अधिसूचना
उत्तर प्रदेश माल और सेवा कर अधिनियम, 2017 (उत्तर प्रदेश अधिनियम संख्या 1 सन् 2017) की धारा 9 की उपधारा (1), धारा 15 की उपधारा (5) द्वारा प्रदत्त शक्तियों का प्रयोग करके राज्यपाल, परिषद की सिफारिशों के आधार पर, एतदद्वारा, अधिसूचना संख्या क0नि0-2-836/ग्यारह-9(47)-17-उ0प्र0अधि0-1- 2017- आदेश-(06)-2017, दिनांक 30 जून, 2017 में अग्रतर निम्नलिखित संशोधन करती हैं, अर्थात् :-
उक्त अधिसूचना में-
क-अनुसूची एक में-2.5%,–
(i) क्रम संख्या-71 और उससे संबंधित प्रविष्टियों के पश्चात, निम्नलिखित क्रम संख्या और प्रविष्टियां बढ़ा दी जाएंगी, अर्थात् :-
| "71क | 1209 | इमली के बीज बुवाई के अलावा किसी अन्य उपयोग के लिए"; |
(ii) क्रम संख्या 138 से 148 और उससे संबंधित प्रविष्टियों को निकाल दिया जाएगा;
(iii) क्रम संख्या 186 और उससे संबंधित प्रविष्टियों के पश्चात, निम्नलिखित क्रम संख्या और प्रविष्टियां रख दी जाएंगी, अर्थात :-
| "186क | 3826 | हाई-स्पीड डीजल के साथ सम्मिश्रण के लिए तेल विपणन कंपनियो को ं पूर्ति —त बायो-डीजल"; |
(iv) क्रम-संख्या 187क और उससे संबंधित प्रविष्टियाँ निकाल दी जायेंगी;
(v) क्रम-संख्या 234 और उससे संबंधित प्रविष्टियाँ निकाल दी जायेंगी;
(vi) सूची 1 में, मद संख्या 231 और उससे संबंधित प्रविष्टियों के पश्चात् निम्नलिखित को बढ़ा दिया जायेगा, अर्थात् :-
"(232) पेम्ब्रोलिजुमाब (कीटूडा)";
( vii) सूची 3 में, मद संख्या (ख) (2) और उससे संबंधित प्रविष्टियों के पश्चात्, निम्नलिखित को बढ़ा दिया जायेगा, अर्थात् :-
"(3) दिव्यांगों द्वारा उपयोग किए जाने वाले वाहनों के लिए रेट्रो फिटमेंट किट";
ख-अनुसूची दो में-6%,–
(i) क्रम संख्या 80क के समक्ष, स्तम्भ (3) में, प्रविष्टि के स्थान पर, निम्नलिखित प्रविष्टि रख दी जायेगी, अर्थातः-
"बायो-डीजल (हाई-स्पीड डीजल के साथ सम्मिश्रण के लिए तेल विपणन कंपनियों को पूर्ति —त बायो-डीजल से भिन्न)";
(ii) क्रम संख्या 122 और उससे संबंधित प्रविष्टियाँ निकाल दी जायेंगी;
(iii) क्रम संख्या 127 से 132 और उससे संबंधित प्रविष्टियाँ निकाल दी जायेंगी;
(iv) क्रम संख्या 201 और उससे संबंधित प्रविष्टियों के पश्चात्, निम्नलिखित क्रम संख्या और प्रविष्टियाँ बढ़ा दी जायेगी, अर्थात् :-
| "201क | 84, 85 या 94 | निम्नलिखित नवीकरणीय ऊर्जा उपकरणों और उनके विनिर्माण के लिये पुर्जे- (क) जैव गैस संयंत्र; (ख) सौर ऊर्जा आधारित उपकरण; (ग) सौर ऊर्जा जनरेटर; (घ) पवन मिलें, पवन संचालित बिजली जेनरेटर (डब्ल्यू ओईजी); (ङ) ऊर्जा संयंत्रों/उपकरणों के लिए अपशिष्ट; (च) सौर लालटेन/सौर लैंप; (छ) महासागरीय तरंगे /ज्वारीय तरंगें ऊर्जा उपकरण/पौधें; ं (ज) फोटो वोल्टाइक सेल, मॉडयूल में असेंबल किया गया है या नहीं या पैनलों मे बना है। ं ः-यदि इस प्रविष्टि में विनिर्दिष्ट माल की पूर्ति की जाती है, तो पूर्तिकर्ता द्वारा, अन्य माल की पूर्तियों और सेवाओ के साथ, जिनमें ं से एक विनिर्दिष्ट कराधेय सेवा ह ै में उल्लिखित सारणी के क्रम संख्या 38 की प्रविष्टि में अधिसूचना संख्या 11/2017-केंद्रीय कर (दर), दिनांक 28 जून, 2017 [जी0एस0आर0 690 (अ)], के लिए माल की पूर्ति का मूल्य इस प्रविष्टि के प्रयोजनार्थ ऐसी समस्त पूर्तियों के लिए प्रभारित सकल प्रतिफल के सत्तर प्रतिशत के रूप में समझा जाएगा और सकल प्रतिफल का अवशेष तीस प्रतिशत प्रभारित उक्त कराधेय सेवा के मूल्य के रूप में समझा जाएगा।"; |
(vi) क्रम संख्या 232 और उससे संबंधित प्रविष्टियाँ निकाल दी जायेंगी;
ग-अनुसूची तीन में-9%,-
(i) क्रम संख्या 26ख और उससे संबंधित प्रविष्टियों के पश्चात्, निम्नलिखित क्रम संख्या और प्रविष्टियां बढ़ा दी जाएंगी, अर्थात् :-

बढ़ा दी जाएंगी, अर्थात् :-
| "157क | 4906 00 00 | वास्तुकला, अभियांत्रिकी, औद्योगिक, वाणिज्यिक, स्थला—तिक या ऐसे प्रयोजनो के लिए योजनाएं और चित्रकारी, जो मूल रूप से हाथ से ं तैयार किए गए हैं; हस्तलिखित ग्रंथ; संवेदनशील कागज पर फोटोग्राफिक प्रति—तियां और पूर्वगामी की कार्बन प्रतियां। |

(v) क्रम संख्या 398 और उससे संबंधित प्रविष्टियों के पश्चात्, निम्नलिखित क्रम संख्या और प्रविष्टियां बढ़ा दी जाएंगी, अर्थात् :-

(vi) क्रम संख्या 447 के समक्ष, स्तम्भ (3) में, प्रविष्टि के स्थान पर, प्रविष्टि "बॉल प्वाइंट पेन; फेल्ट टिप्ड और अन्य पोरस-टिप्ड पेन और मार्कर; फाउंटेन पेन, स्टाइलोग्राफ पेन और अन्य पेन; डुप्लिकेटिंग स्टाइलेस; पेन होल्डर, पेंसिल होल्डर और समान होल्डर; पूर्वगामी सामग्री के भाग (कैप और क्लिप सहित) शीर्षक 9609 से भिन्न", रख दी जायेंगी;
घ-अनुसूची चार में-14%,—
(i) क्रम संख्या 12क और उससे संबंधित प्रविष्टियों के पश्चात्, निम्नलिखित क्रम संख्या और प्रविष्टियां बढ़ा दी जाएंगी, अर्थात् :-
| "12ख | 2202 | फल पेय रस का कार्बोनेटेड बिवरेज या फल रसयुक्त कार्बोनेटेड बिवरेज।"; |
2-यह अधिसूचना तारीख 1 अक्टूबर, 2021 को प्रवृत्त होगी।

IN pursuance of the provision of clause (3) of Article 348 of the Constitution of India, the Governor is pleased to order the publication of the following English translation of Government notification no. 1041/XI-2-21-9(47)-17-U.P. Act-1-2017-Order(202)-2021, dated October 1, 2021 :

IN exercise of the powers conferred by sub-section (1) of section 9 and sub-section (5) of section 15 of the Uttar Pradesh Goods and Services Tax Act, 2017 (U.P. Act no. 1 of 2017), the Governor, on the recommendations of the Council, hereby makes the following further amendments in the notification no. KA.NI.-2-836/XI-9(47)-17-U.P.Act-1-2017-Order(06)-2017, dated June 30, 2017, namely :–
In the said notification- (a) in Schedule I–2.5%,-
(i) after S. No. 71 and the entries relating thereto, the folloiwng S. No. and entries shall be inserted, namely :–
| "71A | 1209 | Tamarind seeds meant for any use other than sowing"; |
(ii) S. Nos. 138 to 148 and the entries relating thereto shall be omitted; (iii) after S. No. 186 and the entries relating thereto, the following S. No. and entries shall be
| "186A | 3826 | Bio-diesel suppplied to Oil Marketing Companies for blending with High Speed Diesel"; |
(iv) S. No. 187A and the entries relating thereto shall be omitted; (v) S. No. 234 and the entries relating thereto shall be omitted; (vi) in List 1, after item number 231 and the entries relating thereto, the following shall be inserted, namely:–
"(232) Penbrolizumab (Keytruda)";

(d) in Schedule IV–14%,-
(i) after S. No. 12A and the entries relating thereto, the following S. No. and entries shall be

2. This notification shall come into force on the 1st day of October, 2021.
