आबकारी अनुभाग-1 ———— संख्या 1537/ई-1/तेरह-21-499(20)-98 टी0सी0 लखनऊ, 5 अगस्त, 2021 ———— अधिसूचना संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करके और इस विषय पर समस्त विद्यमान नियमों और आदेशों का अधिक्रमण करके, राज्यपाल, उत्तर प्रदेश आबकारी सिपाही, ड्राइवर और ताड़ी पर्यवेक्षक सेवा नियमावली, 1983 में संशोधन करने की दृष्टि से निम्नलिखित नियमावली बनाती हैं :-
उत्तर प्रदेश आबकारी सिपाही और ताड़ी पर्यवेक्षक सेवा (छठवाँ संशोधन) नियमावली, 2021
संक्षिप्त नाम 1-(1) यह नियमावली उत्तर प्रदेश आबकारी सिपाही और ताड़ी पर्यवेक्षक (छठवाँ
और प्रारम्भ संशोधन) नियमावली, 2021 कही जायेगी।
(2) यह तुरन्त प्रवृत्त होगी।
2-उक्त नियमावली में, नीचे स्तम्भ-1 में दिये गये विद्यमान नियम 15 के स्थान पर नियम 15 का प्रतिस्थापन स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात् :-

15 (1)-सेवा में आबकारी सिपाही के प्रक्रिया
सीधी भर्ती उत्तर प्रदेश समूह 'ग' के पदों
पद पर सीधी भर्ती, समय-समय पर के लिए सीधी भर्ती (रीति और प्रक्रिया) यथासंशोधित उत्तर प्रदेश समूह 'ग' के नियमावली, 2015 के अनुसार की जायेगी : पदों के लिए सीधी भर्ती (रीति और
प्रक्रिया) नियमावली, 2015 के अनुसार की
जायेगी।
(2) विभिन्न श्रेणियों के लिए प्रभावी परन्तु यह कि चयन में अपनायी
आरक्षण नियमों के आलोक में शारीरिक जाने वाली प्रक्रिया में उत्तर प्रदेश
दक्षता परीक्षा के लिए आयोग द्वारा पर्याप्त आबकारी सिपाही, ड्राइवर और ताड़ी
संख्या में पात्र अभ्यर्थियों को आमंत्रित पर्यवेक्षक सेवा (चतुर्थ संशोधन) नियमावली,
किया जायेगा। शारीरिक दक्षता परीक्षा 2008 में यथा विद्यमान शारीरिक परीक्षा के
अर्हकारी प्रकृति की होगी। शारीरिक दक्षता सम्बन्ध में दिये गये उपबन्ध भी सम्मिलित
परीक्षा में दौड़, लम्बी कूद और क्रिकेट किये जायेंगे :

आबकारी सिपाही का पद, उत्तर प्रदेश
अधीनस्थ सेवा चयन आयोग अधिनियम,
2014 (उत्तर प्रदेश अधिनियम संख्या 20,
2014) की धारा 2 के परन्तुक के अधीन
आयोग की परिधि के बाहर रखा जाता है,

| (ख) लम्बी कूद | दूरी 08 फुट |
| (ग) क्रिकेट बॉल थ्रो | दूरी 12 मीटर |
तो ऐसी स्थिति में सेवा में आबकारी
सिपाही के पद पर सीधी भर्ती की प्रक्रिया
ऐसी होगी जैसी कि उत्तर प्रदेश आबकारी
सिपाही, ड्राइवर और ताड़ी पर्यवेक्षक सेवा
(चतुर्थ संशोधन) नियमावली, 2008 में दी
गयी है।
(3) शारीरिक दक्षता परीक्षा में अर्ह
पाये गये अभ्यर्थी आयोग द्वारा विभिन्न
श्रेणियों के लिए प्रभावी आरक्षण नियमों के
आलोक में लिखित परीक्षा में प्राप्त अंकों के
आधार पर योग्यता के आधार पर चयनित
किये जायेंगे और चयनित अभ्यर्थियों की
सूची, नियुक्ति प्राधिकारी को प्रेषित की
जायेगी। उार प्रदेश असाधारण गजट, 5 अगस्त, 2021 3 3-उक्त नियम 20 के पश्चात नया नियम 20 क बढ़ा दिया जायेगा; अर्थात् :- नियम 20 क
का बढ़ाया जाना सिपाहियों और ताड़ी पर्यवेक्षकों को उनके गृह जिला को छोड़कर उत्तर प्रदेश के किसी
तैनाती जिला में विभाग की किसी इकाई में तैनात किया जा सकता है।
4-उक्त नियमावली में, नीचे स्तम्भ-1 में दिये गये नियम 22 के स्थान पर स्तम्भ-2 में नियम 22 का प्रतिस्थापन दिया गया नियम रख दिया जायेगा, अर्थात् :-

IN exercise of the powers conferred by the proviso to Article 309 of the Constitution, and in Supersession of all existing rules and orders on the Governor is pleased to make the following rules with a view to amending the Uttar Pradesh Excise Constables, Drivers and Tari Supervisors Service Rules, 1983.
THE UTTAR PRADESH EXCISE CONSTABLES AND TARI SUPERVISORS SERVICE (SIXTH AMENDMENT) RULES, 2021
Short title and
1. (1) These rules may be called the Uttar Pradesh Excise Constables and Tari commencement
Supervisors (Sixth Amendment) Rules, 2021.
(2) They shall come into force at once.
Substitution of
2. In the said rules for existing rule 15 set out in Column-1 below, the rule as rule 15
set out in Column-2 shall be substituted, namely:-

Procedure for direct recruitment
15. Direct recruitment to the post of Excise Constable in the Service shall be made in accordance with the Uttar Pradesh Direct Recruitment to Group "C" Posts (Mode and Procedure) Rules, 2015:
15. (1) Direct recruitment to the post of Excise Constable in the Service shall be made in accordance with the Uttar Pradesh Direct Recruitment to Group "C" Posts (Mode and Procedure) Rules, 2015, as amended from time to time.
Provided that the procedure to be adopted in making selection, the provisions regarding the physical test as existed in the Uttar Pradesh Excise Constables, Drivers and Tari Supervisors (Fourth Amendment) Rules, 2008 shall also be included:
(2) In the light of effective reservation rules for various categories, sufficient number of eligible candidates will be invited by the Commission for physical efficiency test. Physical efficiency test shall be of qualifying nature. The physical efficiency test shall comprise of running, long jump and cricket ball throw with following details :-

Provided further that if at any point of time the post of Excise Constable is withdrawn from the purview of the commission under the proviso to section 2 of the Uttar Pradesh Subordinate Service Selection Commission Act, 2014 (U.P. Act, no. 20 of 2014) then in such situation the procedure for direct recruitment to the post of Excise Constable in the Service shall be the same as laid down in the Uttar Pradesh Excise Constables, Drivers and Tari Supervisors (Fourth Amendment) Rules, 2008.

(3) The candidates found qualified in the
Physical efficiency test shall be selected by
the commission on the basis of merit on the
basis of marks obtained in written test in the
light of effective reservation rules for various
categories and the list of selected candidates
shall be sent to the appointing authority.
3. In the said rule 20 the new rule 20 A shall be inserted, namely :–
Insertion of Rule 20 A any district of Uttar Pradesh except their home district.
The constables and tari supervisors may be posted in any unit of the department in Posting
4. In the said rules for rule-22 set out in Column-1 below, the rule as set out in Substitution of rule 22 Column-2 shall substituted, namely:–
