अधिसूचना
उत्तर प्रदेश माल और सेवाकर अधिनियम, 2017 (उत्तर प्रदेश अधिनियम संख्या 1, सन् 2017) की धारा 9 की उपधारा (5) के अधीन शक्तियों का प्रयोग करके राज्यपाल, परिषद् की सिफारिशों के आधार पर, एतद्द्वारा, अधिसूचना संख्या क0नि0-2-848/ग्यारह-9(47)-17-उ0प्र0अधि0-1-2017-आदेश (15)-2017, दिनांक 30 जून, 2017 में अग्रतर निम्नलिखित संशोधन करती हैं, अर्थात् :-
(1) उक्त अधिसूचना में,-
(एक) खण्ड (एक) में, शब्द ''और मोटर साइसकिल'', के स्थान पर, शब्द ''मोटर साईकिल, ओमनिबस किसी अन्य मोटर यान'', रख दिये जायेंगे;
(दो) खण्ड (तीन) के पश्चात्, निम्नलिखित खण्ड बढ़ा दिया जाएगा, अर्थात् :-
''(चार) विनिर्दिष्ट परिसर में स्थित रेस्तरां, इटिंग ज्वाइंटस आदि द्वारा पूर्ति की जाने वाली सेवाओं के अलावा रेस्तरां सेवा की पूर्ति''।
(2) उक्त अधिसूचना में, स्पष्टीकरण में,- 2 उत्तर प्रदेश असाधारण गजट, 20 दिसम्बर, 2021 (दो) मद (ख) के पश्चात् निम्नलिखित मद बढ़ा दिया जाएगा, अर्थात् :- ''(ग) विनिर्दिष्ट परिसर का तात्पर्य ऐसे परिसर से है, जो 'ऐसे होटल की व्यवस्था' की सेवाएं प्रदान करते हैं जिनका ठहरने की एक इकाई का घोषित टैरिफ सात हजार पाँच सै रुपए प्रति इकाई प्रतिदिन से अधिक या समकक्ष हो''।
2-यह अधिसूचना तारीख 1 जनवरी, 2022 से प्रवृत्त होगी।

IN pursuance of the provisions of clause (3) of Article 348 of the Constitution of India, the Governor is pleased to order the publication of the following English translation of Government notification no. 1209/XI-2–21-9(47)-17-U.P. Act-1-2017-Order (212)-2021, dated December 20, 2021 :

IN exercise of the powers under sub-section (5) of Section 9 of the Uttar Pradesh Goods and Services Tax Act, 2017 (U.P. Act no. 1 of 2017), the Governor, on the recommendations of the Council, hereby makes the following amendments to further amend notification no. KA.NI.-2–848/XI-9(47)-17- U.P. Act-1-2017-Order (15)-2017, dated 30th June, 2017, namely :–
(1) In the said notification,–
(i) in clause (i), for the words "and motor cycle", the words "motor cycle, omnibusor any other motor vehicle", shall be substituted;
(ii) after clause (iii), the following clause shall be inserted, namely :–
"(iv) supply of restaurant service other than the services supplied by restaurant, eating joints etc. located at specified premises".
(2) In the said notification, in Explanation,–
(i) in item (b), for the words, brackets, numbers and figures "and motor cycle shall have the same meanings as assigned to them respectively in clauses (22), (25) and (26) of Section 2 of the Motor Vehicle Act, 1988 (59 of 1988)", the words, brackets, numbers and figures, "motor cycle, motor vehicle and omnibus shall have the same meanings as assigned to them respectively in clauses (22), (25), (27), (28) and (29) of Section 2 of the Motor Vehicles Act, 1988 (Act no. 59 of 1988)", shall be substituted.
(ii) after item (b), the following shall be inserted, namely :–
"(c) specified premises means premises providing hotel accommodation service having declared tariff of any unit of accommodation above seven thousand five hundred rupees per unit per day or equivalent."
2. This notification shall come into force with effect from the 1st day of January, 2022.
