उत्तर प्रदेश साधारण खण्ड अधिनियम, 1904 (उत्तर प्रदेश अधिनियम संख्या 1 सन्‌ 1904) की धारा 21 के साथ पठित संयुक्त प्रान्त आबकारी अधिनियम, 1910 (संयुक्त प्रान्त अधिनियम संख्या 4 सन्‌ 1910) की धारा 41 के अधीन शक्तियों का प्रयोग करके, आबकारी आयुक्त, उत्तर प्रदेश, राज्य सरकार की पूर्व अनुमति से समय-समय पर यथा संशोधित आबकारी आयुक्त की अधिसूचना संख्या 6352/दो-931, दिनांक 5 जून, 1961 के अधीन यथा प्रकाशित यवासवनी चलाने के लिए लाइसेंसों से सम्बन्धित नियमों में संशोधन करने की दृष्टि से निम्नलिखित नियमावली बनाते हैं- -(1) यह नियमावली उत्तर प्रदेश यवासवनी (सप्तम संशोधन) नियमावली, 2021 कही जायेगी।

(2) यह दिनांक 01 अप्रैल, 2021 से प्रवृत्त हुई समझी जायेगी।2 उत्तर प्रदेश असाधारण गजट, 17 दिसम्बर, 2021 ई0 2- - -उत्तर प्रदेश यवासवनी नियमावली, 1961, जिसे आगे उक्त नियमावली कहा गया है, में नीचे स्तम्भ-1 में दिये गये विद्यमान नियम-9 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात्‌ स्तम्भ-1 विद्यमान नियम

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम 9- आगामी तीन आबकारी वर्ष तक के लिये लाइसेंस के नवीकरण का आवेदन पत्र कलेक्टर के माध्यम से आबकारी आयुक्त को प्रपत्र बी-2 में वर्ष की 28 फरवरी या उसके पूर्व प्रस्तुत किया जायेगा। यदि प्लांट या भवन में परिवर्तन किया गया हो तो नया प्लान प्रस्तुत किया जायेगा। यदि कोई परिवर्तन नहीं किया गया हो तो इस आशय का प्रमाण पत्र प्रभारी अधिकारी से प्राप्त कर लाइसेंस के नवीकरण के आवेदन पत्र के साथ संलग्न किया जायेगा। 9- आगामी आबकारी वर्ष के लिये लाइसेंस के नवीकरण का आवेदन पत्र कलेक्टर के माध्यम से आबकारी आयुक्त को प्रपत्र बी-2 में प्रत्येक वर्ष की 28 फरवरी या उसके पूर्व प्रस्तुत किया जायेगा। यदि प्लांट या भवन में परिवर्तन किया गया हो तो नया प्लान प्रस्तुत किया जायेगा। यदि कोई परिवर्तन नहीं किया गया हो तो इस आशय का प्रमाण पत्र प्रभारी अधिकारी से प्राप्त कर लाइसेंस के नवीकरण के आवेदन पत्र के साथ संलग्न किया जायेगा। 3- - उक्त नियमावली में, नियम-63 में, नीचे स्तम्भ-1 में दिये गये नियम के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात्‌ स्तम्भ-1

स्तम्भ-2

विद्यमान नियम

एतद्‌द्वारा प्रतिस्थापित नियम (1) कोई व्यक्ति जो होटल/रिसार्ट/रेस्टोरेन्ट /वाणिज्यिक क्लब हेतु बार लाइसेंस धारण करता हो और लघु यवासवनी हेतु लाइसेंस प्राप्त करना चाहता हो, उस जिले के कलेक्टर जहॉ लघु यवासवनी स्थापित किया जाना प्रस्तावित हो, के माध्यम से आबकारी आयुक्त, उत्तर प्रदेश को आवेदन करेगा। लाइसेंस की स्वीकृति हेतु आवेदन-पत्र, प्रपत्र एम0बी0-2 में किया जायेगा। आवेदन-पत्र के साथ निम्नलिखित दस्तावेज संलग्न किये जायेंगे- (1) कोई व्यक्ति जो होटल/रिसार्ट/रेस्टोरेन्ट/वाणिज्यिक क्लब हेतु बार लाइसेंस धारण करता हो और लघु यवासवनी हेतु लाइसेंस प्राप्त करना चाहता हो, उस जिले के जिलाधिकारी जहॉ लघु यवासवनी स्थापित किया जाना प्रस्तावित हो, के माध्यम से आबकारी आयुक्त, उत्तर प्रदेश को आवेदन करेगा। लाइसेंस की स्वीकृति हेतु आवेदन-पत्र, प्रपत्र एम0बी0-2 में किया जायेगा। आवेदन-पत्र के साथ निम्नलिखित दस्तावेज संलग्न किये जायेंगे- (एक) किसी वर्ष अथवा उस वर्ष के आंशिक भाग जिसके लिये लाइसेंस स्वीकृत हो, के लिये अग्रिम में जमा किया गया रुपये 50,000.00 का टे्रजरी चालान। (एक) किसी वर्ष अथवा उस वर्ष के आंशिक भाग जिसके लिये लाइसेंस स्वीकृत हो, के लिये अग्रिम में जमा किया गया रुपये 50,000.00 (पचास हजार रुपये) का टे्रजरी चालान।

(दो) अक्षांश एवं देशान्तर सहित परिसर का पूर्ण (दो) अक्षांश एवं देशान्तर सहित परिसर का पूर्ण विवरण

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम (आठ) आवेदक को बाध्यकारी करते हुये भारतीय स्टाम्प अधिनियम के अनुसार अपेक्षित मूल्य के नान जुडिशियल स्टाम्प पेपर पर विहित प्रपत्र एम0बी0-4 में ऐसा वचनबंध कि वह समय-समय पर आबकारी आयुक्त द्वारा यथाविहित मानकों के अनुसार उपकरण परिनिर्मित करेगा।

(आठ) आवेदक को बाध्यकारी करते हुये भारतीय स्टाम्प अधिनियम के अनुसार अपेक्षित मूल्य के नान जुडिशियल स्टाम्प पेपर पर विहित प्रपत्र एम0बी0-4 में ऐसा वचनबंध कि वह उत्पाद की विशिष्टयॉं और गुण को अनुरक्षित करने के लिए समय-समय पर आबकारी आयुक्त द्वारा यथाविहित मानकों के अनुसार उपकरण परिनिर्मित करेगा।

(2) प्रत्येक आवेदन पत्र की, सम्बन्धित जिले के जिलाधिकारी अथवा उसके द्वारा इस निमित्त प्राधिकृत जिला आबकारी अधिकारी द्वारा संवीक्षा की जायेगी। तत्पश्चात्‌ जिलाधिकारी अपनी संस्तुति, आबकारी आयुक्त को लाइसेंस स्वीकृत किये जाने हेतु अग्रसारित करेगा।

(2) प्रत्येक आवेदन पत्र की, सम्बन्धित जिले के कलेक्टर अथवा उसके द्वारा इस निमित्त प्राधिकृत जिला आबकारी अधिकारी द्वारा संवीक्षा की जायेगी। तत्पश्चात, जिले का कलेक्टर अपनी संस्तुति, आबकारी आयुक्त, उत्तर प्रदेश को लाइसेंस स्वीकृत किये जाने हेतु अग्रेषित करेगा।

(3) ऐसी जांच जैसा कि वह उचित समझे, कराये जाने पर और आवदेक की नियमितता तथा कार्यक्षमता के सम्बन्ध में स्वयं का समाधान करने के पश्चात्‌ आयुक्त, आयुक्त राज्य सरकार के अनुमोदन से प्रपत्र एम0बी0-5 में लघु यवासवनी स्थापना हेतु लाइसेंस स्वीकृत कर सकता है।

(3) ऐसी जांच जैसा कि वह उचित समझे, कराये जाने पर और आवदेक की नियमितता तथा कार्यक्षमता के सम्बन्ध में स्वयं का समाधान करने के पश्चात्‌ आयुक्त, राज्य सरकार के अनुमोदन से प्रपत्र एम0बी0-5 में लघु यवासवनी स्थापना हेतु लाइसेंस स्वीकृत कर सकता है।

(4) लाइसेंस प्राप्त करने के पश्चात्‌ आवेदक एक

वर्ष के अन्तर्गत उपकरण परिनिर्मित करेगा, जिसमें विफल रहने पर उप नियम (1) के अन्तर्गत संदत्त फीस समपहृत हो जायेगी। यदि लाइसेंसधारक, विशिष्टताओं तथा गुणवत्तायुक्त मानकों के अनुसार यवासवनी चलाये जाने में विफल रहता है तो स्वीकृत लाइसेंस किसी नुकसान या क्षति के प्रतिकर के बिना निरस्त किये जाने याग्य होगा। लाइसेंसधारक छः माह तक लाइसेंस के विस्तार हेतु रुपये 25,000.00 (पच्चीस हजार रुपये मात्र) के अतिरिक्त फीस का भुगतान करके आवेदन कर सकता है।

(4) लाइसेंस प्राप्त करने के पश्चात्‌, आवेदक एक वर्ष के भीतर उपकरण परिनिर्मित करेगा, जिसमें विफल रहने पर उप नियम(1) के अधीन संदत्त फीस समपहृत हो जायेगी, यदि लाइसेंसधारक, विशिष्टताओं तथा गुणवत्तायुक्त मानकों के अनुसार यवासवनी चलाये जाने में विफल रहता है तो, स्वीकृत लाइसेंस किसी नुकसान या क्षति के प्रतिकर के बिना निरस्त किये जाने योग्य होगा। लाइसेंसधारक छः माह तक लाइसेंस के विस्तार हेतु रुपये 25,000.00 (पच्चीस हजार रुपये मात्र) के अतिरिक्त फीस का भुगतान करके आवेदन कर सकता है।

(5) लघु यवासवनी की स्वीकृति हेतु लाइसेंस फीस (5) लघु यवासवनी की स्वीकृति हेतु लाइसेंस फीस दो लाख रुपये प्रतिवर्ष होगी।

दो लाख रुपये प्रतिवर्ष होगी।

(6) जैसे ही उपकरणों की स्थापना हो जायेगी, (6) जैसे ही उपकरणों की स्थापना हो जायेगी, लाइसेंसधारक लघुयवासवनी के सम्बन्ध में प्रपत्र एम0बी- 6 में आवेदन, प्रपत्र एम0बी0-5 लाइसेंस स्वीकृत किये जाने के दिनांक से एक वर्ष के भीतर आबकारी आयुक्त को जमा करेगा, जिसके साथ निम्नलिखित दस्तावेज जमा किये जायेंगे-

लाइसेंसधारक लघुयवासवनी के सम्बन्ध में प्रपत्र एम0बी- 6 में आवेदन, प्रपत्र एम0बी0-5 लाइसेंस स्वीकृत किये जाने के दिनांक से एक वर्ष के भीतर आबकारी आयुक्त को जमा करेगा, जिसके साथ निम्नलिखित दस्तावेज जमा किये जायेंगे-

(एक) लाइसेंस स्वीकृति किये जाने हेतु लाइसेंस (एक) लाइसेंस स्वीकृति किये जाने हेतु लाइसेंस फीस हेतु अपेक्षित धनराशि का चालान;

स्तम्भ-1 विद्यमान नियम

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम (दो) अपेक्षित धनराशि की प्रतिभूति जमा की नियत (दो) अपेक्षित धनराशि की प्रतिभूति जमा की नियत जमा रसीद;

रजिस्ट्रीकरण;

(चार) करार का प्रतिलेख;

(7) जहॉ आयुक्त का यह समाधान हो जाय कि (7) जहॉ आयुक्त का यह समाधान हो जाय कि लाइसेंसधारक ने शर्तो का पूरा कर लिया है और लाइसेंसधारक ने शर्तो को पूरा कर लिया है और विशिष्टता तथा गुणवत्तायुक्त मानकों के अनुसार बीयर विशिष्टता तथा गुणवत्तायुक्त मानकों के अनुसार बीयर का उत्पादन करने हेतु तैयार है, तो वह लघु यवासवनी का उत्पादन करने हेतु तैयार है, तो वह लघु यवासवनी हेतु लाइसेंस, प्रपत्र एम0बी0-1 में स्वीकृत कर सकता है। हेतु लाइसेंस, प्रपत्र एम0बी0-1 में स्वीकृत कर सकता है। (8) प्रपत्र एम0बी0-1 में लाइसेंस स्वीकृत किये (8) प्रपत्र एम0बी0-1 में लाइसेंस स्वीकृत किये जाने के पूर्व आबकारी आयुक्त द्वारा प्राधिकृत आबकारी जाने के पूर्व आबकारी आयुक्त द्वारा प्राधिकृत आबकारी अधिकारी परिसर आदि का निरीक्षण करेगा और पूर्वोक्त अधिकारी परिसर आदि का निरीक्षण करेगा और पूर्वोक्त योजना एवं प्रविष्टियों से उसका मिलान कर तदनुसार योजना एवं प्रविष्टियों से उसका मिलान कर तदनुसार सत्यापित करेगा।

(9) किसी प्रकार की बीयर का उत्पादन नहीं (9) किसी प्रकार की बीयर का उत्पादन नहीं किया जायेगा और कोई व्यक्ति, बीयर उत्पादन के किया जायेगा और कोई व्यक्ति, बीयर उत्पादन के प्रयोजनार्थ किसी पदार्थ, बर्तन, साधन एवं उपकरण जो प्रयोजनार्थ किसी पदार्थ, बर्तन, साधन एवं उपकरण जो भी हो, का बिना किसी प्राधिकार के और आबकारी भी हो, का बिना किसी प्राधिकार के और आबकारी आयुक्त द्वारा प्रपत्र एम0बी0-1 में स्वीकृत लाइसें की आयुक्त द्वारा प्रपत्र एम0बी0-1 में स्वीकृत लाइसेंस की निबंधन एवं शर्तों के अध्यधीन उपयोग नहीं करेगा अथवा निबंधन एवं शर्तों के अध्यधीन उपयोग नहीं करेगा अथवा अपने पास नहीं रखेगा।

(10) निम्नलिखित आबकारी वर्ष हेतु नवीनीकरण (10) आगामी तीन आबकारी वर्षों तक के लिये के लिये आवेदन 2.0 लाख रुपये (दो लाख रुपये) की नवीकरण हेतु आवेदन 2.0 लाख रुपये की ट्रेजरी चालान ट्रेजरी चालान के साथ प्रत्येक वर्ष 31 जनवरी को या के साथ प्रत्येक वर्ष 28 फरवरी को या इससे पूर्व इससे पूर्व जिलाधिकारी के माध्यम से प्रपत्र एम0बी0-7 में कलेक्टर को प्रपत्र एम0बी0-7 में किया जायेगा। यदि किया जायेगा। यदि प्लांट या भवन में परिवर्द्धन हुआ हो प्लांट या भवन में परिवर्तन हुआ हो तो नया मानचित्र तो नया मानचित्र प्रस्तुत करना होगा। यदि कोई प्रस्तुत करना होगा। यदि कोई परिवर्तन न किया गया परिवर्द्धन न किया गया हो तो प्रभारी अधिकारी की ओर हो तो प्रभारी अधिकारी की ओर से इस आशय का से इस आशय का प्रमाण-पत्र, लाइसेंस नवीनीकरण हेतु प्रमाण-पत्र, लाइसेंस नवीकरण हेतु आवेदन पत्र के साथ आवेदन पत्र के साथ संलग्न करना होगा।

4- - उक्त नियमावली में नीचे स्तम्भ-1 में दिये गये विद्यमान नियम-67 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात्‌उत्तर प्रदेश असाधारण गजट, 17 दिसम्बर, 2021 ई0 5 स्तम्भ-1 विद्यमान नियम

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम प्रत्येक लघु यवासवनी का

प्रत्येक लघु यवासवनी अनुज्ञापन 1 अप्रैल से प्रारम्भ होने वाले और आगामी वर्ष का लाइसेंस तीन वर्ष तक के लिये, जो 1 अप्रैल से के 31 मार्च को समाप्त होने वाले एक वर्ष के लिए प्रारम्भ होकर 31 मार्च को समाप्त होने वाले वर्ष, जैसा यथाविहित लाइसेंस फीस का भुगतान किये जाने के कि उल्लिखित हो, तक के लिए यथाविहित लाइसेंस अध्यधीन विधिमान्य होगा। परन्तु 1 अप्रैल या उसके फीस का भुगतान किये जाने के अध्यधीन विधिमान्य

होगा।

पश्चात्‌ जारी किया गया लाइसेंस उत्तरवर्षी वर्ष के 31

मार्च तक विधिमान्य रहेगा।

परन्तु यह कि 1 अप्रैल या उसके पश्चात

जारी किया गया लाइसेंस भी 31 मार्च को समाप्त होने

वाले वर्ष जैसा कि उल्लिखित हो, तक विधिमान्य रहेगा। 5- -उक्त नियमावली में नीचे स्तम्भ-1 में दिये गये विद्यमान नियम-71 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात्‌ स्तम्भ-1 विद्यमान नियम

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम (1) लाइसेंस धारी संयुक्त प्रान्त आबकारी अधिनियम 1910 के उपबन्धों और तद्‌धीन जारी अधिसूचनाओं तथा आदेशों द्वारा आबद्ध होगा।

(1) लाइसेंस धारी संयुक्त प्रान्त आबकारी अधिनियम 1910 के उपबन्धों और तद्‌धीन जारी अधिसूचनाओं तथा आदेशों द्वारा आबद्ध होगा। (2) लाइसेंसधारी ड्राट बीयर के उत्पादन, संचयन एवं परोसने को नियंत्रित किये जाने के सम्बन्ध में राज्य सरकार द्वारा यथाविहित नियमों या आबकारी आयुक्त द्वारा समय-समय पर जारी किये जाने वाले अनुदेशों तथा आदेशों का अनुपालन करेगा।

(2) लाइसेंसधारी ड्राट बीयर के उत्पादन, संचयन एवं परोसने को नियंत्रित किये जाने के सम्बन्ध में राज्य सरकार द्वारा यथाविहित नियमों या आबकारी आयुक्त द्वारा समय-समय पर जारी किये जाने वाले अनुदेशों तथा आदेशों का अनुपालन करेगा।

(3) लाइसेंसधारी अपनायी जाने वाली बीयर उत्पादन की प्रक्रिया तथा उत्पादित किये जाने वाली तथा परोसे जाने वाली बीयर के मानकों तथा गुणवत्ता के सम्बन्ध में राज्य सरकार या आबकारी आयुक्त द्वारा पारित किये जाने वाले आदेशों से आबद्ध होगा। (4) लाइसेंसधारी लघु यवासवनी में वाश का घनत्व मापने के लिये आबकारी आयुक्त द्वारा अनुमोदित सेक्रोमीटर एवं थर्मामीटर उपलब्ध करायेगा। ड्राट बीयर की तीव्रता मापने के लिये एक हाइड्रोमीटर भी उपलब्ध कराया जायेगा।

(4) लाइसेंसधारी लघु यवासवनी में वाश का घनत्व मापने के लिये आबकारी आयुक्त द्वारा अनुमोदित सेक्रोमीटर एवं थर्मामीटर उपलब्ध करायेगा। ड्राट बीयर की तीव्रता मापने के लिये एक हाइड्रोमीटर भी उपलब्ध कराया जायेगा।

(5) ग्राहकों को प्रस्तुत तथा उपलब्ध करायी जाने वाली बीयर में अल्कोहल की मात्रा 8% वी0/वी0 से अधिक नहीं होगी।

(6) मैच्योरेशन स्तर तक ब्रू का पी0एच0, तापमान एवं विनिर्दिष्ट घनत्व प्रपत्र एम0बी0-8 में अभिलिखित किये जाने चाहिये और वे सक्षम प्राधिकारी द्वारा मॉंग किये जाने पर निरीक्षण के अध्यधीन होंगे।

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम (7) परिसर को समुचित वातायन एवं प्रकाश (7) परिसर को समुचित वातायन एवं प्रकाश व्यवस्था सहित साफ-सुथरा रखा जायेगा और यह समस्त व्यवस्था सहित साफ-सुथरा रखा जायेगा और यह समस्त प्रकार की सुरक्षा तथा आपात मानकों के अनुरूप हो और प्रकार की सुरक्षा तथा आपात मानकों के अनुरूप हो और साथ ही साथ ग्लास, परोसने की मेज आदि सहित बीयर साथ ही साथ ग्लास, परोसने की मेज आदि सहित बीयर वितरण प्रणाली को स्वास्थ्य की दृष्टि से सदैव अनुरक्षित वितरण प्रणाली को स्वास्थ्य की दृष्टि से सदैव अनुरक्षित रखा जाय।

(8) संचय टैंकों एवं परिसर में समय-समय पर (8) संचय टैंकों एवं परिसर में समय-समय पर धूम्रीकरण प्राधिकृत व्यक्तियों द्वारा नियमित रूप से किया धूम्रीकरण प्राधिकृत व्यक्तियों द्वारा नियमित रूप से किया जायेगा और उसे अभिलेखों में उल्लिखित किया जायेगा। जायेगा और उसे अभिलेखों में अनुरक्षित किया जायेगा। (9) किसी भी दशा में नाबालिगों को बीयर या (9) किसी भी दशा में नाबालिगों को बीयर या अन्य अल्कोहलिक पेय परोसा नहीं जायेगा।

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम जैसे ही बीयर के एक बैच का उत्पादन किया जैसे ही बीयर के एक बैच का उत्पादन किया जायेगा वैसे ही उसे संचय कक्ष में स्थानान्तरित कर जायेगा, वैसे ही उसे संचय कक्ष में स्थानान्तरित कर दिया जायेगा और इस प्रकार स्थानान्तरित बीयर की दिया जायेगा और इस प्रकार स्थानान्तरित बीयर की मात्रा का आंकलन, किण्वन टैंक एवं संचयन टैंक के मात्रा का आंकलन, किण्वन/ब्राइट बीयर टैंक एवं मध्य लगे फ्लो मीटर से किया जायेगा, जिसे अग्रतर टैंक संचयन/सर्विस टैंक के मध्य लगे फ्लो मीटर से किया के साथ लगे केलीब्रेटेड गेज से विधिमान्यकृत किया जायेगा, जिसे अग्रतर टैंक के साथ लगे केलीब्रेटेड गेज जायेगा। उक्त फ्लो मीटर, आबकारी विभाग की ताले एवं से विधिमान्य किया जायेगा। उक्त फ्लो मीटर, आबकारी कुंजी के अधीन होगा। इस प्रकार मापित एवं विभाग की ताले एवं कुंजी के अधीन होगा। इस प्रकार स्थानान्तरित की गयी बीयर की मात्रा, प्रपत्र एम0बी0 8 मापित एवं स्थानान्तरित की गयी बीयर की मात्रा, प्रपत्र क में अभिलिखित की जायेगी । आबकारी शुल्क प्रपत्र एम0बी0 8 क में अभिलिखित की जायेगी। आबकारी एम0बी0 8 क में इस प्रकार अभिलिखित मात्रा के आधार शुल्क प्रपत्र एम0बी0 8 क में इस प्रकार अभिलिखित पर प्रभारित किया जायेगा। संचयन टैंकों में तैयार मात्रा के आधार पर प्रभारित किया जायेगा। संचयन टैंकों उत्पादों को स्थल पर उपभोग हेतु जब अपेक्षित हो में तैयार उत्पादों को स्थल पर उपभोग हेतु जैसे और स्थानान्तरित किया जायेगा।

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित प्रपत्र (1) लाइसेंसधारी संयुक्त प्रान्त आबकारी अधिनियम 1910 के उपबन्धों और तदधीन जारी अधिसूचनाओं तथा आदेशों का पालन करने के लिए बाध्य होगा।

(1) लाइसेंसधारी संयुक्त प्रान्त आबकारी अधिनियम 1910 के उपबन्धों और तदधीन जारी अधिसूचनाओं तथा आदेशों का पालन करने के लिए बाध्य होगा। (2) लाइसेंसधारी उत्पादन, संचय एवं परोसने को नियंत्रित किये जाने के सम्बन्ध में राज्य सरकार द्वारा यथाविहित नियमों या आबकारी आयुक्त द्वारा समय-समय पर निर्गत अनुदेशों एवं आदेशों का अनुपालन करेगा।

(2) लाइसेंसधारी उत्पादन, संचय एवं परोसने को नियंत्रित किये जाने के सम्बन्ध में राज्य सरकार द्वारा यथाविहित नियमों या आबकारी आयुक्त द्वारा समय- समय पर निर्गत अनुदेशों एवं आदेशों का अनुपालन करेगा।

(3) लाइसेंसधारी अपनायी जाने वाली बीयर के उत्पादन की प्रक्रिया और उत्पादित किये जाने एवं परोसने हेतु बीयर के मानकों तथा गुणवत्ता के सम्बन्ध में राज्य सरकार अथवा आबकारी आयुक्त द्वारा पारित आदेशों का अनुपालन करने के लिए बाध्य होगा। (4) लाइसेंसधारी आबकारी आयुक्त द्वारा अनुमोदित सेक्रोमीटर एवं थर्मामीटर यवासवनी में वाश का घनत्व मापने के लिये उपलब्ध करायेगा । ड्राट बीयर की तीव्रता मापने के लिए एक हाइड्रोमीटर भी उपलब्ध कराया जायेगा।

(4) लाइसेंसधारी आबकारी आयुक्त द्वारा अनुमोदित सेक्रोमीटर एवं थर्मामीटर यवासवनी में वाश का घनत्व मापने के लिये उपलब्ध करायेगा। ड्राट बीयर की तीव्रता मापने के लिए एक हाइड्रोमीटर भी उपलब्ध कराया जायेगा।

(5) ग्राहकों को उपलब्ध करायी जाने वाली उत्पादित बीयर में अल्कोहल अन्र्तवस्तु 8% वी0/वी0 सेे अधिक नही होगी।

(6) परिपक्वता स्तर तक ब्रू का पी.एच., तापमान एवं विर्निदिष्ट घनत्व अभिलिखित किया जाना चाहिए और वह निरीक्षण के अध्यधीन होगा, जैसा और जब सक्षम प्राधिकारी द्वारा मांग किया जायेगा। (6) परिपक्वता स्तर तक ब्रू का पी.एच., तापमान एवं विर्निदिष्ट घनत्व प्रपत्र एम.बी.-8 में अभिलिखित किया जाना चाहिए और वह निरीक्षण के अध्यधीन होगा, जैसा और जब सक्षम प्राधिकारी द्वारा मांग किया जायेगा, उसे उपलब्ध कराया जायेगा।

(7) परिसर को समुचित वातायन तथा प्रकाश (7) परिसर को समुचित वातायन तथा प्रकाश व्यवस्था सहित साफ सुथरा रखा जायेगा और यह समस्त व्यवस्था सहित साफ सुथरा रखा जायेगा और यह प्रकार की उपर्युक्त सुरक्षा तथा आपात मानकों के अनुरूप समस्त प्रकार की उपयुक्त सुरक्षा तथा आपात मानकों होगा और साथ ही साथ ग्लास, परोसने की मेज आदि के अनुरूप होगा और साथ ही साथ ग्लास, परोसने की सहित बीयर वितरण प्रणाली को स्वास्थ्य की दृष्टि से मेज आदि सहित बीयर वितरण प्रणाली को स्वास्थ्य की सदैव अनुरक्षित रखा जाय।

In exercise of the powers under section-41 of the United Provinces Excise Act, 1910 (U.P. Act. no. IV of 1910), read with section 21 of the Uttar Pradesh General Clauses Act, 1904 (U.P. Act. no. 1 of 1904), the Excise Commissioner, Uttar Pradesh with the previous sanction of the State Government, makes the following rules with a view to amending Rules regarding licences for working breweries, as published under Excise Commissioner's Notification no. 6352/II-931, dated June 05, 1961, as amended form time to time:
