चू ंकि प्रारम्भिक अधिसूचना संख्या -2672/77-3-2020-90(एम )-2020, दिनांक 21 दिसम्बर , 2020, लोक प्रयोजन , अर्थात् उत्तर प्रदेश एक्सप्रेसवेज औद्योगिक विकास प्राधि ‍करण के माध्यम से डिफे न्स इण्डस्ट्रि यल कॉरिडोर परियोजना के प्रथम चरण हेतु जिला झांसी , तहसील -गरौठा स्थित ग्राम एरच में 16.1542 हेक्टेयर , गेंदाकबूला में 3.8484 हेक्टेयर , झबरा में 0.1010 हेक्टेयर , कठर्री में 0.1253 हेक्टेयर , नैके रा में 3.0147 हेक्टेयर कु ल 23.2436 हेक्टेयर भूमि के संबंध में भूमि अर्जन , पुनर्वासन और पुनव्र्यवस्थापन में उचित प्रतिकर और पारदर्शिता का अधिकार अधिनियम , 2013 (अधिनियम संख्या 30 सन् 2013) (जिसे आगे उक्त अधिनियम कहा गया है ) की धारा 11 की उपधारा (1) के अधीन जारी की गई थी। झांसी के कलेक्टर को परियोजना से प्रभावित परिवारों के पुनर्वासन और पुनव्र्यवस्थापन के प्रयोजनार्थ प्रशासक नियुक्त किया गया था।

अतएव , अब , उक्त अधिनियम की धारा 15 की उप धारा (2) के अधीन उपबन्ध के अनुसरण में प्रस्तुत की गयी कलेक्टर की रिपोर्ट पर विचार करने के पश्चात् , राज्यपाल उक्त अधिनियम की धारा 19 की उप धारा (1) के अधीन घोषणा करती हैं कि उनका यह समाधान हो गया है कि नीचे अनुसूची ―क‖ में उल्लिखित भूमि का क्षेत्रफल108 rph (Audhik vikas 2021 folder) data8 d 2 उत्तर प्रदेश असाधारण गजट, 7 जुलाई, 2021 लोक प्रयोजन के लिए आवश्यक है और अनुसूची ―ख‖ में यथा - प्रदत्त ग्राम , परगना और जिला में कोई भूमि विस्थापित परि वारों के पुनर्वासन और पुनव्र्यवस्थापन के लिए चिन्हांकित नही ं की गयी है (इस परियोजना हेतु भूमि अर्जन के कारण किसी परिवार का विस्थापित होना सम्भाव्य नही ं है )। राज्यपाल अग्रतर उक्त अधिनियम की धारा 19 की उप धारा (2) के अधीन कलेक्टर को इस आशय की घोषणा प्रकाशित करने के साथ पुनर्वासन और पुनव्र्यवस्थापन योजना को संक्षिप्त रूप में प्रकाशित करने के लिए निदेश देती हैं। पुनर्वासन और पुनव्र्यवस्थापन योजना का सारांश इसके साथ संलग्न है। (जिला झांसी में डिफे न्स इण्डस्ट्रि यल कॉरिडोर परियोजना के विकास हेतु भूमि अर्जन से किसी परिवार का विस्थापित होना संभाव्य र् ‍यवस् ‍थापन हेतु कोई भूमि नही ं है। अतएव पुनर्वासन और पुनव् र् ‍यवस् ‍थापन योजना का चिन्हित करने और पुनर्वासन एवं पुनव् सारांश प्रकाशित किये जाने की कोई आवश् ‍यकता नही ं है। )

IN pursuance of the provisions of clause (3) of Article 348 of the Constitution of India, the Governor is pleased to order the publication of the following English translation of notification no. 991/LXXVII-3–2021-90(M)-2020, dated July 7, 2021:

No. 991 /LXXVII-3–2021-90(M)-2020

Dated Lucknow, July 7, 2021

WHEREAS preliminary notification no. 2672/LXXVII-3-2020-90(M)-2020, dated December 21, 2020 was issued under sub-section (1) of section 11 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Act no. 30 of 2013) (hereinafter referred to as the said Act), in respect of total 23.2436 Hectares of land in the Village Erach 16.1542 Hect., Gendakabula 3.8484 Hect., Jhabra 0.1010 Hect., Kathri 0.1253 Hect., Naikera 3.0147 Hect., Tehsil Garautha, District Jhansi. for public purpose, namely first phase of Defence Industrial Corridor Project through Uttar Pradesh Expressways Industrial Development Authority. The Collector Jhansi was appointed as Administrator for the purpose of Rehabilitation and Resettlement of the project affected families.

NOW, THEREFORE, after considering the report of the Collector submitted in pursuance to provision under sub section (2) of section 15 of the said Act, the Governor is pleased to declare under sub-section (1) of section 19 of the said Act that he is satisfied that the area of the land mentioned in the Schedule ―A‖ below is needed for public purpose and no land in the Village, Paragana and District as given in Schedule ―B‖ has been identified for Rehabilitation and Resettlement of the displaced families (No family is likely to be displaced due to land acquisition for this project).

The Governor is further pleased under sub-section (2) of section 19 of the said Act to direct the Collector to publish a summary of the Rehabilitation and Resettlement Scheme with publication of the declaration to this effect. The summary of the Rehabilitation and Resettlement scheme is attached herewith. (No family is likely to be displaced due to land acquisition for the Defense Industrial Corridor Project in district Jhansi. Hence there is no need for identification of any land for Rehabilitation and Resettlement and publication of summary of Rehabilitation and Resettlement Scheme.)
