अधिसूचना

चूँकि प्रारम्भिक अधिसूचना संख्या 850/वि0भू0अ0अ0/सं0सं0/मथुरा/2021 दिनांक 26.03.2021, लोक प्रयोजन अर्थात्‌ उ0प्र0 पावर ट्रांसमिषन कॉरपोरेषन लि0 मथुरा के माध्यम से 132 के0वी0 विद्युत उपकेन्द्र जी0आई0एस0 फरह परियोजना हेतु जिला मथुरा तहसील सदर स्थित ग्राम रौसू में 0.0350 हेक्टेयर भूमि के सम्बन्ध में भूमि-अर्जन, पुनर्वासन और पुनव्र्यवस्थापन में उचित प्रतिकर और पारदर्षिता का अधिकार अधिनियम, 2013 (अधिनियम संख्या 30 सन्‌ 2013) (जिसे आगे ''उक्त अधिनियम'' कहा गया है) की धारा-11 की उप-धारा (1) के अधीन जारी की गयी थी। उपरोक्त परियोजना हेतु भूमि-अर्जन से किसी भी परिवार का विस्थापित होना सम्भाव्य नहीं है। अतएव पुनर्वासन और पुनव्र्यवस्थापन के प्रयोजनार्थ प्रषासक नियुक्त किया जाना आवष्यक नहीं था। अतएव, अब, उक्त अधिनियम की धारा 15 की उप-धारा (2) के अधीन परन्तुक अनुसरण मेंं प्रस्तुत की गयी कलेक्टर की रिपोर्ट पर विचार करने के पष्चात्‌, राज्यपाल उक्त अधिनियम की धारा-19 की उप-धारा (1) के अधीन घोषणा करते हैं कि उनका यह समाधान हो गया है कि नीचे अनुसूची ''क'' में उल्लिखित भूमि का क्षेत्रफल लोक प्रयोजन के लिए आवष्यक है और अनुसूची ''ख'' में यथा-प्रदत्त ग्राम, परगना और जिला में कोई भूमि विस्थापित परिवारों के पुनर्वासन और पुनव्र्यवस्थापन के लिए चिन्हांकित नहीं की गयी है (इस परियोजना हेतु भूमि अर्जन के कारण किसी परिवार का विस्थापित होना सम्भाव्य नहीं है)।

राज्यपाल अग्रतर उक्त अधिनियम की धारा-19 की उप-धारा (2) के अधीन कलेक्टर को इस आषय की घोषणा प्रकाषित करने के साथ पुनर्वासन और पुनव्र्यवस्थापन योजना को संक्षिप्त रूप में प्रकाषित करने के लिए निदेष देते हैं। पुनर्वासन और पुनव्र्यवस्थापन योजना का सारांष इसकेे साथ संलग्न है। जिला मथुरा में347 RPH (Urja Anubhag-3) 2021 Data 4e 2 उत्तर प्रदेश असाधारण गजट, 1 अक्टूबर, 2021 132 के0वी0 विद्युत उपकेन्द्र जी0आई0एस0 फरह परियोजना हेतु भूमि अर्जन से किसी परिवार का विस्थापित होना सम्भाव्य नहीं है। अतएव पुनर्वासन और पुनव्र्यवस्थापन हेतु कोई भूमि चिन्हित करने और पुनर्वासन एवं पुनव्र्यवस्थापन योजना का सारांष प्रकाषित किये जाने की कोई आवष्यकता नहीं है।

The Governor is pleased to order the publication of the following English translation of notification no. 2574/XXIV-P-3–2021-534-2020 T.C., dated October 1, 2021 :

No. 2574/XXIV-P-3–2021-534-2020 T.C.

Dated Lucknow, October 1, 2021

Whereas Preliminary notification No.850 /S.L.A.O /J.O./ Mathura/2021 dated 26-03-2021 was issued under sub-section (1) of section-11 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation & Resettlement Act 2013 (Act no. 30 of 2013) (hereinafter referred to as the said Act), to Land in the Village Rosu, 0.0350 Hectares Tehsil Sadar, District Mathura for public purpose, namely 132KV Substation G.I.S. Farah, Mathura Project through Uttar Pradesh Power Transmission Corporation Ltd. Mathura. There is no family likely to be displaced due to the land acquisition of above said project. Hence there was no need to appoint Administrator for the purpose of Rehabilitation & Resettlement of the Project affected families.

Now, Therefore, after considering the report of the collector submitted in pursuance to provision under sub- section (2) of section 15 of the said Act, the Governor is pleased to declare under sub-section (1) of section 19 of the said Act, that he is satisfied that the area of the land mentioned in the Schedule "A" below is needed for public purpose and no land in the Village, Paragana and Districts as given in Schedule "B" has been identified for Rehabilitation & Resettlement of the displaced families (No family is likely to be displaced due to land acquisition for this project).

The Governor is further pleased under sub-section (2) of section 19 of the said Act, to direct the collector to publish a summary of the Rehabilitation & Resettlement Scheme with publication of the declaration to this effect. The summary of the Rehabilitation & Resettlement Scheme is attached herewith.

(No family if likely to be displaced due to land acquisition for of 132KV Substation G.I.S. Farah, Project in District Mathura. Hence there is no need for identification of any land for Rehabilitation &Resettlement and publication of summary of Rehabilitation &Resettlement Scheme.)
