भारत के असाधारण राजपत्र में यथा प्रकाशित उपभोक्ता मामले, खाद्य और सार्वजनिक वितरण मंत्रालय (उपभोक्ता मामले विभाग), भारत सरकार नई दिल्ली द्वारा जारी निम्नलिखित अधिसूचना संख्या का0आ0 2674(अ), दिनांक 2 जुलाई, 2021, जनसामान्य को सूचनार्थ उत्तर प्रदेश के असाधारण गजट, भाग-4, खण्ड-(ख) में पुनः प्रकाशित की जाती है।

का0आ0 2674(अ).-केन्द्रीय सरकार, आवश्यक वस्तु अधिनियम, 1955 (1955 का 10) की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, विशिष्ट खाद्य पदार्थों पर लाइसेंसी अपेक्षाएं, स्टॉक सीमाएं और संचलन प्रतिबंध हटाना आदेश, 2016 में और संशोधन करने के लिये निम्नलिखित आदेश करती है, अर्थात् :-
1- संक्षिप्त नाम और प्रारम्भ -
(1) इस आदेश का संक्षिप्त नाम विशिष्ट खाद्य पदार्थों पर लाइसेंसी अपेक्षाएं, स्टॉक सीमाएं और संचलन प्रतिबन्ध हटाना (संशोधन) आदेश, 2021 है।
(2) यह तत्काल प्रभाव से लागू होगा। 2 उत्तर प्रदेश असाधारण गजट, 12 जुलाई, 2021 2-विशिष्ट खाद्य पदार्थों पर लाइसेंसी अपेक्षाएं, स्टॉक सीमाएं और संचलन प्रतिबंध हटाना आदेश, 2016 में खण्ड 3 मेें उप-खण्ड (2) में, मद (i) में निम्नलिखित अंतःस्थापित किया जाएगा, अर्थात् :-
''(i) दिनांक 31 अक्टूबर, 2021 तक की अवधि के लिए, सभी दालों (मूंग को छोड़कर) को, सभी राज्यों और संघ राज्य क्षेत्रों में निम्नलिखित स्टॉक सीमाओं के साथ एक साथ रखा जायेगाः-
. थोक विक्रेता ः 200 मीट्रिक टन (बशर्ते कि किसी एक किस्म की मात्रा 100 मीट्रिक टन से अधिक नहीं होनी चाहिए)
. खुदरा विक्रेता : 5 मीट्रिक टन
.मिलर : स्टॉक सीमा विगत 3 माह के उत्पादन अथवा वार्षिक संस्थापित क्षमता का 25%, इनमें से जो अधिक हो, होगी।
. आयातक :
o थोक विक्रेता के लिए लागू स्टॉक सीमा, दिनांक 15 मई, 2021 से पहले आयातित स्टॉक/स्टॉक में धारित मात्रा के लिए आयातकों पर लागू होगी।
o दिनांक 15 मई, 2021 के बाद आयात किए गए स्टॉक हेतु थोक विक्रेता के लिए प्रयोज्य स्टॉक सीमा, सीमा-शुल्क मंजूरी (कस्टम क्लीयरेंस) की तारीख से 45 दिनों के बाद लागू होगी। 3-यदि संबंधित विधिक इकाईयों द्वारा धारित स्टॉक निर्धारित सीमा से अधिक है, तो उनके द्वारा इसकी घोषणा उपभोक्ता मामले विभाग के पोर्टल (fcainfoweb. nic. in) पर की जाएगी और इस अधिसूचना के जारी होने की तारीख से 30 दिनों के भीतर निर्धारित स्टॉक सीमा तक लाई जाएगी। 4-यह सुनिश्चित किया जाएगा कि दालों के स्टॉक को नियमित रूप से घोषित किया जाए और इसे इस विभाग अर्थात उपभोक्ता मामले विभाग के पोर्टल पर अद्यतित किया जाए।

ORDER
New Delhi, the 2nd July, 2021
S.O. 2674(E) .– In exercise of the powers conferred by section 3 of the Essential Commodities Act, 1955 (10 of 1955), the Central Government hereby makes the following order further to amend the Removal of Licensing Requirements, Stock Limits and Movement Restrictions on Specified foodstuffs Order, 2016, namely :–
1.Short title and commencement –
(1) This order may be called the Removal of Licensing Requirements, Stock Limits and Movement Restrictions on Specified Foodstuffs (Amendment) Order, 2021.
(2) It shall come into force with immediate effect.
2. In the Removal of Licensing Requirements, Stock Limits and Movement Restrictions on Specified Foodstuffs Order, 2016, in clause 3, in sub-clause (2), after the item (i) shall be inserted, namely :–
"(i) All Pulses put together (except Moong), for a period up to the 31st October, 2021 with following stock limits for all States and Union Territories:–
. Wholesaler : 200 MT (subject to condition that there should not be more than 100 MT of one variety)
. Retailer : 5 MT
. Millers : Stock limits will be last 3 months production or 25% of annual installed capacity, whichever is higher.
. Importers :
`Stock limit applicable to wholesaler will also apply to importers for stocks held in stock/imported prior to 15th May, 2021.
For Stocks imported after 15th May, 2021, Stock limit applicable to wholesaler, will apply after 45 days from date of customs clearance.
3. In case the stocks held by respective legal entites are higher than the prescribed limits then they shall declare the same on the portal (fcainfoweb. nic.in) of Department of Consumer Affairs and bring it to the prescribed stock limits within 30 days of the issue of this notification.
4. It shall be ensured that pulses stock is regularly declared and updated on the portal of this Department i.e. Department of Consumer Affairs.
