सहकारिता अनुभाग-1 ————— संख्या 1428/49-01–2021 लखनऊ, 3 दिसम्बर, 2021 ------- अधिसूचना उत्तर प्रदेश साधारण खण्ड अधिनियम, 1904 (उत्तर प्रदेश सहकारी समिति अधिनियम, 1965) (उत्तर प्रदेश अधिनियम सं0 11 सन् 1966) की धारा 130 के अधीन शक्ति का प्रयोग करतेे हैं। राज्यपाल उ0प्र0 सहकारी समिति नियमावली, 1968 को संशोधित करने की दृष्टि से निम्नलिखित अधिनियम बनाती हैं। उ0प्र0 सहकारी समिति (उनसठवां संशोधन) नियमावली, 2021
1-(1)यह नियमावली उ0प्र0 सहकारी समिति ( उनसठवां संशोधन) नियमावली 2021 संक्षिप्त नाम एवं प्रारम्भ कही जायेगी।
(2) यह नियमावली गजट में प्रकाशित होने के दिनांक से प्रवृत्त होगी।
2-उ0प्र0 सहकारी समिति नियमावली-1968 नीचे स्तम्भ-1 में दिये गये नियम के नियम 453 का संशोधन स्थान पर स्तम्भ-2 प्रतिस्थापित नियम दिया जायेगा।
स्तम्भ-1 स्तम्भ-2 453 (1) कोई भी व्यक्ति किसी सहकारी समिति की प्रबन्ध कमेटी का सदस्य होने या बने रहने का पात्र न होगा, यदि-
453 (1) कोई भी व्यक्ति किसी सहकारी समिति की प्रबन्ध कमेटी का सदस्य होने या बने रहने का पात्र न होगा, यदि- 2 उत्तर प्रदेश असाधारण गजट, 3 दिसम्बर, 2021 स्तम्भ-1 स्तम्भ-2 (क) उसकी आयु 21 वर्ष से कम हो; (क) उसकी आयु 21 वर्ष से कम हो;
(ख) वह दिवालिया घोषित हो;

(ग) वह विकृत चित्त या बहरा गूंगा या (ग) वह विकृत चित्त या बहरा गूंगा या अन्धा हो अथवा कोढ़ से पीडित हो;

(ङ) वह, या निबन्धक की राय में, उसके परिवार का कोई सदस्य निबन्धक की अनुज्ञा के बिना, समिति के कार्यक्षेत्र के भीतर, उसी प्रकार का कारोबार करना शुरू करे या करता हो, जैसा समिति करती हो;
(च) वह अधिनियम या नियमों अथवा समिति की उपविधियों के प्रतिकूल समिति के साथ कोई व्यवहार या संविदा करें;
(च) वह अधिनियम या नियमों अथवा समिति की उपविधियों के प्रतिकूल समिति के साथ कोई व्यवहार या संविदा करें;
(छ) वह समिति के अधीन या किसी अन्य समिति जो ऐसी समिति से सम्बद्ध हो, के अधीन या कोई लाभ का पद स्वीकार करें या धारण करता होः

किन्तु प्रतिबन्ध यह है कि, यह प्रतिबन्ध ऐसे उत्पादकों या कर्मकारों की समितियों पर लागू नही होगा जिनको राज्य सरकार ने अनुज्ञा दे दी हो कि वे अपनी उपविधियों में कर्मचारियों द्वारा समिति के प्रबन्ध में भाग लेने की व्यवस्था कर सकते हैं;
किन्तु प्रतिबन्ध यह है कि, यह प्रतिबन्ध ऐसे उत्पादकों या कर्मकारों की समितियों पर लागू नही होगा जिनको राज्य सरकार ने अनुज्ञा दे दी हो कि वे अपनी उपविधियों में कर्मचारियों द्वारा समिति के प्रबन्ध में भाग लेने की व्यवस्था कर सकते हैं;
(ज) वह समिति के सामान्य निकाय (ज) वह समिति के सामान्य निकाय का का सदस्य न होः

प्रतिबन्ध यह है कि, इस खण्ड के उपबन्ध धारा 29 की उपधारा (8) के अन्तर्गत आने वाले वृत्तिक व्यक्तियों के सहयोजन पर लागू न होगें;

(झ) वह अधिनियम या नियमों के अधीन किसी अपराध के लिये दोषी सिद्ध किया गया हो, जबतक की दोष सिद्ध के दिनांक से तीन वर्ष की अवधि व्यतीत न हो गयी हो;

() वह ऐसा व्यक्ति हो जिसके विरूद्ध किसी सहकारी समिति में धारा 91 के अधीन ऐसा आदेश प्राप्त कर लिया हो और उस आदेश की पूर्ति न हुई हो;
() वह ऐसा व्यक्ति हो जिसके विरूद्ध किसी सहकारी समिति में धारा 91 के अधीन ऐसा आदेश प्राप्त कर लिया हो और उस आदेश की पूर्ति न हुई हो;
(ट) वह अपने द्वारा लिये गये ऋणों के सम्बन्ध में समिति का (कम से कम छः मास से) बाकीदार हो, या वह समिति का निर्णीत ऋणी हो;
(ट) वह अपने द्वारा लिये गये ऋणों के सम्बन्ध में समिति का (कम से कम छः मास से) बाकीदार हो, या वह समिति का निर्णीत ऋणी हो;
3 उत्तर प्रदेश असाधारण गजट, 3 दिसम्बर, 2021 स्तम्भ-1 स्तम्भ-2(ठ) वह एक ही समय में तीन सहकारी समितियों अर्थात एक प्राथमिक, एक केन्द्रीय और एक शीर्ष समिति की प्रबन्ध कमेटी का पहले से ही सदस्य हो, फिर भी वह तीन से अधिक सहकारी समितियों की प्रबन्ध कमेटी की सदस्यता के लिये चुनाव लडने के लिये हकदार होगा, ऊपर विनिर्दिष्ट तीन से अधिक समितियों की प्रबन्ध कमेटी में उसके निर्वाचित होने की दशा में उसे एक माह के भीतर ऐसी समिति या समितियों की प्रबन्ध कमेटी से त्याग-पत्र देना पडेगा ताकि वह तीन से अधिक समितियों की प्रबन्ध कमेटी का सदस्य न बना रह सके, यदि वह विनिर्दिष्ट अवधि के भीतर त्याग-पत्र देने में विफल रहता है तो ऐसी अवधि की समाप्ति पर यह समझा जायेगा कि उसने एक शीर्ष समिति और एक केन्द्रीय समिति और एक प्राथमिक समिति, जिस पर वह बाद में निर्वाचित हुआ है, के सिवाय समस्त समिति से त्याग-पत्र दे दिया है;
(ठ) वह एक ही समय में तीन सहकारी समितियों अर्थात एक प्राथमिक, एक केन्द्रीय और एक शीर्ष समिति की प्रबन्ध कमेटी का पहले से ही सदस्य हो, फिर भी वह तीन से अधिक सहकारी समितियों की प्रबन्ध कमेटी की सदस्यता के लिये चुनाव लडने के लिये हकदार होगा, ऊपर विनिर्दिष्ट तीन से अधिक समितियों की प्रबन्ध कमेटी में उसके निर्वाचित होने की दशा में उसे एक माह के भीतर ऐसी समिति या समितियों की प्रबन्ध कमेटी से त्याग-पत्र देना पडेगा ताकि वह तीन से अधिक समितियों की प्रबन्ध कमेटी का सदस्य न बना रह सके, यदि वह विनिर्दिष्ट अवधि के भीतर त्याग-पत्र देने में विफल रहता है तो ऐसी अवधि की समाप्ति पर यह समझा जायेगा कि उसने एक शीर्ष समिति और एक केन्द्रीय समिति और एक प्राथमिक समिति, जिस पर वह बाद में निर्वाचित हुआ है, के सिवाय समस्त समिति से त्याग-पत्र दे दिया है;
(ड) वह राजकीय सेवा या किसी सहकारी समिति की सेवा या निगमित निकाय से कपट, दुराचरण या अशुचिता करने के लिये पदच्युत किया गया हो और पदच्युति का ऐसा आदेश अपील में रद्द न किया गया हो;
(ड) वह राजकीय सेवा या किसी सहकारी समिति की सेवा या निगमित निकाय से कपट, दुराचरण या अशुचिता करने के लिये पदच्युत किया गया हो और पदच्युति का ऐसा आदेश अपील में रद्द न किया गया हो;
(ढ) वह किसी ऐसी सहकारी समिति के निबन्धन के प्रार्थना-पत्र में सम्मिलित हो या उसकी प्रबन्ध कमेटी का सदस्य रहा हो जो निबन्धक द्वारा धारा-72 की उपधारा (2) के खण्ड (क) के अधीन इस आधार पर समाप्त कर दी गयी हो की समिति का निबन्धन कपटपूर्वक कराया गया और निबन्धक का ऐसा आदेश अपील में उत्क्रमित न किया गया हो;
(ढ) वह किसी ऐसी सहकारी समिति के निबन्धन के प्रार्थना-पत्र में सम्मिलित हो या उसकी प्रबन्ध कमेटी का सदस्य रहा हो जो निबन्धक द्वारा धारा 72 की उपधारा (2) के खण्ड (क) के अधीन इस आधार पर समाप्त कर दी गयी हो की समिति का निबन्धन कपटपूर्वक कराया गया और निबन्धक का ऐसा आदेश अपील में उत्क्रमित न किया गया हो;
(ण) वह अधिनियम या नियम या समिति की उपविधियों के किसी उपबन्ध के अधीन अन्यथा अनर्ह हो।

(त) यदि वह किसी ऋण समिति, जो केन्द्रीय सहकारी बैंक अथवा उ0प्र0 कोआपरेटिव बैंक की सदस्य है, का प्रतिनिधि है एवं वह समिति 90 दिनों से अधिक की बकायेदार है।
(त) यदि वह किसी ऋण समिति, जो केन्द्रीय सहकारी बैंक अथवा उ0प्र0 कोआपरेटिव बैंक की सदस्य है, का प्रतिनिधि है एवं वह समिति 90 दिनों से अधिक की बकायेदार है। 4 उत्तर प्रदेश असाधारण गजट, 3 दिसम्बर, 2021 स्तम्भ-1 स्तम्भ-2 (थ) यदि कोई व्यक्ति प्रारम्भिक कृषि ऋण समिति में केवल जमा करने के उद्देश्य से सदस्य बना हो और उसके द्वारा समिति में जमा धनराशि रूपये एक हजार से कम हो गयी हो।
(थ) यदि कोई व्यक्ति प्रारम्भिक कृषि ऋण समिति में केवल जमा करने के उद्देश्य से सदस्य बना हो और उसके द्वारा समिति में जमा धनराशि रूपये एक हजार से कम हो गयी हो।
