalised Bank of India and other relevant information shall immediately be sent to the Transport Commissioner, Uttar Pradesh Lucknow and/or the Transport Commissioner, Himanchal Pradesh, Shimla as the case may be, along with details of e-payment or Demand Drafts at monthly intervals.

8. COUNTER SIGNATURE -

Permits issued within the terms of Reciprocal Agreement by a State should normally be disposed of /countersigned immediately on presentation before the State/Regional Transport Authority on the recommendations of the Secretary, State/Regional Transport Authority of the concerned States subject to payment of countersignature fee and other taxes due to the respective State.
