यतः उ(cid:265) (cid:214)थानीय (cid:255)ािधकारी िनवा(cid:170)चन-(cid:177)े(cid:253) से रा(cid:186)य िवधान प(cid:229)रषद् के िलए चुने जाने वाले सद(cid:214)य(cid:332) क(cid:236) काया(cid:170)विध एस.एल.पी.(सी) सं(cid:180)या 17123/2015 (भारत िनवा(cid:170)चन आयोग बनाम् देवेश चं(cid:254) ठाकु र व अ(cid:198)य) के मामले म(cid:164) माननीय उ(cid:275)तम (cid:198)यायालय के िनण(cid:170)य के अ(cid:197)यधीन होगी अतः, अब, लोक (cid:255)ितिनिध(cid:194)व अिधिनयम् 1951 (1951 का 43) क(cid:236) धारा 16 के अनुसरण म(cid:164), भारत िनवा(cid:170)चन आयोग एत(cid:196)(cid:300)ारा 04 फरवरी, 2022 (शु(cid:248)वार) को ऐसी तारीख के (cid:322)प म(cid:164) िसफा(cid:229)रश करता है िजस तारीख को उ(cid:176)र (cid:255)देश रा(cid:186)य के रा(cid:186)यपाल शासक(cid:236)य राजप(cid:253) म(cid:164) (cid:255)कािशत अिधसूचना (cid:300)ारा नीचे क(cid:236) सारणी के (cid:214)त(cid:204)भ (1) म(cid:164) िविनिद(cid:170)(cid:310) उ(cid:265) प(cid:229)रषद् िनवा(cid:170)चन-(cid:177)े(cid:253)(cid:332) से यह अपे(cid:177)ा कर(cid:164)गे िक वे उ(cid:265) अिधिनयम और उसके अधीन बनाए गए िनयम(cid:332) और िकए गए आदेश(cid:332) के उपब(cid:198)ध(cid:332) के अनुसार, उ(cid:265) (cid:229)रि(cid:265)य(cid:332) को भरने के (cid:255)योजन से रा(cid:186)य क(cid:236) िवधान प(cid:229)रषद् के िलए

WHEREAS, the term of all the 36 sitting members of Legislative Council of the State of Uttar Pradesh, elected from 35 Local Authorities' Constituencies is going to expire on 07.03.2022; and WHEREAS, a biennial election has to be held for the purpose of filling the 36 (Thirty Six) vacancies so arising; and

WHEREAS, the term of office of the member (s) to be elected to the State Legislative Council from the said Local Authorities' Constituency shall be subject to the decision of the Hon'ble Supreme Court of India in SLP (C) No. 17123/2015 (Election Commission of India Vs Devesh Chandra Thakur & Others);

NOW, THEREFORE, as recommended by the Election Commission of India in pursuance of Section 16 of the Representation of the People Act, 1951 (43 of 1951), the Governor of the State of Uttar Pradesh is hereby pleased to call upon each of the said Local Authorities' Constituencies, specified in column (1) of the TABLE below, to elect the number of member (s), specified against that Constituency in column (2) of the said TABLE, to the Legislative Council of the State, for the purpose of filling the above vacancies, in accordance with the provisions of the said Act and of the rules and orders made thereunder:-

No. 322/UP-LC-LAC/2022: - WHEREAS, the Governor of the State of Uttar Pradesh has, by notification issued under Section 16 of the Representation of the People Act, 1951 (43 of 1951) and published in the official Gazette of the State on 04th February, 2022, been pleased to call upon each of the Council Constituencies, specified in column (1) of the Table below, to elect the number of member(s) specified against that constituency in column (2) of the said Table, to the Legislative Council of the State of Uttar Pradesh:-

NOW, THEREFORE, in pursuance of Section 30 and Section 56 of the Representation of the People Act, 1951 (43 of 1951), the Election Commission of India hereby –

(A) appoints, with respect to the said election, -

(a) the 11th February, 2022 (Friday), as the last date for making nominations;

(b) the 14th February, 2022 (Monday), as the date for the scrutiny of nominations;

(c) the 16th February, 2022 (Wednesday), as the last date for the withdrawal of candidatures;

(d) the 03rd March, 2022 (Thursday), as the date on which a poll shall, if necessary, be taken; and

(e) the 15th March, 2022 (Tuesday), as the date before which the election shall be completed; and

(B) fixes the hours from 08:00 am to 04:00 pm, as the hours during which the poll shall, if necessary, be taken on the date specified above for the election.
