संविधान के अनुच्छेद 309 के परन्तुक के साथ पठित संविधान के अनुच्छेद 243-ट द्वारा प्रदत्त शक्तियों का प्रयोग करके राज्यपाल, उत्तर प्रदेश राज्य निर्वाचन आयोग (पंचायत राज और स्थानीय निकाय) (नियुक्ति और सेवा की शर्तें) नियमावली, 1994 को संशोधित करने की दृष्टि से निम्नलिखित नियमावली बनाती हैं :-

1-(1) यह नियमावली उत्तर प्रदेश राज्य निर्वाचन आयोग (पंचायत राज और स्थानीय
निकाय) (नियुक्ति और सेवा की शर्तें) (पंचम संशोधन) नियमावली, 2021 कही जाएगी।
संक्षिप्त नाम, प्रारम्भ और लागू होना। (2) यह गजट में प्रकाशित किये जाने के दिनांक से प्रवृत्त होगी।
(3) यह राज्य निर्वाचन आयुक्त का पदधारण करने वाले व्यक्ति पर लागू होगी जिसमें
वर्तमान पदधारक सम्मिलित है। 2 उत्तर प्रदेश असाधारण गजट, 23 नवम्बर, 2021 2- उत्तर प्रदेश राज्य निर्वाचन आयोग (पंचायत राज और स्थानीय निकाय) (नियुक्ति नियम 4 का संशोधन
और सेवा की शर्तें), नियमावली 1994 में नीचे स्तम्भ-1 में दिये गये नियम-4 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात-

स्तम्भ-2 आयुक्त छः वर्ष की अवधि के लिए आयुक्त छः वर्ष की अवधि के लिए
पद धारण करेगाः

परन्तु कोई आयुक्त अड़सठ वर्ष की आयु प्राप्त कर लेने पर अपना पद धारण नही करेगा।
परन्तु यह कि कोई आयुक्त सत्तर वर्ष की आयु प्राप्त कर लेने पर अपना पद धारण नही करेगा।

IN exercise of the powers conferred by Article 243-K of the Constitution read with the proviso to Article 309 of the Constitution the Governor is pleased to make the following rules with a view to amend the Uttar Pradesh State Election Commission (Panchayat Raj and Local Bodies) (Appointment and Condition of Services) Rules, 1994.
THE UTTAR PRADESH STATE ELECTION COMMISSION (PANCHAYAT RAJ AND LOCAL BODIES) (APPOINTMENT AND CONDITIONS OF SERVICES)
(FIFTH AMENDMENT) RULES, 2021
Short titile
1. (1) These rules may be called the The Uttar Pradesh State Election commencement
Commission (Panchayat Raj And Local Bodies) (Appointment And Condition of and applicabilty
Service) (Fifth Amendment) Rules, 2021.
(2) They shall come into force from the date of their publication in the Gazette.
(3) It shall apply to the person holding the office of the State Election Commissioner including the present incumbent.
Amendment of
2. In the Uttar Pradesh State Election Commission (Panchayat Raj And Local rule 4
Bodies) (Appointment And Condition of Service) Rules, 1994, for rule 4, set out in column 1 below the rule as set out in column 2 shall be substituted namely:-
