अधिसूचना
- साधारण खण्ड अधिनियम, 1897 (अधिनियम संख्या 10 सन् 1897) की धारा 21 के साथ पठित उत्तर प्रदेश में उसकी प्रवृत्ति के सम्बन्ध में यथा संशोधित भारतीय स्टाम्प अधिनियम, 1899 (अधिनियम संख्या 2 सन् 1899) की धारा 9 की उपधारा (1) के खण्ड (क) के अधीन शक्तियों का प्रयोग करके, राज्यपाल, इस अधिसूचना के गजट में प्रकाशित किये जाने के दिनांक से ''उत्तर प्रदेश डाटा सेन्टर नीति, 2021'' के पैरा 7.1 में यथा उपबंधित, निम्न अनुसूची के स्तम्भ-2 में यथा उल्लिखित प्रयोजनों के लिए उक्त अनुसूची के स्तम्भ-4 में यथादर्शित लिखतों के सम्बन्ध में, प्रभार्य स्टाम्प शुल्क में, नीचे अनुसूची के स्तम्भ-3 में दर्शित सीमा तक छूट प्रदान करती हैं।

| ''उत्तर प्रदेश डाटा सेन्टर नीति, 2021'' के पैरा 7.1 | (एक) प्राधिकरण/भूस्वामी से डाटा सेन्टर पार्क के पक्ष में भूमि का क्रय/पट्टा। (दो) डाटा सेन्टर पार्क से डाटा सेन्टर इकाई के पक्ष में भूमि का क्रय/पट्टा। | (एक) 100 प्रतिशत ( दो) 50 प्रतिशत | अनुच्छेद-23 के खण्ड (क) के अधीन हस्तान्तरण एवं अनुच्छेद 35 के अधीन पट्टा। |
2-यह छूट, निम्नलिखित शर्तों के अध्यधीन होगी-
(क) जिला का जिला मजिस्टे्रट अथवा उपायुक्त उद्योग, ऐसे लिखत पर इस तथ्य की पुष्टि करने के प्रयोजन हेतु साक्षी के रूप में हस्ताक्षर करेगा कि हस्तान्तरण/पट्टा विलेख, ऊपर उल्लिखित प्रयोजनों हेतु निष्पादन किया जा रहा है, तथा
(ख) ऐसे हस्तान्तरण विलेख/पट्टा विलेख के निबंधन के समय, महानिरीक्षक निबंधन, उत्तर प्रदेश के पक्ष में, स्टाम्प शुल्क की छूट के समतुल्य धनराशि की अप्रतिसंहरणीय बैंक प्रत्याभूति, निबंधनकर्ता अधिकारी के समक्ष प्रस्तुत की जायेगी। इस सम्बन्ध में सूचना प्रौद्योगिकी एवं इलेक्ट्रानिक्स विभाग का यह दायित्व होगा कि वह ऐसी छूट प्राप्त करने वाली इकाई द्वारा विहित अवधि के भीतर प्रयोजन की पूर्ति न करने अथवा वाणिज्यिक उत्पादन प्रारम्भ न करने की प्रास्थिति की सूचना तत्काल स्टाम्प एवं रजिस्टे्रशन विभाग को देगा। ऐसी दशा में, स्टाम्प एवं रजिस्टे्रशन विभाग बैंक प्रत्याभूति को भुना कर विभाग के समुचित लेखाशीर्षक में धनराशि जमा करेगाः
परन्तु यह कि सूचना प्रौद्योगिकी एवं इलेक्ट्रानिक्स विभाग द्वारा इस तथ्य की पुष्टि किये जाने पर कि सम्बन्धित डाटा सेन्टर पार्क /डाटा सेन्टर इकाई द्वारा नीति के अधीन शर्तों का समुचित रूप से अनुपालन कर दिया गया है, उपरोक्त बैंक प्रत्याभूति को स्टाम्प एवं रजिस्टे्रशन विभाग द्वारा अवमुक्त कर दिया जायेगा।

IN pursuance of the provisions of clause (3) of Article 348 of the Constitution of India, the Governor is pleased to order the publication of the following English translation of Government notification no. 11 /2021/1152/XCIV-S. R.-2–2021-700(33)-2021, dated November 29, 2021:

IN exercise of the powers under clause (a) of sub-section (1) of section 9 of the Indian Stamp Act, 1899 (Act no. 2 of 1899), as amended in its application to Uttar Pradesh, read with section 21 of the General Clauses Act, 1897 (Act no. 10 of 1897), the Governor is pleased to remit with effect from the date of publication of this notification in the Gazette, the Stamp duty to the extent shown in Column-3 of the Schedule below, chargeable in respect of the instrument as shown in Column-4 of the said Schedule for the purpose as mentioned in Column-2 of the said Schedule as provided in paragraph 7.1 of the "Uttar Pradesh Data Center Policy, 2021".

2. This remittance shall be subject to the following conditions:-
a. District Magistrate or Deputy Commissioner Industries of the District shall sign such instrument as witness for the purpose of confirming the fact that the conveyance/lease deed is being executed for the purposes above- mentioned, and
b. Irrevocable Bank Guarantee of the amount equal to the remission of stamp duty in favour of Inspector General of Registration, Uttar Pradesh shall be presented before the registering Officer at the time of Registration of such conveyance deed/lease deed. In this regard, it shall be the liability of the I.T. and Electronics Department that it shall inform the status of non-fulfillment of the purpose or non-commencement of commercial production within the prescribed, period, by the Data Center Park/ Data center unit receiving such remission, to the Stamp and Registration Department, immediately. In such a condition, the Stamp and Registration Department shall deposit the amount in the proper account head of the department, by encasing the bank guarantee:
Provided that upon confirmation of the fact by the I.T. and Electronics Department that the conditions under the policy have been properly complied with by the concerned Data Center Park/ Data center unit, the Bank Guarantee shall be released by the Stamp and Registration Department.
