सहकारिता अनुभाग-1 ————— संख्या 1427/49-1–2021-8(56)-13 टी0सी-बी लखनऊ, 3 दिसम्बर, 2021 ------- अधिसूचना उत्तर प्रदेश साधारण खण्ड अधिनियम, 1904 (उत्तर प्रदेश अधिनियम संख्या 1 सन् 1904) की धारा 21 के साथ पठित उत्तर प्रदेश सहकारी समिति अधिनियम, 1965 (उत्तर प्रदेश अधिनियम संख्या 11 सन् 1966) की धारा 130 के अधीन शक्तियों का प्रयोग करके, राज्यपाल उत्तर प्रदेश सहकारी समिति नियमावली, 1968 को संशोधित करने की दृष्टि से निम्नलिखित नियमावली बनाती हैं।
उत्तर प्रदेश सहकारी समिति (अठावनवाँ संशोधन) नियमावली, 2021
1-(1) यह नियमावली उत्तर प्रदेश सहकारी समिति (अठावनवाँॅ संशोधन) नियमावली, संक्षिप्त नाम एवं प्रारम्भ 2021 कही जायेगी।
(2) यह गजट में प्रकाशित किये जाने के दिनांक से प्रवृत्त होगी।
नियम 3 का संशोधन 2-उत्तर प्रदेश सहकारी समिति नियमावली, 1968 (जिसे आगे ''उक्त नियमावली'' कहा गया है) में नीचे स्तम्भ 1 में दिये गये नियम 3, के स्थान पर स्तम्भ 2 में दिया गया नियम रख दिया जायेगा, अर्थात् :-
2 उत्तर प्रदेश असाधारण गजट, 3 दिसम्बर, 2021स्तम्भ-1 स्तम्भ-2 3-किसी समिति के निबन्धन के लिये आवेदन उक्त प्रयोजन के लिए निबन्धक द्वारा समय-समय पर निर्दिष्ट प्रपत्र में किया जायेगा। ऐसा प्रपत्र ई-पेमेंट के माध्यम से दो हजार रूपये का संदाय करके ऑनलाइन प्राप्त किया जा सकेगा।
3-किसी समिति के निबन्धन के लिये प्रार्थना पत्र उक्त प्रयोजन के लिये निबन्धक द्वारा समय-समय पर निर्दिश्ट प्रपत्र में दिया जायेगा। ऐसा प्रपत्र क में प्रार्थना पत्र देकर और 50 रू0 का शुल्क देने पर जिला सहायक निबन्धक से प्राप्त किया जायेगा।
3-उक्त नियमावली में, नीचे स्तम्भ 1 में दिये गये नियम 6 एवं 7 के स्थान पर नियम 6 एवं 7 का संशोधन
स्तम्भ-2 में दिये गये नियम रख दिये जायेंगे, अर्थात्ः-
स्तम्भ-1 स्तम्भ-2 6-नियम 3 के अनुसार निबन्धन के लिये सभी प्रकार से पूर्ण आवेदन ऑनलाइन प्रस्तुत किया जायेगा जिसकी रसीदी/पावती ऑनलाइन प्राप्त की जा सकेगी।
6-निबन्धन के लिये सभी प्रकार से पूर्ण प्रार्थना पत्र निबन्धक को या तो प्राप्य अभिस्वीकृति रजिस्टर्ड डाक द्वारा भेजा जायेगा और पष्चातवर्ती दषा में प्रपत्र ख में निबन्धक से अभिस्वीेकृति ली जायेगी।
7-निबन्धक, निबन्धन का प्रार्थना पत्र प्राप्त होने पर प्रार्थना पत्र के ब्यौरे को प्रपत्र ग में रजिस्टर में दर्ज करेगा या दर्ज करायेगा और प्रार्थना पत्र पर क्रम सं0 डाली जायेगी।
7-निबन्धन हेतु ऑनलाइन प्रस्तुत किये गये आवदेन पर क्रमांक और आवेदन प्राप्त किये जाने के दिनांक का उल्लेख आनलाईन किया जायेगा तत्पष्चात निबन्धक प्रपत्र 'ग' में रजिस्टर में आनलाईन प्रस्तुत किये ऐसे आवेदन का विवरण प्रविष्ट करेगा या प्रविष्ट करायेगा।
4-उक्त नियमावली में, स्तम्भ-1 में दिये गये नियम 388 के स्थान पर का स्तम्भ-2 में नियम 388 का संशोधन
दिया गया नियम रख दिया जायेगा, अर्थात्ः-
स्तम्भ-1 स्तम्भ-2 388-(क) किसी सहकारी समिति द्वारा कारोबार के प्रत्येक दिन के कार्य के लिये ऐसी दर पर जो उपनियम-(ख) में विनिर्दिष्ट दरों से अधिक न हो, दैनिक भत्ते की अनुज्ञा दी जा सकती है।
388-(क) किसी सहकारी समिति द्वारा प्रत्येक दिवस के कारबार के लिये दैनिक भत्ता उपनियम-(ख) में विनिर्दिष्ट दर से अनधिक दर पर अनुज्ञात किया जा सकता है।
(ख) उपनियम (क) के प्रयोजन के लिये दैनिक भत्ते की दर निम्नलिखित अधिकतम सीमा के अधीन होगीः
(ख) उपनियम (क) के प्रयोजन के लिये दैनिक भत्ता की दर निम्नलिखित अधिकतम सीमाओं के अध्यधीन होगीः
(1) शीर्ष सहकारी समिति और ऐसी अन्य समिति की दशा में जिसे निबन्धक उसके वित्तीय तथा कारोबार की दशा को ध्यान में रख कर और कारणों को अधिलिखित करते हुये शीर्ष समिति के सममूल्य अधिसूचित करे, एक सौ पचास रूपये प्रतिदिनः
(एक) किसी शीर्ष सहकारी समिति और ऐसी अन्य समितियों की स्थिति में जैसाकि निबन्धक अपनी वित्तीय तथा कारबार की दशाओं को दृष्टिगत रखते हुये और अभिलिखित किये जाने वाले कारणों से किसी शीर्ष समिति के सममूल्य के अनुसार अधिसूचित करें, चार सौ पचास रूपये प्रतिदिनः 3 उत्तर प्रदेश असाधारण गजट, 3 दिसम्बर, 2021 स्तम्भ-1 स्तम्भ-2 प्रतिबन्ध यह है कि किसी शीर्ष समिति की स्थिति मेें कारबार के पूर्ववर्ती और पश्चात्वर्ती दिवस के लिये भी दैनिक भत्ता उक्त दर पर अनुज्ञेय होगाः
प्रतिबन्ध यह है कि किसी शीर्ष समिति की दशा मेें कारोबार के पूर्ववर्ती दिन और पश्चात्वर्ती दिन के लिये भी दैनिक भत्ता उक्त दर पर अनुमन्य होगाः
अग्रतर प्रतिबन्ध यह है कि पूर्ववर्ती या पश्चात्वर्ती कारबार दिवस कारबार दिवस नही होगा।
अग्रेतर प्रतिबन्ध यह है कि कारोबार का पूर्ववर्ती दिन या पश्चात्वर्ती दिन कारोबार का दिन नही होगा।
(दो) केन्द्रीय सहकारी समिति की
(2) केन्द्रीय समिति की दशा में,
स्थिति में, दो सौ पच्चीस रूपये प्रतिदिन;
पचहत्तर रूपया प्रतिदिन;
(तीन) किसी कृषि प्रारम्भिक सहकारी
(3) प्रारम्भिक कृषि सहकारी समिति
समिति की स्थिति में, नब्बे रूपये प्रतिदिन;
की दशा में, तीस रूपया प्रतिदिन;
(चार) किसी अन्य सहकारी समिति
(4) किसी अन्य सहकारी समिति
की दशा में, साठ रूपया प्रतिदिन।
की स्थिति में, एक सौ अस्सी रूपये प्रतिदिन।
(ग) यात्रा भत्ता के प्रयोजनों के लिये किसी श्रेणी की समिति के सम्बंध में कोई संदेह होने की स्थिति में निबंधक की राय अंतिम होगी।
(ग) यदि यात्रा भत्ता के प्रयोजनों के लिये समाप्ति को किसी श्रेणी के बारे में कोई संदेह हो तो निबन्धक की राय अन्तिम होगी।
5-उक्त नियमावली में, नीचे स्तम्भ 1 में दिये गये नियम 438-क के स्थान पर नियम 438-क का संशोधन
स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात्ः-
स्तम्भ-1 स्तम्भ-2 438 क-जहाँ नियम 434, 435 या 438 के अधीन कोई अन्तरिम प्रबंध कमेटी नियुक्त की जाये, वहॉ उस अन्तरिम प्रबंध कमेटी का यह उत्तरदायित्व होगा कि अपनी नियुक्ति के छः माह के भीतर निर्वाचित प्रबंध कमेटी का पुनर्गठन की व्यवस्था करे, और ऐसी निर्वाचित प्रबंध कमेटी, अपने गठन पर तत्काल अन्तरिम प्रबंध कमेटी का स्थान लेगी।
438 क-जहाँ नियम 434, 435 या 438 के अधीन कोई अन्तरिम प्रबंध कमेटी नियुक्त की जाये, वहाँ ऐसी अन्तरिम प्रबंध कमेटी का यह उत्तरदायित्व होगा कि वह अपनी नियुक्ति के छः माह के भीतर किसी निर्वाचित प्रबंध कमेटी के पुनर्गठन की व्यवस्था करे, और ऐसी निर्वाचित प्रबंध कमेटी, अपने गठन पर तत्काल अन्तरिम प्रबंध कमेटी का स्थान लेगी, परन्तु यह कि असाधारण परिस्थितियों के कारण यदि प्रबंध कमेटी के सदस्य निर्वाचित नहीं किये जाते हैं या उनका निर्वाचन आयोजित नहीं किया जाता है तो सहकारी समिति के प्रबंधन के अनुसार निबन्धक का यह कर्तव्य होगा कि वह ऐसी कमेटी में अनधिक छः मास की अवधि तक के लिये एक नई अंतरिम प्रबंध कमेटी नियुक्त करे।

IN exercise of the powers under section 130 of the Uttar Pradesh Co-operative Societies Act, 1965 (U.P. Act no. 11 of 1966) read with section 21 of the Uttar Pradesh General Clauses Act, 1904 (U.P. Act no. 1 of 1904), the Governor is pleased to make the following rules with a view to amend the Uttar Pradesh Co-operative Societies Rules, 1968.

AMENDMENT) RULES, 2021
Short title and
