उत्तर प्रदेश साधारण ख(cid:7003)ड अधिनियम, 1904 (उत्तर प्रदेश अधिनियम संख्या 1 सन् 1904) की धारा 21 के साथ पठित उत्तर प्रदेश गन्ना (पू(cid:7414)त तथा खरीद विनियमन) अधिनियम, 1953 (उत्तर प्रदेश अधिनियम संख्या 24 सन् 1953) की धारा 28 के अधीन शक्तियों का प्रयोग करके , राज्यपाल उत्तर प्रदेश गन्ना (पू(cid:7414)त तथा खरीद विनियमन) नियमावली, 1954 को संशोधित करने की दृष्टि से निम्नलिखित नियमावली बनाती हैं:-

संक्षिप्त नाम और 1-(1) यह नियमावली उत्तर प्रदेश गन्ना (पू(cid:7414)त तथा खरीद विनियमन) (इकतीसवां
प्रारम्भ
संशोधन) नियमावली, 2021 कही जायेगी।
(2) यह दिनांक 11 नवम्बर, 2021 से (cid:7263)ई समझी जाएगी। 2 उत्तर प्रदेश असाधारण गजट, 13 दिसम्बर, 2021 2-उत्तर प्रदेश गन्ना (पू(cid:7414)त तथा खरीद विनियमन) नियमावली, 1954 में,नीचे स्तम्भ-एक नियम 49 का संशोधन
में दिये गये नियम 49 के स्थान पर, स्तम्भ-दो में दिया गया नियम रख दिया जायेगा, अर्थात्:-

49- किसी फै क्टरी का अध्यासी, खरीदे गये 49- किसी फै क्टरी का अध्यासी, खरीदे गये गन्ने पर भारत सरकार द्वारा निर्धारित गन्ने पर भारत सरकार द्वारा निर्धारित न्यूनतम सांविधिक गन्ना मूल्य, जिसे संप्रति न्यूनतम सांविधिक गन्ना मूल्य, जिसे संप्रति उचित एवं लाभकारी मूल्य (एफ0आर0पी0) उचित एवं लाभकारी मूल्य (एफ0आर0पी0) के रूप में जाना जाता है, के तीन प्रतिशत की के रूप में जाना जाता है, के तीन प्रतिशत दर से अंशदान देगा, जिसमें से पचहत्तर की दर से अंशदान देगा, जिसमें से पचहत्तर प्रतिशत गन्ना उत्पादकों की सहकारी समिति प्रतिशत गन्ना उत्पादकों की सहकारी समिति को और प(cid:6994)चीस प्रतिशत परिषद को संदेय को और प(cid:6994)चीस प्रतिशत परिषद को संदेय होगा:

IN exercise of the powers under section 28 of the Uttar Pradesh Sugarcane (Regulation of Supply and Purchase) Act, 1953 (U.P. Act no.XXIV of 1953) read with section 21 of the Uttar Pradesh General Clauses Act, 1904 (U.P. Act no. 1 of 1904), the Governor is pleased to make the following rules with a view to amending the Uttar Pradesh Sugarcane (Regulation of Supply and Purchase) Rules, 1954:-
THE UTTAR PRADESH SUGARCANE (REGULATION OF SUPPLY AND PURCHASE) (THIRTY FIRST AMENDMENT) RULES, 2021
1. (1) These rules may be called the Uttar Pradesh Sugarcane (Regulation of Short title and commencement
Supply and Purchase) (Thirty First Amendment) Rules, 2021.
(2) They shall come into force with effect from 11th November, 2021.
2. In the Uttar Pradesh Sugarcane (Regulation of Supply and Purchase) Rules, Amendment of rule-49
1954 for rule 49 set out in column-I below, the rule as set out in column II shall be substituted, namely:-

The Occupier of a factory shall pay contribution on cane purchase at the rate of three percent of minimum statutory cane price, presently known as Fair and Remunerative Price (F.R.P.) fixed by the Government of India, out of which seventy five percent shall be payable to the cane grower's co-operative society and twenty five percent to the council:

Provided that the commission payable on cane purchased during crushing season 2020-21 shall be paid at the rate of five rupees and fifty paisa per quintal instead of three percent of Fair and Remunerative Price (F.R.P.).
Provided that the contribution payable on cane purchased during crushing season 2021-22 shall be paid at the rate of five rupees and fifty paisa per quintal instead of three percent of Fair and Remunerative Price (F.R.P.).
