दिव्यांगजन सशक्तिकरण अनुभाग-3 ----- संख्या 451/65-3-2021-01-2017 लखनऊ, 1 नवम्बर, 2021 ----- अधिसूचना दिव्यांगजन अधिकार अधिनियम, 2016 (अधिनियम संख्या 49 सन् 2016) की धारा 101 के अधीन शक्तियों का प्रयोग करके राज्यपाल जिस नियमावली को बनाने का प्रस्ताव करती हैं, उसका निम्नलिखित प्रारूप, उक् त धारा की उपधारा (1) की अपेक्षानुसार आपत्तियां और सुझाव आमंत्रित किये जाने की ष्टि से एतद् प्रकाशित किया जाता है।
आपत्तियां और सुझाव, यदि कोई हों, अपर मुख्य सचिव, उत्तर प्रदेश शासन, दिव्यांगजन सशक्तिकरण विभाग, कक्ष संख्या-301, तृतीय तल, बापू भवन, लखनऊ को लिखित रूप से सम्बोधित करके प्रेषित किये जाएंगे।
के वल उन्हीं आपत्तियों और सुझावों पर विचार किया जायेगा जो इस अधिसूचना के गजट में प्रकाशित किये जाने के दिनांक से पंद्रह दिन के भीतर प्राप्त होंगे। उत्तर प्रदेश दिव्यांगजन अधिकार (प्रथम संशोधन) नियमावली, 2021
1-(1) यह नियमावली उत्तर प्रदेश दिव्यांगजन अधिकार (प्रथम संशोधन) नियमावली, संक्षिप्त नाम और प्रारम्भ
2021 कही जायेगी ।
(2) यह गजट में प्रकाशित किये जाने के दिनांक से प्रवृत्त होगी ।
2-उत्तर प्रदेश दिव्यांगजन अधिकार नियमावली, 2017 में, नियम 21 में, नीचे नियम-21 का
संशोधन
स्तम्भ-1 में दिये गये उपनियम (1) के स्थान पर स्तम्भ-2 में दिया गया उपनियम रख दिया जायेगा, अर्थात्:-
स्तम्भ-1 स्तम्भ-2 2 उत्तर प्रदेश असाधारण गजट, 1 नवम्बर, 2021 21 (1) कोई व्यक्ति आयुक् त के रूप में नियुक्ति के लिए तब तक पात्र नहीं होगा, जब तक कि-
वि मान उपनियम एत रा प्रतिस्थापित उपनियम 21 (1) कोई व्यक्ति अधिनियम की धारा 79 की उपधारा (1) के अधीन राज्य दिव्यांगजन आयुक् त (जिसे आगे इस अध्याय में राज्य आयुक् त कहा गया है) के रूप में तब तक नियुक् त किये जाने हेतु अर्ह नहीं होगा जब तक-
(क) वह किसी मान्यता प्राप्त
विश्वविद्यालय से स्नातक न हो:
(क) उसके पास विकलांगजन के पुनर्वास से संबंधित मामलों में विशेष ज्ञान या व्यवहारिक अनुभव न हो;
परन्तु यह कि सामाजिक कार्य या विधि या प्रबंधन या मानव अधिकार या पुनर्वास या दिव्यांगजन शिक्षा में मान्यता प्राप्त डिग्री या डिप्लोमा धारण करने वाले व्यक्ति को अधिमान प्रदान किया जायेगा। (ख) उस वर्ष, जिसमें राज्य आयुक्त की नियुक्ति हेतु आवेदन पत्र आमंत्रित करते हुए विज्ञापन में यथाविनिदिष्ट आवेदन पत्र प्राप्त किये जाने का अन्तिम दिनांक नियत हो, के एक जनवरी को छप्पन वर्ष की आयु प्राप्त न किया हो;
(ख) वह के न्द्रीय सरकार या राज्य सरकार या सार्वजनिक क्षेत्र के उपक्रम या दिव्यांगता या सामाजिक क्षेत्र से संबंधित मामलों को व्यवहृत करने वाले किसी अ सरकारी या स्वायत्तशासी निकाय में समूह ''क'' स्तरीय पद पर अथवा दिव्यांगता या सामाजिक क्षेत्र के अन्तर्गत रजिस्ट्रीकृ त राष्ट्रीय और अन्तर्राष्ट्रीय स्वैच्छिक संगठन में ज्येष्ठ स्तर के कृ त्यकारी के रूप में कम से कम पन्द्रह वर्ष का अनुभव धारित न कर ले:
परन्तु यह कि पन्द्रह वर्ष के कु ल अनुभव में से उसके पास दिव्यांगजन के पुनर्वास या सशक्तिकरण के क्षेत्र में कम से कम तीन वर्ष का अनुभव होना चाहिए; और
(ग) उसके पास निम्नलिखित शैक्षिक
(ग) वह भर्ती वर्ष के 1 जनवरी को अर्हताएं और अनुभव न हो, अर्थात्:-
छप्पन वर्ष की आयु से कम न हो। (क) शैक्षिक अर्हताएं (एक) आवश्यक- किसी मान्यता
प्राप्त विश्वविद्यालय से स्नातक।
(दो) वांछनीय सामाजिक या स्तम्भ-1 स्तम्भ-2 वि मान उपनियम एत रा प्रतिस्थापित उपनियम विधि या प्रबन्धन या मानवाधिकार या पुनर्वास या दिव्यांगजन शिक्षा में मान्यता प्राप्त उपाधि या डिप्लोमा।
अनुभवः- निम्नलिखित में समूह 'क' स्तरीय पद
पर कम से कम पन्द्रह वर्ष का अनुभव- (एक) के न्द्र या राज्य सरकार; या (दो) सार्वजनिक क्षेत्र के उपक्रम या दिव्यांगता से संबंधित मामलों या सामाजिक क्षेत्र का व्यवहृत करने वाले अ सरकारी या स्वायत्तशासी निकाय; या (तीन) दिव्यांगता या सामाजिक विकास के क्षेत्र में कार्य करने वाले रजिस्ट्रीकृ त राज्य या राष्ट्रीय या अन्तर्राष्ट्रीय स्तर से स्वैच्छिक संगठन में वरिष्ठ स्तर के पदाधिकारी की हैसियत से कार्य;
परन्तु इस उपखण्ड में उल्लिखित कु ल पन्द्रह वर्ष के अनुभव में से दिव्यांगजन के के क्षेत्र में निकटपूर्व में कम से कम तीन वर्ष का अनुभव। उत्तर प्रदेश असाधारण गजट, 1 नवम्बर, 2021 3 आज्ञा से,

IN pursuance of the provisions of clause (3) of Article 348 of the Constitution of India, the Governor is pleased to order the publication of the following English translation of notification no. 451/LXV-3–2021-1-2017, dated November 01, 2021 :

THE following draft rules, which the Governor proposes to make, in excercise of the powers under section 101 of the Rights of Persons with Disabilities Act, 2016 (Act no. 49 of 2016) is hereby published with a view to inviting objections and suggestions as required under sub-section (1) of the said section.
Objections and suggestions, if any, shall be sent in writing addressed to the Additional Chief Secretary, Uttar Pradesh Shasan, Divyangjan Sashaktikaran Vibhag, Room No. 301, 3rd floor, Bapu Bhawan, Lucknow.
Only such objections and suggestions shall be taken into consideration as are received within fifteen days from the date of publication of this notification in the Gazette.
Draft Rules
THE UTTAR PRADESH RIGHTS OF PERSONS WITH DISABILITIES (FIRST AMENDMENT) RULES, 2021
1. (1) These rules may be called the Uttar Pradesh Rights of Persons with Short title and commencement
Disabilities (First Amendment) Rules, 2021.
(2) They shall come into force on the date of their final publication in the Gazette.
Amendment of rule 21
2. In the Uttar Pradesh Rights of Persons with Disabilities Rules, 2017 in rule 21, in sub-rule (1) set out in Column-I below, the sub-rule as set out in Column- II shall be subsituted, namely:-

21. (1) No Person shall be eligible for appointment as Commissioner, Unless-
21. (1) A person shall not be qualified to be appointed as a State Commissioner for Persons with Disability under sub-section (1) of section 79 of the Act (here in after in this Chapter referred to as the State Commissioner) unless,-
(a) he is a Graduate from a
recognized University:
(a) he has special knowledge or practical experience in respect of the matters relating to rehabilitation of persons with disabilities;
Provided that preference shall be given to person having recognized degree or diploma in social work or law or management or human rights or rehabilitation or education of persons with disabilities;
(b) he has not attained the age of fifty six years on the 1st January of the year in which the last date for receipt of applications, as specified in the advertisement inviting applications for
(b) he is having at least fifteen years experience in a Group "A" level post in the Central Government or a State Government or a public sector undertaking or a semi Government or an autonomous body dealing with 4 उत्तर प्रदेश असाधारण गजट, 1 नवम्बर, 2021 appointment of the State Commissioner, occurs;
disability related matters or social sector or as senior level functionary in registered national and international voluntary organization in the field of disability or social development:
Provided that out of the total of fifteen years of experience, he should have at least three years of experience in the field of rehabilitation or empowerment of persons with disabilities; and
(c) He is less than fifty-six years of age as on Ist January of the year of recruitment.
(c) he possesses the following educational qualifications and experience, namely:-
(A) Educational qualifications:
(i) essential: Graduate from a
recognized University;
(ii) desirable: recognized degree or diploma in Social Work or Law or Management or Human Rights or
Rehabilitation or Education of
disabled persons.
COLUMN-I COLUMN-II
Existing Sub-rule Sub-rule as hereby substituted
(B) Experience:
atleast fifteen years experience
in a Group 'A' level post:-
(i) in Central or State
Government; or
(ii) Public Sector Undertakings or Semi Government or Autonomous Bodies dealing with disability related matters or social sector, or
(iii) works in the capacity of a senior level functionary in a registered state or national or international level voluntary organization working in the field of disability or social development:
Provided that out of the total fifteen years experience mentioned in this sub-clause, at least three years of experience in the recent past had been in the field of empowerment of persons with disabilities.
