संयुक्त प्रान्त आबकारी अधिनियम, 1910 (अधिनियम संख्या 4 सन् 1910) की धारा 41 के अधीन शक्तियों का प्रयोग करके, और राज्य सरकार की पूर्व स्वीकृति से आबकारी आयुक्त, समय-समय पर यथासंशोधित, उत्तर प्रदेश वि—त स्प्रिट तथा विशिष्टतया वि—त स्प्रिट को कब्जे में रखने के लिये लाइसेंस नियमावली, 1976 में संशोधन करने की दृष्टि से निम्नलिखित नियमावली बनाते हैं-
(1) यह नियमावली उत्तर प्रदेश वि—त स्प्रिट तथा विशिष्टतया वि—त स्प्रिट
को कब्जे में रखने के लिये लाइसेंस (सातवां संशोधन) नियमावली, 2021 कही जायेगी। (2) यह गजट में प्रकाशित किये जाने के दिनांक से प्रवृत्त होगी।2 उत्तर प्रदेश असाधारण गजट, 10 दिसम्बर, 2021 ई0 - उत्तर प्रदेश वि—त स्प्रिट तथा विशिष्टतया वि—त स्प्रिट को कब्जे में रखने के
लिये लाइसेंस नियमावली, 1976 (जिसे आगे "उक्त नियमावली" कहा गया है) मेें नियम-4 में, नीचे स्तम्भ-1 में दिये गये उप नियम (9) के स्थान पर स्तम्भ-2 में दिया गया उप नियम रख दिया जायेगा, अर्थात्-

- वर्तमान उप नियम एतद्द्वारा प्रतिस्थापित उप नियम (9) लाइसेंसधारी, लाइसेंस के अधीन प्राप्त की गयी (9) लाइसेंसधारी, लाइसेंस के अधीन प्राप्त की स्प्रिट के किसी परिमाण को ना तो बेचेगा, या उसे भेंट गयी स्प्रिट के किसी परिमाण को ना तो बेचेगा, या न के रूप में या अन्यथा किसी को देगा या लाइसेंस में उसे भेंट के रूप में या अन्यथा रूप में किसी को देगा उल्लिखित प्रयोजनों से भिन्न प्रयोजनों के लिये उसका या न लाइसेंस में उल्लिखित प्रयोजनों से भिन्न प्रयोजनों उपयोग करेगा।

प्रतिबन्ध यह है कि मोनो इथलीन ग्लाइकाल या परन्तु यह कि पेट्रोल में विकृत पावर अल्कोहल के तत्सदृश्य उत्पाद का निर्माण करने वाली कोई औद्योगिक मिश्रण हेतु पेट्रोलियम डिपो को जारी किये जाने वाले इकाई आबकारी आयुक्त, उत्तर प्रदेश के लिखित रूप में एफ0एल0-41 लाइसेंस का धारक, अन्य राज्यों में स्थित पूर्व स्वीकृति से, निर्माण की प्रक्रिया में पायी गयी अपनी कम्पनी के तेल डिपो को, निर्यात नियमों के अवशिष्ट स्प्रिट को जिसमें 0.5 पी0बी0एम0 से अधिक अधीन विहित निबंधनों और शर्तों के अनुसार, विकृत सल्फर हो, आबकारी आयुक्त द्वारा इस निमित्त पावर अल्कोहल का निर्यात, रेल वैगन के माध्यम से कर यथाविनिर्दिष्ट निबन्धनों और शर्तों के अनुसार इस सकता है।
नियमावली के अधीन लाइसेंस रखने वाली किसी अन्य
इकाई को बेच सकती है।
परन्तु यह और कि एफ0एल0-41 लाइसेंसधारी रेल
वैगन के माध्यम से निर्यात किये जाने वाले ऐसे प्रत्येक
परेषण हेतु पी0डी0-25 प्रपत्र में परिवहन पास जारी
करेगा जिसकी एक प्रति संबंधित जिला आबकारी
अधिकारी कार्यालय में प्रस्तुत की जायेगी। प्रत्येक निर्यात
हेतु विहित निर्यात पास फीस अग्रिम रूप से संदत्त
होगी।
-उक्त नियमावली में नियम-5 में, नीचे स्तम्भ-1 में दिये गये उप नियम (3) के खण्ड (घ) के स्थान पर स्तम्भ-2 में दिया गया खण्ड रख दिया जायेगा, अर्थात्-

- वर्तमान खण्ड
एतद्द्वारा प्रतिस्थापित खण्ड (घ) लाइसेन्स धारी स्प्रिट की दैनिक प्राप्ति तथा (घ) लाइसेन्स धारी स्प्रिट की दैनिक प्राप्ति तथा उपयोग का सही लेखा-जोखा आबकारी आयुक्त द्वारा उपयोग और रेल वैगन से विकृत पावर अल्कोहल के समय-समय पर विहित प्रपत्र में रखेगा।
निर्यात का सही लेखा-जोखा आबकारी आयुक्त द्वारा
समय-समय पर विहित प्रपत्र में रखेगा।

In exercise of the powers under section 41 of the Excise Act, 1910 (Act no. 4 of 1910), the Excise Commissioner, with the previous sanction of the State Government, is pleased to make the following rules with a view to amending the Uttar Pradesh Licences for the possession of Denatured Sprit and Specially Denatured Spirit Rules, 1976, as amended from time to time.
UTTAR PRADESH LICENSES FOR THE POSSESSION OF THE DENATURED SPIRIT AND SPECIALLY DENATURED SPIRIT (SEVENTH AMENDMENT), RULES, 2021 1. Short title and commencement –(1) These rules may be called the Uttar Pradesh Licenses for the Possession of Denatured Spirit and Specially Denatured Spirit (Seventh Amendment), Rules, 2021.
(2) They shall come into force with effect from the date of their publication in the Gazette.
2. Amendment of rule-4–In the Uttar Pradesh Licenses for the Possession of Denatured Spirit and Specially Denatured Spirit Rules, 1976 (hereinafter referred to as the ''said rules'') in rule-4 sub rule (9) set out in Column I below, the sub rule as set out in the Column II shall be substituted, namely :
