संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करके राज्यपाल, ''उत्तर प्रदेश चिकित्सा एवं स्वास्थ्य सेवा नियमावली, 2020'' को संशोधित करने की दृष्टि से निम्नलिखित नियमावली बनाती हैं :-
उत्तर प्रदेश चिकित्सा एवं स्वास्थ्य सेवा (प्रथम संशोधन) नियमावली, 2021
1-(1) यह नियमावली ''उत्तर प्रदेश चिकित्सा एवं स्वास्थ्य सेवा (प्रथम संशोधन) संक्षिप्त नाम और प्रारम्भ
नियमावली, 2021'' कही जायेगी।
(2) यह तुरन्त प्रवृत्त होगी।
नियम-5 का संशोधन
2-''उत्तर प्रदेश चिकित्सा एवं स्वास्थ्य सेवा नियमावली, 2020'', जिसे आगे उक्त नियमावली कहा गया है, में नियम 5 के उपनियम (1) में नीचे स्तम्भ-1 में दिये गये विद्यमान खण्ड (तीन) और (चार) के स्थान पर स्तम्भ-2 में दिये गये खण्ड रख दिये जायेंगे, अर्थात्ः- 2 उत्तर प्रदेश असाधारण गजट, 4 जनवरी, 2022

| ऐसे व्यक्तियों, जो चिकित्सा अधिकारी ग्रेड-2 (एल-2) के पद पर मौलिक रूप से नियुक्त हो और ं भर्ती वर्ष के प्रथम दिवस को इस रूप में 07 (सात) वर्ष की सेवा पूर्ण कर लिये हों, में से चयन समिति के माध्यम से पदोन्नति द्वारा। | ऐसे व्यक्तियो , जो चिकित्सा अधिकारी ग्रेड-2 ं (एल-2) के पद पर मौलिक रूप से नियुक्त हों और भर्ती वर्ष के प्रथम दिवस को इस रूप मे छः (6) वर्ष ं की सेवा पूर्ण कर लिये हों, में से चयन समिति के माध्यम से पदोन्नति द्वारा। | |
| ऐसे व्यक्तियो , जो परामर्शदाता (एल-3) के ं पद पर मौलिक रूप से नियुक्त हों और भर्ती वर्ष के प्रथम दिवस को इस रूप में 06 (छः) वर्ष की सेवा पूर्ण कर लिये हों, या क्रम संख्या-5 (1) (दो) एवं 5 (1) (तीन) में उल्लिखित पदों पर सभी को मिलाकर तेरह वर्ष की सेवा पूर्ण कर लिये हों, मे से चयन ं समिति के माध्यम से पदोन्नति द्वारा। | ऐसे व्यक्तियों, जो परामर्शदाता (एल-3) के पद पर मौलिक रूप से नियुक्त हों और भर्ती वर्ष के प्रथम दिवस को इस रूप में सात (7) वर्ष की सेवा पूर्ण कर लिये हों, या क्रम संख्या-5 (1) (दो) एवं 5 (1) (तीन) में उल्लिखित पदों पर सभी को मिलाकर तेरह (13) वर्ष की सेवा पूर्ण कर लिये हों, में से चयन समिति के माध्यम से पदोन्नति द्वारा। |
3-उक्त नियमावली के परिशिष्ट-2 में, नीचे स्तम्भ-1 में दिये गये विद्यमान खण्ड के परिशिष्ट-2 का संशोधन
क्रम संख्या 6 और 7 के स्थान पर स्तम्भ-2 में दिये गये खण्ड रख दिये जायेंगे, अर्थात्ः-

IN exercise of the powers conferred by the proviso to Article 309 of the Constitution, the Governor is pleased to make the following rules with a view to amending "The Uttar Pradesh Medical and Health Services Rules, 2020":-
THE UTTAR PRADESH MEDICAL AND HEALTH SERVICES (FIRST AMENDMENT) RULES, 2021
1. (1) These rules may be called "The Uttar Pradesh Medical and Health Short Title and Commencement Services (First Amendment) Rules, 2021."
Amendment of rule 5
(2) They shall come into force at once. 2. In "The Uttar Pradesh Medical and Health Services Rules, 2020", hereinafter referred to as said rules, in sub-rule (1) of the rule 5 for existing clause (iii) and (iv) set out in Column-1 below, the clause as set out in Column-2 shall be substituted, namely:-

3. In "Appendix-2" of the said rules, Sl. no. 6 and 7 of existing clause set out in Column-1 below, the clause as set out in Column-2 shall be substituted, namely:-
