( सामान्य परिनियम नियम )

उत्तर प्रदेष साधारण खण्ड अधिनियम 1904 (उत्तर प्रदेष अधिनियम संख्या 1 सन्‌ 1904) की धारा 21 के साथ पठित संयुक्त प्रान्त आबकारी अधिनियम, 1910 (यू0 पी0 अधिनियम संख्या 4 सन्‌ 1910) की धारा 41 के अधीन प्रदत्त शक्तियों का प्रयोग करके, आबकारी आयुक्त, उत्तर प्रदेश राज्य सरकार की पूर्व अनुमोदन से इस निम्ति प्रकाशित समस्त पूर्व नियमों, जहां तक वे इस नियमावली से असंगत हों का अधिक्रमण करके देशी मदिरा को बोतलों में भरने (बाटलिंग) के लिये लाइसेंसो से सम्बन्धित निम्नलिखित नियमावली बनाते हैं-

(1) यह नियमावली उत्तर प्रदेष देषी मदिरा को बोतलों में भरने की

(प्रथम संषोधन) नियमावली, 2022 कही जायेगी।

(2) यह दिनांक 01 अप्रैल, 2021 से प्रवृत्त हुयी समझी जायेगी ।2 उत्तर प्रदेश असाधारण गजट, 11 फरवरी, 2022 ई0 उत्तर प्रदेष देषी मदिरा को बोतलों में भरने की नियमावली, 2020 जिसे आगे उक्त नियमावली कहा गया है, में नीचे स्तम्भ-1 में दिये गये नियम-7 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात्‌ः-

स्तम्भ-1 विद्यमान नियम

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम 7 (1) बोतल भरने के लाइसेंस का नवीकरण करने 7 (1) बोतल भरने के लाइसेंस का नवीकरण के लिए आवेदन आबकारी आयुक्त, उत्तर प्रदेश को करने के लिए आवेदन आबकारी आयुक्त, उत्तर प्रदेश प्रत्येक वर्ष 28 फरवरी को या उसके पूर्व प्रपत्र को प्रत्येक वर्ष 28 फरवरी को या उसके पूर्व प्रपत्र सी0एल0बी0-3 में दिया जायेगा। जब तक शुल्क या सी0एल0बी0-3 में दिया जायेगा। जब तक शुल्क या उसका कोई आंशिक भाग बकाया न हो, या कोई अन्य उसका कोई आंशिक भाग बकाया न हो, या कोई अन्य पर्याप्त कारण न हो, आबकारी आयुक्त द्वारा प्रपत्र पर्याप्त कारण न हो, आबकारी आयुक्त द्वारा प्रपत्र सी0एल0बी0-1 एवं सी0एल0बी0-2 में बोतल भरने के सी0एल0बी0-1 एवं सी0एल0बी0-2 में बोतल भरने के लाइसेंस को दो वर्षों के लिये नवीकृत किया जा सकता लाइसेंस को दो वर्षों के लिये नवीकृत किया जा है। किन्तु उक्त लाइसेंस नवीकरण सम्बन्धित सकता है। किन्तु उक्त लाइसेंस नवीकरण सम्बन्धित पी0डी0-2/पी0डी0-33 लाइसेंस की वैधता की अवधि पी0डी0-2/पी0डी0-33 लाइसेंस की वैधता की अवधि तक वैध रहेगा।

तक वैध रहेगा।

(2) सी0एल0बी0-1 व सी0एल0बी0-2 लाइसेंसों के

नवीकरण के लिए फीस निम्नानुसार व संदेय होगी-

(2) किसी वर्ष के लिये नवीकरण के आवेदन-पत्र के साथ नवीकरण के लिये आवेदित वर्ष में भरी जाने वाली बोतलों की कुल संख्या के संबंध में एक घोषणा- पत्र संलग्न होगा। उक्त वर्ष के लिये सीएलबी-1 और सीएलबी-2 लाइसेंस के नवीकरण शुल्क की गणना रुपया 2,00,000 प्रति पचास लाख बोतल या उसके किसी भाग, जो विहित धारिताओं में उक्त घोषणा-पत्र में यथा उल्लिखित भरी जानी हो, की दर से की जायेगी और इसे लाइसेंसधारी द्वारा अग्रिम रूप से जमा किया जायेगा।

परन्तु यह कि यदि वर्ष में भरी जाने वाली बोतलों की वास्तविक संख्या, घोषणा-पत्र में उल्लिखित बोतलों की संख्या से अधिक होने वाली हो, तो लाइसेंसधारी इसके लिये एक अतिरिक्त घोषणा-पत्र प्रस्तुत करेगा और उपर्युक्तानुसार आगणित नवीकरण शुल्क की अतिरिक्त धनराशि जमा करेगा।

दो लाख

2 पचास लाख से दो करोड़

बोतलों तक

परन्तु यह और कि नवीकरण शुल्क के रूप में जमा की गयी धनराशि किसी भी स्थिति में प्रतिदेय या सामयोज्य नहीं होगी।

4 चार से छः करोड़ बोतलों दस लाख

परन्तु यह और कि सीएलबी-1 या सीएलबी-2 लाइसेंस के लिये न्यूनतम नवीकरण शुल्क रुपया 2,00,000 होगा। परन्तु यह और कि नवीकरण शुल्क के आधे के बराबर फ्रेंचाइजी शुल्क और अतिरिक्त नवीकरण शुल्क के आधार पर आगणित अतिरिक्त फ्रेंचाइजी शुल्क, यदि कोई हो, सीएलबी-2 लाइसेंस के नवीकरण के लिये भी संदेय होगाउत्तर प्रदेश असाधारण गजट, 11 फरवरी, 2022 ई0 3 स्तम्भ-1 विद्यमान नियम

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम परन्तु यह कि सी0एल0बी0-2 लाइसेंस के नवीकरण के लिये आधी नवीकरण फीस के समतुल्य फ्रेंचाइजी फीस भी संदेय होगी। अनुमानित वार्षिक बोतलों में भरी मदिरा की मात्रा की गणना माह जनवरी के अन्त मेंं पूर्ववर्ती दस माह में बोतलों में भरी गयी कुल मदिरा की मात्रा के आधार पर की जायेगी।

उक्त नियमावली में, नीचे, स्तम्भ-1 में दिये गये नियम-8 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात्‌ः-

लाइसेंस हेतु निबंधन एवं शर्तें प्रपत्र सी0एल0बी0-1

तथा सी0एल0बी-2 में प्रदान किया गया प्रत्येक लाइसेंस,

निम्नलिखित निबंधन एवं शर्तों के अध्यधीन होगा-

लाइसेंस हेतु निबंधन एवं शर्तें प्रपत्र सी0एल0बी0-1 तथा सी0एल0बी-2 में प्रदान किया गया प्रत्येक लाइसेंस, निम्नलिखित निबंधन एवं शर्तों के अध्यधीन होगा-

(1) लाइसेंसधारी बोतल में भराई कार्य उसी भू-

(1) लाइसेंसधारी बोतल में भराई कार्य उसी भू- गृहादि में करेगा जो आबकारी आयुक्त अथवा उसके द्वारा प्राधिकृत अधिकारी द्वारा पूर्वानुमोदित हो और लाइसेंस पर सम्यकृ रूप से पृष्ठांकित हो। उक्त भू-गृहादि का प्रयोग देशी मदिरा को बोतल में भरने एवं उसे भण्डारित करने के सिवाय किसी अन्य प्रयोजन के लिये नहीं किया जायेगा।

गृहादि में करेगा जो आबकारी आयुक्त अथवा उसके द्वारा प्राधिकृत अधिकारी द्वारा पूर्वानुमोदित हो और लाइसेंस पर सम्यकृ रूप से पृष्ठांकित हो। उक्त भू- गृहादि का प्रयोग देशी मदिरा को बोतल में भरने एवं उसे भण्डारित करने के सिवाय किसी अन्य प्रयोजन के लिये नहीं किया जायेगा।

(2) लाइसेंसधारी उक्त भू-गृहादि में आबकारी आयुक्त, के पूर्व अनुमोदन के बिना कोई परिवर्धन या परिवर्तन नहीं करेगा। इस प्रकार के सभी परिवर्धन एवं परिवर्तन लाइसेंसधारी द्वारा प्रस्तुत नक्शे एवं नीले मुद्रण पर दर्शाये जायेंगे।

(3) बोतल में भराई कार्य इस प्रयोजनार्थ अलग किये गये, पृथक कक्ष (कक्षों) में किया जायेगा। लाइसेंसधारी मदिरा के भण्डारण के लिये भराई कक्ष (कक्षों) में बोतल भराई के कुण्ड स्थापित करेगा। वह भराई कक्ष (कक्षों) में छानने, भराई करने या इससे सम्बन्धित प्रक्रिया के लिये आवश्यक उपकरण स्थापित करेगा।

((3) बोतल में भराई कार्य इस प्रयोजनार्थ अलग किये गये, पृथक कक्ष (कक्षों) में किया जायेगा। लाइसेंसधारी मदिरा के भण्डारण के लिये भराई कक्ष (कक्षों) में बोतल भराई के कुण्ड परिनिर्मित करेगा। वह भराई कक्ष (कक्षों) में छानने, भराई करने या इससे सम्बन्धित प्रक्रिया के लिये आवश्यक उपकरण स्थापित करेगा।

(4) बोतलों में भरी गयी मदिरा, पृथक्‌ कक्ष (कक्षों) (4) बोतलों में भरी गयी मदिरा, पृथक्‌ कक्ष (कक्षों) में रखी जायेगी।

(5) प्रत्येक कक्ष के बाहर एक तख्ती लगायी जायगी जिस पर स्पष्ट रूप से लिखा जायेगा कि कक्ष का प्रयोग किस प्रयोजन के लिये किया जा रहा है।

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम (6) सिवाय आबकारी आयुक्त के विशेष अनुज्ञा के

और उसे अनुसार सम्मिश्रण या तीव्रतावरोह निषिद्ध है।

(6) सिवाय आबकारी आयुक्त के विशेष अनुज्ञा के और उसे अनुसार सम्मिश्रण या तीव्रतावरोह निषिद्ध है। (7) सिवाय आबकारी आयुक्त की विशेष अनुज्ञा के और उसके अनुसार देशी मदिरा में कोई सुवास पैदा करने वाला या रंजन करने वाला पदार्थ अथवा कोई अन्य पदार्थ मिलाना निषिद्ध है।

(7) सिवाय आबकारी आयुक्त की विशेष अनुज्ञा के और उसके अनुसार देशी मदिरा में कोई सुवास पैदा करने वाला या रंजन करने वाला पदार्थ अथवा कोई अन्य पदार्थ मिलाना निषिद्ध है।

(8) विशेष परिस्थितियों में भारत निर्मित विदेशी मदिरा को बोतल में भरने के लिये आबकारी आयुक्त द्वारा अनुमोदित बोतल भराई कक्ष को आबकारी आयुक्त की पूर्व स्वीकृति से देशी मदिरा की बोतल भराई के लिये प्रयोग किया जा सकेगा, परन्तु यह कि किसी भी दशा में देशी मदिरा की बोतल भराई के समय भारत निर्मित विदेशी मदिरा की बोतल भराई नहीं की जायेगी।

(9) लाइसेंसधारी देशी मदिरा को ऐसी क्षमता एवं तीव्रता की बोतलों या अन्य संधानों में भराई करेगा जैसा कि आबकारी आयुक्त द्वारा राज्य सरकार के पूर्वानुमोदन से निर्धारित किया जाये।

(9) लाइसेंसधारी देशी मदिरा को ऐसी क्षमता एवं तीव्रता की बोतलों या अन्य संधानों में भराई करेगा जैसा कि आबकारी आयुक्त द्वारा राज्य सरकार के पूर्वानुमोदन से विहित किया जाये।

(10) लाइसेंसधारी आबकारी आयुक्त द्वारा देशी शराब की बोतल भराई के लये प्रयुक्त बोतलों या अन्य संधानों के संबंध में जारी निर्देशों का अनुपालन करेगा।

दो अंकों सहित शब्द यू0पी0ई0 समुद्धृत किया जायेगा।

(11) टेट्रा पैक सहित कांच या पेट-बोतलों के लेबुलों पर वर्ष के अन्तिम दो अंकसहित शब्द यू0पी0ई0 अधिमुद्रित किया जायेगा।

(12) बोतलों को भरने के तुरंत बाद, बोतलबंद शराब के भण्डारण कक्ष में निकालने से पूर्व उनमें सुरक्षा कोड चस्पा करने के साथ कार्क, कैप्सूल तथा लेबल लगा दिया जायेगा। बोतलों में भराई की प्रत्येक प्रक्रिया की एक विशिष्ट क्रम संख्या दी जायेगी, जिसे बैच नम्बर के रूप में जाना जाता है और यह बैच नम्बर लेबल पर लिख दिया जायेगा। आबकारी विभाग के अभिहित पोर्टल पर प्रतिदिन एक डिजिटल रिकार्ड भी ऑनलाइन अनुरक्षित किया जायेगा और प्रस्तुत किया जायेगा।

(13) बोतलों पर लेबल इस प्रकार चिपकाये जायेंगे जिससे कि वे सरलता से पहचाने जा सके। बोतलों पर उभारे गये या बालुकाक्षेपित शब्दों, अक्षरों तथा अंकों पर लेबल नहीं चिपकाया जायेगा।

(13) बोतलों पर लेबल इस प्रकार चिपकाये जायेंगे जिससे कि वे सरलता से पहचाने जा सके। बोतलों पर उभारे गये या बालुकाक्षेपित शब्दों, अक्षरों तथा अंकों पर लेबल नहीं चिपकाया जायेगा।उत्तर प्रदेश असाधारण गजट, 11 फरवरी, 2022 ई0 5 स्तम्भ-1 विद्यमान नियम

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम (14) लाइसेंसधारी उत्तर प्रदेश में विक्रय की जाने वाली देशी मदिरा के लेबुलों पर अधिकतम फुटकर मूल्य इस प्रकार मुद्रित करेगा जो सरलता से दृश्य हो।

(14) लाइसेंसधारी उत्तर प्रदेश में विक्रय की जाने वाली देशी मदिरा के लेबुलों पर अधिकतम फुटकर मूल्य इस प्रकार मुद्रित करेगा जो सरलता से दृश्य हो। (15) बॉटलिंग इकाई ठोस कचरे के पुनर्चक्रण और प्रबंधन के लिये ऐसी समस्त व्यवस्थायें करेगा जैसा कि ठोस अपशिष्ट प्रबंधन नियम 2016 में विहित किया गया है।

(15) बॉटलिंग इकाई ठोस अपशिष्टों के पुनर्चक्रण और प्रबंधन के लिये ऐसी समस्त व्यवस्थायें करेगा जैसा कि ठोस अपशिष्ट प्रबंधन नियम 2016 में विहित किया गया है। आबकारी आयुक्त, उत्तर प्रदेश।

- उक्त नियमावली में, नीचे, स्तम्भ-1 में दिये गये विद्यमान प्रपत्र के स्थान पर स्तम्भ-2 में दिया गया प्रपत्र रख दिया जायेगा, अर्थात्‌ः-

जिला......................................................को ..............................से जिला............................................को ....................................से ......................................................................तक की अवधि के .....................................................................तक की अवधि के लिये...................................................................................प्रतिफल लिये...............................................................................प्रतिफल शुल्क का भुगतान के पश्चात्‌ नीचे विनिर्दिष्ट भू-गृहादि शुल्क का भुगतान के पश्चात्‌ नीचे विनिर्दिष्ट भू-गृहादि में देशी मदिरा के बोतल भराई हेतु लाइसेंस स्वीकृत में देशी मदिरा के बोतल भराई हेतु लाइसेंस स्वीकृत किया जाता है, जिसके लिये देशी मदिरा के बोतल भराई किया जाता है, जिसके लिये देशी मदिरा के बोतल से सम्बन्धित नियमावली के उपबंधों के अध्यधीन अग्रिम भराई से सम्बन्धित नियमावली के उपबंधों के अध्यधीन में 2,00,000 (दो लाख रुपये) का भुगतान कर दिया गया अग्रिम में 2,00,000 (दो लाख रुपये) का भुगतान कर है, जिनमें से किसी उपबंध का व्यतिक्रमण किये जाने पर दिया गया है, जिनमें से किसी उपबंध का व्यतिक्रमण या संयुक्त प्रान्त आबकारी अधिनियम, 1910 अथवा किये जाने पर या संयुक्त प्रान्त आबकारी अधिनियम, स्वापक औषधि और मनः प्रभावी पदार्थ अधिनियम, 1985 1910 अथवा स्वापक औषधि और मनः प्रभावी पदार्थ अधिनियम, के अधीन किसी अपराध के लिये दोष सिद्ध होने पर 1985 के अधीन किसी अपराध के लिये दोष सिद्ध होने पर6 उत्तर प्रदेश असाधारण गजट, 11 फरवरी, 2022 ई0 स्तम्भ-1 विद्यमान प्रपत्र सी0एल0बी.1

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित प्रपत्र सी0एल0बी.1 लाइसेंसधारी उपर्युक्त विधियों के अधीन अधिरोपित किसी शास्ति के अतिरिक्त अपना लाइसेंस और प्रतिभूति जमा समपहृत हो जाने के लिये दायी होगा-

देशान्तर 1-लाइसेंसधारी, आबकारी आयुक्त द्वारा यथा अनुमोदित मात्रा से अधिक मदिरा की बोतल भराई के लिये हकदार नहीं हागा।

1-लाइसेंसधारी, आबकारी आयुक्त द्वारा यथा अनुमोदित मात्रा से अधिक मदिरा की बोतल भराई के लिये हकदार नहीं हागा।

2-लाइसेंसधारी, आबकारी आयुक्त, उत्तर प्रदेश से स्वीकृति प्राप्त करने के पश्चात्‌ अपने द्वारा भरी गयी बोतलों के लेबिलों पर अपना स्वयं का ब्राण्ड नाम अंकित करने के लिये हकदार होगा।

3-आबकारी आयुक्त की विशेष अनुज्ञा के सिवाय स्प्रिट का रंगना, समिश्रण करना (ब्लेंडिंग), सुवासित करना और तीव्रतावरोह करना (रेडक्शन) निषिद्ध होगा।

3-आबकारी आयुक्त की विशेष अनुज्ञा के सिवाय स्प्रिट का रंगना, समिश्रण करना (ब्लेंडिंग), सुवासित करना और तीव्रतावरोह करना (रेडक्शन) निषिद्ध होगा। 4-लाइसेंसधारी, कांच या पेट बोतलों पर उभरे हुये शब्दों में यू0पी0ई0 मात्रा तथा वर्ष के अन्तिम दो डिजिट का अंकन करने हेतु प्रबन्ध करेगा।

4-लाइसेंसधारी, टेट्रापैक सहित कांच या पेट बोतलों के लेबुलों पर शब्द "यू0पी0ई0" मात्रा तथा वर्ष के अन्तिम दो अंक को अधिमुद्रित करने हेतु प्रबन्ध करेगा।

5-लाइसेंसधारी, अपने स्वयं के उत्पादों की बोतल 5-लाइसेंसधारी, अपने स्वयं के उत्पादों की बोतल में भराई के पश्चात्‌ अलग से स्टाक रखेगा।

4-लाइसेंसधारी, कांच या पेट बोतलों पर उभरे हुये शब्दों में यू0पी0ई0 मात्रा तथा वर्ष के अन्तिम दो डिजिट का अंकन करने हेतु प्रबन्ध करेगा।

4-लाइसेंसधारी, टेट्रा पैक सहित कांच या पेट बोतलों के लेबुलों पर शब्द "यू0पी0ई0" मात्रा तथा वर्ष के अन्तिम दो अंक को अधिमुद्रित करने हेतु प्रबन्ध करेगा।

NOTIFICATION

In exercise of the powers conferred under section 41 of the United Provinces Excise Act, 1910 (U.P. Act no. IV of 1910), read with section 21 of the Uttar Pradesh General Clauses Act, 1904 (U.P. Act no. 1 of 1904), the Excise Commissioner, Uttar Pradesh with the previous sanction of the State Government, makes the following rules relating to licences for the bottling of Country liquor in supersession of all previous Rules published in this behalf to the extent of their inconsistency with these rules.

THE UTTAR PRADESH BOTTLING OF COUNTRY LIQUOR (FIRST AMENDMENT) RULES, 2022

1. Short title and commencement–(1) These rules may be called the Uttar Pradesh Bottling of Country Liquor (First Amendment) Rules, 2022.

(2) They shall be deemed to have come into force from April 01, 2021.

2. Amendment of Rule 7–In the Uttar Pradesh Bottling of Country Liquor Rules, 2020, hereinafter referred to as the said rules, for rule-7 set out in Column-1 below, the rule as set out in Column-2, shall be substituted, namely:-

7 (1) Application for the renewal of bottling license shall be made in Form C.L.B-3to the Excise Commissioner, Uttar Pradesh on or before February 28 of the year of expiry of the license. Unless the fee or any part thereof is in arrear or there be any other sufficient reason, a bottling license in Form C.L.B-1and C.L.B-2may be renewed by the Excise Commissioner for two years, but the license shall be valid only till the period of validity of concerning PD-2/PD-33 License.
