दिव्यांगजन सशक्तिकरण अनुभाग-3 ----- संख्या 521/65-3-2021-01-2017 लखनऊ, 2 दिसम्बर, 2021 ----- अधिसूचना चूंकि साधारण खण्ड अधिनियम, 1897 (अधिनियम संख्या 10 सन् 1897) की धारा 21 के साथ पठित दिव्यांगजन अधिकार अधिनियम, 2016 (अधिनियम संख्या 49 सन् 2016) की धारा 101 के अधीन शक्तियों का प्रयोग करके राज्यपाल द्वारा बनायी जाने हेतु प्रस्तावित उत्तर प्रदेश दिव्यांगजन अधिकार (प्रथम संशोधन) नियमावली, 2021 का प्रारूप उक् त अधिसूचना के गजट में प्रकाशित किये जाने के दिनांक से पन्द्रह दिन की अवधि समाप्त होने के पूर्व सम्भावित रूप में प्रभावित होने वाले समस्त सम्बंधित व्यक्तियों से आपत्तियों और सुझाव आमंत्रित किये जाने की दृष्टि से दिव्यांगजन अधिकार अधिनियम, 2016 (अधिनियम संख्या 49 सन् 2016) की धारा 101 की उपधारा (1) की अपेक्षानुसार सरकारी अधिसूचना संख्या- 451/65-3-2021-01/2017, दिनांक 01 नवम्बर, 2021 द्वारा प्रकाशित किया गया था;
ूकि पन्द्रह दिन की उक् त अवधि के समाप्त होने के पूर्व राज्य सरकार द्वारा प्रभावित और चॅ
व्यक्तियों से प्राप्त आपत्तियों एवं सुझावों पर विचार कर लिया गया है;
अतएव, अब, दिव्यांगजन अधिकार अधिनियम, 2016 (अधिनियम संख्या 49 सन् 2016) की धारा 101 के अधीन शक्तियों का प्रयोग करके राज्यपाल निम्नलिखित नियमावली बनाती हैं, अर्थात्:-
2 उत्तर प्रदेश असाधारण गजट, 2 दिसम्बर, 2021और प्रारम्भ (2) यह गजट में प्रकाशित किये जाने के दिनांक से प्रवृत्त होगी ।
2- उत्तर प्रदेश दिव्यांगजन अधिकार नियमावली, 2017 में, नीचे स्तम्भ-1 नियम 21 का संशोधन
में दिये गये नियम 21 के उपनियम (1) के स्थान पर स्तम्भ-2 में दिया गया उपनियम रख दिया जायेगा, अर्थात्:-
स्तम्भ-एक स्तम्भ-दो
वि मान उपनियम एत रा प्रतिस्थापित उपनियम 21-(1) कोई व्यक्ति राज्य आयुक् त के रूप में नियुक्ति के लिए तब तक पात्र नहीं होगा, जब तक कि-
(क) वह किसी मान्यता प्राप्त
विश्वविद्यालय से स्नातक न हो:
21-(1) कोई व्यक्ति अधिनियम की धारा 79 की उपधारा (1) के अधीन राज्य दिव्यांगजन आयुक् त (जिसे आगे इस अध्याय में राज्य आयुक् त कहा गया है) के रूप में तब तक नियुक् त किये जाने हेतु अर्ह नहीं होगा जब तक- (क) उसके पास विकलांगजन के पुनर्वास से संबंधित मामलों में विशेष ज्ञान या व्यवहारिक अनुभव न हो,
परन्तु यह कि सामाजिक कार्य या विधि या प्रबंधन या मानव अधिकार या पुनर्वास या दिव्यांगजन शिक्षा में मान्यता प्राप्त डिग्री या डिप्लोमा धारण करने वाले व्यक्ति को अधिमान प्रदान किया जायेगा;
(ख) उस वर्ष, जिसमें राज्य आयुक्त की नियुक्ति हेतु आवेदन पत्र आमंत्रित करते हुए विज्ञापन में यथाविनिदिष्ट आवेदन पत्र प्राप्त किये जाने का अन्तिम दिनांक नियत हो, के एक जनवरी को छप्पन वर्ष की आयु प्राप्त न किया हो;
(ग) उसके पास निम्नलिखित शैक्षिक अर्हताएं और अनुभव न हो, अर्थात-
(क) शैक्षिक अर्हताएं:-
(एक) आवश्यक- किसी मान्यता
प्राप्त विश्वविद्यालय से स्नातक।
(ख) वह के न्द्रीय सरकार या राज्य सरकार या सार्वजनिक क्षेत्र के उपक्रम या दिव्यांगता या सामाजिक क्षेत्र से संबंधित मामलों को व्यवहृत करने वाले किसी अद्र्ध सरकारी या स्वायत्तशासी निकाय में समूह ''क'' स्तरीय पद पर अथवा दिव्यांगता या सामाजिक क्षेत्र के अन्तर्गत रजिस्ट्रीकृ त राष्ट्रीय और अन्तर्राष्ट्रीय स्वैच्छिक संगठन में ज्येष्ठ स्तर के कृ त्यकारी के रूप में कम से कम पन्द्रह वर्ष का अनुभव धारित न कर ले:
परन्तु यह कि पन्द्रह वर्ष के कु ल (दो) वांछनीय सामाजिक कार्य या विधि या प्रबन्धन या मानवाधिकार या पुनर्वास या दिव्यांगजन शिक्षा में मान्यता प्राप्त उपाधि या डिप्लोमा।
अनुभव में से उसके पास दिव्यांगजन के पुनर्वास या सशक्तिकरण के क्षेत्र में कम से कम तीन वर्ष का अनुभव होना चाहिए; और
(ग) वह भर्ती वर्ष के 1 जनवरी को छप्पन वर्ष की आयु से कम न हो। (ख) अनुभवः- निम्नलिखित में समूह 'क' स्तरीय पद पर कम से कम पन्द्रह वर्ष का अनुभव-
(एक) के न्द्र या राज्य सरकार या (दो) सार्वजनिक क्षेत्र के उपक्रम या दिव्यांगता से संबंधित मामलों या सामाजिक क्षेत्र का व्यवहृत करने वाले अद्र्धसरकारी या स्वायत्तशासी निकाय या उत्तर प्रदेश असाधारण गजट, 2 दिसम्बर, 2021 3 स्तम्भ-एक स्तम्भ-दो
वि मान उपनियम एत रा प्रतिस्थापित उपनियम (तीन) दिव्यांगता या सामाजिक विकास के क्षेत्र में कार्य करने वाले रजिस्ट्रीकृ त राज्य या राष्ट्रीय या अन्तर्राष्ट्रीय स्तर से स्वैच्छिक संगठन में वरिष्ठ स्तर के पदाधिकारी की हैसियत से कार्य:
परन्तु इस उपखण्ड में उल्लिखित कु ल पन्द्रह वर्ष के अनुभव में से दिव्यांगजन के सशक्तीकरण के क्षेत्र में निकटपूर्व में कम से कम तीन वर्ष का अनुभव।

IN pursuance of the provisions of clause (3) of Article 348 of the Constitution of India, the Governor is pleased to order the publication of the following English translation of notification no. 521/LXV-3–2021-1-2017, dated December 2, 2021 :

WHEREAS the draft of the Uttar Pradesh Rights of Persons with Disabilities (First Amendment) Rules, 2021 was published by Government notification no.451/65-3-2021-01/2017 dated November 01, 2021 with a view to inviting objections and suggestions from all concerned likely to be affected thereby as required under section 101 of the Rights of Persons with Disabilities Act, 2016;
AND WHEREAS Objections and suggestions in pursuance of the aforesaid notification on the said draft have been considered by the State Government.
NOW, THEREFORE, in exercise of the powers conferred under section 101 of the Rights of Persons with Disabilities Act, 2016 (Act no. 49 of 2016), the Governor is pleased to make the following rules:-
THE UTTAR PRADESH RIGHTS OF PERSONS WITH DISABILITIES (FIRST AMENDMENT) RULES, 2021
1. (1) These rules may be called the Uttar Pradesh Rights of Persons with Short title and commencement Disabilities (First Amendment) Rules, 2021.
(2) They shall come into force on the date of their final publication in the
Gazette.
Amendment of rule 21 2. In the Uttar Pradesh Rights of Persons with Disabilities Rules, 2017 in rule 21, in sub-rule (1) set out in Column-I below, the clause as set out in Column-II shall be substituted, namely:-

21. (1) No Person shall be eligible for appointment as State Commissioner, Unless-
21. (1) A person shall not be qualified to be appointed as a State Commissioner for Persons with Disability under sub-section (1) of section 79 of the Act (here in after in this Chapter referred to as the State Commissioner) unless,- 4 उत्तर प्रदेश असाधारण गजट, 2 दिसम्बर, 2021 COLUMN-I COLUMN-II Existing Sub-rule Sub-rule as hereby substituted (a) he is a Graduate from a
recognized University:
(a) he has special knowledge or practical experience in respect of the matters relating to rehabilitation of persons with disabilities;
Provided that preference shall be given to person having recognized degree or diploma in social work or law or management or human rights or rehabilitation or education of persons with disabilities:
(b) he has not attained the age of fifty six years on the 1st January of the year in which the last date for receipt of applications, as specified in the advertisement inviting applications for appointment of the State Commissioner, occurs;
(c) he possesses the following educational qualifications and experience, namely:-
(A) Educational qualifications: (i) essential: Graduate from a
recognized university;
(b) he is having at least fifteen years experience in a Group "A" level post in the Central Government or a State Government or a public sector undertaking or a semi Government or an autonomous body dealing with disability related matters or social sector or as senior level functionary in registered national and international voluntary organization in the field of disability or social development:
(ii) desirable: recognized degree or diploma in Social Work or Law or Management or Human Rights or Rehabilitation or Education of disabled persons.
Provided that out of the total of fifteen years of experience, he should have at least three years of experience in the field of rehabilitation or empowerment of persons with disabilities; and
(c) he is less than fifty-six years of age as on 1st January of the year of recruitment.
(B) Experience:
atleast fifteen years experience in a
Group 'A' level post:-
(i) in Central or State Government; or
(ii) Public Sector Undertakings or Semi Government or Autonomous Bodies dealing with disability related matters or social sector, or
(iii) works in the capacity of a senior level functionary in a registered state or national or international level voluntary organization working in the field of disability or social development:
Provided that out of the total fifteen years experience mentioned in this sub-clause, at least three years of experience in the recent past had been in the field of empowerment of persons with disabilities.
