न्याय अनुभाग-1 (उच्च न्यायालय) ———— संख्या 48/2021/सा0-1457/सात-न्याय-1-2021-178-2011 लखनऊ, 21 सितम्बर, 2021 ———— अधिसूचना प्रकीर्ण संविधान के अनुच्छेद 229 के खण्ड (2) के अधीन प्रदत्त शक्ति का प्रयोग करके, मुख्य न्यायाधीश उच्च न्यायालय, इलाहाबाद राज्यपाल के अनुमोदन से उत्तर प्रदेश उच्च न्यायालय रिवाल्विंग फण्ड नियमावली, 2013 में संशोधन करने की दृष्टि से निम्नलिखित नियमावली बनाते हैं।

1-(1) यह नियमावली उत्तर प्रदेश उच्च न्यायालय रिवाल्विंग फण्ड (प्रथम संशोधन) संक्षिप्त नाम और प्रारम्भ
नियमावली, 2021 कही जायेगी।
(2) यह गजट में प्रकाशित किये जाने के दिनांक से प्रवृत्त होगी। 2-उत्तर प्रदेश उच्च न्यायालय रिवाल्विंग फण्ड नियमावली, 2013 में नीचे स्तम्भ-1 में दिये गये विद्यमान नियम 5(13) के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जाएगा, अर्थात्ः-
नियमावली से संलग्न के करार के पैरा 13 का संशोधन स्तम्भ-1 स्तम्भ-2 (13)-यदि लाभार्थी, पूर्वोक्त पैरा 12 के
(13) ''संस्थान के अनिवार्यता प्रमाण- प़त्र सहित मूल रूप मे सत्यापित देयक/बीजक प्राप्तियों और नुस्खों इत्यादि का सत्यापन इस निमित्त
शीर्षक के सापेक्ष व्ययों के सम्बन्ध में संस्थान की अत्याधुनिक प्रणाली के माध्यम से जनित उसके कुल अवमुक्ति देयक 2 उत्तर प्रदेश असाधारण गजट, 21 सितम्बर, 2021 स्तम्भ-1 स्तम्भ-2 धनराशि के पाँच प्रतिशत धनराशि को वहन करने हेतु सहमत हो तो अवशेष 95 प्रतिशत धनराशि की प्रतिपूर्ति, संस्थान को निर्विवाद रूप से कर दी जायेगी और ऐसे देयक, मुख्य चिकित्सा अधिकारी या किसी ऐसे प्राधिकृत अधिकारी द्वारा सत्यापन/ प्रतिहस्ताक्षर किये जाने से छूट प्राप्त होंगे। यदि लाभार्थी इस पाँच प्रतिशत धनराशि को वहन करने में तैयार न हो तो चिकित्सा एवं स्वास्थ्य विभाग के सक्षम अधिकारियों द्वारा, पूर्व नीति के अनुसार, सत्यापन और प्रतिहस्ताक्षर किये जाने के पश्चात् देयकों का संदाय किया जायेगा।
प्राधिकृत सक्षम प्राधिकारी द्वारा किया जायेगा। प्रत्येक कर्मचारी/भूतपूर्व कर्मचारी या उनके परिवार के पूर्ण रूप से आश्रित सदस्यों हेतु उत्तर प्रदेश सरकारी सेवक (चिकित्सा परिचर्या) नियमावली, 2011 में विहित अनिवार्यता प्रमाण-पत्र (सम्यक रूप से भरा हुआ तथा सत्यापित) भी संस्थान उच्च न्यायालय, इलाहाबाद को प्रस्तुत करेगा। ऐसे चिकित्सीय दावे, परीक्षण हेतु और प्रतिपूर्ति के निमित्त अनुमन्य धनराशि की संस्तुति करने हेतु अपर निदेशक, चिकित्सा स्वास्थ्य, लखनऊ मण्डल, लखनऊ को प्रेषित किये जायेंगे। उच्च न्यायालय, इलाहाबाद तदनुसार अनुमोदन जारी करेगा।''

IN exercise of the powers conferred under clause (2) of Article, 229 of the Constitution of India The Chief Justice of the High Court of Judicature at Allahabad, the Governor is pleased to make the following rules with a view to amending the Uttar Pradesh High Court Revolving Fund Rules, 2013.
THE UTTAR PRADESH HIGH COURT REVOLVING FUND (FIRST
AMENDMENT) RULES, 2021
1. (1) These Rules may be called the Uttar Pradesh High Court Revolving Fund Short Title and Commencement
(First Amendment) Rules, 2021.
(2) They shall come into force with effect from the date of this publication in the Gazette.
2. IN the Uttar Pradesh High Court Revolving Fund Rules, 2013, for the existing para 13 of the Agreement appended to the Rules set out in Column-1 below, the para as set out in Column-2 shall be substituted, namely:-

3 उत्तर प्रदेश असाधारण गजट, 21 सितम्बर, 2021(13) If the beneficiary agrees to bear 5 percent of his total discharge bill amount, generated through latest system of the Institute with regard to the expenses against the heads of aforesaid para 12, Reimbursement of the remaining 95 percent amount shall undisputedly be made to the Institute and such bills shall be exempted from verification/ counter- signature by the Chief Medical Officer or any such authorized officer. If the beneficiary is not ready to bear this 5 percent amount, the payment of bill shall be made after the verification and counter- signature by the competent officers of the Medical and Health Department, as per earlier policy.
(13) "The verified bill/cash memo, receipts, prescription etc, in original along with essentiality certificate of the Institute shall be verified by the Competent Authority authorized in this behalf. The Institute shall also submit to the High Court of Judicature at Allahabad the prescribed essentiality certificate (duly filled in and verified) for every employee/ex-employees or wholly dependent family members thereof in the manner prescribed in the Uttar Pradesh Government Servants (Medical Attendance) Rules, 2011. Such medical claims will be sent to the Additional Director Medical Health, Lucknow Division, Lucknow for examination and to recommend the admissible amount for the Reimbursement. The High Court of Judicature at Allahabad will issue sanction accordingly."
