अधिसूचना

संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करके राज्यपाल, उत्तर प्रदेश सरकारी सेवक (चिकित्सा परिचर्या) नियमावली, 2011 में संशोधन करने की दृष्टि से निम्नलिखित नियमावली बनाती हैं।

उत्तर प्रदेश सरकारी सेवक (चिकित्सा परिचर्या) (तृतीय संशोधन) नियमावली, 2021

1-(1) यह नियमावली उत्तर प्रदेश सरकारी सेवक (चिकित्सा परिचर्या) (तृतीय संशोधन) संक्षिप्त नाम और प्रारम्भ

नियमावली, 2021 कही जायेगी।

2-उत्तर प्रदेश सरकारी सेवक (चिकित्सा परिचर्या) नियमावली, 2021, जिसे आगे उक्त नियमावली कहा गया है, में, नियम 3 में, नीचे स्तम्भ-1 में दिये गये विद्यमान खण्ड ''झ'' और ''ञ'' के स्थान पर स्तम्भ-2 में दिया खण्ड रख दिया जायेगा, अर्थात्‌ :- स्तम्भ-1 स्तम्भ-2

विद्यमान खण्ड एतद्‌द्वारा प्रतिस्थापित खण्ड

झ-(एक) ''सरकारी चिकित्सालय'' का तात्पर्य राज्य सरकार अथवा केन्द्र सरकार द्वारा चलाये जा रहे या किसी सरकारी चिकित्सा महाविद्यालय से सहबद्ध चिकित्सालय से है।

झ-''सरकारी चिकित्सालय'' का तात्पर्य चिकित्सा विश्वविद्यालय/ चिकित्सा महाविद्यालय/ चिकित्सा संस्थान/स्वशासी सरकारी चिकित्सा महाविद्यालय और किसी सरकारी चिकित्सालय से सम्बद्ध किसी चिकित्सालय से है।

(दो) ''प्राधिकृत संविदाकृत चिकित्सालयों'' का तात्पर्य ऐसे निजी चिकित्सालयाें से है, जो कि राज्य सरकार द्वारा सी0जी0एच0एस0 योजना के अधीन अधिसूचित किये जांय; ञ-(1) ''स्वास्थ्य कार्ड'' का तात्पर्य लाभार्थी की पहचान की पुष्टि के लिये राज्य सरकार द्वारा जारी किये गये कार्ड से है, जो स्वास्थ्य पत्र से भिन्न हो।

ञ-(1) ''स्वास्थ्य कार्ड'' का तात्पर्य सरकारी कर्मचारियों/पेन्शनरों और उनके आश्रितों को बेनकदी चिकित्सा उपचार हेतु जारी किये गये कार्ड से है।

3-उक्त नियमावली में, नियम 3 में उपनियम (द) के पश्चात्‌ निम्नलिखित उपनियम नये उपनियम का बढ़ाया जाना (ध) बढ़ा दिया जायेगा, अर्थात्‌ :-

(ध) ''बेनकदी उपचार सुविधा'' का तात्पर्य चिकित्सा विश्वविद्यालय/चिकित्सा महाविद्यालय/चिकित्सा संस्थान/स्वशासी सरकारी चिकित्सा महाविद्यालय और किसी सरकारी चिकित्सालय से सम्बद्ध चिकित्सालयों में किसी वित्तीय सीमा के बिना सरकारी कर्मचारियों/पेन्शनरों और उनके आश्रितों के बेनकदी उपचार और आयुष्मान भारत प्रधानमंत्री जन आरोग्य योजना के अधीन पैनलकृत निजी चिकित्सालयों में उक्त योजना के अधीन परिभाषित वित्तीय सीमा तक बेनकदी उपचार से है।

4-उक्त नियमावली में, नीचे स्तम्भ-1 में दिये गये विद्यमान नियम 4 के स्थान पर नियम 4 का प्रतिस्थापन स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात्‌ :-

समस्त लाभार्थी किसी सरकारी चिकित्सालय या चिकित्सा महाविद्यालय या प्राधिकृत संविदाकृत चिकित्सालयों में निःशुल्क चिकित्सा परिचर्या और उपचार पाने के हकदार होंगे। सामान्यतः यह सुविधा लाभार्थी के निवास या तैनाती के स्थान पर उपलब्ध करायी जायेगी। चिकित्सा परिचर्या और उपचार के लिये पंजीकरण फीस और अन्य विहित फीस सरकार द्वारा पूर्णतया प्रतिपूरित की

जायेगी। आपात मामलों में यदि परिस्थितियों की अपेक्षा हो तो, एम्बुलेन्स भी निःशुल्क उपलब्ध करायी जायेगी।

5-उक्त नियमावली में, नीचे स्तम्भ-1 में दिये गये विद्यमान नियम 10 के स्थान पर नियम 10 का प्रतिस्थापन

स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात्‌ :-

संजय गांधी स्नातकोत्तर आयुर्विज्ञान संस्थान, लखनऊ, डा0 राम मनोहर लोहिया आयुर्विज्ञान संस्थान, गोमतीनगर लखनऊ, उत्तर प्रदेश आयुर्विज्ञान विश्वविद्यालय, सैफई, इटावा, किंग जार्ज चिकित्सा विश्वविद्यालय, लखनऊ और ऐसे अन्य समान सरकारी वित्त पोषित संस्थानों और किसी सरकारी चिकित्सालय से सम्बद्ध चिकित्सालयों में बेनकदी उपचार उपलब्ध कराया जायेगा।

जब तक लाभार्थियों को स्वास्थ्य कार्ड जारी नहीं किया जाता है तब तक चिकित्सा विश्वविद्यालय/चिकित्सा महाविद्यालय/ चिकित्सा संस्थान/स्वशासी सरकारी चिकित्सा महाविद्यालय और किसी सरकारी चिकित्सालय से सम्बद्ध चिकित्सालयों में अंतरंग उपचार के पश्चात्‌ चिकित्सा अधीक्षक द्वारा सत्यापित देयकों की पूर्ण प्रतिपूर्ति लाभार्थी के प्रशासकीय विभाग द्वारा की जायेगी। ऐसे देयकों का मुख्य चिकित्साधिकारी या किसी अन्य प्राधिकारी द्वारा तकनीकी रूप से परीक्षण किया जाना आवश्यक नहीं है :

संजय गांधी स्नातकोत्तर आयुर्विज्ञान संस्थान, लखनऊ, डा0 राम मनोहर लोहिया आयुर्विज्ञान संस्थान, गोमतीनगर लखनऊ, उत्तर प्रदेश आयुर्विज्ञान विश्वविद्यालय, सैफई, इटावा, के0जी0एम0यू0, लखनऊ और ऐसे अन्य समान सरकारी पोषित संस्थानों में उपचार प्राप्त करने पर यदि लाभार्थी उक्त संस्थानों के चिकित्सा अधीक्षकों द्वारा सम्यक्‌ रूप से हस्ताक्षरित/सत्यापित बीजकों की कुल धनराशि की 05 प्रतिशत धनराशि को वहन करने में सहमत हो तो ऐसी स्थिति में उपरोक्त बीजकों को शेष 95 प्रतिशत धनराशि का भुगतान सरकार द्वारा किया जायेगा और ऐसे बीजकों का मुख्य चिकित्साधिकारी या कोई अन्य प्राधिकृत अधिकारी द्वारा सत्यापित/ प्रति हस्ताक्षरित किये जाने से छूट प्रदान की जायेगी। यदि लाभार्थी बीजकों की 05 प्रतिशत धनराशि वहन करने में असहमत हो तो चिकित्सा एवं स्वास्थ्य विभाग के सक्षम प्राधिकारियों द्वारा बीजकों को सत्यापित और प्रति हस्ताक्षरित किये जाने के पश्चात्‌ ही उक्त संस्थानों के चिकित्सा बीजकों का भुगतान पूर्वत्तर नीति के अनुसार किया जायेगा।549 RPH-2022 Chikitsa data 4E 4 उत्तर प्रदेश असाधारण गजट, 5 जनवरी, 2022 स्तम्भ-1 स्तम्भ-2 विद्यमान खण्ड एतद्‌द्वारा प्रतिस्थापित खण्ड

परन्तु यह कि ऐसी औषधियां, जो खाद्य वस्तुओं, टानिक, टॉयलेटरीज आदि के रूप में उपयोग की जांय, देयकों में सम्मिलित नहीं की जायेंगी। लाभार्थी ऐसी व्ययों के लागत का वहन करेगा।

उपर्युक्त के अतिरिक्त प्राधिकृत संविदाकृत चिकित्सालयों में सन्दर्भ के साथ भुगतान के प्रति उपचार प्राप्त किया जा सकता है। विहित नियमावली के अधीन चिकित्सीय देख-रेख या उपचार पर उपगत व्यय हेतु दावा प्रस्तुत किये जाने पर पूर्ण रूप से प्रतिपूर्णीय होगा।

अन्तःरोगी को प्राधिकृत संविदाकृत चिकित्सालयों में असाध्य रोगों के सी0जी0एच0एस0 दर पर निःशुल्क चिकित्सा उपचार और आकस्मिक/ अप्रत्याशित रोगी के लिये निःशुल्क चिकित्सा उपचार उपलब्ध कराया जायेगा।

IN exercise of the power conferred by the proviso to Article 309 of the Constitution, the Governor is pleased to make the following rules with a view to amending the Uttar Pradesh Government Servants (Medical Attendance) Rules, 2011.

THE UTTAR PRADESH GOVERNMENT SERVANTS (MEDICAL ATTENDANCE) (THIRD AMENDMENT) RULES, 2021

Short title and

1. (1) These rules may be called the Uttar Pradesh Government Servants commencement

(2) They shall come into force at once.

On availing treatment in Sanjay Gandhi Post Graduate Institute of Medical Sciences, Lucknow, Dr. Ram Manohar Lohia Institute of Medical Sciences, Gomti Nagar, Lucknow, Uttar Pradesh Medical Sciences University, Saifai, Etawah, King George Medical University, Lucknow and such other similar Government financed Institutes, if the beneficiary agrees to bear five per cent amount of the total amount of the bills duly signed/verified by the Medical Superintendent of the said Institutes, then in such situation the remaining ninety five per cent amount of the aforesaid bills shall be paid by the State Government and such bills shall be exempted from being verified or countersigned by the Chief Medical Officer or any other authorized officer. If the beneficiary disagrees to bear the five per cent amount of the bills, the medical bills of the said institutes shall be paid in accordance with the earlier policy only after the bills are verified and countersigned by the competent authorities of the Medical and Health Department.

Provided that such medicines which are used as food items, tonics, toiletries etc. will not be included in the bills. The beneficiary will bear the cost of such expenses.

In addition to the above, the treatment can be obtained with reference against payment from the Authorized Contracted Hospitals. The expenses incurred on medical care or treatment under the prescribed rules will be fully reimbursable on submission of the claim.

Free medical treatment shall be made available for indoor patient at C.G.H.S. rate of incurable diseases and free medical treatment for contingent/unforeseen diseases in Authorized Contracted Hospitals.
