अधिसूचना

चूँकि प्रारम्भिक अधिसूचना संख्या 1171/77-3-2021-131एम-2018, दिनांक 27 जुलाई, 2021, लोक प्रयोजन, अर्थात्‌, उत्तर प्रदेश एक्सप्रेसवे औद्योगिक विकास प्राधिकरण के माध्यम से पूर्वांचल एक्सप्रेसवे परियोजना हेतु अपेक्षित तहसील जलालपुर, जिला अम्बेडकरनगर स्थित ग्राम रामगढ़ क्षेत्र में 0.345825 हेक्टेयर भूमि के संबंध में भूमि अर्जन, पुनर्वासन और पुनव्र्यवस्थापन में उचित प्रतिकर और पारदर्शिता का अधिकार अधिनियम, 2013 (अधिनियम संख्या 30 सन्‌ 2013) (जिसे आगे ''उक्त अधिनियम'' कहा गया है) की धारा 11 की उपधारा (1) के अधीन जारी की गयी थी और अंततः दिनांक 5 अगस्त, 2021 को प्रकाशित की गई थी;

और, चूँकि, उक्त 0.56104 हेक्टेयर भूमि में से 0.215215 हेक्टेयर भूमि, पूर्वोक्त परियोजना के प्रयोजनार्थ पहले ही अर्जित की जा चुकी है;

और, चूँकि, उप कलेक्टर/सहायक कलेक्टर जलालपुर, जिला अम्बेडकरनगर को परियोजना से प्रभावित परिवारों के पुनर्वासन और पुनव्र्यवस्थापन के प्रयोजनार्थ प्रशासक नियुक्त किया गया था; अतएव, अब, उक्त अधिनियम की धारा 15 की उपधारा (2) के उपबंधों के अनुसरण में प्रस्तुत की गयी कलेक्टर की रिपोर्ट पर विचार करने के पश्चात्‌, राज्यपाल उक्त अधिनियम की धारा 19 की उपधारा (1) के अधीन घोषणा करती हैं कि उनका यह समाधान हो गया है कि दी गयी अनुसूची ''क'' में उल्लिखित 0.345825 हेक्टेयर भूमि, लोक प्रयोजन के लिए आवश्यक है और अनुसूची ''ख'' में यथा-प्रदत्त ग्राम, परगना और जिला में कोई भूमि विस्थापित परिवारों के पुनर्वासन और पुनव्र्यवस्थापन के लिए चिन्हांकित नहीं की गयी है (इस परियोजना हेतु भूमि अर्जन के कारण कोई परिवार विस्थापित होना सम्भाव्य नहीं है)।449 RPH (Audhik vikas folder) 2021 data--4e उत्तर प्रदेश असाधारण गजट, 6 दिसम्बर, 2021 2 राज्यपाल, अग्रतर उक्त अधिनियम की धारा 19 की उपधारा (2) के अधीन अम्बेडकरनगर के कलेक्टर को इस आशय की घोषणा प्रकाशित करने के साथ पुनर्वासन और पुनव्र्यवस्थापन योजना को संक्षिप्त रूप में प्रकाशित करने के लिए निदेश देती हैं। पुनर्वासन और पुनव्र्यवस्थापन योजना का सारांश इसके साथ संलग्न है।

IN pursuance of the provisions of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of notification no. 2439/LXXVII-3– 2021-131(M) -2018, dated December 6, 2021 :

No. 2439/LXXVII-3–2021-131(M) -2018

Dated Lucknow, December 6, 2021

WHEREAS preliminary notification no. 1171/LXXVII-3–2021-131M-2018, dated July 27,2021 was issued under sub-section (1) of section 11 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Act no. 30 of 2013), in respect of 0.56104 Hectares of land in the village Ramgarh, Tehsil Jalalpur, District Ambedkarnagar, required for public purpose namely Purvanchal Expressway Project through Uttar Pradesh Expressways Industrial Development Authority (UPEIDA) and it was lastly published on August 5, 2021;

AND, WHEREAS, out of the said 0.56104 Hectares of land, 0.215215 of land has already been acquired for the purpose of the aforesaid project;

AND, WHEREAS, Deputy Collector/Assistant Collector Jalalpur, District Ambedkarnagar was appointed as the Administrator for the purpose of rehabilitation and resettlement of the project affected families;

NOW, THEREFORE, after considering the report of the Collector submitted in pursuance to provisions under sub-section (2) of section 15 of the aforesaid Act, the Governor is pleased to declare under sub-section (1) of section 19 of the aforesaid Act that she is satisfied that the area of the land mentioned in the given Schedule "A" is needed for public purpose and land to the extent of nil Hectare in the Village-nil, Pargana-nil and District-nil as given in the Schedule "B" has been identified for rehabilitation and resettlement of the displaced families, i.e., No family is likely to be displaced, due to land acquisition for this project.

The Governor is further pleased under sub-section (2) of section 19 of the aforesaid Act, to direct the Collector of Ambedkarnagar to publish summary of the Rehabilitation and Resettlement Scheme with publication of the declaration to this effect. The summary of Rehabilitation and Resettlement Scheme is given below.
