अधिसूचना

चूँकि राज्य सरकार ने नगर भूमि (अधिकतम सीमा और विनियमन), अधिनियम, 1976, (अधिनियम संख्या 33 सन्‌ 1976) और नगर भूमि (अधिकतम सीमा विनियमन) निरसन अध्यादेश, 1999 (अध्यादेश संख्या 5 सन्‌ 1999) को संविधान के अनुच्छेद 252 के अधीन अंगीकार कर लिया है।

और, चूँकि, उपर्युक्त अध्यादेश की धारा 4 में व्यवस्था है कि अधिनियम के अधीन किये गये किसी आदेश या दिये जाने के लिए आशयित किसी आदेश से सम्बन्धित सभी कार्यवाहियाँ, जो उपरोक्त अध्यादेश के प्रारम्भ के ठीक पूर्व किसी न्यायालय, न्यायाधिकरण या किसी प्राधिकारी के समक्ष लम्बित थी, उपशमित हो जायेंगी, किन्तु उक्त धारा 4 के परन्तुक अनुसार उपर्युक्त अधिनियम की धारा 11, 12, 13 व 14 से सम्बन्धित कार्यवाहियाँ जहाँ तक ऐसी कार्यवाहियाँ ऐसे भूमि के सम्बन्ध में हैं, जिसका राज्य सरकार या राज्य सरकार द्वारा इस निमित्त सम्यक्‌ रूप से प्राधि—त किसी व्यक्ति द्वारा या सक्षम प्राधिकारी द्वारा कब्जा लिया जा चुका है, उपशमित नहीं होगी ;

और, चूँकि, यह आवश्यक है कि उपर्युक्त अधिनियम की धारा 11 से सम्बन्धित कार्यवाहियों की निरन्तरता के प्रयोजन के लिए किसी अधिकारी को सक्षम प्राधिकारी के रूप में प्राधि—त किया जाय;

पठित उपर्युक्त अध्यादेश की धारा 4 के परन्तुक के उपबन्धों के अनुसरण में राज्यपाल महोदय उपर्युक्त अधिनियम सन्‌ 1976 की धारा 2 के खण्ड (घ) के अधीन जारी अधिसूचना संख्या 559/आठ-6-19-111 (10)-एस-83, दिनांक 5 अप्रैल, 2019 का अतिक्रमण करते हुए श्री राकेश कुमार पटेल, अपर जिलाधिकारी, (नगर), अलीगढ़ को सन्‌ 1976 की उपर्युक्त अधिनियम की धारा 11 के प्रयोजन के लिए अलीगढ़ नगर बस्ती के सक्षम प्राधिकारी के —

त्यों का निष्पादन करने के लिए दिनांक 4 अक्टूबर, 2021 से प्राधि—त करती हैं।

IN pursuance of the provisions of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of notification no. 1893/Aath-6–21-111(10)-S-83, dated November 8, 2021.

No. 1893/Aath-6–21-111(10)-S-83

Dated Lucknow, November 8, 2021

WHEREAS the State Government has adopted the Urban Land (Ceiling and Regulation) Act, 1976 (Act no. 33 of 1976) and the Urban Land (Ceiling and Regulation) Repeal Ordinance, 1999 (Ordinance no. 5 of 1999) under article 252 of the Constitution ;

AND, WHEREAS, section 4 of the aforesaid Ordinance provides that all proceedings relating to any order made or purported of to be made under the aforesaid Ordinance before any Court, Tribunal or any authority shall abate but according to the proviso to the said section 4 the proceedings relating to sections 11, 12, 13 and 14 of the aforesaid Act in so for as such proceedings are relatable to the land possession of which has been taken over by the State Government or any person duly authorised by the State Government in this behalf or by the Competent Authority, shall not abate ;

AND, WHEREAS, it is necessary to authorise an officer to be the competent Authority for the purposes of continuing the proceedings relating to section 11 for the aforesaid Act ;

NOW, THEREFORE, in pursuance of the provisions of the proviso to section 4 of the aforesaid Ordinance read with section 6 of the General Clauses Act, 1897 (Act no. 10 of 1897) and in supersession of notification no. 559/Aath-6-19-111(10)-S-83, dated April 5, 2019 the Governor is pleased to authorise under clause (d) of section 2 of the aforesaid Act of 1976 Sri Rakesh Kumar Patel, ADM (City), Aligarh to perform the functions of the competent authority for the purposes of section 11 of the afroresaid Act of 1976 of entire Urban Agglomeration Aligarh with effect from the dated October 4, 2021.
