अधिसूचना

भूमि अर्जन, पुनर्वासन और पुनव्र्यवस्थापन में उचित प्रतिकर और पारदर्शिता का अधिकार अधिनियम, 2013 की धारा 11 की उपधारा (1) के अधीन चूंँकि उत्तर प्रदेश सरकार का यह समाधान हो गया है कि जिला सुलतानपुर, तहसील-कादीपुर के ग्राम-रतनपुर में 0.1077 हेक्टेयर, ग्राम-फरीदपुर में 0.4308 हेक्टेयर, अर्थात कुल 0.5385 हेक्टेयर, भूमि की, लोक प्रयोजन अर्थात्‌ उत्तर प्रदेश एक्सप्रेसवेज औद्योगिक विकास प्राधिकरण के माध्यम से पूर्वांचल एक्सप्रेस-वे परियोजना हेतु आवश्यकता है।

2-राज्य सामाजिक समाघात निर्धारण अभिकरण द्वारा सामाजिक समाघात निर्धारण सम्बन्धी अध्ययन किया गया था। सामाजिक समाघात निर्धारण रिपोर्ट के मूल्यांकन के लिये राज्य सरकार द्वारा गठित बहुशाखीय विशेषज्ञ समूह ने उत्तर प्रदेश सरकार को अपनी संस्तुतियांँ प्रस्तुत कर दी हैं जिसने दिनांक 04-08-2021 को उसकी संस्तुति को अनुमोदित कर दिया है।

3-संक्षेप में, सामाजिक समाघात निर्धारण रिपोर्ट और सामाजिक समाघात प्रबंध योजना से संबंधित बहुशाखीय विशेषज्ञ समूह की संस्तुतियां निम्नानुसार हैं :-

1-पूर्वांचल एक्सप्रेस-वे परियोजना एक पारम्परिक परियोजना है, जो किसी प्रभावित ग्राम में अधिकतम 120मी0 चौड़ाई की भूमि पट्‌टी पर संचालित की जा रही है। इस प्रकार यह परियोजना, किसी ग्राम के अधिकांश अथवा कुल क्षेत्र को प्रभावित नहीं कर रही है। ताकि इस परियोजना से विस्थापन नगण्य हो।

2-यद्यपि इस परियोजना के माध्यम से संबंधित ग्रामों केे कृषि योग्य क्षेत्रफल में कमी आना संभाव्य है किन्तु भूमि के सर्किल दर के चार गुना के बराबर के प्रतिकर से कृषकों को फार्मों का उन्नयन करने, फार्म मशीनरी में वृद्धि करने एवं सिंचाई सुविधाओं को विकसित करने में सहायता प्राप्त होगी।

3-भूमि अर्जन के प्रतिकर से वैकल्पिक रोजगार के साधनों, बेहतर आवास निर्माण, परिवहन के साधनों तथा कृषि प्रौद्योगिकी के विकास में वृद्धि होना संभाव्य है। इससे भू-धृतियों में होने वाली हृास की क्षति पूर्ति होगी।234 RPH 2021 (Audyogik Vikas Anubhag-3) Data 4e 2 उत्तर प्रदेश असाधारण गजट, 17 अगस्त, 2021 4-लम्बी दूरी की इस परियोजना से उत्तर प्रदेश के सुदूर क्षेत्रों से राज्य की राजधानी लखनऊ से जुड़ना संभाव्य होगा जिससे समय और लागत में कमी आयेगी और दूरस्थ क्षेत्रों में वाणिज्यिक क्रियाकलापों का विकास होगा। इससे दुग्ध एवं दुग्ध उत्पादों, फलों एवं सब्जियों तथा अन्य विनश्वर वस्तुओं को बड़े बाजारों तक ले जाने में सुविधा होगी और यह कृषि एवं सहबद्ध प्रयोजनों में सहायक होगा।

5-तीव्र एवं उत्तम परिवहन के साधनों की वृद्धि से पर्यटन, चिकित्सा परिचर्या और साथ ही साथ अन्तर्राज्यीय परिवहन को बढ़ावा मिलेगा।

6-अतएव, बहुशाखीय विशेषज्ञ समूह का अभिमत है कि :- (क) जिला सुलतानपुर में पूर्वांचल एक्सप्रेस-वे परियोजना के प्रयोजनार्थ भूमि अर्जित करना लोकहित में है और इससे लोक प्रयोजन की पूर्ति होती है।

(ख) इस परियोजना की संभाव्य प्रसुविधाएं, सामाजिक व्यय एवं प्रतिकूल सामाजिक समाघात से अपेक्षाकृत अधिक हैं और अर्जित की जाने वाली कुल भूमि, इस परियोजना के लिये अपेक्षित कुल भूमि से अत्यन्त कम है। 4-अतएव, राज्यपाल सामान्य सूचना हेतु यह अधिसूचित करती हैं कि नीचे अनुसूची में उल्लिखित भूमि की लोक प्रयोजन हेतु आवश्यकता हैः-

5-राज्यपाल, उक्त अधिनियम की धारा 12 के अधीन यथा उपबन्धित तथा विनिर्दिष्ट रूप में, भूमि अर्जन के प्रयोजन हेतु आवश्यक कदम उठाये जाने और भूमि में प्रवेश करने तथा उसका सर्वेक्षण करने, किसी भूमि का समतलीकरण करने, खुदाई करने तथा कार्य के समुचित क्रियान्वयन हेतु अपेक्षित समस्त कार्य करने के लिये भी कलेक्टर को प्राधिकृृत करती हैं।234 RPH 2021 (Audyogik Vikas Anubhag-3) Data 4e उत्तर प्रदेश असाधारण गजट, 17 अगस्त, 2021 3 6-उक्त अधिनियम की धारा 15 के अधीन, भूमि में हितबद्ध कोई व्यक्ति, इस अधिसूचना को प्रकाशित किये जाने के पश्चात्‌ 60 दिन के भीतर अपने क्षेत्र में भूमि अर्जन करने के लिये लिखित रूप में कलेक्टर को आपत्ति प्रस्तुत कर सकता है।

7-उक्त अधिनियम की धारा 11 की उपधारा (4) के अधीन, कोई व्यक्ति, ऐसी अधिसूचना के प्रकाशित किये जाने के दिनांक से भूमि अर्जन की कार्यवाहियाँ पूर्ण होने तक कलेक्टर के पूर्व अनुमोदन के बिना प्रारम्भिक अधिसूचना में विनिर्दिष्ट भूमि का कोई संव्यवहार नहीं करेगा अथवा उसका संव्यवहार अर्थात्‌ विक्रय/क्रय नहीं करने देगा अथवा ऐसी भूमि पर कोई विल्लंगम सृजित नहीं करेगा।

टिप्पणी-उक्त भूमि का स्थल नक्शा, कलेक्टर, सुलतानपुर के कार्यालय में देखा जा सकता है।

IN pursuance of the provisions of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of notification no.1335/LXXVII-3–21-134(M)-2018, dated August 17, 2021 :

No. 1335/LXXVII-3–21-134(M)-2018

Dated Lucknow, August 17, 2021

Under sub-section (1) of section 11 of the Right to Fair Compensation and Transparency in Rehabilitation and Resettlement Act, 2013. Whereas the Government of Uttar Pradesh/Collector (for the purpose of Appropriate Government) is aquired in the that a total of 0.5385 Hectares of land in Disrict Sultanpur is required in the Village Ratanpur 0.1077, Farteedpur 0.4308 hect. Tehsil Kadipur for the public purpose namely Purvanchal Expressway Project through Uttar Pradesh Expressway Industrial Development Authority (UPEIDA).

2. Social Impact Assessment study was carried out by the State Social Impact Assessment Agency. Multi Disciplinary Expert group constituted by State Government for evaluation of Social Impact Assessment report has submitted its recommendations to the Government of Uttar Pradesh which has approved its recommendations on date August 04, 2021.

3. In brief, the recommendations of Multi Disciplinary Expert group regarding Social Impact Assessment report and Social Impact Management Plan is as follows–

1- Purvanchal Expressway is a linear which is being run upon a land stretch in maximum 120 mt. width in any affected village. In this way this project is not affecting major or total area any village. So they the displacement from this project is negligible.

2- Though this project is likely to reduce the cultivable area in the concerned villages but compensation equal to four times of the circle rate of the land will help the farmers to upgrade the farms, increase in farm machinery, and development of irrigation facilities. 3- The compensation of the land acquisition is likely to develop alternate employment measures, construction of better houses, development of means of transport and agriculture technology. This will compensate the loss due to reduction in land holdings.

4- This long distance project is likely to connect the remote areas of Uttar Pradesh with the state capital Lucknow reducing the time and cost and improving the commercial in the remote areas. It will cause convenience in transporting milk and milk products, fruits and vegetables and other perishable items to big markets and this will help in agricultural and allied purposes.

5- Growth of fast and better means of transport will help in development of tourism medical attendance as well as interstate transport.

6. So the Multi Disciplinary Expert group is opinion that-

(a) It is in the public interest to acquire land for the purpose of Purvanchal Expressway Project in District Sultanpur and it serves the public purpose.

(b) The probable benefits from this project are more than the social expenditure and adverse social impact and total land to be acquired is much less than the total land required for this project.

4. Therefore, the Governor is pleased to notify for general information that the land mentioned in the Schedule below, is needed for public purpose-

5. The Governor is also pleased to authorise the Collector, for the purpose of land acquisition to take necessary steps to enter upon and survey of land, take levels of any land, dig and do all the acts required for the proper execution of work as provided and specified under section12 of the Act.

6. Under section 15 of the Act, any person interested in the land may within 60 days after the publication it this notification, make an objection to the acquisition of the land in the locality in writing to the Collector.

7. Under section 11(4) of the Act, no person shall make any transaction or cause any transaction of land i.e. sale/purchase, specified in the preliminary notification or create any encumbrances on such land from the date of publication of such notification till such time as the proceedings of land acquisition its completed, without prior approval of the Collector.

Note : A site plan of the land may be inspected in the Dy.LA. Office of the Collector, Sultanpur.
