पुलिस अधिनियम, 1861 (अधिनियम सं0 5 सन्‌ 1861) की धारा 2 के साथ पठित धारा 46 की उपधारा (2) और संयुक्त प्रान्त प्रादेशिक आर्म्‌ड कांस्टेबुलरी अधिनियम, 1948 (उत्तर प्रदेश अधिनियम संख्या 40 सन्‌ 1948) की धारा 15 के अधीन शक्तियों का प्रयोग करके और उत्तर प्रदेश सिविल पुलिस/प्रादेशिक सशस्त्र कान्सटेबुलरी भर्ती और पदोन्नति प्रक्रिया नियमावली, 2011 तथा इस निमित्त कुशल खिलाड़ियों की भर्ती/बिना पारी की पदोन्नति के सम्बन्ध में जारी अन्य समस्त विद्यमान नियमों, आदेशों या अनुदेशों का उन बातों के सिवाय अधिक्रमण करके जो ऐसे अधिक्रमण से पूर्व किये गये हों या किये जाने हेतु लोपित हों, राज्यपाल उत्तर प्रदेश के कुशल खिलाड़ियों की उप निरीक्षक नागरिक पुलिस, प्लाटून कमाण्डर प्रादेशिक सशस्त्र कांस्टेबुलरी, आरक्षी नागरिक पुलिस, आरक्षी प्रादेशिक सशस्त्र कान्सटेबुलरी, आरक्षी घुड़सवार पुलिस एवं अन्य समकक्ष अराजपत्रित पदों की भर्ती, पुलिस निरीक्षक, नागरिक पुलिस, कम्पनी कमाण्डर, प्रादेशिक सशस्त्र कान्सटेबुलरी, निरीक्षक घुड़सवार पुलिस व अन्य551 RPH (Grih Police) Anu.-10-2022-data-4E 2 उत्तर प्रदेश असाधारण गजट, 6 जनवरी, 2022 समकक्ष पदों पर बिना पारी की पदोन्नति, प्रशिक्षण, वेतन, ज्येष्ठता निर्धारण तथा विनियमितीकरण का उपबंध करने हेतु निम्नलिखित नियमावली बनाती हैं :-

उत्तर प्रदेश पुलिस (कुशल खिलाड़ियों) की भर्ती एवं बिना पारी पदोन्नति नियमावली, 2021 भाग-एक 1-(1) यह नियमावली उत्तर प्रदेश पुलिस (कुशल खिलाड़ियों) की भर्ती एवं संक्षिप्त नाम और प्रारम्भ

बिना पारी पदोन्नति नियमावली, 2021 कही जायेगी। (2) यह गजट में प्रकाशित किये जाने के दिनांक से प्रवृत्त होगी। परिभाषाएं 2-जब तक विषय अथवा सन्दर्भ में कोई प्रतिकूल बात न हो, इस नियमावली में :- 'नियुक्ति प्राधिकारी' का तात्पर्य :- (1) निरीक्षक नागरिक पुलिस/कम्पनी कमाण्डर प्रादेशिक सशस्त्र कान्सटेबुलरी/निरीक्षक घुड़सवार पुलिस और उपनिरीक्षक नागरिक पुलिस/प्लाटून कमाण्डर, प्रादेशिक सशस्त्र कान्सटेबुलरी/उपनिरीक्षक घुड़सवार पुलिस के पद के सम्बन्ध में पुलिस उप महानिरीक्षक और,

(2) मुख्य आरक्षी, नागरिक पुलिस/प्रादेशिक सशस्त्र कान्सटेबुलरी/घुड़सवार पुलिस और आरक्षी नागरिक पुलिस/प्रादेशिक सशस्त्र कान्स्टेबुलरी/घुड़सवार पुलिस के सम्बन्ध में यथास्थिति वरिष्ठ पुलिस अधीक्षक/पुलिस अधीक्षक अथवा सेनानायक (प्रादेशिक सशस्त्र कांस्टेबुलरी), से है :-

(क) 'अखिल भारतीय पुलिस खेल प्रतियोगिता' का तात्पर्य ऐसी पुलिस खेल प्रतियोगिताओं से है, जो अखिल भारतीय पुलिस खेल नियंत्रण बोर्ड के संरक्षण में आयोजित किये जाते हैं;

(ख) 'बोर्ड' का तात्पर्य उत्तर प्रदेश पुलिस भर्ती एवं प्रोन्नति बोर्ड से है;

(ग) 'सरकार' का तात्पर्य उत्तर प्रदेश राज्य सरकार से है; '(घ) विभागाध्यक्ष' का तात्पर्य पुलिस महानिदेशक, उत्तर प्रदेश से है; (ङ) 'अन्तर्राष्ट्रीय प्रतियोगिता' का तात्पर्य अन्तर्राष्ट्रीय ओलम्पिक संघ एवं उससे सम्बद्धता प्राप्त खेल परिसंघों (ओलम्पिक खेल, विश्व चैम्पियनशिप, विश्व कप, कामनवेल्थ खेल, एशियाई खेल एवं एशियाई चैम्पियनशिप) द्वारा आयोजित अन्तर्राष्ट्रीय प्रतियोगिताओं से है;

(च) 'राष्ट्रीय चैंम्पियनशिप' का तात्पर्य भारतीय ओलम्पिक संघ एवं उससे सम्बद्धता प्राप्त खेल परिसंघों (राष्ट्रीय खेल, राष्ट्रीय चैम्पियनशिप, राष्ट्रीय अन्तर राज्यीय फेडरेशन कप, अखिल भारतीय पुलिस एवं अखिल भारतीय विश्वविद्यालय प्रतियोगिता) द्वारा आयोजित प्रतियोगिताओं से है;

(छ) 'चयन समिति' का तात्पर्य उत्तर प्रदेश पुलिस भर्ती एवं प्रोन्नति बोर्ड द्वारा गठित समिति से है;

(ज) 'सेवा' का तात्पर्य इस नियमावली के अधीन सीधी भर्ती द्वारा अथवा पदोन्नति के माध्यम से संवर्ग में किसी पद पर नियुक्त किसी व्यक्ति की सेवा से है;

(झ) 'कुशल खिलाड़ी' का तात्पर्य ऐसे महिला/पुरूष खिलाड़ियों से है जिन्होंने अन्तर्राष्ट्रीय ओलम्पिक परिसंघ और उसके सम्बद्धता प्राप्त खेल परिसंघों द्वारा आयोजित अन्तर्राष्ट्रीय प्रतियोगिताओं या भारतीय ओलम्पिक संघ और उसके सम्बद्धता प्राप्त खेल परिसंघों द्वारा आयोजित राष्ट्रीय प्रतियोगिताओं में भाग लिया हो अथवा पुलिस खेल नियंत्रण बोर्ड, नई दिल्ली के संरक्षण में आयोजित अखिल भारतीय पुलिस खेल प्रतियोगिताओं में सहभागिता किया हो;

() 'खेल उपलब्धि' का तात्पर्य किसी खिलाड़ी द्वारा सृजित मानकों अथवा

उसके द्वारा अर्जित पदकों से है;

(ट) 'मौलिक नियुक्ति' का तात्पर्य सेवा संवर्ग में किसी पद पर नियमानुसार और यदि नियमानुसार न हो तो सरकार द्वारा तत्‌समय विहित प्रक्रिया के अनुसार जारी कार्यकारी अनुदेशों के अनुसार तदर्थ नियुक्ति से भिन्न किसी नियुक्ति से है;

(ठ) 'टीम' का तात्पर्य खिलाड़ियों के ऐसे समूह से है, जिनकी संख्या राष्ट्रीय/अन्तर्राष्ट्रीय ओलम्पिक संघ/समिति द्वारा राष्ट्रीय/अन्तर्राष्ट्रीय खेलों के लिये नियत की जाती है;

(ड) 'उत्तर प्रदेश पुलिस खेल नियंत्रण बोर्ड' का तात्पर्य ऐसी ईकाई से है, जो उत्तर प्रदेश पुलिस के लिए विभिन्न खेल गतिविधियों को नियंत्रित और आयोजित करती है;

(ढ) 'भर्ती का वर्ष' का तात्पर्य किसी कैलेण्डर वर्ष की प्रथम जुलाई से प्रारम्भ

होने वाली बारह माह की अवधि से है। भाग-दो 3-(1) नियुक्ति के लिये वह पद, जिसके लिये किसी कुशल खिलाड़ी की भर्ती सेवा का संवर्ग

की गयी है, सेवा के संवर्ग में उसे उस पद के लिये नियुक्त किया गया समझा जायेगा।

(2) यदि किसी भर्ती/चयन वर्ष में उपयुक्त और अर्ह अभ्यर्थियों के उपलब्ध नहीं होने के कारण, अथवा किसी कारण से रिक्ति के सापेक्ष भर्ती की प्रक्रिया सम्पन्न होने के उपरान्त कतिपय रिक्तियां बिना भरी हुयी रह जाती हैं, तो ऐसी रिक्तियों को अगले तीन वर्षों के लिए अग्रेनीत किया जायेगा तथा यदि तीन वर्षों के उपरान्त भी ऐसी रिक्तियॉं बिना भरी हुयी रह जाती हैं तो उन्हें सीधी भर्ती प्रक्रिया के माध्यम से भरा जा सकता है।

भाग-तीन

भर्ती का स्रोत

4-उप निरीक्षक नागरिक पुलिस, प्लाटून कमाण्डर प्रादेशिक सशस्त्र कान्सटेबुलरी, और आरक्षी नागरिक पुलिस, आरक्षी प्रादेशिक सशस्त्र कान्सटेबुलरी, आरक्षी घुड़सवार पुलिस एवं समकक्ष अराजपत्रित पदों में से 02 प्रतिशत रिक्तियाँ, जिनके लिये सीधी भर्ती अनुध्यात की गयी हो, सीधी भर्ती द्वारा कुशल खिलाड़ियों में से भरी जायेंगी :

परन्तु यह कि इस नियमावली के अधीन विभाग में नियुक्त कोई कर्मचारी, जो कुशल खिलाड़ी हो, सीधी भर्ती के माध्यम से चयनित किया गया हो तो उसे यद्यपि सीधी भर्ती का अभ्यर्थी माना जायेगा, फिर भी उसे भी पदोन्नति के क्रम में इस नियमावली का लाभ अनुमन्य होगा ।

आरक्षण

5-(1) कुशल खिलाड़ियों के लिये सम्बन्धित सेवा संवर्ग में चयन हेतु उस वर्ष की रिक्तियों में से 2 प्रतिशत रिक्त पदों को अलग करके भरा जायेगा। उत्तर प्रदेश लोक सेवा (शारीरिक रूप से विकलांग स्वतन्त्रता संग्राम सेनानियों के आश्रितों और भूतपूर्व सैनिकों के लिए आरक्षण) अधिनियम, 1993 (अधिनियम संख्या 40, सन्‌ 1993) की धारा 3 की उप धारा (3) के अनुसार यदि ऐसे भर्ती किये गये कुशल खिलाड़ी अनुसूचित जातियों/अनुसूचित जनजातियों या अन्य पिछड़े वर्गों के व्यक्ति हों तो ऐसे अभ्यर्थियों को नियमानुसार उक्त आरक्षित श्रेणी के लिये आरक्षित प्रतिशत के अधीन समायोजित किया गया माना जायेगा। यही व्यवस्था सामान्य श्रेणी के चयनित अभ्यर्थियों के लिए होगी।

(2) अधियाचित वर्ष के दौरान होने वाली रिक्तियों के सापेक्ष सभी कोटा पूर्ण किये

जायेंगे।

(3) शारीरिक रूप से विकलांग (अक्षम) व्यक्ति पुलिस सेवाआें के लिये पात्र नहीं होंगे।551 RPH (Grih Police) Anu.-10-2022-data-4E 4 उत्तर प्रदेश असाधारण गजट, 6 जनवरी, 2022 भाग-चार राष्ट्रीयता 6-सेवा में किसी पद पर सीघी भर्ती के लिये अभ्यर्थी के लिये भारत का नागरिक होना आवश्यक है। शैक्षिक अर्हताएं 7-(1) (क) उप निरीक्षक नागरिक पुलिस/प्लाटून कमाण्डर, प्रादेशिक सशस्त्र कांस्टेबुलरी के पद पर भर्ती के लिये किसी अभ्यर्थी/खिलाड़ी के पास भारत में विधि द्वारा स्थापित किसी विश्वविद्यालय से स्नातक उपाधि या सरकार द्वारा मान्यता प्राप्त उसके समकक्ष अर्हता होनी चाहिये।

(ख) आरक्षी, नागरिक पुलिस/प्रादेशिक सशस्त्र कांस्टेबुलरी/घुड़सवार पुलिस के पद पर भर्ती के लिये किसी अभ्यर्थी/खिलाड़ी के पास भारत में विधि द्वारा स्थापित बोर्ड द्वारा बारहवीं कक्षा उत्तीर्ण होना चाहिये या सरकार द्वारा मान्यता प्राप्त उसके समकक्ष अर्हता होनी चाहिये। (2) यदि किसी अभ्यर्थी/खिलाड़ी को उत्—ष्ट खेल उपलब्धि के आधार पर भर्ती किया जाता है, किन्तु वह सम्बन्धित पद हेतु निर्धारित न्यूनतम शैक्षिक अर्हता पूर्ण नहीं करता है तो ऐसी स्थिति में उसे इस शर्त के साथ भर्ती किया जा सकता है कि वह भर्ती/नियुक्ति के दिनांक से 05 वर्षों में न्यूनतम शैक्षिक अर्हता पूर्ण कर लेगा। इस अवधि में उसकी नियुक्ति परिवीक्षाधीन मानी जायेगी :

परन्तु यह कि उक्त अवधि में न्यूनतम शैक्षिक अर्हता पूर्ण न कर पाने की स्थिति में उसे सेवामुक्त (Discharge) कर दिया जायेगा। कुशल खिलाडियों की भर्ती हेतु अर्हताएं 8 (1) कोई खिलाड़ी, जो अन्तर्राष्ट्रीय/राष्ट्रीय स्तर पर, अन्तर्राष्ट्रीय/भारतीय ओलम्पिक संघ एवं उससे सम्बद्धता प्राप्त खेल परिसंघों द्वारा आयोजित सीनियर अथवा जूनियर प्रतियोगिताओं अथवा अखिल भारतीय पुलिस खेल नियंत्रण बोर्ड के संरक्षण में आयोजित अखिल भारतीय पुलिस खेल प्रतियोगिताओं अथवा अखिल भारतीय विश्वविद्यालय संघ द्वारा मान्यता प्राप्त अखिल भारतीयविश्वविद्यालय प्रतियोगिताओं,जिनकी मुख्य खेल विधाओं का विवरण निम्नवत्‌ है, में विज्ञापित भर्ती वर्ष के विगत 02 वर्षों मे पदक अर्जित किया हो या प्रतिभाग किया हो, को कुशल खिलाड़ी के रूप में भर्ती किया जायेगा :-

ऊपर उल्लिखित खेल विधाओं के अतिरिक्त अखिल भारतीय पुलिस खेल नियंत्रण बोर्ड द्वारा जो विधाएं सम्मिलित की जायेंगी अथवा हटायी जायेंगी, वे इस नियमावली के अधीन समायोजित मानी जायेंगी। उनके लिये उत्तर प्रदेश शासन द्वारा पृथक से कोई आदेश जारी नहीं किया जायेगा।

(2) विभिन्न खेल स्पर्धाओं का श्रेणीवार वर्गीकरण निम्नवत्‌ है :-

श्रेणी-क 1-ओलम्पिक गेम्स,

2-विश्व चैंम्पियनशिप,

3-विश्व कप

श्रेणी-ख 1-एशियाई खेल

2-कामनवेल्थ खेल (सीनियर)

3-कामनवेल्थ चैंम्पियनशिप (सीनियर)

4-एशियाई चैंम्पियनशिप (सीनियर)

श्रेणी-ग 1-यूथ ओलम्पिक खेल

2-एशियाई चैंम्म्पियनशिप (जूनियर/सीनियर, अण्डर-21)

3-कामनवेल्थ युवा खेल

4-दक्षिण एशियाई खेल

5-विश्व विश्वविद्यालय खेल/चैंम्पियनशिप

6-ओलम्पिक संघ से सम्बद्धता प्राप्त अन्य अन्तर्राष्ट्रीय खेल प्रतियोगिता

श्रेणी-घ 1-नेशनल खेल

2-नेशनल चैंम्पियनशिप (जूनियर/सीनियर)

3-फेडरेशन कप नेशनल (जूनियर/सीनियर)

4-अखिल भारतीय अन्तर राज्यीय चैंम्पियनशिप (सीनियर)

5- अखिल भारतीय अन्तर विश्वविद्यालय टूर्नामेंट

6-विश्व स्कूल खेल (अण्डर-19)

7-राष्ट्रीय विद्यालय खेल (अण्डर-19)

8-अखिल भारतीय पुलिस खेल प्रतियोगिता

(3) खिलाड़ी-कोई खिलाडी, जो रिक्तियों के विज्ञापन के दिनांक को निम्नलिखित

अर्हताएं धारित करता है, निम्नलिखित पदों पर भर्ती के लिये पात्र होगा :-

आरक्षी उपरोक्त श्रेणी-घ के अधीन किसी खेल स्पर्धा में प्रतिभाग

किया हो।

उपनिरीक्षक उपरोक्त श्रेणी-घ के अधीन सीनियर स्तर की राष्ट्रीय प्रतियोगिता में किसी व्यक्तिगत/टीम स्पर्धा में कोई भी पदक अर्जित किया हो अथवा श्रेणी-घ के अधीन किसी अन्य प्रतियोगिता में स्वर्ण पदक अर्जित किया हो, अथवा श्रेणी-ग के अधीन किसी व्यक्तिगत खेल स्पर्धा में पदक प्राप्त किया हो अथवा टीम स्पर्धा में प्रतिभाग किया हो, अथवा श्रेणी-ख के अधीन किसी खेल स्पर्धा में प्रतिभाग किया हो।551 RPH (Grih Police) Anu.-10-2022-data-4E 6 उत्तर प्रदेश असाधारण गजट, 6 जनवरी, 2022 (4) उप निरीक्षक के पद पर सीधी भर्ती हेतु ऐसे अभ्यर्थी (अनुदेशक) पात्र होंगे जिन्होंनेः-

(क) नियम 9 के उप नियम (1) में उल्लिखित किसी खेल स्पर्धा में (एलएनआईपी ग्वालियर अथवा नेताजी सुभाष राष्ट्रीय क्रीड़ा संस्थान पटियाला से) एन0आई0एस0 डिप्लोमा प्राप्त किया हो; या

(ख) नियम 9 के उप नियम (2) में उल्लिखित श्रेणी ग अथवा श्रेणी घ के किसी खेल स्पर्धा में (टीम/व्यक्तिगत) पदक जीता हो; और

(ग) कम से कम 03 वर्ष का प्रशिक्षण देने का अनुभव प्राप्त हो।

आयु 9-(1) सीधी भर्ती के लिये किसी अभ्यर्थी को जिसमें रिक्तियाँ विज्ञापित की जाती हैं, नीचे दी गयी सारणी में पद के सम्बन्ध में विनिर्दिष्ट न्यूनतम आयु अवश्य पूरी करनी चाहिए एवं अधिकतम आयु से अधिक आयु नहीं होनी चाहिएः-

(2) कुशल खिलाड़ियों को प्रोत्साहित करने के लिये विशेष परिस्थितियों में पुलिस महानिदेशक, उत्तर प्रदेश द्वारा आरक्षी पद हेतु न्यूनतम आयु सीमा में 02 वर्ष तथा अधिकतम आयु सीमा में 05 वर्ष की छूट तथा उप निरीक्षक पद हेतु न्यूनतम एवं अधिकतम आयु सीमा में 05 वर्ष की छूट और अनुदेशक (कोच) के लिये अधिकतम आयु सीमा में 05 वर्ष की छूट प्रदान की जायेगी।

(3) न्यूनतम आयु सीमा में छूट प्राप्त कर भर्ती हुए खिलाड़ी को ''खेल प्रशिक्षणार्थी'' के पद पर रखा जायेगा तथा उसे निर्धारित मूल वेतन की धनराशि का 80 प्रतिशत मानदेय प्रतिमाह अनुमन्य होगा। शासकीय सेवा की विहित न्यूनतम आयु पूर्ण कर लेने पर उसे शासकीय सेवा में लिया जा सकता है।

चरित्र

10-(1) सीधी भर्ती के लिये अभ्यर्थी/खिलाड़ी का चरित्र ऐसा होना चाहिए कि वह सरकारी सेवा में सेवायोजन के लिये सभी प्रकार से उपयुक्त हो। नियुक्ति प्राधिकारी इस बिन्दु पर स्वयं का समाधान कर लेगा।

परन्तु यह कि संघ सरकार या किसी राज्य सरकार या किसी स्थानीय प्राधिकरण द्वारा संघ सरकार या किसी राज्य सरकार द्वारा सशस्त्र अथवा नियंत्रित किसी निगम या निकाय द्वारा पदच्युत व्यक्ति सेवा में किसी पद पर नियुक्ति के लिये पात्र नैतिक अधमता, अधमता से सम्बन्धित किसी अपराध के लिये दोषसिद्ध व्यक्ति भी अपात्र होगा।

11-ऐसा कोई पुरूष/महिला खिलाड़ीः-

(क) जिसने किसी ऐसी महिला/पुरूष से विवाह किया है या संविदा किया है, वैवाहिक प्रास्थिति

जिसके पूर्व से ही एक पति/पत्नी हो; या

(ख) जिसकी पति/पत्नी जीवित होते हुए उसने किसी ऐसी महिला/पुरूष से विवाह किया हो या संविदा किया हो उक्त सेवा में नियुक्ति हेतु पात्र नहीं होगा/होगी :

परन्तु राज्य सरकार का यदि इस बात का समाधान हो जाय कि विवाह हेतु ऐसे व्यक्ति और अन्य पक्ष के लिये लागू पर्सनल लॉ के अधीन ऐसा विवाह अनुज्ञेय है, ऐसा करने के अन्य आधार हैं तो वह ऐसे किसी व्यक्ति को इस नियम के प्रर्वतन से छूट दे सकती है। शारीरिक स्वस्थता

12-कोई खिलाड़ी जो राष्ट्रीय अथवा अन्तर्राष्ट्रीय खेलों में नियमित रूप से प्रतिभाग कर रहा है सामान्य व्यक्ति की तुलना मे शारीरिक एवं मानसिक रूप से अधिक स्वस्थ एवं उपयुक्त रहता है। अतः कुशल खिलाड़ी के रूप में भर्ती किये जाने वाले अभ्यर्थियों का स्वास्थ्य परीक्षण सामान्य प्रक्रिया के अन्तर्गत किसी असाध्य रोग की जांच मात्र के लिये की जायेगी। उपचार योग्य रोग एवं ऐसी शारीरिक विषमता जिसका इसके खेल पर कोई प्रतिकूल प्रभाव नहीं पड़ता हो, के आधार पर कुशल खिलाड़ी कोटे के अन्तर्गत किसी चयनित अभ्यर्थी को अनुपयुक्त/अनर्ह घोषित नहीं किया जायेगा।551 RPH (Grih Police) Anu.-10-2022-data-4E उत्तर प्रदेश असाधारण गजट, 6 जनवरी, 2022 7

भाग-पाँच

रिक्तियों का अवधारण 13-(1) क्रमशः पदों से सम्बन्धित नियमावली के अधीन भर्ती वर्ष में भरी जाने वाली रिक्तियों का वर्ष के दौरान अवधारण, नियुक्ति प्राधिकारी करेगा और वह विभागाध्यक्ष को सूचित करेगा। कुल 02 प्रतिशत रिक्तियां उन कुशल खिलाडियों द्वारा अलग से भरी जायेंगी, जो रिक्तियों के विज्ञापन के दिनांक को सभी अपेक्षायें पूरी करते हों। रिक्तियों की संख्या की गणना पूर्णांक में की जायेगी और 1 से नीचे दशमलव की गणना नहीं की जायेगी।

(2) उप नियम (2) के अधीन संख्यांकित रिक्तियों के सम्बन्ध में विभागाध्यक्ष राज्य

सरकार को सूचित करेगा और अग्रेत्तर कार्यवाही के लिये बोर्ड को भी अधिसूचित करेगा।

(3) यदि किसी दिये गये वर्ष में कोई उपयुक्त और अर्ह अभ्यर्थी भर्ती के लिये उपलब्ध नहीं होता है अथवा यदि रिक्ति के सापेक्ष भर्ती की कार्यवाही किये जाने के उपरान्त रिक्ति शेष रह जाती है तो यह शेष रिक्ति अग्रतर तीन वर्ष के लिये अग्रेनीत की जायेगी तथा तीन वर्षो के उपरान्त ऐसी शेष रिक्तियाँ सामान्य भर्ती प्रक्रिया के माध्यम से भरी जा सकती हैं।

(4) कुशल खिलाड़ियों एवं कोच (प्रशिक्षक) को भर्ती करने हेतु उपलब्ध रिक्तियाँ/पदों की संख्या की सूचना उत्तर प्रदेश पुलिस खेल नियंत्रण बोर्ड द्वारा पुलिस महानिदेशक उत्तर प्रदेश को प्रेषित की जायेंगी एवं साथ ही विभिन्न खेल स्पर्धाओं में पदों की संख्या निश्चित करके उसका अनुमोदन पुलिस महानिदेशक उत्तर प्रदेश से प्राप्त किया जायेगा। पुलिस महानिदेशक उत्तर प्रदेश द्वारा तदोपरान्त कुशल खिलाडियों एवं कोच (प्रशिक्षक) की भर्ती के लिए विभिन्न खेल स्पर्धाओं के लिए विनिश्चित रिक्तियों का अधियाचन उत्तर प्रदेश पुलिस भर्ती एवं प्रोन्नति बोर्ड को उपलब्ध कराया जायेगा। भर्ती एवं प्रोन्नति बोर्ड द्वारा प्राप्त अधियाचन का परीक्षण करने के उपरान्त विज्ञापन के माध्यम से भरी जाने वाली रिक्तियों के सम्बन्ध में निम्नलिखित रीति से अधिसूचित किया जायेगाः-

(क) व्यापक प्रसार वाले दैनिक हिन्दी एवं अंग्रेजी समाचार-पत्रों में विज्ञापन

जारी करके;

(ख) कार्यालय के सूचना पट्ट पर नोटिस चस्पा करके या रेडियो/दूरदर्शन

और अन्य रोजगार समाचार-पत्रों के माध्यम से विज्ञापन द्वारा;

(ग) रोजगार कार्यालय को रिक्तियों को अधिसूचित करके; और (घ) जनसंचार के अन्य माध्यमों द्वारा;

(5) बोर्ड की अधिसूचना की प्रति उत्तर प्रदेश खेल नियंत्रण बोर्ड, लखनऊ को प्रेषित की जायेगी, जिसके द्वारा सभी खेल फेडरेशन/एसोसिएशन आदि से भी खिलाड़ियों के मध्य उक्त भर्ती के सम्बन्ध में व्यापक प्रचार-प्रसार हेतु अनुरोध किया जायेगा।

(6) विभिन्न खेल स्पर्धाओं के लिये अधिसूचित रिक्तियों के सापेक्ष यदि अपेक्षानुसार अधिक अथवा कम अभ्यर्थियों द्वारा आवेदन किया जाता है तो रिक्तियों की संख्या परस्पर घटायी अथवा बढ़ायी जा सकती हैं। इसके लिये बोर्ड की संस्तुति पर पुलिस महानिदेशक, उत्तर प्रदेश द्वारा अनुमोदन प्रदान किया जायेगा। सीधी भर्ती की प्रक्रिया विज्ञप्ति के माध्यम से अधिसूचित रिक्तियों के सापेक्ष भर्ती हेतु अभ्यर्थी केवल एक आवेदन-पत्र भर सकता है। भर्ती बोर्ड केवल आन लाईन आवेदन-पत्र स्वीकार करेगा। एक से अधिक आवेदन भरने वाले अभ्यर्थी का आवेदन पत्र बोर्ड द्वारा निरस्त कर दिया जायेगा। अभ्यर्थी द्वारा जिस पद के लिये आवेदन किया जा रहा हो उस पद की अर्हताओं से सम्बन्धित प्रमाण-पत्र आनलाइन आवेदन पत्र के साथ अपलोड किया जायेगा। भर्ती बोर्ड विभागाध्यक्ष से विचार-विमर्श कर किसी भर्ती के लिए आवेदन शुल्क नियत करेगा। आवेदन-पत्र भरने एवं बुलावा-पत्र जारी करने के सम्बन्ध में विस्तृत प्रक्रिया बोर्ड द्वारा निर्धारित की जायेगी और इसे अपनी वेबसाइट पर प्रदर्शित की जायेगी।551 RPH (Grih Police) Anu.-10-2022-data-4E 8 उत्तर प्रदेश असाधारण गजट, 6 जनवरी, 2022 सरकार किसी भी समय किसी भर्ती के लिए रिक्तियों की संख्या परिवर्तित कर सकती है और किसी भर्ती को किसी भी समय या भर्ती को किसी स्तर पर बिना कोई कारण बताये निरस्त कर सकती है। बोर्ड में प्राप्त सभी आवेदन पत्रों एवं उनके संलग्नकों अर्थात्‌ प्रमाण पत्रों की विस्तृत संवीक्षा की जायेगी। यदि आवेदन पत्र में उल्लिखित अभिलेखों की कोई प्रमाणित प्रतियाँ आवेदन के साथ संलग्नक नहीं हैं तब ऐसे अपूर्ण अथवा अशुद्ध आवेदन पत्र बोर्ड द्वारा निरस्त किये जा सकते हैं। उन अभ्यर्थियों/खिलाड़ियों को, जिनके आवेदन पत्र संवीक्षा के उपरान्त शुद्ध पाये गये हों, को मूल शैक्षणिक/खेल प्रमाण-पत्रों से अभिलेखों की संवीक्षा हेतु बुलावा पत्र जारी किये जायेंगे और यह अपेक्षा की जायेगी कि वे चयन समिति के समक्ष विनिर्दिष्ट दिनांक/समय और स्थान पर उपस्थित होकर अपनी आयु, शिक्षा और खेल उपलब्धियों से सम्बन्धित सभी आवश्यक अभिलेख मूलरूप में प्रस्तुत करें जिससे कि आवेदन पत्र में अंकित प्रविष्टियों/संलग्न अभिलेखों का सत्यापन किया जा सके। विभिन्न खेल स्पर्धाओं में कुशल खिलाड़ियों के प्रदर्शन के आधार पर सीधी भर्ती हेतु अभ्यर्थी/खिलाड़ी, किसी भी शारीरिक परीक्षण (ऊॅँचाई/सीने की माप/वजन) से मुक्त होगा। विज्ञप्ति के माध्यम से कुशल खिलाडियों के चयन के लिए परीक्षण समिति, बोर्ड द्वारा निम्नानुसार गठित की जायेंगीः- (एक) पुलिस महानिरीक्षक/उप महानिरीक्षक अध्यक्ष (दो) वरिष्ठ पुलिस अधीक्षक/पुलिस अधीक्षक सदस्य (तीन) प्रादेशिक क्रीड़ाधिकारी(पुलिस) सदस्य (चार) खेल निदेशालय द्वारा नाम निर्दिष्ट खेल विशेषज्ञ सदस्य परीक्षण समिति में कुशल खिलाड़ियों के परीक्षण के लिये उत्तर प्रदेश पुलिस भर्ती एवं प्रोन्नति बोर्ड द्वारा चार सदस्यीय (जिन्हें खेलों का अनुभव हो) निम्नवत समिति गठित की जायेगीः-

(एक) वरिष्ठ पुलिस अधीक्षक/पुलिस अधीक्षक अध्यक्ष (दो) अपर पुलिस अधीक्षक/पुलिस उपाधीक्षक सदस्य (तीन) प्रादेशिक क्रीड़ाधिकारी (पुलिस) सदस्य (चार) अन्तर्राष्ट्रीय खिलाड़ी (खेल विशेषज्ञ) सदस्य (पांच) प्रशिक्षक (राष्ट्रीय खिलाड़ी/एन0आई0एस0) सदस्य परीक्षण समिति खेलों की विभिन्न खेल विधाओं के लिए अन्तर्राष्ट्रीय ख्याति प्राप्त खिलाड़ियों का विशेषज्ञ के रूप में सहयोग ले सकेगी। परीक्षण समिति के सभी सदस्यों की उपस्थिति में ही खिलाड़ियों का परीक्षण किया जायेगा। उत्तर प्रदेश पुलिस खेलों के लिए उपयुक्तता के सम्बन्ध में परीक्षण समिति संस्तुति करेगी, परीक्षण समिति अधिकतम-80 अंक प्रदान करेगी, जो निम्नलिखित मानदण्ड के अनुसार होगा। परीक्षण समिति के प्रत्येक सदस्य द्वारा पृथक-पृथक निर्धारित प्रारूप पर अभ्यर्थी को अंक प्रदान किया जायेगा और ट्रायल रिपोर्ट में कुल प्राप्तांक लिखा जायेगा। प्रत्येक अभ्यर्थी के मार्क शीट पर उसका हस्ताक्षर होगा, जिसको ट्रायल रिपोर्ट के साथ संलग्न की जायेगी। परीक्षण समिति निम्नवत्‌ मानक के अनुसार अंकों को प्रदान करेगीः- उपयुक्त 50 अंक अथवा अधिक अनुपयुक्त 50 अंक से कम परीक्षण में उपयुक्त पाये गये अभ्यर्थियों को अगले चरण के लिए भेजा जायेगा। उपयुक्त पाये गये अभ्यर्थियों के चयन का विनिश्चय चयन समिति की प्रक्रियानुसार किया जायेगा। अगला चरण 20 अंकों का होगा, जो अभ्यर्थियों की खेल उपलब्धियों पर आधारित होंगे। अभ्यर्थी को चयन समिति द्वारा अनुपयुक्त घोषित किये जाने के उपरान्त दोबारा चयन प्रक्रिया में शामिल नहीं किया जायेगा।551 RPH (Grih Police) Anu.-10-2022-data-4E उत्तर प्रदेश असाधारण गजट, 6 जनवरी, 2022 9 अन्तिम चयन सूची बनाने के लिए परीक्षण में उपयुक्त पाये गये अभ्यर्थियों को चयन समिति एवं परीक्षण समिति द्वारा दिये गये अंकों का योग किया जायेगा तथा चयन के सम्बन्ध में संस्तुति की जायेगी। संस्तुति पर चयन समिति के सभी सदस्यों के हस्ताक्षर होंगे। अंकों का विभाजन-परीक्षण समिति द्वारा लिया जाने वाला परीक्षण तथा चयन समिति द्वारा परीक्षण के समय दिये जाने वाले अंकों का मानक का विवरण निम्नवत्‌ होगाः-

(1) खेल कौशल परीक्षण 80 अंक (2) खेल प्रमाण पत्रों का मूल्यांकन 20 अंक चयन समिति में अनुसूचित जातियों, अनुसूचित जन जातियों तथा नागरिकों के अन्य पिछड़े वर्गों के अधिकारियों को प्रतिनिधित्व देने के लिये समय-समय पर यथासंशोधित उत्तर प्रदेश लोक सेवा (अनुसूचित जातियों, अनुसूचित जन जातियों और अन्य पिछड़े वर्गों के लिये आरक्षण) अधिनियम, 1994 की धारा 7 के अधीन किये गये आदेशानुसार नामांकन किया जायेगा। नियुक्ति के लिये विभागाध्यक्ष को संस्तुति भेजने से पूर्व बोर्ड द्वारा चयनित अभ्यर्थियों/खिलाड़ियों के खेल प्रमाण-पत्रों का सत्यापन सम्बन्धित खेल फेडरेशन/एसोशिएसन से कराया जायेगा। किसी अभ्यर्थी द्वारा प्रस्तुत खेल प्रमाण-पत्र त्रुटिपूर्ण एवं कूटरचित/फर्जी पाये जाने की स्थिति में उसका अभ्यर्थन तत्काल निरस्त कर दिया जायेगा। :- बोर्ड रिक्तियों के सापेक्ष अभ्यर्थियों की ज्येष्ठता क्रम के अनुसार खेल प्रतियोगिताओं से सम्बन्धित परीक्षण में सफल पाये गये अभ्यर्थियों की चयन सूची तैयार करेगा और इसे संस्तुति के साथ चरित्र सत्यापन के अधीन विभागाध्यक्ष को प्रेषित करेगा। बोर्ड द्वारा कोई प्रतीक्षा सूची तैयार नहीं की जायेगी। विभागाध्यक्ष बोर्ड द्वारा प्रेषित सूची को अनुमोदन के पश्चात्‌ अग्रतर कार्यवाही हेतु नियुक्ति प्राधिकारी को अग्रसारित करेगा।

(क) अभ्यर्थी/खिलाड़ी, जो चयन सूची में हों, से नियुक्ति प्राधिकारी द्वारा चिकित्सीय परीक्षण में उपस्थित होने की अपेक्षा की जायेगी। चिकित्सीय परीक्षण हेतु, सम्बन्धित जिला के मुख्य चिकित्सा अधिकारी द्वारा एक चिकित्सा परिषद गठित की जायेगी जिसमें तीन चिकित्सक रखें जायेंगे, जो महानिदेशक, चिकित्सा और पुलिस भर्ती चिकित्सीय परीक्षण बोर्ड द्वारा विहित प्रक्रिया के अनुसार अभ्यर्थियों का चिकित्सीय परीक्षण करेंगे। चयनित अभ्यर्थी/खिलाड़ी साध्य रोग और ऐसे जटिल शारीरिक असमानता, जिससे संबंधित खेल के खिलाड़ी के प्रदर्शन पर प्रतिकूल प्रभाव न पड़े, के आधार पर चिकित्सा परिषद द्वारा अनुपयुक्त/अनर्ह घोषित नहीं किये जायेंगे। असाध्य रोगों और ऐसे शारीरिक असमानताओं, जिनसे खिलाड़ी के खेल प्रदर्शन पर प्रतिकूल प्रभाव पड़ता हो, उक्त चिकित्सीय परीक्षण में अनुपयुक्त/अनर्ह घोषित किये जायेंगे।

(ख) यदि कोई अभ्यर्थी/खिलाड़ी, जो अपने चिकित्सीय परीक्षण से असंतुष्ट हो और अपील करना चाहता हो, तो उसे मण्डलीय चिकित्सा परिषद के समक्ष अपील करने के लिये चिकित्सा परिषद द्वारा विहित प्रपत्र उपलब्ध कराया जायेगा और असंतुष्ट अभ्यर्थी/खिलाड़ी इसके पश्चात्‌ उपरोक्त विहित प्रपत्र में तत्काल या परीक्षा दिवस पर आवेदन करेगा। अपील अगले दिवस प्रस्तुत की जा सकती है। अपील प्रस्तुत किये जाने के एक माह के भीतर प्रस्तुत की गयी अपील पर मण्डली चिकित्सा परिषद द्वारा पूर्ण रूप से केवल उस स्थिति में विचार किया जायेगा कि अभ्यर्थी/खिलाड़ी के चिकित्सीय परीक्षण में जिला चिकित्सा परिषद द्वारा कृत विनिश्चय में कोई त्रुटि हुई है। गठित मण्डलीय चिकित्सा परिषद में सम्बन्धित त्रुटि का एक विशेषज्ञ होना आवश्यक होगा।

(ग) चिकित्सीय परीक्षण संचालित किये जाने सम्बन्धी विस्तृत अनुदेश पुलिस महानिदेशक द्वारा जारी किये जायेंगे। चिकित्सीय परीक्षण में असफल पाये गये अभ्यर्थी/खिलाड़ी नियुक्ति प्राधिकारी द्वारा अनुपयुक्त घोषित किये जायेंगे और ऐसी रिक्तियां अग्रतर चयन हेतु अग्रेनीत कर दी जायेंगी।

चरित्र सत्यापन नियुक्ति पत्र जारी किये जाने से पूर्व, नियुक्ति प्राधिकारी के पर्यवेक्षण के अधीन, अभ्यर्थियों को प्रशिक्षण पर भेजे जाने के पूर्व चरित्र सत्यापन पूर्ण कराया जायेगा। सामान्यतः चरित्र सत्यापन एक माह के भीतर पूर्ण कर लिया जायेगा। किसी अभ्यर्थी के चरित्र सत्यापन के दौरान कोई प्रतिकूल तथ्य पाये जाने के मामले में, उसे नियुक्ति प्राधिकारी द्वारा अनुपयुक्त घोषित कर दिया जायेगा और ऐसी रिक्तियां अग्रतर चयन के लिये अग्रेनीत कर दी जायेंगी।551 RPH (Grih Police) Anu.-10-2022-data-4E 10 उत्तर प्रदेश असाधारण गजट, 6 जनवरी, 2022 पदोन्नति हेतु पात्रता

16 (1) ऐसे कुशल खिलाड़ियों, जो इस नियमावली में विहित अर्हताएं धारित करते हों और जो खेलों में अपने सर्वोत्तम प्रदर्शन के आधार पर क्रमशः प्रत्येक संवर्ग/पद के लिये सेवा नियमावली में विहित अर्हताओं के आधार पर बिना पारी के पदोन्नति के लिये अर्ह हैं, को मुख्य आरक्षी नागरिक पुलिस/प्रादेशिक सशस्त्र कान्सटेबुलरी/घुड़सवार पुलिस और उप निरीक्षक नागरिक पुलिस/प्लाटून कमाण्डर प्रादेशिक सशस्त्र कान्सटेबुलरी/निरीक्षक घुड़सवार पुलिस अथवा समकक्ष पदों पर पदोन्नत किया जा सकता है।

(2) उत्कृष्ट खेल प्रदर्शन के आधार पर बिना पारी के पदोन्नति प्रदान करते हुए, प्रतिकूल प्रविष्टि/शास्ति, सत्यनिष्ठा प्रमाण-पत्र आदि के सम्बन्ध में अग्रतर कार्यवाही सरकारी आदेश संख्या 761/कार्मिक-1/1993, दिनांक 30-06-1993 के उपबंधों के अनुसार किया जायेगा और विभागीय या दाण्डिक प्रक्रियाओं और निलम्बन आदि के मामले में अग्रतर कार्यवाही सरकारी आदेश संख्या 13/21/89/का-1-1977, दिनांक 28-05-1997 के उपबंधों के अनुसार की जायेगी।

(3) सम्बन्धित खेल स्पर्धा में पदक अर्जित करने के समय प्रभावी नियमावली के अधीन पदोन्नति का लाभ दिया जायेगा।

पदोन्नति के लिये रिक्ति का निर्धारण

17-इस नियमावली के अनुसार, बिना पारी के पदोन्नति हेतु अर्ह अभ्यर्थी के चयन के पश्चात्‌, उसका समायोजन पूर्ववर्ती भर्ती वर्ष में उपलब्ध रिक्तियों के सापेक्ष किया जायेगा। यदि रिक्तियां उक्त वर्ष में उपलब्ध न हों तो ऐसे पदोन्नत कर्मचारियों को अगले वर्ष की रिक्तियों के सापेक्ष समायोजित किया जायेगा। 18-(1) कुशल खिलाड़ी की पदोन्नति के लिये निम्नलिखित अर्हतायें होंगीः-

पदोन्नति की अर्हताएं मुख्य आरक्षी राष्ट्रीय खेल/चैम्पियनशिप/अखिल भारतीय पुलिस प्रतियोगिता/ड्यूटी मीट में कोई पदक अर्जित किया हो। उपनिरीक्षक नेशनल खेल/चैम्पियनशिप में स्वर्ण पदक अथवा एशियाई/कामनवेल्थ चैम्पियनशिप एवं विश्वकप अथवा किसी अन्य मान्यताप्राप्त अन्तर्राष्ट्रीय खेल स्पर्धा में कोई पदक अर्जित किया हो।

या

निरीक्षक एशियाई/कामनवेल्थ चैम्पियनशिप में स्वर्ण पदक अथवा

एशियाई/कामनवेल्थ खेल में कोई पदक अर्जित किया हो।

या राष्ट्रीय प्रतियोगिता/राष्ट्रीय खेलों में चार पदक अर्जित

किया हो, जिसमें दो स्वर्ण पदक हों। या अखिल भारतीय पुलिस प्रतियोगिता/ड्‌यूटी मीट में पॉंच

पदक अर्जित किया हो, जिसमे दो स्वर्ण पदक हों। (2) कोच (अनुदेशक) की पदोन्नति के लिए निम्नलिखित अर्हताएं होंगी :-

यदि किसी कोच के प्रदर्शन/प्रशिक्षण में कोई खिलाड़ी अथवा टीम, ओलम्पिक खेल/विश्व चैम्पियनशिप/एशियाई/कामनवेल्थ खेल में कोई पदक अर्जित करता है तो सम्बन्धित कोच को बिना पारी की पदोन्नति पर विचार किया जायेगा।

(3) कुशल खिलाड़ियों के लिये बिना पारी की पदोन्नति की कोई सीमा नहीं होगी, किन्तु कोच के आधार पर अधिकतम दो बिना पारी की पदोन्नति दी जा सकेगी।

(4) बिना पारी की पदोन्नति, खिलाड़ियों के विभिन्न खेल स्पर्धाओं में खेल प्रदर्शन के आधार पर दी जायेगी न कि उनके वर्तमान रैंक (पद) के आधार पर। उदाहरणार्थ यदि कोई आरक्षी ऐशियाई खेल में कांस्य पदक अर्जित करता है तो उसे सीधे निरीक्षक के पद पर पदोन्नति दी जायेगी न कि अगले पद पर अर्थात्‌ मुख्य आरक्षी के पद पर।551 RPH (Grih Police) Anu.-10-2022-data-4E उत्तर प्रदेश असाधारण गजट, 6 जनवरी, 2022 11 (1) कुशल खिलाड़ियो को बिना पारी पदोन्नति हेतु बोर्ड द्वारा पदोन्नति की प्रक्रिया गठित चयन समिति विचार करेगी। (3) कुशल खिलाड़ियों को बिना पारी पदोन्नति हेतु गठित चयन समिति का अध्यक्ष, बोर्ड द्वारा नामनिर्दिष्ट होगा तथा जिस पद पर पदोन्नति के लिए चयन समिति गठित हुई है, उस पद के नियुक्ति प्राधिकारी से कनिष्ठ नहीं होगा। समिति में समुचित स्तर का एक सदस्य विभागाध्यक्ष द्वारा नामनिर्दिष्ट किया जायेगा और समिति के शेष सदस्य तत्समय प्रवृत्त शासनादेशों के अनुसार भर्ती एवं प्रोन्नति बोर्ड द्वारा नामनिर्दिष्ट किये जायेंगे।

(4) पदोन्नति हेतु निर्विवाद कुशल खिलाडियों की सूची खेल नियंत्रण बोर्ड द्वारा बोर्ड

को उपलब्ध करायी जायेंगी।

(5) चयन समिति सफल कुशल खिलाड़ियों का परिणाम अपनी संस्तुति सहित बोर्ड को प्रस्तुत करेगा। भर्ती एवं प्रोन्नति बोर्ड चयनित कुशल खिलाड़ियों की सूची अपनी संस्तुति सहित विभागाध्यक्ष को प्रस्तुत करेगा।

(6) विभागाध्यक्ष अपने अनुमोदन के पश्चात्‌ सूची को नियुक्ति प्राधिकारी को प्रेषित

करेगा जो प्रोन्नति हेतु अंतिम आदेश जारी करेगा। (7) प्रोन्नति हेतु चयनित अभ्यर्थियों की अंतिम सूची विभागाध्यक्ष के अनुमोदन के पश्चात्‌ बोर्ड द्वारा अपनी वेबसाइट तथा उत्तर प्रदेश पुलिस की वेबसाइट (website) पर प्रदर्शित की जायेगी।

(8) इस नियमावली के अधीन की गयी समस्त प्रोन्नतियाँ पदभार/कार्यभार ग्रहण

करने की तिथि से प्रवृत्त होंगी। नियुक्ति

20-(1) नियम 15 एवं 16 के उपबन्धों के अधीन, नियुक्ति प्राधिकारी अभ्यर्थियों के नामों को उसी क्रम में, जिसमें वे नियम 15 के अधीन तैयार की गयी सूची में आते हैं, नियुक्त प्राधिकारी अभ्यर्थियों को इस निदेश के साथ नियुक्ति पत्र जारी करेगा कि वे पत्र के जारी किये जाने के दिनांक से या नियुक्ति पत्र में इस प्रयोजनार्थ विनिर्दिष्ट किसी दिनांक से एक माह के भीतर सेवा/प्रशिक्षण के लिये उपस्थित हों। किसी अभ्यर्थी द्वारा ऐसा न करने पर उनके चयन/नियुक्ति को रद्‌द कर दिया जायेगाः

परन्तु यह कि इस नियमावली के प्रारम्भ के पूर्व से सेवा में किसी पद पर मौलिक रूप से नियुक्त और कार्यरत किसी व्यक्ति को इस नियमावली के अधीन मौलिक रूप से नियुक्त किया गया समझा जायेगा।

(2) नियम 19 के अधीन किसी एक चयन के संबंध में नियुक्ति के एक से अधिक आदेश जारी किये जायें तो, एक संयुक्त सम्मिलित आदेश भी जारी किया जायेगा, जिसमें खिलाड़ियों के नामों का उल्लेख ज्येष्ठता क्रम में किया जायेगा जैसी यथास्थिति चयन में अवधारित की जाये या जैसी की उस संवर्ग में हो जिससे उन्हें प्रोन्नत किया जाना है, जैसा भी मामला हो :

परन्तु इस नियमावली के प्रारम्भ होने के पूर्व सेवा में किसी पद पर नियुक्त और उक्त पद पर कार्यरत किसी खिलाड़ी को इस नियमावली के अधीन मौलिक रूप से नियुक्त हुआ समझा जायेगा और ऐसी मौलिक नियुक्ति को इस नियमावली के अधीन की गयी नियुक्ति समझी जायेगी।

प्रशिक्षण 21-(1) उपनिरीक्षक नागरिक पुलिस/प्लाटून कमाण्डर प्रादेशिक सशस्त्र कांस्टेबुलरी और आरक्षी नागरिक पुलिस/प्रादेशिक सशस्त्र कान्सटेबुलरी/घुड़सवार पुलिस के पदों पर इस नियमावली के अधीन भर्ती कुशल खिलाड़ियों को विभाग में आगमन कराने के उपरान्त पद का आधारभूत प्रशिक्षण प्राप्त करना अनिवार्य होगा।

(2) इस प्रशिक्षण के दौरान ऐसे कुशल खिलाड़ियों को अखिल भारतीय पुलिस खेलों/राष्ट्रीय खेलों/अन्तर्राष्ट्रीय खेलों में भाग लेने की छूट प्राप्त होगी, यह समयावधि प्रशिक्षण का ही भाग होगा।551 RPH (Grih Police) Anu.-10-2022-data-4E 12 उत्तर प्रदेश असाधारण गजट, 6 जनवरी, 2022 (3) उपनियम (1) के अनुसार प्राप्त बेसिक प्रशिक्षण बिना पारी पदोन्नति के उद्देश्य से आधारभूत प्रशिक्षण माना जायेगा। अतः पद विषयक मूलभूत प्रशिक्षण पूर्ण न करने के आधार पर किसी अभ्यर्थी/खिलाड़ी को बिना पारी पदोन्नति हेतु अयोग्य नहीं किया जायेगा। (4) कुशल खिलाड़ी कोटे के अधीन भर्ती/पदोन्नत खिलाड़ियों का पद सम्बन्धी प्रशिक्षण किसी ऐसे प्रशिक्षण केन्द्र पर कराया जा सकता है, जहाँ खेलों से सम्बन्धित सुविधायें उपलब्ध हों।

परिवीक्षा 22-(1) कुशल खिलाड़ी के रूप में चयनित होने वाले अभ्यर्थियों को नियुक्ति की तिथि से दो वर्षों की परिवीक्षा पर रखा जायेगा :

परन्तु उपनियम (2) के अनुसार न्यूनतम शैक्षिक अर्हता पूर्ण न करने वाले खिलाड़ियों को अधिकतम पांच वर्ष तक परिवीक्षा पर रखा जा सकेगा।

(2) परिवीक्षा अवधि के दौरान, परिवीक्षाधीन खिलाड़ी से ऐसा प्रशिक्षण प्राप्त कराने की अपेक्षा की जायेगी जैसा की विभागाध्यक्ष द्वारा विहित किया जाय।

(3) यदि ऐसे चयनित किये गये अभ्यर्थी परिवीक्षा अवधि के दौरान अपने खेल स्तर व कौशल को नहीं बनाये रखते हैं, तो उनके परिवीक्षा की अवधि सचिव, उत्तर प्रदेश पुलिस खेल नियंत्रण बोर्ड द्वारा सम्यक विचारोपरान्त एक वर्ष अथवा विशेष परिस्थिति में दो वर्ष तक बढ़ाई जा सकेगी।

(4) यदि इस विस्तारित अवधि में सचिव, उत्तर प्रदेश पुलिस खेल नियंत्रण बोर्ड इस राय के हैं कि उक्त पदधारक कुशल खिलाड़ी ने अपने खेल स्तर व कौशल को बनाये नहीं रखा है, तो ऐसे पदधारक कुशल खिलाड़ी को सचिव, उत्तर प्रदेश पुलिस खेल नियंत्रण बोर्ड सेवा से उन्मोचन करने की संस्तुति नियुक्ति प्राधिकारी को प्रेषित कर सकेंगे, और इस प्रकार उन्मोचन करने में नियमानुसार कोई अनुशासनिक कार्यवाही आवश्यक नहीं होगी।

(5) ऐसा परिवीक्षाधीन खिलाड़ी जिसकी सेवायें समाप्त की जायें, किसी प्रतिकर का हकदार नहीं होगा। स्थायीकरण 23-(1) नियम 22 के उपबन्धों के अधीन रहते हुए किसी परिवीक्षाधीन खिलाड़ी को परिवीक्षा अवधि या विस्तारित परिवीक्षा अवधि के अन्त में उसकी नियुक्ति में स्थायी कर दिया जायेगा, यदि-

(क) उसके द्वारा आधारभूत प्रशिक्षण सफलतापूर्वक पूर्ण कर लिया गया हो; (ख) उसका कार्य और आचरण संतोषजनक रहा हो और उसकी सत्यनिष्ठा प्रमाणित की गयी हो।

(2) जहाँ उत्तर प्रदेश राज्य के सरकारी सेवकों की स्थायीकरण नियमावली, 1991 के उपबन्धों के अनुसार स्थायीकरण आवश्यक नहीं है वहाँ उत्तर प्रदेश राज्य के सरकारी सेवकों की स्थायीकरण नियमावली, 1991 के नियम 5 के उपनियम (3) के अधीन यह घोषणा करते हुए आदेश कि सम्बन्धित खिलाड़ी ने परिवीक्षा अवधि सफलतापूर्वक पूरी कर ली है, स्थायीकरण का आदेश समझा जायेगा।

ज्येष्ठता 24-(1) कुशल खिलाड़ी कोटे के अधीन चयन से नियुक्त किये गये पुलिस कर्मियोें की वरिष्ठता उनके चयन के दिनांक से निर्धारित की जायेगी। :- इस उपनियम में यहां चयन के दिनांक का तात्पर्य बोर्ड द्वारा भेजी गयी चयन सूची को पुलिस महानिदेशक, उत्तर प्रदेश द्वारा अनुमोदित किये जाने के दिनांक से है। (2) बोर्ड द्वारा कुशल खिलाड़ी के रूप में भर्ती पुलिस कर्मियों के चयन को एक पृथक चयन माना जायेगा। कुशल खिलाड़ी कोटे के अधीन चयन के माध्यम से भर्ती कर्मियों की पारस्परिक वरिष्ठता बोर्ड द्वारा जारी अन्तिम चयन सूची के क्रम के अनुसार होगी।

(3) पदोन्नति के माध्यम से नियुक्त पुलिस कर्मियों की ज्येष्ठता उनके चयन की तिथि से निर्धारित की जायेगी। ः- इस उपनियम में यहां चयन के दिनांक का तात्पर्य बोर्ड द्वारा भेजी गयी चयन सूची को पुलिस महानिदेशक, उत्तर प्रदेश द्वारा अनुमोदित किये जाने के दिनांक से है तथा पूर्ववर्ती वर्ष में चयनित कर्मी पश्चातवर्ती वर्ष में चयनित कर्मियों से ज्येष्ठ होंगे।551 RPH (Grih Police) Anu.-10-2022-data-4E उत्तर प्रदेश असाधारण गजट, 6 जनवरी, 2022 13 वेतन

25-विभाग में मौलिक पद/सेवा के लिये प्रचलित वेतन संरचना के अनुसार कुशल

खिलाड़ियों को वही वेतन और भत्ते अनुज्ञेय होंगे जिसके सापेक्ष उनकी नियुक्ति की गयी है।

26-(1) मूल नियम में किसी प्रतिकूल उपबन्ध के होते हुए भी परिवीक्षाधीन खिलाड़ी परिवीक्षा अवधि में वेतन

को, यदि वह पहले से स्थायी सरकारी सेवा में न हो, समयमान में उसकी प्रथम वेतनवृद्धि तभी

दी जायेगी जब उसने एक वर्ष की संतोषजनक सेवा पूरी कर ली हो, एवं प्रशिक्षण पूर्ण कर

लिया हो; और द्वितीय वेतनवृद्धि दो वर्ष की सेवा के पश्चात्‌ तभी दी जायेगी जब उसने परिवीक्षा

अवधि पूरी कर ली हो और उसे स्थायी भी कर दिया गया होः

परन्तु यह कि यदि संतोष प्रदान न कर सकने के कारण परिवीक्षा अवधि बढायी जाय

तो इस प्रकार बढायी गयी अवधि की गणना वेतनवृद्धि के लिए नहीं की जायेगी जब तक कि नियुक्ति प्राधिकारी अन्यथा निर्देश न दें।

(2) ऐसा खिलाड़ी जो पहले से सरकार के अधीन कोई पद धारण कर रहा हो, का

परिवीक्षा अवधि में वेतन, सुसंगत मूल नियम द्वारा विनियमित होगा।

(3) ऐसे खिलाड़ी जो पहले से स्थायी सरकारी सेवा में हों, का परिवीक्षा अवधि में

वेतन राज्य के कार्यकलाप के सम्बन्घ में सेवारत सरकारी सेवकों पर सामान्यतया लागू सुसंगत

नियमों द्वारा विनियमित होगा। भाग-आठ 27-(1) ऐसी विषय वस्तुएं, जो इस नियमावली या अन्य सुसंगत आदेशों द्वारा सुस्पष्ट अन्य प्रकीर्ण उपबन्ध

रूप से आच्छादित न हों, ऐसी नियमावली, उपबन्ध और आदेशों द्वारा नियंत्रित होगी जो सामान्यतः राज्य के अन्य सेवारत कर्मचारियों के लिए उनके संचालन हेतु लागू हों।

(2) समय-समय पर जारी सरकारी आदेशों के अनुपालन में ऐसे खिलाड़ियों, जो

अपनी खेल उपलब्धियों के आधार पर जारी पदोन्नति प्राप्त किये हों, को पदोन्नति के दिनांक से

उनके, संवर्ग में पदोन्नति किया हुआ समझा जायेगा।

28-(1) जहाँ राज्य सरकार को यह समाधान हो जाता है कि सेवा में नियुक्त सेवा शर्तों में शिथिलता

खिलाड़ियों की सेवा शर्तों से सम्बन्धित किसी नियम के प्रवर्तन से किसी विशिष्ट मामले में

अनुचित कठिनाई उत्पन्न होती है तो वह उक्त मामलों में लागू नियमों में अन्तर्विष्ट किसी बात के

होते हुए भी आदेश द्वारा, उस नियम की अपेक्षाओं में अभिमुक्ति या शिथिलता इस सीमा तक और

ऐसी शर्तों के अध्यधीन प्रदान कर सकती है जैसा कि वह न्यायसंगत और साम्यपूर्ण रीति से मामले को व्यवहृत करने के लिये आवश्यक समझें।

(2) इस नियमावली के प्रवृत्त होने के दिनांक को पूर्व में प्रख्यापित कुशल खिलाड़ियों

की भर्ती/बिना पारी पदोन्नति से सम्बन्धित नियमावली एवं अन्य शासनादेश/निर्देश स्वतः

IN exercise of the powers under sub-section (2) of section 46 read with section 2 of the Police Act, 1861 (Act no. 5 of 1861) and section 15 of the United Provinces Provincial Armed Constabulary Act, 1948 (U.P. Act no. 40 of 1948) and in supersession of the Uttar Pradesh Civil Police/Provincial Armed Constabulary Recruitment and Promotion Process Rules, 2011 and all the other existing rules, orders or instructions issued in this behalf regarding recruitment/promotion of skilled sportspersons without innings, except as respects things done or omitted to be done before such supersession, the Governor is pleased to make the following rules to provide for promotion, training, pay, seniority determination and regularization of skilled sportspersons of Uttar Pradesh to the posts of Sub Inspector Civil Police, Platoon Commander Provincial Armed Constabulary, Constable Civil Police, Constable Provincial Armed Constabulary, Constable Equestrian Police and other equivalent non-gazetted posts, Inspector of Police, Civil Police, Company Commander Provincial Armed Constabulary, Inspector Equestrian Police without innings on other equivalent posts.

THE UTTAR PRADESH POLICE (SKILLED PLAYERS) RECRUITMENT AND

PROMOTION WITHOUT INNINGS RULES,2021

PART-I

(GENERAL)

1. (1) These rules may be called the Uttar Pradesh Police (Skilled Players) Short title and commencement Recruitment and Promotion Without Innings Rules, 2021.

(2) They shall come into force with effect from the date of their publication in the Gazette.

Definitions 2. In these rules, unless there is anything repugnant in the subject or context:-

' Appointing Authority' means–

(i) in relation to the post of Inspector Civil Police/Company Commander Provincial Armed Constabulary/Inspector Equestrian Police and Sub-Inspector Civil Police/Platoon Commander, Provincial Armed Constabulary/Sub Inspector Equestrian Police, Deputy Inspector General of Police; and

(ii) in relation to the post of the Chief Constable Civil Police/Provincial Armed Constabulary/Equestrian Police and the Constable Civil Police/Provincial Armed Constabulary/ Equestrian Police, the Senior Superintendent of Police/Superintendent of Police or the Commandant (Provincial Armed Constabulary), as the case may be;

(a) 'All India Police Sports Competition' means such police sports competitions which are organized under the aegis of All India Police Sports Control Board, New Delhi;

(b) 'Board' means the Uttar Pradesh Police Recruitment and Promotion Board;

(c) 'Government' means the State Government of Uttar Pradesh;

(d) 'Head of the Department' means the Director General of Police, Uttar Pradesh;

(e) 'International Competition' means Inetrnational Competitions organized by the Inernational Olympic Federation and its affiliated sports federations (Olympic Games, World Championship, World Cup, Commonwealth Games, Asian Games and Asian Championship);

(f) 'National Championship' means championship organized by the Olympic Association of India and its affiliated sports federtation, National Games, National Championship, National Inter State, Federation Cup, All India Police and All India Vishwavidyalaya Competition;

(g) 'Selection Committee' means the committee constituted by the Uttar Pradesh

Police Recruitment and Promotion Board;

(h) 'Service' means the service of a person appointed to a post in the cadre by

direct recruitment or by way of promotion under these rules;

(i) 'Skilled Sportsperson' means such male/female sportspersons who have competed in international competitions organized by the Inertnational Olympic Federation and its affiliated sports federations or national competitions organized by the Indian Olympic Association and its affiliated sports federtion of participants in All India Police Sports Competitions organized under the aegis of Police Sports Control Board, New Delhi;

(j) 'Sports Achievement' means the standards created by a sportsperson or the

medal earned by him;

(k) 'Substantive Appointment' means a appointment other than an ad-hoc appointment to a post in the cadre of the service in accordance with the rules and if not in accordance with the instructions issued by the Government in accordance with the procedure prescribed for the time being;

(l) 'Team' means a group of players whose number is fixed by the National/

International Olympic Association/Committee for the National/International Games;

(m) 'Uttar Pradesh Police Sports Control Board' means the unit which

controls and organizes various sports activities for the Uttar Pradesh Police;

(n) 'Year of Recruitment' means a period of twelve months commencing from

the 1st July of a calendar year.

PART-II

(CADRE)

3. (1) The post for which a skilled sportsperson has been recruited shall be Cadre of service

deemed to have been the post to which he has been appointed in the cadre of service.

(2) If due to non-availability of suitable and eligible candidates in any recruitment/selection year, or for any reason after completion of recruitment process against the vacancy, certain vacancies are unfilled, then such vacancies shall be filled for the next three years and if such vacancies are unfilled after three years, they can be filled through the direct recruitment process.

PART-III (RECRUITMENT)

Source of recruitment 4. Two percent vacancies out of the posts of Sub Inspector Civil Police, Platoon Commander Provincial Armed Constabulary, and Constable Civil Police, Constable Provincial Armed Constabulary, Constable Mounted Police and equivalent non-gazetted post for which direct recruitment is contemplated, shall be filled by way direct recruitment out of skilled players:

Provided that any employee appointed in the department under these rules, who is a skilled sportsperson, has been selected through direct recruitment, then although he will be considered a candidate of direct recruitment, yet he will also be allowed the benefit of this rule in the order of promotion.

Reservation 5.(1)For skilled players, for selection in respective service cadre, two per cent of the vacancies of the year will be filled separately. According to sub-section (3) of section 3 of the Uttar Pradesh Public Service (Reservation for Physically Handicapped, Dependents of Freedom Fighters and Ex-Serviceman) Act, 1993 (Act no. 4 of 1993), if the skilled sportspersons so recruited belong to Scheduled Castes/Scheduled Tribes or Other Backward Castes, then such cadidates will be considered adjusted under the percentage reserved for the said reserved category as per rules. The same arrangement will be made for the selected candidates of general category.

(2) All quotas shall be filled in relation to the vacancies occurring during the

requisitioned year.

(3) Physically handicaped (disabled) persons shall not be eligible for police

services.

PART-IV (QUALIFICATIONS FOR DIRECT RECRUITMENT)

Nationality

6. For direct recruitment to any post in the service, a candidate must be citizen of India.

Educational

7.(1) (a) For recruitment to the post of Sub Inspector Civil Police/Platoon qualification

Commander Provincial Armed Constabulary, a candidate/sportsman should possess a Bachelor's Degree from a University in India by law or its equivalent qualification recognized by the Government.

(b) For recruitment to the post of Constable Civil Police/Provincial Armed Constabulary/ Equestrian Police, a candidate/sportsman should have passed class XII by a Board established by law in India or its equivalent qualification recognized by the Government.

(2) If a candidate/sportspereson is recruited on the basis of outstanding sports achievement but he does not fulfill the minimum educational qualification prescribed for the post concerned, then in such a situation he can be admitted with the condition that he shall completed the minimum educational qualification within five years from the date of his recruitment/appointment. During this period his appointment will be treated as probationary:

Provided that in the event of not fulfilling the minimum educational qualification even within the said period of five years, he will be discharged.

Qualifications

8. (1) Any sportsperson who has participated in International/National level, for recruitment Senior or Junior competitions organized by International/Indian Olympic Association of skilled

and its affiliated sports federations or All India Police Sports Competitions organized sportsperson

under the aegis of All India Police Sports Control Board or All India University Competitions recognized by All India University Association who has earned medals or participated in the last 02 years of the advertised recruitment year, in the sports diciplines mentioned below, will be recruited as skilled sportspersons :-

NOTE: In addition to the above mentioned sports disciplines, the sports

disciplines which will be included or removed by the All India Police Sports Control

Board will be considered adjusted under this rule. No separate order will be issued for

them by the Uttar Pradesh Government.

(2) The category wise classification of various sports events shall be as given

below:-

(3) Player– A sportsperson who possesses the following qualifications

as on the date of advertisement of vacancies shall be eligible for recruitment to the

following posts:-

Designation Minimum qualification

Constable Participated in any sports event

under Category-D above.

Sub Inspector Should have earned any medal in any

individual/team event in senior level national

competition under above category-D or earned

Gold medal in any other competition under

category-D, or have won a medal in any individual

sports event under Category-C or have participated

in team event, or participated in any sports event

under Category-B.

(4) Instructor – Such candidates (trainers) will be eligible for direct recruitment to the post of Sub Inspector who,–

(a) have obtained NIS Diploma (from LNIP Gwalior or Netaji Subhas National Sports Institute Patiala) in any of the sports mentioned in sub-rule (1) of rule 9; or

(b) have won a medal (team/individual) in any sports event of Category-C or Category-D mentioned in sub-rule (2) of rule 9; and

(c) have at least 03 years training experience.

Age 9. (1) A candidate for direct recruitment in which the vacancies are advertised must fulfill the minimum age specified in relation to the post in the table given below and should not be more than the maximum age :–

(2) In order to encourage skilled players, in special circumstances, 02 years in the minimum age limit and 05 years in the maximum age limit for the post of constable and 05 years in the minimum and maximum age limit for the post of Sub Inspector, and relaxation of 05 years will be given in maximum age limit for Instructor (coach) may be given by the Director General of Police, Uttar Pradesh.

(3) The player recruited after getting relaxation in the minimum age limit will be placed on the post of "Sports Trainee", and he will be allowed an honorarium of 80 per cent of the amount of basic pay fixed per month. After completing the prescribed minimum age of Government service, he can be taken in Government service.

Character 10. (1) The character of the candidate/sportsperson for direct recruitment should be such that he is suitable in all respects for employment in Government service.

The appointing authority will satisfy itself on this point:

Provided that persons dismissed by the Union Government or any State Government or any local authority armed or controlled by the Union Government or any State Government shall be ineligible for appointment to any post in the Service. A person convicted of an offense involving moral turpitude shall also be ineligible.

Marital status 11. Any such male/female player,–

(a) who has entered into or contracted a marriage with a woman/man who already has a spouse living; or

(b) whose spouse while living, has entered into or contracted a marriage with any man/woman, shall not be eligible for appointment to the said service:

Provided that the State Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage, has other grounds for so doing, exempt any such person from the operation of this rule.

Physical

12. A player who is participating regularly in national or international sports

fitness

remains physically and mentally more healthy and fit than normal person. Therefore, the

health test of the candidates to be recruited as skilled sportspersons will be done under the

normal procedure only to check for any incurable disease. On the basis of curable disease

and such physical deformity which does not have any adverse effect on its game, no

selected candidate under skilled sportsperson quota will be declared unfit/disqualified.

PART-V

(PROCEDURE FOR DIRECT RECRUITMENT)

Determination 13. (1) The vacancies to be filled in the recruitment year under the rules relating

of vacancies to the posts respectively shall be determined by the appointing authority during the year

of recruitment and it shall inform the same to the Head of the Department. 02 per cent of

the total vacancies will be filled separately by those skilled sportspersons who fulfill all

the requirements as on the date of advertisement of vacancies. The number of vacancies

will be counted in whole numbers and below 01 will not be counted in decimal.

(2) The Head of the Department shall inform the State Government about the

vacancies enumerated under sub-rule (1) and shall also notify the Board for further

action.

(3) If in a given year no suitable and eligible candidate is available for

recruitment or if the vacancy remains after the recruitment process against the vacancy,

then this remaining vacancy will be carried forward for the next three years and after

three years, the remaining such vacancies can be filled through the normal recruitment

process.

(4) Information about the number of vacancies/posts available to recruit skilled

sportspersons and coaches (trainers) will be sent by the Uttar Pradesh Police Sports

Control Board to the Director General of Police, Uttar Pradesh. The approval of the

Director General of Police shall also be obtained for fixing the number of posts in various

sports events. After that, the advertisement for the recruitment of skilled sportspersons

and coaches (instructors) shall be sent by the Director General of Police, Uttar Pradesh to

the Police Recruitment and Promotion Board will be made available to the Board. After

examining the requisition received by the Board, the vacancies to be filled through

advertisement will be notified in the following manner :-

(a) By issue of advertisements in daily Hindi and English newspapers

having wide circulation;

(b) By pasting notices on the notice board of the office or by advertisement

through Radio/ Doordarshan and other employment newspapers;

(c) By notifying the vacancies to the Employment Exchange;

(d) By other means of mass communication.

(5) A copy of the notification of the Board will be sent to the Uttar Pradesh

Police Sports Control Board, Lucknow through which all sports Federations/Associations

etc. will also be requested for wide publicity regarding the said recruitment among the

sportspersons.

(6) The number of vacancies may be increased or decreased depending on the

number of candidates who have applied for various sports events against the notified

vacancies. For this, approval will be given by the Director General of Police,

Uttar Pradesh on the recommendation of the Board.

Process of direct recruitment

14.(1) Application Form :- The candidate can fill only one application for recruitment against the vacancies notified through the release. The Board will accept online application form only. The application form of the candidate who fills more than one application shall be rejected by the board. The certificates related to the qualifications of the post for which the candidate is applying shall be uploaded along with the online application form. The Board shall fix the application fee for any recruitment in consultation with the Head of the Department. The detailed procedure regarding filling the application form and issuing the call letter will be decided by the Board and it shall be displayed on its website.

The Government may at any time change the number of vacancies for any recruitment and may cancel any recruitment at any time or at any stage without assigning any reason therefor.

(2) Scrutiny of Applications :-

All the applications received in the Board and their enclosures i.e. certificates will be scrutinized in detail. If no attested copies of the records mentioned in the application form are attached with the application, then such incomplete or incorrect applications may be rejected by the Board.

(3) Scrutiny of Records :-

Those candidates/sportsmen whose applications are found to be correct after scrutiny, will be issued call letters for scrutiny of records from original academic/sports certificates and will be required to appear before the selection committee on the specified date/time and present at the place all the necessary records related to their age, education and sports achievements in original so that the entries/attached records in the application form can be verified.

(4) Physical Standards :-

On the basis of the performance of skilled players in various sports events, the candidate/sportsperson shall be free of any physical examination (height/chest measurement/weight) for direct recruitment.

(5) Constitution of the Examination Committee :-

The examination committee for the selection of skilled players through release shall be constituted by the Board as follows:-

(a) Testing Committee–

(i) Inspector General of Police/Deputy Inspector General --- Chairman (ii) Senior Superintendent of Police/Superintendent of Police --- Member (iii) Regional Sports Officer (Police) --- Member (iv) Sports Specialist Nominated by the Directorate of Sports --- Member (b) Sports Skill Testing Committee–For the testing of skilled players in the Testing Committee, the following committee will be constituted by the Board (who have experience of sports):-

(i) Senior Superintendent of Police/Superintendent of Police --- Chairman (ii) Additional Superintendent of Police/Deputy Superintendent

of Police --- Member (iii) Regional Sports Officer (Police) --- Member (iv) International Players (Sports Specialist) --- Member (v) Coach (National Player/NIS) --- Member The Testing Committee may take cooperation of players of international repute as experts for various sports disciplines of sports.

NOTE :- The players will be tested only in the presence of all the members of the Testing Committee.

(6) The Uttar Pradesh Police will recommend the Testing Committee regarding the suitability for the Games. The Testing Committee will award a maximum of 80 marks, which will be according to the following criteria. Marks will be awarded to the candidate on the prescribed format separately by each member of the test committee and the total score will be written in the trial report. Each candidate will have his signature on the mark sheet, which will be attached with the trial report. The Testing Committee will award the marks as per the following criteria:-

Sports Skill Test (Integer-80 Marks)

Suitable 50 marks or more Unsuitable less than 50 marks (7) The candidates found suitable in the test will be sent for the next stage. (8) The selection of the candidates found suitable will be decided as per the procedure of the Selection Committee. The next stage will be of 20 marks, which will be based on the sports achievements of the candidates. The candidate will not be included in the selection process again after being declared unfit by the selection committee.

(9) To prepare the final selection list, the marks awarded by the selection committee and the test committee to the candidates found suitable in the test will be summed up and the recommendation will be made regarding the selection. The recommendation shall be signed by all the members of the selection committee.

(10) Division of marks - The details of the standard integer-100 of the test to be taken by the test committee and the marks to be given by the selection committee at the time of the test will be as follows:-

(1) Sports Skill Test 80 Marks (2) Evaluation of sports certificates 20 marks Integer 100 marks NOTE :– The Uttar Pradesh Public Services (Reservation for Scheduled Castes, Scheduled Tribes and Other Backward Classes) Act, 1994 (Act no. 4 of 1994), as amended from time to time, to provide representation to the officers belonging to the Scheduled Castes, Scheduled Tribes and Other Backward Classes of citizens in the selection committee. Nomination will be done as per the order made under section 7.

(11) Verification of Certificates:- Before sending the recommendation to the Head of the Department for appointment, the sports certificates of the selected candidates/players will be verified by the Board from the concerned Sports Federation/Association. In case the sports certificate submitted by any candidate is found to be incorrect and forged/fake, his candidature will be cancelled forthwith.

(12) Selection and Final Merit List :- The Board will prepare the selection list of the candidates found successful in the test related to sports competition according to the order of merit of the candidates relative to the vacancies and send it to the Head of the Department under character verification along with the recommendation. No waiting list will be prepared by the Board. The Head of the Department will forward the list sent by the Board to the Appointing Authority for further action after approval.

(13) Medical Examination:- (a) The candidates/sportspersons who are placed in the selection list will be expected to appear in the medical examination by the appointing authority. For medical examination, a medical council will be constituted by the Chief Medical Officer of the concerned district, in which three doctors will be kept, who will conduct the medical examination of the candidates as per the procedure prescribed by the Director General, Medical and Police Recruitment Medical Examination Form. The selected candidate/sportsperson will not be declared unfit/disqualified by the Medical Council on the basis of curable disease and such subtle physical abnormality which does not adversely affect the performance of the concerned sport of the player. Incurable diseases and such physical abnormalities, which adversely affect the sports performance of the player, will be declared unfit/disqualified in his medical examination.

(b) If any candidate/sportsperson who is dissatisfied with his medical examination wants to appeal, then the prescribed form will be provided to him by the Medical Council for appealing before the Divisional Medical Council and the dissatisfied candidate/sportsperson will apply on the above prescribed form on the day of examination or immediately thereafter. Appeal can be presented on the next day. The submitted appeal will be fully considered by the Divisional Medical Council within one month of the submission of the appeal, only in the event that there has been an error in the decision taken by the District Medical Council in the medical examination of the candidate/sportsperson. It will be necessary to have a specialist in the concerned medical defect in the constituted Divisional Medical Council.

(c) Detailed instructions regarding conducting of medical tests will be issued by the Director General of Police. The candidates/sportsmen found unsuccessful in the medical test will be declared unfit by the appointing authority and such vacancies will be carried forward for further selection.

Character verification

15. Before issuance of appointment letter, under the supervision of the appointing authority, the character verification will be completed before the candidates are sent on training. Normally the character verification will be completed within a month. In case any adverse fact comes to light during the character verification of a candidate, he will be declared unfit by the Appointing Authority and such vacancies shall be carried forward for further selection.

Eligibility for promotion

16. (1) Such skilled sportspersons who possess the qualifications prescribed in these rules and who on the basis of their excellent performence in sports are eligible for promotion without innings on the basis of qualifications prescribed in the respective service rules for each respective cadre/post can be promoted to Head Constable Civil Police/Provincial Armed Constabulary/Equestrian Police and Sub Inspector Civil Police/Platoon Commander and in the Regional Armed Constabulary/Sub-Inspector Mounted Police and Inspector Civil Police/Company Commander, Provincial Armed Constabulary/Inspector Mounted Police or equivalent posts.

(2) While granting promotion without innings on the basis of excellent sports performance, in relation to adverse entry/penalty (punishment), integrity certificate etc., further action will be taken as per the provisions of Government Order No. 761/ personnel-1/1993, dated 30.06.1993 and in cases of departmental or criminal proceedings and suspension, etc. further action will be taken as per the provisions of Government Order No. 13/21/89-Ka-1-1997, dated 28.05.1997.

(3) The benefit of promotion will be given under the rules in force at the time of earning medal in the respective sports event.

Evaluation of vacancy for promotion

17. According to these rules, after selection of eligible candidate for promotion without innings, his adjustment will be made against the vacancies available in the year of the prevailing recruitment. If vacancies are not available in the said year, then such promoted employees will be adjusted against the vacancies of the next year.

18. (1) The following shall be the qulaification for promotion of skilled player:-

Head Constable Should have won any medal in National Games/Championship/All India Police Competition/Duty Meet. Should have won Gold medal in National Games/ Championship or any medal in Asian/Commonwealth Championship and World Cup or any other recognized international sporting event.

Or Should have earned four medals in All India Police

Competition/Duty Meet, out of which two Gold medals.

Should have won Gold medal in Asian/ Commonwealth Inspector

Championship or any medal in Asian/ Commonwealth Games.

Or Should have won four medals in National Competition/

National Games, out of which two Gold medals.

Or Should have won five medals in All India Police

Competition/Duty Meet, out of which two Gold medals.

(2) The following shall be the qualification for promotion of Coach

(Instructor):–

If a player or team earns any medal in Olympic Games/World

Championship/Asian/Commonwealth Games in the performance/training of any coach,

the concerned coach will be considered for out-of-turn promotion.

(3) There will be no limit for out-of-turn promotions for skilled players,

but a maximum of two out-of-turn promotions can be given depending on the coach.

(4) Out-of-turn promotion will be given on the basis of sports performance

of the sportspersons in various sports events and not on the basis of their present rank(s).

For example, if a constable earns a Bronze medal in the Asian Games, then he will be

promoted directly to the post of Inspector and not to the next post i.e. the post of Chief

Constable.

Promotion 19. Selection Committee (1) The Selection Committee constituted by the

process

Board will consider the skilled players for promotion without innings.

(2) The meeting of the selection committee will be organized twice a year in

the months of February and August, which will submit its recommendations to the Head of the Department by the end of February and August.

(3) The Chairman of the committee constituted for promotion of skilled players

without innings shall be nominated by the Board and shall not be junior to the appointing

authority of the post for which the selection committee has been constituted for

promotion. One member of the appropriate level in the committee will be nominated by

the Head of the Department and the remaining members of the committee will be

nominated by the Recruitment and Promotion Board as per the orders for the time being

in force.

(4) The list of undisputed skilled players for promotion will be made available

to the Board by the Sports Control Board.

(5) The Selection Committee shall submit the result of successful skilled

players along with its recommendation to the Board. The Recruitment and Promotion

Board will present the list of selected skilled players along with its recommendation to

the Head of the Department.

(6) The Head of the Department after his approval will send the list to the

appointing authority who will issue the final order for promotion.

(7) The final list of selected candidates for promotion will be displayed by the

Board on its website and on the website of Uttar Pradesh Police after the approval of the

Head of the Department.

(8) All promotions made under these rules shall be effective from the date of

joining/assuming the charge.

PART-VI (APPOINTMENT, TRAINING, PROBATION, CONFIRMATION AND SENIORITY)

Appointment 20. (1) Subject to the provisions of rules 15 and 16, the appointing authority shall appoint the names of the candidates in the order in which they appear in the list prepared under rule 15. The appointing authority will issue appointment letters to the candidates with the direction that they should appear for service/training within one month from the date of issue of the letter or from any date specified for the purpose in the appointment letter. Failure to do so by a candidate will result in the cancellation of his/her selection/appointment:

Provided that any person who has been substantively appointed and has been serving in any post in the Service before the commencement of these rules, shall be deemed to have been substantively appointed under these rules.

(2) Under rule 19, if more than one order of appointments is issued in relation to any one selection, then a joint combined order shall also be issued in which the names of the players will be mentioned in the order of seniority, as determined in selection or as determined from the cadre from which they may be promoted, as the case may be:

Provided that a sportsperson appointed to a post in the service and working in the said post before the commencement of these rules shall be deemed to have been substantively appointed under these rules and such substantive appointment shall be deemed to be an appointment made under these rules.

Training

21. (1) It will be mandatory for the skilled sportspersons recruited under this rule, to the posts of Sub Inspector Civil Police/Platoon Commander Provincial Armed Constabulary and Constable Civil Police/ Provincial Armed Constabulary/Equestrian Police, to get basic training of the post.

(2) During this training, such skilled players will be allowed to participate in All India Police Games/National Games /International Games and this time period will be part of the training.

(3) Basic training received in accordance with sub-rule (1) shall be treated as basic training for the purpose of promotion without innings. Therefore, no candidate/sportsperson will be disqualified for promotion without innings on the basis of not having completed the basic training related to the post.

(4) The training related to the post of recruited/promoted sportsperson under the skilled player quota can be done at any such training center where facilities related to sports are available.

Probation

22. (1) Candidates who are selected as skilled sportspersons will be placed on probation for a period of two years from the date of appointment:

Provided that according to sub-rule (2) of rule 8, sportspersons who do not fulfill the minimum educational qualification can be kept on probation for a maximum period of five years.

(2) During the period of probation, the probationer shall be required to undergo such training as may be prescribed by the Head of the Department.

(3) If such selected candidates do not maintain their sports level and skills during the period of probation, then their period of probation can be extended by the Secretary, Uttar Pradesh Police Sports Control Board after due consideration by one year or in special circumstances by two years.

(4) If during this extended period the Secretary, Uttar Pradesh Police Sports Control Board is of the opinion that the skilled sportsperson holding the above post has not maintained his level and skill, then recommendation for discharge from service of such skilled sportsperson may be sent to the appointing authority by the secretary, U.P. Police Sports Control Board, and in such discharge, no disciplinary action will be necessary as per the rules.

(5) A probationer whose services are terminated shall not be entitled to any compensation.

Stabilization 23. (1) Subject to the provisions of rule 22, a probationer shall be confirmed in his appointment at the end of the period of probation or extended period of probation, if ,–

(a) he has successfully completed basic training; and

(b) his work and conduct have been satisfactory and its integrity has been certified.

(2) Where confirmation is not necessary in accordance with the provisions of the Uttar Pradesh State Government Servants' Confirmation Rules, 1991, an order under sub-rule (3) of rule 5 of Uttar Pradesh State Government Servants' confirmation Rules, 1991 declaring that the sportsperson concerned has successfully completed the period of probation, shall be deemed to be an order of confirmation.

Seniority 24. (1) The seniority of the police personnel appointed from the selection under the skilled player quota will be determined from the date of their selection.

Explanation :– The date of selection in this sub-rule means the date of approval

of the selection list, sent by the Board, by the Director General of Police, Uttar Pradesh.

(2) The selection of police personnel recruited by the Board as skilled

sportspersons will be treated as a separate selection. The inter-se seniority of the

personnel recruited through the selection under the skilled sportsperson quota will be as

per the order of the final selection list issued by the Board.

(3) The seniority of the police personnel appointed through promotion shall

be determined from the date of their selection.

Explanation :– The date of selection in this sub-rule means the date of approval

of the selection list, sent by the Board, by the Director General of Police, Uttar Pradesh

and the personnel selected in the previous year will be senior to the personnel selected in

the subsequent year.

PART-VII

(SALARY etc.)

Salary

25. According to the prevailing pay structure for the basic post/service in the

department, the same pay and allowances will be admissible to the skilled sportspersons

against which they have been appointed

Salary during 26. (1) Notwithstanding anything to the contrary in the Fundamental Rules, a

probation

probationer, if he is not already in permanent Government service, will be given his first

period

increment in the time scale only after he has completed one year of satisfactory service

and has completed his training, and the second increment shall be given after two years'

of service only after he has completed the period of probation and also after he has been

made permanent:

Provided that if the period of probation is extended due to non-satisfaction, the

period so extended shall not count for increment unless the appointing authority directs

otherwise.

(2) The salary of a sportsperson who is already holding a post under the

Government during the period of probation shall be regulated by the relevant

Fundamental Rules.

(3) The pay during the period of probation of a sportsperson who is already in

permanent Government service shall be regulated by the relevant rules generally

applicable to Government servants serving in connection with the affairs of the State.

PART-VIII

MISCELLANEOUS

Other

27. (1) Matters not expressly covered by these rules or other relevant orders

miscellaneous shall be governed by such rules, provisions and orders as may be generally applicable to

provision

other serving employees of the State for their conduct.

(2) In compliance with the Government orders issued from time to time, such

sportspersons, who have been promoted on the basis of their sports achievements, shall

be deemed to have been promoted in their cadre from the date of promotion.

Laxity in

28. (1) Where the State Government is satisfied that the operation of any terms of service rule relating to the conditions of service of sportspersons appointed to the service causes undue hardship in any particular case, it may, notwithstanding anything contained in the rules applicable to the said cases, by order dispense with or relax the requirements of that rule to such extent and subject to such conditions as it may consider necessary for dealing with the case in a just and equitable manner.

(2) On the date of coming into force of these rules, the rules and other orders/instructions related to the recruitment/promotion without innings of skilled players, promulgated earlier, will automatically be deemed to be canceled.
