साधारण खण्ड अधिनियम, 1897 (अधिनियम संख्या 10 सन्‌ 1897) की धारा 21 के साथ पठित भ्रष्टाचार निवारण अधिनियम, 1988 (अधिनियम संख्या 49 सन्‌ 1988) (जिसे आगे ''उक्त अधिनियम'' कहा गया है) की धारा 3 की उपधारा (1) और धारा 4 की उपधारा (2) के अधीन शक्तियों का प्रयोग करके और इस निमित्त जारी सरकारी अधिसूचना के क्रम में राज्यपाल, नीचे अनुसूची के स्तम्भ-2 में उल्लिखित अपर जिला एवं सत्र न्यायाधीशों को, उनके कार्यभार ग्रहण करने के दिनांक से उक्त अधिनियम की धारा 3 की उपधारा (1) में यथा विनिर्दिष्ट ऐसे अपराधों, जिनमें एतद्‌पश्चात्‌ भारत सरकार के विशेष पुलिस अधिष्ठान द्वारा उनके न्यायालयों में आरोप-पत्र दाखिल किये जायें, के विचारण के लिये उक्त अनुसूची के स्तम्भ-4 में उल्लिखित क्षेत्रों के लिए विशेष न्यायाधीश के रूप में नियुक्त करती हैं और यह निर्देश देती हैं कि उक्त क्षेत्रों के भीतर उद्‌भूत होने वाले ऐसे अन्य मामलों का, जिनमें उक्त अधिनियम के अधीन नियुक्त किसी अन्य विशेष न्यायाधीश के समक्ष आरोप-पत्र पहले से ही दाखिल कर दिये गये हों और उक्त क्षेत्र के भीतर उद्‌भूत होने वाले उक्त विशेष पुलिस अधिष्ठान से सम्बन्धित ऐसे अन्य मामलों का भी, जो ऐसे किसी विशेष न्यायाधीश के समक्ष विचाराधीन हो, विचारण और निस्तारण भी उनके द्वारा किया जायेगा और उनका न्यायालय, उक्त अनुसूची के स्तम्भ-3 में यथा विनिर्दिष्ट रूप से अभिहित किया जायेगा, जिनका मुख्यालय गाजियाबाद में होगा।151 RPH (Grih Police Anu.-9) 2021 Data 4e 2 उत्तर प्रदेश असाधारण गजट, 29 जून, 2021 राज्यपाल अग्रतर नीचे अनुसूची मे स्तम्भ-2 में यथा उल्लिलिखित विशेष न्यायालय, भष्टाचार निरोध, सी0बी0आई0, गाजियाबाद में कार्यरत अधिकारियों को, समस्त और साथ ही साथ ऐसे मामलों, जो उक्त अनुसूची के स्तम्भ-4 में यथा उल्लिखित अधिकारिता क्षेत्र के लिए भविष्य में दायर किये जा सकते हैं, का निस्तारण करने के लिये तत्काल प्रभाव से सशक्त करती हैं और भविष्य में, उक्त विशेष न्यायालय के पदधारी द्वारा प्रभार का त्याग किये जाने पर पद में उनके उत्तरवर्ती समस्त और साथ ही साथ ऐसे मामलों जो, उक्त अनुसूची के स्तम्भ-4 में यथा उल्लिलिखत अधिकारिता क्षेत्र के लिए भविष्य में दायर किये जा सकते हैं, का विचारण और निस्तारण करेंगे।

IN pursuance of the provisions of clause (3) of Article 348 of the Constitution of India, the Governor is pleased to order the publication of the following English translation of notification no. U.O.- 67/VI-P-9–2021-167G-09-Nyay-2, dated June 29, 2021:

Dated Lucknow, June 29, 2021

IN exercise of the powers under sub-section (1) of section 3 and sub-section (2) of section 4 of the Prevention of Corruption Act, 1988 (Act no. 49 of 1988) (hereinafter referred to as the "said Act") read with section 21 of the General Clauses Act, 1897 (Act no. 10 of 1897), and in continuation of the Government notification issued in this behalf, the Governor is pleased to appoint from the date of their taking over charge the Additional District Judges mentioned in Column-2 of the Schedule below as Special Judges for the areas mentioned in Column-4 of the said Schedule for the trial of such offences as specified in sub-section (1) of section 3 of the said Act in which, hereinafter charge sheets are filed in their Courts by Special Police Establishment of the Government of India, and to direct that such other cases arising within the said areas, in which charge sheets have already been filed before any other Special Judge appointed under the said Act and also such other cases arising within the said area relating to the said Special Police Establishment which are pending before such a Special Judge, shall also be tried and disposed off by them and their court shall be designated as specified in Column-3 of the said schedule with headquarter at Ghaziabad.

The Governor is further pleased to empower the officer as mentioned in Column-2 of the Schedule below holding the Special Court, Anti Corruption, CBI, Ghaziabad for dispose of all as well as cases which may be filed in future for the area of Jurisdiction as mentioned in Column-4 of the said Schedule with immediate effect and in future, upon relinquishing the charge by the incumbent of the said Special Court, his successor in office will try and dispose all as well as cases which may be filed in future for the area of jurisdiction as mentioned in Column-4 of the said Schedule.
