अधिसूचना
साधारण खण्ड अधिनियम, 1897 (अधिनियम संख्या 10 सन 1897) की धारा 21 और विद्युत अधिनियम, 2003 (अधिनियम संख्या 36 सन 2003) की धारा 180 की उपधारा (2) के खण्ड (घ) के साथ पठित धारा 180 की उप धारा (1) के अधीन शक्तियों का प्रयोग करके राज्यपाल, उत्तर प्रदेष विद्युत नियामक आयोग (अध्यक्ष और सदस्यों की नियुक्ति और सेवा की शर्तें) नियमावली, 2008 में संषोधन करने की दृश्टि से निम्नलिखित नियमावली बनाती है।
उत्तर प्रदेष विद्युत नियामक आयोग (अध्यक्ष और सदस्यों की नियुक्ति और सेवा की शर्तें) (प्रथम संषोधन), नियमावली, 2021
1-(1) यह नियमावली उत्तर प्रदेष विद्युत नियामक आयोग (अध्यक्ष और सदस्यों की संक्षिप्त नाम और प्रारम्भ नियुक्ति और सेवा की शर्तें) (प्रथम संषोधन), नियमावली, 2021 कही जाएगी।
(2) यह गजट में प्रकाषित किये जाने के दिनांक से प्रवृत्त होगी।
नियम 15 का संषोधन 2-उत्तर प्रदेष विद्युत नियामक आयोग (अध्यक्ष और सदस्यों की नियुक्ति और सेवा की शर्तें) नियमावली, 2008 में, नीचे स्तम्भ एक में दिये गये विद्यमान नियम 15 के स्थान पर
स्तम्भ दो में दिया गया नियम रख दिया जाएगा ; अर्थात :-

| पेंषन 15 | अध्यक्ष और सदस्य पेन्षन के हकदार होंगेः प्रतिबन्ध यह है कि ऐसी कोई पेन्षन देय नहीं होगी, (एक) यदि उसने दो वर्श से कम की स ेवा की हो; या (दो) यदि उसे इस सम्बन्ध में अधिनियम क े उपबन्धों के अनुसार आयोग के किसी पद से हटा दिया गया होः परन्तु यह और कि इस नियम के अधीन किसी व्यक्ति को देय पेन्षन की कुल धनराषि किसी पेन्षन की धनराषि के साथ (जिसमें पेन्षन की सारांषीकृत भाग भी है।) यदि कोई हो, जो उच्च न्यायालय के न्यायाधीष या सरकारी सेवक के रूप मे ं आयोग में अपनी नियुक्ति के पूर्व उसके द्वारा की गयी सेवा के सम्बन्ध में उसे अनुमन्य हो, वह उच्च न्यायालय के किसी न्यायाधीष या भारत सरकार के किसी सचिव को अनुमन्य पेन्षन की अधिकतम धनराषि इसमें जो भी अधिक हो, से अधिक नहीं होगी। | पेंषन 15. दिनांक 1 अप्रैल, 2005 को अथवा उसके पष्चात नियुक्त अध्यक्ष और सदस्य राश्ट्रीय पेन्षन योजना (एन0पी0एस0) से आच्छादित होंगे। |

In exercise of the powers under sub-section (1) of section 180 read with clause (d) of sub-section (2) of section 180 of the Electricity Act, 2003 (Act no. 36 of 2003) and section 21 of the General Clauses Act, 1897 (Act no. 10 of 1897), the Governor is pleased to make the following rules with a view to amend the Uttar Pradesh Electricity regulatory Commission (Appointment and Conditions of Service of the उत्तर प्रदेश असाधारण गजट, 25 अक्टूबर, 2021 3 UTTAR PRADESH ELECTRICITY REGULATORY COMMISSION
(APPOINTMENT AND CONDITIONS OF SERVICE OF THE CHAIRPERSON
AND MEMBERS) (FIRST AMENDMENT) RULES, 2021
Short title and 1. (1) These rules may be called the Uttar Pradesh Electricity
commencement Regulatory Commission (Appointment and Conditions of Service of the
Chairperson and Members) (First Amendment) Rules, 2021.
(2) They shall come into force with effect from the date of their publication
in the Gazette.
Amendment 2. In the Uttar Pradesh Electricity Regulatory Commission (Appointment
of rule 15 and Conditions of Service of the Chairperson and Members) Rules, 2008 for the
existing rule 15 set out in Column-I below, the rule as set out in Column-II shall be

The Chairperson and the members shall be entitled to pension provided that no such pension shall payable, (i) if he has put in less than two years of service ; or (ii) if he has been removed from an office in the Commission as per the provisions of the Act: Provided further that the aggregate amount of the pension payable to any person under this rule together with amount of any pension (including commuted portion of pension),if any, admissible to him in respect of the service rendered by him prior admissible to him in respect of the service rendered by him prior to his appointment in the Commission as a Judge of the High Court or a Government Servant shall not exceed the maximum amount of pension admissible to a Judge of the High Court or a Secretary to the Government of India, whichever is more. | Pension15. The Chairman and Members appointed on or after 1St April, 2005 shall be covered under the National Pension Scheme (N.P.S.). |
