संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करके और इस विषय पर समस्त विद्‌यमान नियमों और आदेशों का अधिक्रमण करके, राज्यपाल, उत्तर प्रदेश, आयुष (यूनानी) नर्सिंग सेवा में भर्ती और उसमें नियुक्त व्यक्तियों की सेवा शर्तो को विनियमित करने के लिये निम्नलिखित नियमावली बनाती हैं :-

उत्तर प्रदेश आयुष विभाग (यूनानी) नर्सिंग सेवा नियमावली, 2021 भाग-एक सामान्य

संक्षिप्त नाम और प्रारम्भ

1-(1) यह नियमावली उत्तर प्रदेश आयुष विभाग (यूनानी) नर्सिंग सेवा नियमावली, 2021 कही जायेगी।

(2) यह तुरन्त प्रवृत्त होगी।

सेवा की प्रास्थिति 2-उत्तर प्रदेश आयुष (यूनानी) विभाग नर्सिंग सेवा एक ऐसी सेवा है, जिसमें

''समूह-ख'' के पद समाविष्ट हैं।

3-जब तक विषय या सन्दर्भ में कोई प्रतिकूल बात न हो, इस नियमावली मेंः- परिभाषाएं

(क) "अधिनियम" का तात्पर्य उत्तर प्रदेश लोक सेवा (अनुसूचित जातियों, अनुसूचित

जनजातियों और अन्य पिछडे़ वर्गों के लिए आरक्षण) अधिनियम, 1994 से है;

(ख) ''नियुक्ति प्राधिकारी'' का तात्पर्य निदेशक यूनानी सेवायें, उत्तर प्रदेश से है;

(ग) ''भारत का नागरिक'' का तात्पर्य ऐसे व्यक्ति से है, जो संविधान के भाग-दो के अधीन भारत का नागरिक हो या सम़झा जाय;

(घ) ''आयोग'' का तात्पर्य उत्तर प्रदेश लोक सेवा आयोग से है;

(ड.) ''संविधान''का तात्पर्य भारत का संविधान से है;

(च) ''निदेशक'' का तात्पर्य निदेशक, यूनानी सेवायें, उत्तर प्रदेश, से है;

(छ) ''राज्यपाल'' का तात्पर्य उत्तर प्रदेश के राज्यपाल से है;

(ज) ''सेवा का सदस्य'' का तात्पर्य सेवा के संवर्ग में किसी पद पर इस नियमावली या इस नियमावली के प्रारम्भ होने के पूर्व प्रवृत्त नियमों या आदेशों के अधीन मौलिक रूप से नियुक्त किसी व्यक्ति से है;

(झ) नागरिकाें के अन्य ''पिछडे वर्गों'' का तात्पर्य समय-समय पर यथा संशोधित अधिनियम की अनुसूची-एक में विनिर्दिष्ट नागरिकों के पिछड़े वर्गों से है;

(ञ) ''राज्य सरकार'' का तात्पर्य उत्तर प्रदेश की राज्य सरकार से है;

(ट) ''सेवा'' का तात्पर्य उत्तर प्रदेश आयुष विभाग (यूनानी) नर्सिंग सेवा से है;

(्‌्‌ठ) ''मौलिक नियुक्ति'' का तात्पर्य सेवा के संवर्ग में किसी पद पर ऐसी नियुक्ति से है, जो तदर्थ नियुक्ति न हो, और नियमों के अनुसार चयन के पश्चात्‌ की गयी हो, और यदि कोई नियम न हाें तो राज्य सरकार द्वारा जारी कार्यपालक अनुदेशों द्वारा तत्समय विहित प्रक्रिया के अनुसार की गयी हो;

(ड) ''भर्ती वर्ष'' का तात्पर्य किसी कैलेन्डर वर्ष की पहली जुलाई से प्रारम्भ होने वाली बारह मास की अवधि से है।

भाग-दो-संवर्ग

सेवा का संवर्ग 4-(1) सेवा की सदस्य संख्या और उसमें प्रत्येक श्रेणी के पदों की संख्या उतनी होगी जितनी सरकार द्वारा समय-समय पर अवधारित की जाय।

(2) जब तक कि उपनियम (1)के अधीन उसमें परिवर्तन करने के आदेश न दिये जायें, सेवा की सदस्य संख्या और उसमें प्रत्येक श्रेणी के पदों की संख्या उतनी होगी, जितनी परिशिष्ट-1 में दी गयी है।

परन्तु यह कि-

(एक) नियुक्ति प्राधिकारी किसी रिक्त पद को बिना भरे हुए छोड़ सकता है अथवा राज्यपाल उसे आस्थगित रख सकती हैं, जिससे कोई व्यक्ति प्रतिकर का हकदार न हो; या (दो) राज्यपाल ऐसे अतिरिक्त स्थाई या अस्थाई पदों का सृजन कर सकती हैं, जैसा कि वह उचित समझें।

भाग-तीन-भर्ती

भर्ती का स्रोत 5-सेवा में विभिन्न श्रेणियों के पदों पर भर्ती निम्नलिखित स्रोताें से की जाएगी :- (1) सिस्टर : मौलिक रूप से नियुक्त स्टॉफ नर्साें, जिन्होंने भर्ती वर्ष के प्रथम दिवस को इस रूप में सात वर्षो की सेवा पूरी कर ली हो, में से विभागीय चयन समिति के माध्यम से पदोन्नति द्वारा।

(2) स्टॉफ नर्सः

(क) नब्बे प्रतिशत ऐसे महिला छात्र नर्सों और मिडवाईफों, जो नियम 9 में स्टाफ नर्स हेतु निर्धारित अर्हता पूर्ण करती हों, में से आयोग के माध्यम से सीधी भर्ती द्वारा;

(ख) दस प्रतिशत ऐसे पुरूष अभ्यर्थियों, जो नियम 9 में निर्धारित अर्हता पूर्ण करते

6-अनुसूचित जातियों, अनुसूचित जनजातियों और अन्य पिछड़े वर्गों तथा अन्य श्रेणियों के अभ्यर्थियों के लिए आरक्षण, समय-समय पर यथासंशोधित अधिनियम और उत्तर प्रदेश लोक सेवा (शारीरिक रूप से विकलांग, स्वतंत्रता सेनानियों के आश्रितों और भूतपूर्व सैनिकों के लिए आरक्षण) अधिनियम, 1993 और उत्तर प्रदेश लोक सेवा (आर्थिक रूप से कमजोर वर्गों के लिए आरक्षण) अधिनियम, 2020 के अनुसार और भर्ती के समय प्रवृत्त शासनादेशों के अनुसार किया जाएगा।

भाग-चार-अर्हता

राष्ट्रीयता

7-सेवा में किसी पद पर सीधी भर्ती के लिए यह आवश्यक है कि अभ्यर्थीः- (क) भारत का नागरिक हो; या (ख) तिब्बती शरणार्थी हो जो भारत में स्थायी निवास के अभिप्राय से पहली जनवरी,

1962 के पूर्व भारत में आया हो; या

(ग) भारतीय मूल का ऐसा व्यक्ति हो जिसने भारत में स्थायी निवास के अभिप्राय से पाकिस्तान, वर्मा, श्रीलंका, या किसी पूर्वी अफ्रीका देश केनिया, युगांडा और यूनाइटेड रिपब्लिक ऑफ तन्जानिया (पूर्ववर्ती तांगानिका और जंजीवार) से प्रवर्जन किया होः

परन्तु यह कि श्रेणी (ख) या (ग) के अभ्यर्थी के लिए ऐसा व्यक्ति होना आवश्यक है

जिसके पक्ष में राज्य सरकार द्वारा पात्रता का प्रमाण-पत्र जारी किया गया हो :

परन्तु यह और कि श्रेणी (ख) के अभ्यर्थी से यह भी अपेक्षा की जाएगी कि वह पुलिस उपमहानिरीक्षक, अभिसूचना शाखा, उत्तर प्रदेश से पात्रता का प्रमाण-पत्र प्राप्त कर लेः

परन्तु यह भी कि यदि कोई अभ्यर्थी उपर्युक्त श्रेणी (ग) का हो तो पात्रता का प्रमाण-पत्र एक वर्ष से अधिक अवधि के लिए जारी नही किया जाएगा और ऐसे अभ्यर्थी को एक वर्ष की अवधि के आगे सेवा में इस शर्त पर रहने दिया जाएगा कि वह भारत की नागरिकता प्राप्त कर लें।

टिप्पणीः-ऐसे अभ्यर्थी को जिसके मामले में पात्रता का प्रमाण-पत्र आवश्यक हो किन्तु जिसे न तो जारी किया गया हो और न देने से इन्कार किया गया हो, किसी परीक्षा या साक्षात्कार में सम्मिलित किया जा सकता है और उसे इस शर्त पर अनन्तिम रूप से नियुक्त भी किया जा सकता है कि आवश्यक प्रमाण-पत्र उसके द्वारा प्राप्त कर लिया जाये या उसके पक्ष में जारी कर दिया जाये।

आयु

8-स्टाफ नर्स के पद पर सीधी भर्ती के लिए यह आवश्यक है कि अभ्यर्थी ने उस कैलेण्डर वर्ष, जिसमें आयोग द्वारा सीधी भर्ती के लिए रिक्तियॉ विज्ञापित की जायं, की पहली जुलाई को इक्कीस वर्ष की आयु प्राप्त कर ली हो और चालीस वर्ष से अधिक की आयु प्राप्त न की होः

परन्तु यह कि अनुसूचित जातियों, अनुसूचित जनजातियों, और अन्य पिछड़े वर्गों तथा ऐसी अन्य श्रेणियों, जो सरकार द्वारा समय-समय पर अधिसूचित की जायं, के अभ्यर्थियों के मामले में उच्चतर आयु सीमा उतने वर्ष अधिक होगी जितनी विनिर्दिष्ट की जाय।

शैक्षणिक अर्हता 9-स्टाफ नर्स के पद पर सीधी भर्ती हेतु किसी अभ्यर्थी के लिए निम्नलिखित

अर्हताएं होनी आवश्यक हैं :-

(i) माध्यमिक शिक्षा परिषद्‌ उत्तर प्रदेश से विज्ञान के साथ हाई स्कूल और इण्टरमीडिएट परीक्षा या सरकार द्वारा मान्यता प्राप्त उसके समकक्ष कोई परीक्षा उत्तीर्ण की हो।

(ii) आयुर्वेदिक तथा यूनानी तिब्बी चिकित्सा पद्धति बोर्ड, उत्तर प्रदेश के साथ पंजीयन योग्य चिकित्सा एवं सर्जिकल नर्सिंग (यूनानी) में डिप्लोमा धारित करता हो।

(iii) आयुर्वेदिक तथा यूनानी तिब्बी चिकित्सा पद्धति बोर्ड, उत्तर प्रदेश के साथ

पंजीयन योग्य मिडवाईफरी (यूनानी) में डिप्लोमा धारित करता हो।

(iv) यूनानी नर्स और मिडवाईफरी (धात्री) के रूप में आयुर्वेदिक तथा यूनानी तिब्बी

चिकित्सा पद्धति बोर्ड, उत्तर प्रदेश से पंजीकरण प्रमाणपत्र धारित करता हो। अधिमानी अर्हता 10-अन्य बातों के समान होने पर सीधी भर्ती के मामले में ऐसे अभ्यर्थी को अधिमान दिया जायेगा, जिसने :-

(एक) प्रादेशिक सेना में न्यूनतम दो वर्ष की अवधि तक सेवा की हो, -या- (दो) राष्ट्रीय कैडेट कोर का 'बी'-प्रमाण-पत्र प्राप्त किया हो।

चरित्र 11-सेवा में किसी पद पर सीधी भर्ती के लिए अभ्यर्थी का चरित्र ऐसा होना चाहिए, कि वह सरकारी सेवा में सेवायोजन के लिए सभी प्रकार से उपयुक्त हो सके। नियुक्ति प्राधिकारी इस सम्बन्ध में अपना समाधान कर लेगा।

टिप्पणी :-संघ सरकार या किसी राज्य सरकार द्वारा या संघ सरकार या किसी राज्य सरकार के स्वामित्वाधीन या नियंत्रणाधीन किसी स्थानीय प्राधिकरण या किसी निगम या निकाय द्वारा पदच्युत व्यक्ति सेवा में किसी पद पर नियुक्ति के लिए पात्र नही हाेंगे। नैतिक अधमता के किसी अपराध के लिए दोष सिद्ध व्यक्ति भी पात्र नही होंगे।

वैवाहिक प्रास्थिति

12-सेवा में किसी पद पर नियुक्ति के लिए ऐसा पुरूष अभ्यर्थी पात्र न होगा जिसकी एक से अधिक पत्नियां जीवित हों या ऐसी महिला अभ्यर्थी पात्र न होगी जिसने ऐसे पुरूष सेे विवाह किया हो जिसकी पहले से एक पत्नी जीवित होः

परन्तु यह कि सरकार किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकती है, यदि उसका यह समाधान हो जाये कि ऐसा करने के लिए विशेष कारण विद्यमान हैं।

शारीरिक स्वस्थता 13-किसी अभ्यर्थी को सेवा में किसी पद पर तब तक नियुक्त नहीं किया जायेगा जब तक कि मानसिक और शारीरिक दृष्टि से उसका स्वास्थ्य अच्छा न हो और वह किसी ऐसे शारीरिक दोष से युक्त न हो, जिससे उसे अपने कर्तव्यों का दक्षतापूर्वक पालन करने में बाधा पड़ने की सम्भावना हो। किसी अभ्यर्थी को नियुक्ति के लिए अन्तिम रूप से अनुमोदित किये जाने के पूर्व उससे यह अपेक्षा की जायेगी कि वह वित्तीय हस्तपुस्तिका, खण्ड-2, भाग-3 के अध्याय तीन में दिये गये फन्डामेन्टल रूल, 10 के अधीन बनाये गये नियमों के अनुसार स्वस्थता प्रमाण-पत्र प्रस्तुत करेः

परन्तु यह कि पदोन्नति द्वारा भर्ती किये गये अभ्यर्थी से स्वास्थता प्रमाण-पत्र की अपेक्षा नहीं की जायेगी।

भाग-पाँच-भर्ती की प्रक्रिया

रिक्तियों का अवधारण

14-नियुक्ति प्राधिकारी भर्ती वर्ष के दौरान भरी जाने वाली रिक्तियों की संख्या के साथ-साथ नियम-6 के अधीन अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों और अन्य श्रेणियों के अभ्यर्थियों के लिए आरक्षित की जाने वाली रिक्तियों की संख्या अवधारित करेगा, और उसे आयोग को सूचित करेगा।

सीधी भर्ती की प्रक्रिया

15-(1) प्रतियोगी परीक्षा में सम्मिलित होने की अनुज्ञा हेतु आवेदन, आयोग द्वारा जारी विज्ञापन में प्रकाशित प्रपत्र में उत्तर प्रदेश लोक सेवा आयोग द्वारा आमंत्रित किये जायेंगे।

(2) किसी अभ्यर्थी को परीक्षा में तब तक प्रवेश नहीं दिया जायेगा, जब कि उसके पास आयोग द्वारा जारी किया गया प्रवेश-पत्र न हो।

(3) लिखित परीक्षा का परिणाम प्राप्त किये जाने और उसे सारणीबद्ध किये जाने के पश्चात्‌ आयोग, नियम 6 के अधीन अनुसूचित जातियों, अनुसूचित जनजातियों और अन्य श्रेणियाें के अभ्यर्थियों का सम्यक्‌ प्रतिनिधित्व सुनिश्चित करने की आवश्यकता को ध्यान में रखते हुए अभ्यर्थियों की एक सूची तैयार करेगा जो इस संबंध में आयोग द्वारा निर्धारित मानक तक पहुंच सके हों।

(4) आयोग अभ्यर्थियों की, उनकी प्रवीणता क्रम में जैसा कि लिखित परीक्षा में प्रत्येक अभ्यर्थी द्वारा प्राप्त किये गये अंकों के कुल योग से प्रकट हो, एक सूची तैयार करेगा और उतनी संख्या में अभ्यर्थियों की संस्तुति करेगा जितना कि वे नियुक्ति के लिए उपयुक्त433 RPH data 4e ayurved fold. 2021 उार प्रदेश असाधारण गजट, 18 नवम्बर, 2021 5 हों, यदि दो या उससे अधिक अभ्यर्थी लिखित परीक्षा में भी बराबर-बराबर अंक प्राप्त करें, तो आयु में ज्येष्ठ अभ्यर्थी का नाम सूची में उच्चतर स्थान पर रखा जायेगा। आयोग नियुक्ति प्राधिकारी को सूची अग्रसारित करेगा।

टिप्पणीः- प्रतियोगी परीक्षा हेतु पाठ्‌य विवरण और नियम ऐसे होंगे जैसा कि

आयोग द्वारा समय-समय पर सरकार की सहमति से विहित किया जाय।

पदोन्नति द्वारा भर्ती की प्रक्रिया 16-सेवा में सिस्टर के पद पर पदोन्नति द्वारा भर्ती, समय-समय पर यथा संशोधित उत्तर प्रदेश विभागीय पदोन्नति समिति का गठन (सेवा आयोग के क्षेत्र के बाहर के पदों के लिए) नियमावली, 1992 के उपबन्धों केे अनुसार गठित चयन समिति के माध्यम से समय-समय पर यथासंशोधित उत्तर प्रदेश सरकारी सेवक (पदोन्नति द्वारा भर्ती के लिए मानदण्ड) नियमावली, 1994 में दिये गये मानदण्ड के आधार पर की जायेगी।

टिप्पणीः-(क) चयन समिति में अनुसूचित जातियों, अनुसूचित जन-जातियों

और नागरिकाें के अन्य पिछड़े वर्गों का प्रतिनिधित्व देने लिए अधिकारी का नाम निर्देशन, समय-समय पर यथा संशोधित अधिनियम की धारा 7 के अधीन किये गये आदेशों के अनुसार किया जायेगा।

(ख) नियुक्ति प्राधिकारी, अभ्यर्थियों की पात्रता सूची समय-समय पर यथा संशोधित उत्तर प्रदेश (लोक सेवा आयोग के क्षेत्र के बाहर के पदाें पर) चयनोन्नति पात्रता सूची नियमावली, 1986 के अनुसार तैयार करेगा और उसे उनकी चरित्र पंजियों और उनसे सम्बन्धित ऐसे अन्य अभिलेखों के साथ, जो उचित समझे जायें, चयन समिति के समक्ष रखेगा।

(ग) चयन समिति उपनियम (2) में निर्दिष्ट अभिलेखों के आधार पर अभ्यर्थियों के मामलों पर विचार करेगी और यदि वह आवश्यक समझे तो अभ्यर्थियों का साक्षात्कार भी कर सकती है।

(घ) चयन समिति, चयनित अभ्यर्थियों की ज्येष्ठताक्रम में जैसी उस संवर्ग में हो, जिससे उनकी पदोन्नति की जानी है, एक सूची तैयार करेगी और उसे नियुक्ति प्राधिकारी को अग्रसारित करेगी।

भाग-छः नियुक्ति, परिवीक्षा, स्थायीकरण और ज्येष्ठता

नियुक्ति

17-(1) नियुक्ति प्राधिकारी अभ्यर्थियों के नाम उसी क्रम में लेकर जिसमें वे यथा

स्थिति, नियम, 15 या 16 के अधीन तैयार की गयी सूची मेें हों, नियुक्ति करेगा।

(2) यदि किसी एक चयन के सम्बन्ध में नियुक्ति के एक से अधिक आदेश जारी किये जायें तो एक संयुक्त आदेश भी जारी किया जायेगा, जिसमें व्यक्तियों के नामों का उल्लेख ज्येष्ठता क्रम में किया जायेगा, जैसा कि यथा स्थिति चयन में अवधारित की जाय या जैसा कि उस संवर्ग में हो जिससेे उन्हें पदोन्नति किया जाय।

ज्येष्ठता

18-सेवा में किसी श्रेणी के पद पर मौलिक रूप से नियुक्त व्यक्तियों की ज्येष्ठता, समय-समय पर यथा संशोधित उत्तर प्रदेश सरकारी सेवक ज्येष्ठता नियमावली,1991 के अनुसार अवधारित की जायेगी।

परिवीक्षा

19-(1) सेवा में किसी पद पर मौलिक रूप से नियुक्त किये जाने पर किसी व्यक्ति को समय-समय पर यथा संशोधित उत्तर प्रदेश सरकारी सेवक परिवीक्षा नियमावली, 2013 के अनुसार परिवीक्षा पर रखा जायेगा;

(2) यदि परिवीक्षा अवधि या बढ़ाई गयी परिवीक्षा अवधि के दौरान किसी भी समय या उसके अन्त में नियुक्ति प्राधिकारी को यह प्रतीत हो कि परिवीक्षाधीन व्यक्ति ने अपने अवसरों का पर्याप्त उपयोग नहीं किया है या अन्यथा सन्तोषजनक सेवा प्रदान करने में विफल हो गया है, तो उसे उसके मौलिक पद, यदि कोई हो, पर प्रत्यावर्तित किया जा सकता है, और यदि उसका किसी पद पर धारणाधिकार न हो तो उसकी सेवायें समाप्त की जा सकती है;

(3) ऐसा परिवीक्षाधीन व्यक्ति, जिसे प्रत्यावर्तित किया जाय या उप नियम (2) के

अधीन जिसकी सेवायें समाप्त की जायं, किसी प्रतिकर का हकदार नहीं होगा।433 RPH data 4e ayurved fold. 2021 6 उार प्रदेश असाधारण गजट, 18 नवम्बर, 2021 स्थायीकरण 20-(1) उपनियम, (2) के उपबन्धों के अध्यधीन किसी परिवीक्षाधीन व्यक्ति को परिवीक्षा अवधि या बढ़ाई गयी परिवीक्षा अवधि के अन्त में उसकी नियुक्ति में स्थायी कर दिया जायेगा, यदि- (क) उसका कार्य व आचरण सन्तोषजनक बताया जाय; (ख) उसकी सत्यनिष्ठा प्रमाणित हो; और (ग) नियुक्ति प्राधिकारी का यह समाधान हो जाय कि वह स्थायीकरण हेतु अन्यथा उपयुक्त है;

(2) जहाँ उत्तर प्रदेश राज्य के सरकारी सेवकों की स्थायीकरण नियमावली, 1991 के उपबन्धों के अनुसार स्थायीकरण आवश्यक न हो, वहाँ उस नियमावली के नियम (5) के उप नियम (3) के अधीन यह घोषणा करते हुए आदेश कि सम्बन्धित व्यक्ति ने परिवीक्षा अवधि सफलता पूर्वक पूर्ण कर ली है, स्थायीकरण का आदेश समझा जायेगा।

भाग-सात-वेतन इत्यादि

वेतनमान 21-(1) सेवा में विभिन्न श्रेणियोें के पदों पर नियुक्त व्यक्तियों का अनुमन्य वेतनमान ऐसा होगा, जैसा कि राज्य सरकार द्वारा समय-समय पर अवधारित किया जाय और इस प्रकार पुनरीक्षित हुआ माना जायेगा।

(2) इस नियमावली के प्रारम्भ के समय के वेतनमान नीचे दिये गये हैं :-

22-(1) फण्डामेन्टल रूल्स में किसी प्रतिकूल उपबन्ध के होते हुए भी, परिवीक्षाधीन व्यक्ति को, यदि वह पहले से स्थायी सरकारी सेवा में न हो, समयमान में उसे प्रथम वेतन-वृद्धि तभी दी जायेगी जब उसने एक वर्ष की संतोषजनक सेवा पूरी कर ली हो, विभागीय परीक्षा उत्तीर्ण कर ली हो और जहाँ विहित हो, प्रशिक्षण प्राप्त कर लिया हो, और द्वितीय वेतन-वृद्धि दो वर्ष की सेवा के पश्चात्‌ तभी दी जायेगी जब उसने परिवीक्षा अवधि पूरी कर ली हो और उसे स्थायी भी कर दिया गया होः

परन्तु यह कि यदि संतोषजनक सेवा प्रदान करने में विफल रहने के कारण परिवीक्षा अवधि बढ़ाई जाती है तो ऐसी बढायी गयी अवधि की गणना वेतन-वृद्धि के लिए नहीं की जायेगी जब तक कि नियुक्ति प्राधिकारी अन्यथा निदेश न दे;

(2) ऐसे व्यक्ति का, जो पहले से सरकार के अधीन कोई पद धारण कर रहा हो, परिवीक्षा अवधि में, वेतन सुसंगत फण्डामेन्टल रूल्स द्वारा विनियमित होगाः परन्तु यह कि यदि संतोषजनक सेवा प्रदान करने में विफलता के कारण परिवीक्षा अवधि बढ़ाई जाती है तो ऐसी बढायी गयी अवधि की गणना वेतन वृद्धि के लिए नहीं की जायेगी जब तक कि नियुक्ति प्राधिकारी अन्यथा निदेश न दे;

(3) ऐसे व्यक्ति का, जो पहले से स्थायी सरकारी सेवा में हो, परिवीक्षा अवधि में वेतन राज्य के कार्य कलाप के संबंध में सेवारत सरकारी सेवकों पर सामान्यतया लागू सुसंगत नियमों द्वारा विनियमित होगा।

पक्ष समर्थन 23-किसी पद पर या सेवा में लागू नियमों के अधीन अपेक्षित सिफारिशों से भिन्न किन्हीं सिफारिशों पर, चाहें लिखित हो या मौखिक, विचार नहीं किया जायेगा। किसी अभ्यर्थी की ओर से अपनी अभ्यर्थिता के लिए प्रत्यक्ष या अप्रत्यक्ष रूप से समर्थन प्राप्त करने का कोई प्रयास उसे नियुक्ति के लिए अनर्ह कर देगा।433 RPH data 4e ayurved fold. 2021 उार प्रदेश असाधारण गजट, 18 नवम्बर, 2021 7 अन्य विषयों पर विनियमन

24-ऐसे विषयों के सम्बन्ध में, जो विनिर्दिष्ट रूप से इस नियमावली या विशेष आदेशों के अन्तर्गत न आते हाें, सेवा में नियुक्त व्यक्ति राज्य के कार्य कलापों के सम्बन्ध में सेवारत्‌ सरकारी सेवकों पर सामान्यतया लागू नियमों, विनियमों और आदेशों द्वारा शासित हाेंगे।

सेवा की शर्तो में शिथिलता

25-जहाँ राज्य सरकार का यह समाधान हो जाये कि सेवा में नियुक्त व्यक्तियों की सेवा शर्तों को विनियमित करने वाले किसी नियम के प्रवर्तन से किसी विशिष्ट मामले में अनुचित कठिनाई होती हैं, वहाँ वह उस मामले में लागू नियमों में किसी बात के होते हुए भी, आदेश द्वारा उस नियम की अपेक्षाओं को उस सीमा तक और ऐसी शर्तों के अधीन रहते हुए, जिन्हें वह मामले में न्याय संगत और साम्यपूर्ण रीति से कार्यवाही करने के लिए आवश्यक समझे, अभिमुक्त या शिथिल कर सकती है।

व्यावृत्ति

26-इस नियमावली में किसी बात का कोई प्रभाव, ऐसे आरक्षण व अन्य रियायतों पर नहीं पड़ेगा, जिनका इस सम्बन्ध में सरकार द्वारा समय-समय पर जारी किये गये आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जन-जातियों और अन्य विशेष श्रेणियों के व्यक्तियों के लिए उपबंध किया जाना अपेक्षित हो।

THE UTTAR PRADESH AYUSH DEPARTMENT (UNANI) NURSING SERVICE RULES, 2021

PART-I-GENERAL

Short title

1. (1) These rules may be called the Uttar Pradesh Ayush Department (Unani) Nursing Service Rules, 2021.

and commencement

(2) They shall come into force at once.

2. The Uttar Pradesh Ayush (Unani) Department Nursing Service is a service Status of the service

comprising Group 'B' posts.

Definitions 3. In these rules, unless there is anything repugnant in the subject or context:

(a) "Act" means The Uttar Pradesh Public Services (Reservation for Scheduled Castes, Scheduled Tribes and Other Backward Classes) Act, 1994.

(b) 'Appointing Authority' means the Director, Unani Services U.P.

(c) 'Citizen of India' means a person who is or is deemed to be citizen of India under part II of the Constitution.

(d) „Commission" means the Uttar Pradesh Public Service Commission;

(e) „Constitution" means the Constitution of India;

(f) „Director" means the Director, Unani Services, Uttar Pradesh;

(g) „Governor" means the Governor of Uttar Pradesh;

(h) „member of the service" means a person substantively appointed under these rules or the rules or orders in force prior to the commencement of these rules to a post in the cadre of the service;

(i) other backward classes of citizens means the backward classes of citizens specified in schedule I of the Act as amended from time to time;

(j) „State Government" means the State Government of Uttar Pradesh;

(k) „Service" means Uttar Pradesh Ayush Department (Unani) Nursing service.

(l) „Substantive Appointment" means an appointment, not being an ad hoc appointment, on a post in the cadre of the service, made after selection in accordance with the rules and, if there were no rules, in accordance with the procedure prescribed for the time being by executive instructions issued by the State Government;

(m) „Year of Recruitment" means a period of twelve months commencing on the first day of July of a calendar year.

PART-II-CADRE

4. (1) The strength of the service and of each category of posts therein shall be Cadre of service

such as may be determined by the Governor from time to time.

(2) The strength of the service and of each category of posts therein shall, until orders varying the same are passed under sub-rule (1) shall be as given in the Appendix-1.

Provided that:-

(i) the appointing authority may "leave" "unfilled" or the Governor may hold in abeyance any vacant post, without thereby entitling any person to compensation; or

(ii) the Governor may create such additional permanent or temporary posts as he may consider proper.

PART-III- RECRUITMENT

Source of recruitment 5. Recruitment to the various categories of posts in the service shall be

made from the following sources:-

(1) Sister:-

By promotion through the Departmental Selection Committee from amongst substantively appointed Staff Nurses who have completed seven years service as such on the first day of the year of recruitment.

(2) Staff Nurse:-

(a) Ninety percent by direct recruitment through the Commission from amongst female student Nurses and Midwives who fulfill the qualification laid down in rule 9 for Staff Nurse.

(b) Ten Percent by direct recruitment through the Commission from

amongst Male candidates who fulfill the qualifications laid down in rule 9.

Reservation

6. Reservation for the candidates belonging to the Scheduled Castes, Scheduled Tribes, Other Backward classes and other categories shall be in accordance with the Act and the Uttar Pradesh Public Services (Reservation for Physically Handicapped, Dependents of Freedom Fighters and Ex-Servicemen) Act, 1993, and the Uttar Pradesh Public Services (Reservation for economically Weaker Sections) Act, 2020 as amended from time to time, and the orders of the Government in force at the time of the recruitment.

PART-IV-QUALIFICATION

Nationality

7. A candidate for direct recruitment to a post in the service must be:

(a) a citizen of India; or (b) a Tibetan refugee who came over to India before 1st January, 1962

with the intention of permanently settling in India; or

(c) a person of Indian origin who has migrated from Pakistan, Myanmar (Burma), Sri Lanka or any of East African countries of Kenya, Uganda and United Republic of Tanzania (formerly Tanganiyaka and Zanzibar) with the intention of permanently settling in India:

Provided that a candidate belonging to category (b) or (c) above must be a person in whose favour a certificate of eligibility has been issued by the State Government:

Provided further that a candidate belonging to category (b) will also be required to obtain a certificate of eligibility granted by the Inspector General of Police, Intelligence Branch, Uttar Pradesh:

Provided also that if a candidate belongs to category (c) above, no certificate of eligibility will be issued for a period of more than one year the retention of such a candidate in service beyond a period of one year, shall be subject to his acquiring Indian citizenship.

Note:-A candidate in whose case a certificate of eligibility is necessary but the same has neither been issued nor refused may be admitted to an examination or interview and he may also be provisionally appointed subject to the necessary certificate being obtained by him or issued in his favour.

Age 8. A candidate for direct recruitment to the post of staff Nurse must have attained the age of 21 years and must not have attained the age of more than 40 years on the first day of July of the calendar year in which vacancies for direct recruitment are advertised:

Provided that the upper age limit in the case of candidate belonging to the Scheduled Castes, Schedule Tribes and other backward classes and such other categories as may be notified by the State Government from time to time shall be greater by such number of years as may be specified.

9. A candidate for direct recruitment to the post of Staff Nurse must:-

Academic qualification

(i) have passed High School examination with Science and passed Intermediate examination of the Board of High School and Intermediate Education, Uttar Pradesh or an examination recognized by the Government as equivalent thereto.

(ii) Possess diploma in Medical and Surgical Nursing (Unani) registrable with the Ayurvedic and Unani Tibbi Medicine Board of Uttar Pradesh.

(iii) Possess Diploma in Midwifery (Unani) registrable with the Ayurvedic and Unani Tibbi Medicine Board of Uttar Pradesh.

(iv) Possess registration certificate as Unani Nurse and Midwife (Dhatri) from the Ayurvedic and Unani Tibbi Medicine Board of Uttar Pradesh.

10. A candidate who has:

Preferential Qualification

(i) Served in the Territorial Army for a minimum period of two years.

Or

(ii) Obtained a "B" certificate of National Cadet Corps, shall, other things being equal, be given preference in the matter of direct recruitment.

Character 11. The Character of a candidate for direct recruitment to a post in the service must be such as to render him suitable in all respects for employment in State Government service. The appointing authority shall satisfy itself on this point.

NOTE- Persons dismissed by the Union Government or a State Government or by a Local Authority or a Corporation or Body owned or controlled by the Union Government or State Government shall be ineligible for appointment to any post in the service. Persons convicted of an offence involving moral turpitude shall also be ineligible.

Marital status 12. A male candidate who has more than one wife, living or a female candidate who has married a man already having a living wife shall not be eligible for the appointment to a post in the service:

Provided that the Government may, if satisfied that there exists special grounds for doing so, exempt any person from the operation of this rule.

Physical fitness 13. No candidate shall be appointed to a post in the service unless he/she be in good mental and bodily health and free from any physical defect likely to interfere with the efficient performance of his duties, before a candidate is finally approved for appointment, he/she shall be required to produce a Medical Certificate of fittness, in accordance with the rules framed under Fundamental rule 10, contained in chapter III of the Financial Hand-Book, Volume II, Part III:

Provided that a medical certificate of fitness shall not be required from a candidate recruited by promotion.

PART-V- PROCEDURE FOR RECRUITMENT

Determination of vacancies

14. The appointing authority shall determine and intimate to the Commission number of vacancies to be filled during the course of the year of recruitment as also the number of vacancies to be reserved for candidate belonging to Scheduled Castes, Scheduled Tribes, Other Backward Classes and other categories under rule 6.

Procedure for direct recruitment

15. (1) Applications for permission to appear in the Competitive Examination shall be invited by the Commission in the form published in the advertisement issued by the Uttar Pradesh Public Service Commission.

(2) No Candidate shall be admitted to the Examination unless he holds a certificate of admission issued by the Commission.

(3) After the result of the written examination have been received and tabulated the Commission shall, having regard to the need for securing due representation of the candidates belonging to the scheduled castes, scheduled tribes and other categories under rule 6, prepare list of candidates who have come upto standard fixed by the commission in this respect.

(4) The Commission shall, prepare a list of candidates who have come upto standard fixed by the Commission in this respect, in order of their proficiency as disclosed by the marks obtained by each candidate at the written examination and recommend such number of candidates as they consider fit for appointment. If two or more candidates obtain equal marks, the name of candidate senior in age shall be placed higher in the list. The Commission shall forward the list to the appointing authority.

Note- The syllabus and rules for competitive examination shall be such as may be prescribed by the Commission with the concurrence of the Government from time to time.

16. (1) Recruitment by promotion to the post of Sister in the service shall

be made on the basis of the criteria laid down in the Uttar Pradesh Government

Procedure for recruitment by promotion

Servants criteria for the Recruitment by Promotion Rules 1994, as amended from

time to time, through the Selection Committee constituted in accordance with the

provisions of the Uttar Pradesh Constitution of Departmental Promotion

Committee for posts out side the purview of the Service Commission rules, 1992,

as amended from time to time.

NOTE-(a) Nomination of Officers for giving representation to the

Scheduled Castes/Scheduled Tribes and Other Backward Classes of Citizens in the

Selection committee shall be made in accordance with the order made under

section 7 of the Act as amended from time to time.

(b) The appointing authority shall prepare eligibility list of the Candidates

in accordance with the Uttar Pradesh Promotion by Selection (On posts out side the

purview of the Public Service Commission) Eligibility List Rules, 1986, as

amended from time to time, and place the same before the Selection Committee

along with their character rolls and such other records, pertaining to them, as may

be considered proper.

(c) The Selection Committee shall consider the cases of candidates on the

basis of records, referred to in sub-rule (2), and, if it, consider necessary, it may

interview the candidates also.

(d) The Selection Committee shall prepare a list of selected candidates in

order of seniority as it stood in the cadre from which are to be promoted and

forward the same to the appointing authority.

PART-VI-APPOINTMENT, PROBATION,

CONFIRMATION AND SENIORITY

Appointment

17. (1) The appointing authority shall make appointment by taking the names of candidate in the order in which they stand in the lists prepared under rules 15 or 16, as the case may be.

(2) If more than one orders of appointment are issued in respect of any one selection, a combined order shall also be issued, mentioning the names of the persons in order seniority as determined in the selection or, as the case may be, as it stood in the cadre from which they are promoted.

Seniority

18. The seniority of persons substantively appointed in any category of posts in the service shall be determined in accordance with the Uttar Pradesh Government Servants Seniority Rules 1991, as amended from time to time.

Probation

19. (1) A person on substantive appointment to a post in the service shall be placed on probation in accordance with the Uttar Pradesh Government Servants Probation Rules, 2013, as amended from time to time.

(2) If it appears to the appointing authority at any time during or at the end of the period of probation or extended period of probation that a probationer has not made sufficient use of his opportunities or has otherwise failed to give satisfaction, he may be reverted to his substantive post, if any, and if he does not hold a lien on any post, his services may be dispensed with.

(3) A probationer who is reverted or whose services are dispensed with under sub-rule (2) shall not be entitled to any compensation.

Confirmation 20. (1) Subject to the provisions of sub-rule(2), a probationer shall be confirmed in his appointment at the end of the period of probation or the extended period of probation if:

(a) her/his work and conduct is reported to be satisfactory;

(b) her/his integrity is certified; and

(c) The appointing authority is satisfied that she/he is otherwise fit for confirmation.

(2) Where, in accordance with the provisions of the Uttar Pradesh State Government Servants Confirmation Rules, 1991, confirmation is not necessary, the order under sub- rule (3) of rule (5) of those rules declaring that the person concerned has successfully completed the probation, shall be deemed to be fit for the order of confirmation.

PART-VII- PAY ETC.

Scale of Pay

21. (1) The scales of pay admissible to persons appointed to the various categories of posts the services shall be such as may be determined by the State Government from time to time and shall stand revised as such.

(2) The scales of pay at the time of the commencement of these rules are given as follows:-

PART – VIII- OTHER PROVISIONS

Pay during Probation

22. (1) Notwithstanding any provision in the fundamental Rules, to the contrary, a person on probation, if she/he is not already in permanent service, shall be allowed her/his first increment in the time scale when she/he has completed one year of satisfactory service and has undergone training, if prescribe, and second increment after two years services when she/he has completed the probationary period and is also confirmed:

Provided that if the period of probation is extended on account of failure to give satisfaction such extension shall not count for increment unless the appointing authority directs otherwise.

(2) The pay during probation of a person who was already holding a post under the Government, shall be regulated by the relevant fundamental rules:

Provided that, if the period of probation is extended on account of failure to give satisfaction, such extension shall not count for increment unless the appointing authority directs otherwise.

(3) The pay during probation of a person already in permanent Government service shall be regulated by the relevant rules, applicable to Government servants generally serving in connection with the affairs of the State.

Canvassing 23. No recommendations, either written or oral, other than those required under the rules applicable to the post or service will be taken into consideration. Any attempt on the part of a candidate to enlist support directly or indirectly for his candidature will disqualify him for appointment.

Regulations of other matters 24. In regard to the matters not specifically covered by these rules or special orders, persons appointed to the service shall be governed by the rules, regulations and orders applicable generally to Government Servants serving in connection with affairs of the State.

Relaxation from the conditions of service

25. Where the State government is satisfied that the operation of any rule regulating the conditions of service of persons appointed to the service causes undue hardship in any particular case, it may, notwithstanding anything contained in the rules applicable to the case, by order, dispense with or relax the requirement of that rule to such extent and subject to such conditions as it may consider necessary for dealing with the case in a just and equitable manner.

Savings

26. Nothing in these rules shall affect reservations and other concessions as required to be provided for the candidates belonging to the Scheduled Castes, Scheduled Tribes, Other Backward Classes and other special categories of persons in accordance with the orders of the State Government issued from time to time in this regard.
