अधिसूचना
खान और खनिज (विकास और विनियमन) अधिनियम, 1957 (अधिनियम संख्या 67 सन् 1957) की धारा 9ख की उपधारा (3) और धारा 15 एवं 15क द्वारा प्रदत्त शक्तियों का प्रयोग करके, राज्यपाल, जिला खनिज फाउन्डेशन न्यास नियमावली, 2017 में संशोधन करने की दृष्टि से निम्नलिखित नियमावली बनाती हैंः-

1-(1) यह नियमावली उत्तर प्रदेश जिला खनिज फाउन्डेशन न्यास (द्वितीय संशोधन) संक्षिप्त नाम और प्रारम्भ
नियमावली, 2021 कही जायेगी।
नियम 4 का संशोधन
(2) यह गजट में प्रकाशित किये जाने के दिनांक से प्रवृत्त होगी। 2-उत्तर प्रदेश जिला खनिज फाउन्डेशन न्यास नियमावली, 2017 (जिसे आगे ''उक्त नियमावली'' कहा गया है), में, नीचे स्तम्भ-1 में दिये गये नियम-4 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात् :-

होगा :- (1) न्यास में एक शासी परिषद एवं एक प्रबन्ध समिति होगी। (2) न्यास का प्रबन्ध करने का प्राधिकार शासी परिषद् में निहित होगा।

(ट) (एक) जिले का लोक सभा में संसद-सदस्य (एम0पी0),
यदि किसी जिले में एक से अधिक लोक सभा के संसद-सदस्य (एम0पी0) हों तो उक्त जिला के लोक सभा के ऐसे समस्त संसद- सदस्य शासी परिषद् के सदस्य होंगे।
यदि लोक सभा के संसद -सदस्य का निर्वाचन क्षेत्र एक से अधिक जिले में आता हो तो ऐसे लोक सभा के संसद-सदस्य ऐसे समस्त जिलों के शासी परिषद् के सदस्य होंगे। उत्तर प्रदेश असाधारण गजट, 17 अगस्त, 2021 3 स्तम्भ-1 स्तम्भ-2 -सदस्य

(दो) राज्य से स्वयं द्वारा चयनित एक जिले का राज्य सभा संसद सदस्य राज्य सभा के संसद सदस्य को स्वयं द्वारा चयनित जिले का नाम, राज्य के खनन विभाग के प्रभारी सचिव को सूचित करना होगा, जो सम्बन्धित जिला मजिस्ट्रेट को तत्सम्बंध में सूचित करेगा। (तीन) जिला का विधान सभा-सदस्य (चार) राज्य का स्वयं द्वारा चयनित एक जिले का विधान परिषद सदस्य विधान परिषद सदस्य (एम0एल0सी0) अपने द्वारा चयनित जिला का नाम राज्य के खनन विभाग के प्रभारी सचिव को सूचित करेगा, जो सम्बन्धित जिला मजिस्ट्रेट को तत्सम्बंध में सूचित करेगा।
(4) गैर सरकारी सदस्य का कार्यकाल 3 वर्ष का होगा। (5) कोई सरकारी सदस्य तब पद धारण करने से प्रविरत हो जायेगा, जब वह सरकारी पद धारण करने से प्रविरत हो जायेगा/जायेगी। (6) न्यास की दिन प्रतिदिन की कार्य प्रणाली प्रबन्ध समिति में निहित होगीः- (क) प्रबन्ध समिति में निम्नलिखित

2-उक्त नियमावली में नीचे स्तम्भ-1 में दिये गये नियम-17 के स्थान पर स्तम्भ-2 नियम 17 का संशोधन
में दिया गया नियम रख दिया जायेगा, अर्थात् :-

निम्नलिखित के लिये किया जायेगाः- (क) उच्च प्राथमिकता वाले क्षेत्र-कम से कम 60 प्रतिशत निधि का प्रयोग निम्नलिखित मदों में किया जायेगा :-
निम्नलिखित के लिये किया जायेगाः- (क) उच्च प्राथमिकता वाले क्षेत्र कम से कम 60 प्रतिशत निधि का प्रयोग निम्नलिखित मदों में किया जायेगा :-
- केन्द्रीकृत निर्मलीकरण प्रणाली, जल उपचार संयंत्र, स्थायी/अस्थायी जल वितरण नेटवर्क, जिसमेें पेयजल की आपूर्ति हेतु जल पाईप बिछाने की अच्छी सुविधा सम्मिलित है।
-केन्द्रीकृत निर्मलीकरण प्रणाली, जल उपचार संयंत्र, स्थायी/अस्थायी जल वितरण नेटवर्क, जिसमेें पेयजल की आपूर्ति हेतु जल पाईप बिछाने की अच्छी सुविधा सम्मिलित है। - वहिःस्रोत उपचार संयत्र क्षेत्र में झरना, झील, तालाब, भूगर्भ जल और अन्य जलस्रोत के प्रदूषण की रोकथाम, खनन संक्रियाओं और भंडारणों से उत्पन्न वायु एवं धूल प्रदूषण को नियंत्रित करने के उपाय, खान जल निकासी प्रणाली, खान प्रदूषण निवारण तकनीकेंं, कार्यशील या निषिद्ध खानों के लिए उपाय, अन्य वायु, जल तथा भू-सतह प्रदूषण नियंत्रण के उपाय, पर्यावरणीय सौहार्द एवं सम्पोषणीय खान विकास हेतु वैज्ञानिक दृष्टिकोण से जिला सर्वेक्षण रिपोर्ट तैयार करना, तथा पर्यावरण संरक्षण एवं प्रदूषण नियंत्रण के दृष्टिकोण से अवैध खनन/परिवहन पर नियंत्रण रखने हेतु तकनीकी अवसंरचनाओं के सृजन हेतु आवश्यक उपकरण एवं कार्मिक उपलब्ध कराना।
- वहिःस्त्रोत उपचार सयंत्र, क्षेत्र में झरना, झील, तालाब, भूगर्भ जल और अन्य जलस्रोत के प्रदूषण की रोकथाम, खनन संक्रियाओं और भंडारणों से उत्पन्न वायु एवं धूल प्रदूषण को नियंत्रित करने के उपाय, खान जल निकासी प्रणाली, खान प्रदूषण निवारण तकनीकेंं, कार्यशील या निषिद्ध खानों के लिए उपाय, अन्य वायु, जल तथा भू-सतह प्रदूषण नियंत्रण के उपाय, पर्यावरणीय सौहार्द एवं सम्पोषणीय खान विकास हेतु वैज्ञानिक दृष्टिकोण से जिला सर्वेक्षण रिपोर्ट तैयार करना, तथा पर्यावरण संरक्षण एवं प्रदूषण नियंत्रण के दृष्टिकोण से अवैध खनन/परिवहन पर प्रभावी नियंत्रण रखने हेतु तकनीकी अवसंरचनाओं के सृजन के कार्य अन्तर्गत आवश्यक उपकरण एवं कर्मचारी उपलब्ध कराना। प्रभावित क्षेत्रों में प्राथमिक/द्वितीयक/ तृतीयक स्वास्थ्य देखभाल सुविधाओं के सृजन पर ध्यान केन्द्रित किया जाना चाहिए। स्वास्थ्य देखभाल अवसंरचना के सृजन
प्रभावित क्षेत्रों में प्राथमिक/ द्वितीयक/ तृतीयक स्वास्थ्य देखभाल सुविधाओं के सृजन पर ध्यान केन्द्रित किया जाना चाहिए। स्वास्थ्य देखभाल अवसंरचना के सृजन उत्तर प्रदेश असाधारण गजट, 17 अगस्त, 2021 5 स्तम्भ-1 स्तम्भ-2 पर ही केवल जोर नही दिया जाना चाहिए, बल्कि ऐसी प्रभावी सुविधा उपलब्ध कराने के लिये अपेक्षित आवश्यक कर्मचारी, उपकरण और आपूर्तियों के उपबन्ध पर भी जोर दिया जाना चाहिये। उस सीमा तक स्थानीय निकायों, राज्य और केन्द्र सरकार के विद्यमान स्वास्थ्य देखभाल अवसंरचना के अनुरूप अनुपूरक प्रयास और कार्य किया जाना चाहिये। राष्ट्रीय खनिक स्वास्थ्य संस्थान में उपलब्ध विशेषज्ञ को भी खनन से सम्बन्धित बीमारी और रोगों की देखभाल करने के लिये आवश्यक विशेष अवसंरचना को अभिकल्पित करने के लिये ध्यानाकर्षित किया जा सकता है। सामूहिक स्वास्थ देखभाल बीमा योजना, खनन से प्रभावित व्यक्तियों के लिये क्रियान्वित की जा सकती है।
पर ही केवल जोर नहीं दिया जाना चाहिए, बल्कि ऐसी प्रभावी सुविधा उपलब्ध कराने के लिये अपेक्षित आवश्यक कर्मचारी, उपकरण और आपूर्तियों के उपबन्ध पर भी जोर दिया जाना चाहिये। उस सीमा तक स्थानीय निकायों, राज्य और केन्द्र सरकार के विद्यमान स्वास्थ्य देखभाल अवसंरचना के अनुरूप अनुपूरक प्रयास और कार्य किया जाना चाहिये। राष्ट्रीय खनिज स्वास्थ्य संस्थान में उपलब्ध विशेषज्ञ को भी खनन से सम्बन्धित बीमारी और रोगों की देखभाल करने के लिये आवश्यक विशेष अवसंरचना को अभिकल्पित करने के लिये ध्यानाकर्षित किया जा सकता है। खनन से प्रभावित व्यक्तियों के लिये सामूहिक स्वास्थ देखभाल बीमा योजना, क्रियान्वित की जा सकती है। विद्यालय भवनों, अतिरिक्त शिक्षण कक्षाओं, प्रयोगशालाओं, पुस्तकालयों, कला और हस्तकला कक्ष, सामूहिक शौचालय का निर्माण, पेयजल उपबन्ध, सुदूरवर्ती क्षेत्रों में छात्रों/अध्यापकों के लिये आवासीय छात्रावास, खेल अवसंरचना, व्यवसायिक प्रशिक्षण सुविधा, अध्यापकों एवं अन्य सहायक कर्मचारियों को कार्य में लगाया जाना, इंटरनेट के माध्यम से शिक्षण व्यवस्था, परिवहन सुविधाओं (बस/वैन /साईकिल/रिक्शा आदि) और पौष्टिकता से सम्बन्धित कार्यक्रमों की व्यवस्था किया जाना।
विद्यालय भवनों, अतिरिक्त शिक्षण कक्षाओं, प्रयोगशालाओं, पुस्तकालयों, कला और हस्तकला कक्ष, सामूहिक शौचालय का निर्माण, पेयजल उपबन्ध, सुदूरवर्ती क्षेत्रों में छात्रों/ अध्यापकों के लिये आवासीय छात्रावास, खेल अवसंरचना, व्यवसायिक प्रशिक्षण सुविधा, अध्यापकों एवं अन्य सहायक कर्मचारिवर्ग को कार्य में लगाया जाना, ई-शिक्षण व्यवस्था, परिवहन सुविधाओं (बस/वैन/साईकिल/ रिक्शा आदि) और पौष्टिकता से सम्बन्धित कार्यक्रमों की व्यवस्था किया जाना। मातृ एवं बाल स्वास्थ्य, कुपोषण, किशोरावस्था तथा संक्रामक रोगों से सम्बन्धित समस्याओं का पता लगाने हेतु विशेष कार्यक्रम न्यास के अधीन किये जायेंगे।

जीविका अवलम्ब एवं आय सृजन हेतु कौशल विकास और स्थानीय पात्र, व्यक्तियों के लिये आर्थिक 6 उत्तर प्रदेश असाधारण गजट, 17 अगस्त, 2021 स्तम्भ-1 स्तम्भ-2 गतिविधियों/परियोजनाओं/योजनाओं में प्रशिक्षण व्यावसायिक /कौशल विकास केन्द्र का विकास स्वरोजगार योजनाएं, स्वयं सहायता समूह अवलम्ब और ऐसे स्वरोजगार सम्बन्धी आर्थिक क्रिया-कलापों हेतु अगड़े और पिछड़े लोगों के प्रति जुड़ाव का उपबन्ध सम्मिलित है।
के लिये आर्थिक गतिविधियों/ परियोजनाओं/योजनाओं में प्रशिक्षण व्यावसायिक/कौशल विकास केन्द्र का विकास स्वरोजगार योजनाएं, स्वयं सहायता समूह अवलम्ब और ऐसे स्वरोजगार सम्बन्धी आर्थिक क्रिया-कलापों हेतु अगड़े और पिछड़े लोगों के प्रति जुड़ाव का उपबन्ध सम्मिलित है। अपशिष्ट का संग्रहण, परिवहन और निस्तारण, सार्वजनिक स्थलों की सफाई, जल निकाय और मल उपचार संयंत्र का उपबन्ध, कीचड़ निस्तारण उपबन्ध और प्रसाधन तथा अन्य सम्बन्धित क्रियाकलापों से सम्बन्धित उपबन्ध।
अपशिष्ट का संग्रहण, परिवहन और निस्तारण, सार्वजनिक स्थलों की सफाई, जल निकाय और मल उपचार संयंत्र का उपबन्ध, कीचड़ निस्तारण उपबन्ध और प्रसाधन तथा अन्य सम्बन्धित क्रियाकलापों से सम्बन्धित उपबन्ध। 40 प्रतिशत तक की निधि का उपयोग निम्नलिखित मदों में किया जायेगा :-

IN exercise of the powers conferred by sub-section (3) of section 9-B and sections 15 and 15-A of the Mines and Minerals (Development and Regulation) Act, 1957 (Act no. 67 of 1957), the Governor is pleased to make the following rules with a view to amend the District Mineral Foundation Trust Rules, 2017 .
THE UTTAR PRADESH DISTRICT MINERAL FOUNDATION TRUST (SECOND AMENDMENT) RULES, 2021
1.(1) These rules may be called the Uttar Pradesh District Short title and commencement
Mineral Foundation Trust (Second Amendment) Rules, 2021.
(2) They shall come into force with effect from the date of their publication in
the Gazette.
Amendment of rule 4 2. In the Uttar Pradesh District Mineral Foundation Trust Rules, 2017 (hereinafter referred to as the "said rules") , for rule 4 set out in Column-I below, the rule as set out in Column-II shall be substituted, namely:-

of the Trust shall be:- (1) The Trust shall consist of a Governing Council and a Managing Committee.
(2) The authority to manage the trust shall vest in the Governing Council.

In case there are more than one Member of Parliament (MPs) of Lok Sabha in a district, all such MPs of Lok Sabha of the said district shall be members of the Governing Council. In case the constituency of a Member of Parliament of Lok Sabha falls in more than one districts, such an MP of Lok Sabha shall be member of the Governing Council of all such districts. (ii) Member of Parliament in Rajya Sabha from the State in one district selected by him. The Member of Parliament in Rajya Sabha shall intimate name of the district selected by him to the Secretary in-charge of the Mining Department of the State, who in turn shall inform about the same to the concerned District Magistrate. (iii) The Member of Legislative Assembly (MLAs) of the District. (iv) The Members of Legislative Council of the State (MLC) in one district selected by him. The MLC shall intimate name of the district selected by him to the Secretary in- charge of the Mining Department of the State, who in turn shall inform about the same to the concerned District Magistrate.

3. In the said rules, for rule 17 set out in Column-I below, the rule as set out in Amendment of rule 17

(b) Environment preservation and pollution control measures-Effluent treatment plants, prevention of pollution of streams, lakes, ponds, ground water and other water sources in the region, measures to control air and dust pollution caused by mining operations and dumps, mine drainage system, mine pollution prevention technologies, measures for working or abandoned mines, other air, water and surface pollution control mechanisms, preparation of scientific district survey report for environmental friendly and sustainable mine development and providing necessary equipment and personnel for the creation of technical infrastructure to control illegal mining/ transportation with the purpose of environmental protection and pollution control.

(c) Health care-The focus must be on creation of primary/secondary /tertiary health care facilities in the affected areas. The emphasis should not be only on the creation of the health care infrastructure, but also on provision of providing necessary staff, equipment and supplies required for making such facilities effective. To that extent, the effort should be to supplement and work in convergence with the existing health care infrastructure of the local bodies, State and Central Government. The expertise available with the National Institute of Mines Health may also be drawn upon to design special infrastructure needed to take care of mining related illness and diseases. Group insurance Scheme for health care may be implemented for mining affected persons.

The project/ schemes may include training, development of vocational/skill development center, self employment schemes, support to Self help groups and provision of forward and backward linkages for such self-employment economic activities.

(i) The overall development of the area affected by mining related operation in the District in accordance with the Annual Action Plan prepared by the trustees of the Foundation for the purpose;
