अधिसूचना
- साधारण खण्ड अधिनियम, 1897 (अधिनियम संख्या 10 सन् 1897) की धारा 21 के साथ पठित उत्तर प्रदेश में उसकी प्रवृत्ति के सम्बन्ध में यथा संशोधित भारतीय स्टाम्प अधिनियम, 1899 (अधिनियम संख्या 2 सन् 1899) की धारा 9 की उपधारा (1) के खण्ड (क) के अधीन शक्तियों का प्रयोग करके, राज्यपाल, इस अधिसूचना के गजट में प्रकाशित किये जाने के दिनांक से "उत्तर प्रदेश पोस्ट कोविड-19 के परिप्रेक्ष्य में राज्य के आर्थिक रूप से पिछड़े क्षेत्रों के लिए त्वरित निवेश संप्रवर्तन नीति-2020" के पैरा 5.1 में यथा उपबंधित, निम्न अनुसूची के स्तम्भ-2 में यथा उल्लिखित प्रयोजनों के लिए उक्त अनुसूची के स्तम्भ-4 में यथादर्शित लिखतों के सम्बन्ध में, प्रभार्य स्टाम्प शुल्क में, नीचे अनुसूची के स्तम्भ-3 में दर्शित सीमा तक छूट प्रदान करती हैं।

| उत्तर प्रदेश पोस्ट कोविड-19 के परिप्रेक्ष्य मे ं राज्य के आर्थिक रूप से पिछड़े क्षेत्रों के लिए त्वरित निवेश संप्रवर्तन नीति-2020 का पैरा 5.1 | भूमि का क्रय/पट्टा। | (एक) ब ुन्देलखण्ड और पूर्वांचल क्षेत्र में 100 प्रतिशत (दो) मध्यांचल क्षेत्र में 75 प्रतिशत | अनुच्छेद-23 के खण्ड (क) के अधीन हस्तान्तरण एवं अनुच्छेद 35 के अधीन पट्टा। |
2-यह छूट, निम्नलिखित शर्तों के अध्यधीन होगी,-
(क) उक्त इकाई को राज्य सरकार की किसी अन्य नीति के अधीन अन्य छूट या सुविधा नहीं प्रदान की जायेगी;
(ख) जिला का जिला मजिस्ट्रेट अथवा उपायुक्त उद्योग, ऐसे लिखत पर इस तथ्य की पुष्टि करने के प्रयोजन हेतु साक्षी के रूप में हस्ताक्षर करेगा कि हस्तान्तरण/पट्टा विलेख, ऊपर उल्लिखित प्रयोजनों हेतु निष्पादित किया जा रहा है, तथा
(ग) ऐसे हस्तान्तरण विलेख/पट्टा विलेख के निबन्धन के समय, महानिरीक्षक निबन्धन, उत्तर प्रदेश के पक्ष में, स्टाम्प शुल्क की छूट के समतुल्य धनराशि की अप्रतिसंहरणीय बैंक प्रत्याभूति, निबन्धनकर्ता अधिकारी के समक्ष प्रस्तुत की जायेगी। इस सम्बन्ध में औद्योगिक विकास विभाग का यह दायित्व होगा कि वह ऐसी छूट प्राप्त करने वाली इकाई द्वारा विहित अवधि के भीतर प्रयोजन की र्पूर्ति न करने अथवा वाणिज्यिक उत्पादन प्रारम्भ न करने की प्रास्थिति की सूचना तत्काल स्टाम्प एवं रजिस्ट्रेशन विभाग को देगा। ऐसी दशा में, स्टाम्प एवं रजिस्ट्रेशन विभाग, बैंक प्रत्याभूति को भुना कर विभाग के समुचित लेखार्शीषक में धनराशि जमा करेगा :
परन्तु यह कि औद्योगिक विकास विभाग द्वारा इस तथ्य की पुष्टि किये जाने पर कि सम्बन्धित इकाई द्वारा नीति के अधीन शर्तों का समुचित रूप से अनुपालन कर दिया गया है, उपरोक्त बैंक प्रत्याभूति को स्टाम्प एवं रजिस्ट्रेशन विभाग द्वारा अवमुक्त कर दिया जायेगा।

IN pursuance of the provisions of clause (3) of Article 348 of the Constitution of India, the Governor is pleased to order the publication of the following English translation of notification no. 07/2021/1041/94-S. R.-2–2021-700(13)-2021, dated September 24, 2021 :

IN exercise of the powers under clause (a) of sub-section (1) of section 9 of the Indian Stamp Act, 1899 (Act no. 2 of 1899), as amended in its application to Uttar Pradesh read with section 21 of the General Clauses Act, 1897 (Act no. 10 of 1897), the Governor is pleased to remit with effect from the date of publication of this notification in the Gazette, the stamp duty to the extent shown in Column-3 of the Schedule below, chargeable in respect of the instrument as shown in Column-4 of the said Schedule for the purpose as mentioned in Column-2 of the said Schedule as provided in paragraph 5.1 of "the Uttar Pradesh Post-COVID-19 Accelerated Investment Promotion Policy for Economically Backward Regions of the State-2020".

2. This remittance shall be subject to the following conditions ,–
(a) The unit shall not be provided with other remittance or facility under any other policy of the State Government;
(b) District Magistrate or Deputy Commissioner Industries of the District shall sign such instrument as witness for the purpose of confirming the fact that the conveyance/lease deed is being executed for the purposes above-mentioned, and
(c) Irrevocable Bank guarantee of the amount equal to the remission of stamp duty in favour of Inspector General of Registration,Uttar Pradesh shall be presented before the Registering Officer at the time of registration of such conveyance deed/lease deed. In this regard, it shall be the liability of Industrial Develoment Department that it shall inform, the status of non-fulfillment of the purpose or non-commencement of commercial production within the prescribed period, by the unit receiving such remission, to the Stamp and Registration Department, immediately. In such a condition, the Stamp and Registration Department shall deposit the amount in the proper account head of the Department, by encasing the bank guarantee:
Provided that, upon confirmation of the fact by the Induatrial Development Department that the conditions under the policy have been properly complied with by the concerned unit, the Bank Guarantee shall be released by the Stamp and Registration Department.
