''भारत का संविधान'' के अनुच्छेद 200 के अधीन श्री राज्यपाल ने उत्तर प्रदेश (तृतीय) निरसन विधेयक, 2021 जिससे विधायी अनुभाग-1 प्रशासनिक रूप से सम्बन्धित है, पर दिनांक 24 अगस्त, 2021 को अनुमति प्रदान की और वह उत्तर प्रदेश अधिनियम संख्या 21 सन्‌ 2021 के रूप में सर्वसाधारण की सूचनार्थ इस अधिसूचना द्वारा प्रकाशित किया जाता है। [

] कतिपय अधिनियमितियों, जो वतर्मान समय में अप्रचलित और अनावश्‍यक हो गयी

हैं, का निरसन करने के लिए 2-नीचे अनुसूची में विनिदिष्ट अधिनियमितियाँ एतद्‌द्वारा निरसित कीकतिपय अधिनियमितियों 263 RPH ( nirsan vidhyak 2021) data 4e (vid fol.-21) makeup data8d 2 उत्तर प्रदेश असाधारण गजट, 24 अगस्त, 2021 का निरसन जाती हैं।

व्‍यावृत्ति 3-इस द्वारा किसी अधिनियमिति के निरसन से,- (क) ऐसी कोई अन्य अधिनियमिति प्रभावित नहीं होगी जिसमें निरसित अधिनियमिति लागू की गयी हो, सम्मिलित की गयी हो या निदिष्ट हो ;

(ख) पहले से कृ त या ग्रस्त किसी बात अथवा पहले से अजित, प्रोदभूत या उपगत किसी अधिकार, हक, बाध्यता या दायित्व अथवा तत्सम्बन्धी किसी उपाय या कार्यवाही अथवा पहले से स्वीकृ त किसी ऋण, शास्ति, बाध्यता, दायित्व, दावा या माँग या क्षतिपूति के या से किसी प्रकार के निर्मोचन या उन्मोचन अथवा किसी पूर्व कृत्य या बात के प्रमाण की विधि मान्यता, अविधिमान्यता, अर्थ या परिणाम प्रभावित नहीं होंगे ;

(ग) इस बात के होते हुए कोई सिद्धान्त या विधि का नियम या स्थापित अधिकारिता, अभिवचन, पद्धति या प्रक्रिया का प्रारूप या प्रक्रम अथवा विद्यमान प्रथा, रूढ़ि, विशेषाधिकार, निर्बन्धन, छू ट, पद या नियुक्ति प्रभावित नहीं होंगे कि एतद्‌द्वारा निरसित किसी अधिनियमिति द्वारा, में या से उनकी क्रमशः किसी भी रीति से अभिपुष्टि कर ली गयी होगी या उन्हें मान्यता प्रदान कर दिया गया होगा या उन्हें व्युत्पन्न कर लिया गया होगा ;

(घ) कोई अधिकारिता, पद, रूढ़ि, दायित्व, अधिकार, हक, विशेषाधिकार, निर्बन्धन, छू ट, प्रथा, पद्धति, प्रक्रिया अथवा सम्प्रति अविद्यमान या अप्रवृत्त कोई अन्य विषय या बात पुनः प्रवतित या प्रत्यावतित नहीं होंगे ;

(ङ) लेखा-परीक्षा, परीक्षा, लेखांकन, अनुसन्धान, जाँच या तत्सम्बन्ध में किसी प्राधिकारी द्वारा कृ त या की जाने वाली कोई अन्य कार्यवाही प्रभावित नहीं होगी और ऐसी लेखा-परीक्षा, परीक्षा, लेखांकन, अनुसन्धान, जाँच या कार्यवाही की जा सकती है, और या जारी रखी जा सकती है मानों उक्त अधिनियमितियाँ इस द्वारा निरसित न हों। अनुसूची

IN pursuance of the provisions of clause (3) of Article 348 of the Constitution of India, the Governor is pleased to order the publication of the following English translation of the Uttar Pradesh (Tritiya) Nirsan Adhiniyam, 2021 (Uttar Pradesh Adhiniyam Sankhya 21 of 2021) as passed by the Uttar Pradesh Legislature and assented to by the Governor on August 24, 2021. The Vidhayi Anubhag-I is administratively concerned with the said Adhiniyam.

THE UTTAR PRADESH (THIRD) REPEALING ACT, 2021

(U. P. ACT no. 21 OF 2021)

[As passed by the Uttar Pradesh Legislature]

AN

ACT

to repeal certain enactments that have become obsolete and redundant in the

recent times.

IT IS HEREBY enacted in the Seventy-second Year of the Republic of India as

follows :–

1. This Act may be called the Uttar Pradesh (Third) Repealing Act, 2021. Short title 2. The enactments specified in the Schedule below are hereby repealed. Repeal of certain

3. The repeal by this Act of any enactment shall not,-

(a) affect any other enactment in which the repealed enactment has been

applied, incorporated or referred to;

(c) affect any principle or rule of law, or established jurisdiction, form or course of pleading, practice or procedure, or existing usage, custom, privilege, restriction, exemption, office or appointment, notwithstanding that the same respectively may have been in any manner affirmed or recognized or derived by, in or from any enactment hereby repealed;

(d) revive or restore any jurisdiction, office, custom, liability, right, title, privilege, restriction, exemption, usage, practice, procedure or other matter or thing not now existing or in force;

(e) affect the audit, examination, accounting, investigation, inquiry or any other action taken or to be taken in relation thereto by any authority and such audit, examination, accounting, investigation, inquiry or action could be taken, and, or continued as if the said enactments are not repealed by this Act.

STATEMENT OF OBJECTS AND REASONS

This Bill is one of those periodical measures by which enactments which have ceased to be in force or have become obsolete, are repealed. On recommendation of the State Law Commission, and in order to reduce regulatory compliance burden to facilitate ease of doing business for citizens and industries and with the objective of decriminalization, it has been decided to repeal enactments which have become redundant and obsolete in present times or retention whereof as separate Acts is unnecessary, by introducing a Bill in the second session, of the year 2021, of the State Legislature after obtaining the consent of the Administrative Departments related therewith.

The Uttar Pradesh (Third) Repealing Bill, 2021 is introduced accordingly.
