राज्य कर अनुभाग-2 ———— संख्या 1391/ग्यारह-2-21-9(47)-17-उ0प्र0अधि0-1-2017-आदेश (219)-2021 लखनऊ, 31 दिसम्बर, 2021 ———— अधिसूचना
उत्तर प्रदेश माल और सेवा कर अधिनियम, 2017 (उत्तर प्रदेश अधिनियम संख्या 1 सन् 2017) की धारा 11 की उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करके, राज्यपाल, परिषद् की सिफारिशों पर, एतद्द्वारा, अधिसूचना संख्या क0नि0-2-837/ग्यारह-9(47)-17-उ0प्र0अधि0-1-2017-आदेश (07)-2017, दिनांक 30 जून, 2017 में अग्रतर निम्नलिखित संशोधन करती हैं, अर्थात् :-
उक्त अधिसूचना में, अनुसूची में,-
(i) क्रम संख्या 22 के समक्ष, स्तम्भ (2) में प्रविष्टि के स्थान पर, प्रविष्टि ''0303 0304, 0305, 0306, 0307, 0308, 0309'' रख दी जायेगी;
(ii) क्रम संख्या 43ख के समक्ष, स्तम्भ (3) में, प्रविष्टि के स्थान पर, प्रविष्टि ''सब्जियाँ जो वैकल्पिक रूप से संरक्षित रखी गयी हों, लेकिन जिनका उसी अवस्था में तत्काल उपयोग नहीं किया जा सकता है'' रख दी जायेगी;
(iii) क्रम संख्या 49 के समक्ष, स्तम्भ (3) में प्रविष्टि के स्थान पर, प्रविष्टि ''अन्य नट्स, ताज़ा, जैसे बादाम, हेज़लनट्स या फ़िलबर्ट्स (कोरिलस एसपीपी.), अखरोट, चेस्टनट (कास्टेनिया एसपीपी.), पिस्ता, मैकाडामिया नट्स, कोला नट्स (कोला एसपीपी.), अरीका नट्स, पाइन नट्स, ताज़ा, चाहे कवच रहित या छिलका रहित हों या नहीं'', रख दी जायेगी;
2 उत्तर प्रदेश असाधारण गजट, 31 दिसम्बर, 2021(iv) क्रम संख्या 97 और उससे संबंधित प्रविष्टियों के पश्चात्, निम्नलिखित क्रम संख्या और प्रविष्टियाँ बढ़ा दी जाएंगी, अर्थातः-
| ''97क | 2009 89 90 | टेंडर नारियल जल, जो यूनिट कंटेनर में रखे गए से भिन्न और,- (क) जिनका कोई रजिस्ट्रीकृत ब्रांड नाम न हो; या (ख) जिनका कोई ऐसा ब्रांड नाम न हो जिस पर किसी विधिक न्यायालय में कार्रवाई योग्य दावा किया जा सकता हो या उसपर कोई प्रवर्तनी अधिकार उपलब्ध हो [अनुबंध-I में यथा विनिर्दिष्ट शर्तों के आधीन रहते हुए, उनसे भिन्न जहाँ के ऐसे ब्रांड नाम पर किसी कार्रवाई योग्य दावा या प्रवर्तनी अधिकार का स्वेच्छा से परित्याग कर दिया गया हो]"; |
(v) क्रम संख्या 101 और उससे संबंधित प्रविष्टियाँ निकाल दी जाएंगी;
(vi) क्रम संख्या 141 के समक्ष, स्तम्भ (2) में प्रविष्टि के स्थान पर, प्रविष्टि ''8807'' रख दी जायेगी; 2-यह अधिसूचना तारीख 1 जनवरी, 2022 से प्रवृत्त होगी।

IN pursuance of the provisios of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of Government notification no. 1391/XI-2-21-9(47)-17-U.P. Act-1-2017-Order (219)-2021, dated December 31, 2021 :

IN exercise of the powers conferred by sub-section (1) of section 11 of the Uttar Pradesh Goods and Services Tax Act, 2017 (U.P. Act no. 1 of 2017), the Governor, on the recommendations of the Council, hereby makes the following further amendments in the notification no. KA.NI.-2-837/XI-9(47)- 17-U.P. Act-1-2017-Order (07)-2017, dated June 30, 2017, namely :–
In the said notification, in the Schedule,–
(i) against S. no. 22, for the entry in Column (2), the entry "0303, 0304, 0305, 0306, 0307, 0308, 0309" shall be substituted;
(ii) against S. no. 43B, in column (3), for the entry the entry "Vegetables provisionally preserved, but unsuitable in that state for immediate consumption" shall be substituted;
(iii) against S. no. 49, in Column (3), for the entry, the entry "Other nuts, fresh such as Almonds, Hazelnuts or filberts (Corylus spp.), Walnuts, Chestnuts (Castanea spp.), Pistachios, Macadamia nuts, Kola nuts (Cola spp.), Areca nuts, Pine nuts, fresh, whether or not shelled or peeled" shall be substituted;
(iv) after S. no. 97 and entries relating thereto, the following S. no. and entries , shall be inserted; namely:-
उत्तर प्रदेश असाधारण गजट, 31 दिसम्बर, 2021 3| "97A | 2009 89 90 | Tender coconut water other than those put up in unit container and,- (a) bearing a registered brand name; or (b) bearing a brand name on which an actionable claim or enforceable right in a court of law is available [other than those where any such actionable claim or enforceable right in respect of such brand name has been voluntarily foregone, subject to the conditions as specified in the ANNEXURE-I]"; |
(vi) against S. no. 141, for the entry in Column (2), the entry "8807" shall be substituted;
2. This notification shall come into force on the 1st day of January, 2022.
