अधिसूचना

''भारत का संविधान'' के अनुुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करके, राज्यपाल, विभिन्न सरकारी विभागों की सेवाओं में और पदों पर उत्कृष्ट खिलाड़ियों की बिना पारी की पदोन्नति सुनिश्चित किये जाने की दृष्टि से निम्नलिखित नियमावली बनाती हैं।

''उत्तर प्रदेश सरकारी विभाग (उत्कृष्ट खिलाड़ियों की बिना पारी की पदोन्नति) नियमावली, 2022''

1-(1) यह नियमावली ''उत्तर प्रदेश सरकारी विभाग (उत्कृष्ट खिलाड़ियों की बिना संक्षिप्त नाम और प्रारम्भ

पारी की पदोन्नति) नियमावली, 2022'' कही जायेगी।

अध्यारोही प्रभाव (2) यह तुरन्त प्रवृत्त होगी । 2-यह नियमावली संविधान के अनुच्छेद 309 के परन्तुक के अधीन राज्यपाल द्वारा बनायी गयी किसी अन्य नियमावली (उत्तर प्रदेश पुलिस भर्ती एवं प्रोन्नति बोर्ड को छोड़कर) या तत्समय प्रवृत्त आदेशों में अन्तर्विष्ट किसी बात के प्रतिकूल होते हुए भी प्रभावी होगी।629 RPH Karmik anu-2-2022 niya. Data 8d 2 उत्तर प्रदेश असाधारण गजट, 7 जनवरी, 2022 परिभाषाएं 3-जब तक विषय या सन्दर्भ से अन्यथा अपेक्षित न हो, इस नियमावली में-

(क) ''नियुक्ति प्राधिकारी'' का तात्पर्य संबंधित पदों की सेवा नियमावली या संबंधित पदों के कार्यकारी अनुदेशों में यथा परिभाषित नियुक्ति प्राधिकारी से है;

(ख) ''संविधान'' का तात्पर्य भारत का संविधान से है;

(ग) ''सरकार'' का तात्पर्य उत्तर प्रदेश राज्य सरकार से है;

(घ) ''राज्यपाल'' का तात्पर्य उत्तर प्रदेश के राज्यपाल से है;

(ङ) ''राज्य'' का तात्पर्य उत्तर प्रदेश राज्य से है।

बिना पारी की पदोन्नति

4-राज्य सरकार की सेवा में समूह-ख, ग एवं घ के पदों पर मौलिक रूप से नियुक्त कोई व्यक्ति नियम-5 मेंं उल्लिखित खेल उपलब्धि के आधार पर बिना पारी की पदोन्नति प्रदान किये जाने हेतु विचार किया जायेगा :

परन्तु यह कि समूह-ग एवं घ में कार्यरत व्यक्ति को उसकी सम्पूर्ण सेवा अवधि में अनधिक दो बार और समूह-ख में कार्यरत व्यक्ति को अनधिक एक बार बिना पारी की पदोन्नति प्रदान की जा सकती है।

5-पदोन्नति के लिए निम्नलिखित शर्तें अवधारित की जायेंगी :-

बिना पारी की पदोन्नति की शर्तें

(1) पदोन्नति हेतु पात्र व्यक्ति को वर्तमान धारित पद पर मौलिक रूप से नियुक्त और स्थायी—त होना चाहिए;

(2) बिना पारी की पदोन्नति हेतु परिशिष्ट-1 में उल्लिखित अंतर्राष्ट्रीय/राष्ट्रीय खेलों की निम्नलिखित श्रेणियों में निम्नलिखित उपलब्धि प्राप्त करना आवश्यक होगा :-

श्रेणी-क ओलम्पिक खेल (सीनियर कैटेगरी)

पैरा ओलम्पिक खेल (सीनियर कैटेगरी)

विश्वकप (सीनियर कैटेगरी)

विश्व चैम्पियनशिप्स (सीनियर कैटेगरी)

श्रेणी-ख एशियाई खेल (सीनियर कैटेगरी)

एशियाई पैरा खेल (सीनियर कैटेगरी)

कॉमन वेल्थ खेल (सीनियर कैटेगरी)

कॉमनवेल्थ चैम्पियनशिप्स (सीनियर कैटेगरी)

एशियाई चैम्पियनशिप्स (सीनियर कैटेगरी)

श्रेणी-ग दक्षिण एशियाई खेल (सीनियर कैटेगरी)

युवा ओलम्पिक खेल

कॉमनवेल्थ युवा ख्ेाल

श्रेणी-घ राष्ट्रीय खेल (सीनियर कैटेगरी)

राष्ट्रीय चैम्पिनशिप (सीनियर कैटेगरी)

(3) इस नियमावली में बिना पारी की पदोन्नति हेतु केवल वही व्यक्ति पात्र होंगे जो सेवा के दौरान श्रेणी-'क', 'ख', 'ग' या 'घ' (टीम/वैयक्तिक) में पदक जीते हों।

अतिरिक्त वेतन वृद्धि प्रदान किया जाना

6-राज्य सरकार की सेवा में 'मौलिक' रूप से नियुक्त व्यक्ति उपर्युक्त नियम-5 (2) में यथा उल्लिखित श्रेणी-'क', 'ख', 'ग' या 'घ' में सहभागिता किये जाने/अर्ह होने या पदक जीतने पर पांच अतिरिक्त वेतनवृद्धियों के लिये पात्र हो सकते है :

परन्तु यह कि एक बार में केवल दो वेतन वृद्धियां प्रदान की जायेंगी। प्रथम दो बार की उपलब्धियों हेतु प्रत्येक उपलब्धि हेतु दो वेतन वृद्धिया और तृतीय उपलब्धि हेतु एक वेतन वृद्धि अधिक प्रदान की जायेगी :

परन्तु यह और कि अतिरिक्त वेतन वृद्धि का लाभ ऐसी स्पर्धा के लिए अनुमन्य

नही होगा, जिसके लिए बिना पारी की पदोन्नति अनुमन्य हो।

7-(1) बिना पारी की पदोन्नति हेतु निम्नलिखित समिति गठित की जायेगी :- बिना पारी की

पदोन्नति की प्रक्रिया (एक) सम्बन्धित विभाग का अपर मुख्य सचिव/

प्रमुख सचिव/सचिव - अध्यक्ष

(दो) सम्बन्धित विभाग का विभागाध्यक्ष - सदस्य/सचिव

(तीन) निदेशक, खेल, उत्तर प्रदेश - सदस्य

(चार) कार्मिक विभाग का नाम निर्दिष्ट अधिकारी - सदस्य

(कार्मिक विभाग के अपर मुख्य सचिव/प्रमुख सचिव/

सचिव द्वारा नाम निर्दिष्ट किया जायेगा)

(पांच) उत्तर प्रदेश शासन के सम्बन्धित विभाग

के अपर मुख्य सचिव/प्रमुख सचिव द्वारा

नामनिर्दिष्ट संयुक्त सचिव की श्रेणी से

अनिम्न अनुसूचित जाति का एक अधिकारी - सदस्य

(छः) उत्तर प्रदेश शासन के सम्बन्धित विभाग के अपर मुख्य सचिव/प्रमुख सचिव द्वारा नामनिर्दिष्ट संयुक्त सचिव की श्रेणी से अनिम्न अन्य पिछड़ा वर्ग का एक अधिकारी - सदस्य (सात) मुख्य सचिव द्वारा नामनिर्दिष्ट अंतराष्ट्रीय/

राष्ट्रीय ख्याति के कम से दो खिलाड़ी - सदस्य

(2) मा0 मुख्यमंत्री जी के अनुमोदन के पश्चात्‌ उपनियम (1) के अनुसार मुख्य सचिव के माध्यम से गठित समित की संस्तुति पर नियुक्ति प्राधिकारी द्वारा पदोन्नति आदेश जारी किया जायेगा।

नियमों में शिथिलता 8-जहाँ राज्य सरकार का यह समाधान हो जाय कि ऐसा करना आवश्यक तथा समीचीन है वहॉ वह नियमावली में अन्तर्विष्ट किसी बात के होते हुए भी इस नियमावली के किसी उपबन्ध को समाप्त कर सकती है या उसमें शिथिलता प्रदान कर सकती है।

IN pursuance of the provisions of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of notification no. 01/2022/1/ 47Personnel-2-2022, dated January 7, 2022 :

Dated Lucknow, January 7, 2022

IN exercise of the powers conferred by the proviso to Article 309 of the Constitution, the Governor is pleased to make the following rules with a view to ensuring promotion of Out-standing sportsperson in the services and posts of the various Government Departments.

"UTTAR PRADESH GOVERNMENT DEPARTMENTS (OUT OF TURN

PROMOTION OF OUT-STANDING SPORTSPERSON) RULES, 2022"

Short title and

1. (1) These rules may be called the "Uttar Pradesh Government commencement Departments (Out of turn Promotion of Out-standing Sportsperson) Rules, 2022".

(2) They shall come into force at once.

Overriding effect 2. These rules shall have effect notwithstanding anything to the contrary contained in any other rule made by the Governor under the proviso to Articel 309 of the Constitution (except the Uttar Pradesh Police Recruitment and Promotion Board) or orders for the time being in force.

Definitions 3. In these rules, unless there is anything repugnant in the subject or context :–

(a) "Appointing authority" means an appointing authority as defined in concern service rules of the posts or executive instructions for concern posts.

(b) "Constitution" means the Constitution of India;

(c) "Government" means the State Government of Uttar Pradesh;

(d) "Governor" means the Governor of Uttar Pradesh;

(e) "State" means the State of Uttar Pradesh.

Out of Turn

4-(1) Any person substantively appointed inthe service of the State Promotion

Government in Group-B, C and D shall be considered for grant of out-of-turn promotion on sporting achievement mentioned in rule-5 :

Provided that the person working in Group-C and D may be promoted out- of-turn not exceeding two time during his/her entire service period and person working in Group-B may be promoted out of turn not exceeding one time.

Conditions of

5. The following conditions shall be determined for promotion :–

out-of-turn

(1) Eligible person for promotion should have substantively appointed and promotion

confirmed on the presently held post;

(2) For out-of-turn promotion it will be necessary to achieve the following achievements in the following categories of International/National Games mentioned in Appendix-1 :–

Category-A Olympic Games (Senior Category)

Para Olympic Games (Senior Category)

World Cup (Senior Category)

Category-B Asian Games (Senior Category)

Asian Para Games (Senior Category)

Common Wealth Games (Senior Category)

Common Wealth Championships (Senior Category)

Asian Championships (Senior Category)

Category-C South Asian Games (Senior Category)

Youth Olympic Games

Commonwealth Youth Games

Category-D National Games (Senior Category)

who have won the medal in Category-A, B, C or D (tem/individual) during in service.

Grant of

6. The person substantively appointed in the service of the State Government,

on participation/qualifying or winning medal in Category-A, B, C or D as mentioned in

increment

above rule-5(2), he/she may be eligible form maximum of 05 additional increments:

Provided that only two additional increments will be given at a time. For the

first two times of achievements, 02- increments for each achievement and one

increment will be granted for the third achievement:

Provided further that the benefit of additional increment will not be

admissible for the event for which out of turn promotions admissible.

7.(1) The following committee shall be constituted for out of turn promotion :- Procedure of

promotion

(i) Additonal Chief Secretary / Principle - Chairman

Secretary/Secretary of the concerned

department

(ii) Head of the department concerned - Member/ Secretary

(iii) Director, Sports, Uttar Pradesh - Member

(iv) A nominated Officer of Personnel Department - Member

(Nominated by Additional Chief Secretary/Principle

Secretary/Secretary of the Personnel department)_.

(v) An officer of Scheduled Caste, not below the

rank of Joint Secretary, nominated by the

Additional Chief Secretary/Principal

Secretary of the concerned department,

Government of Uttar Pradesh.

- Member

(vi) An officer of OBC, not below the rank of

Joint Secretary, nominated by the Additional

Chief Secretary/Principal Secretary,

Government of Uttar Pradesh, of the

concerned department.

- Member

(vii) At least Two sportsperson of International/

National repute nominated by the Chief

- Member

Secretary.

(2) The Promotion order will be issued by the appointing authority on the

recommendation of the committee, constituted as sub rule (1) through the Chief

Secretary, after the apporoval of the Chief Minister.

relaxation of 8. Where the State Government is satisfied that is necessary or expedient to do

rules

so, it may notwithstanding contained in the rules, by order dispense with or relax any

of the provisions of these rules.
